Randolph County sheriff says he won't enforce warrantless gun confiscation


Randolph County Sheriff Greg Seabolt said he won't enforce warrantless gun confiscation that has been legalized by the courts. 
The community caretaking exception to a warrant means if officers are performing a community caretaking duty, such as helping someone in medical distress, they can seize evidence without a warrant. This only applies to when law enforcement is performing non-investigative functions. 
Seabolt said that he thinks this measure is a way to take guns from law-abiding citizens, and he won't enforce it in Randolph County, calling it "legal gymnastics to make one’s Second or Fourth Amendment rights moot."
This comes after President Joe Biden and other Democratic leaders have expressed support for an assault weapons ban and increased background checks — measures that many Republicans feel would inhibit Second Amendment rights.
