The bayview area plan. It requires an authorization under 2010. 3. The establishment to cultivate cannabis. This site also includes an unpermitted second floor. The applicant also applied for a variance to legalize. After working with their architect and city staff, the applicant has withdrawn that request and proposes to remove the second floor and render the site back into compliance with 145. 5 of the planning code. The department has received no correspondence regarding this application. This site is a preexisting use which is legitamizing and will be required to comply with the office of Cannabis Licensing Office and will submit a review by the police department. This site existed for eight years. The use is consistent with the intent of the core district and general plan and meets the requirements of the planning code. The Department Recommends approval of the requested authorization. This concludes my presentation. Im available for any questions. Thank you very much. Do we have a project sponsor . Hi. So these clients came to me o looking to remove notices of vin given. And we spent a good amount of time coming to the point where a complete gut and remodel is now the request within the context of the 10,000 square feet. There are three tenants in this space, all three are Small Business owners in the city. They have families. They have children in the school system. And they have been operating at this location for more than eight years. And we respectfully request that you provide us the ability to continue operating. They had temporary permits now. And this conditional use authorization will enable them to be fully compliant with the law. So thats the ask. Thank you. Thanks. Do we have any Public Comment on this item . Okay. Public comment is closed. Motion to approve. Second. Thank you, commissioners. On that motion to approve with conditions. [roll call vote] so moved, that motion passes unanimously, 50. Item 25, case 2019005500cua, 2934 cesar va she has street, conditional use authorization. Department staff again. Before you is a request for conditional use authorization to establish a 171 square foot retail use at 2934cesar chavez avenue located within the nc3 Zoning District and 40x height and bulk district. It is located along with this street serving as a small island of nc zoning surrounded by residential house districts. It is plea three blocks south of the calle 24 corridor and six blocks east from the beginning of the Core Commercial areas of mission street. It is dominated by two to three story buildings. Other commercial uses at this intersection include a restaurant and brewery, Automotive Service station, dry cleaner and Appliance Service shop. The commercial tenant space at the Southwest Corner of the intersection appears vacant. The tenant appears to be occupied as an office. The project sponsor is an equity applicant by the city of cannabis. No other Cannabis Retailers within 600 feet. The project was originally scheduled for hearing on octobeo allow additional outreach and discussion to the neighbors. Since that hearing the applicant reported very constructive conversations with calle 24 to bring the proposed facility into compliance with the guidelines for the district. He has held multiple outreach events with neighbors. The department has received nine letters of opposition to the project and the petition submittal of 107 letters in opposition. Currently no letters of support have been received. The opposition to the project centers on the perception of the area as primarily residential, concern over increase in crime and the concern the establishment doesnt include parking as part of the proposal. The department initially had concern regarding the small size of the proposed establishment, however maintaining small and affordable spaces is a goal of the calle 24 plan and theres other dispensaries in the city approximately the same size. The project does not include any request for onsite consumption and the space is too small to be able to include onsite consumption in compliance with the health codes requirements. Staff recommends approval to prohibit any onsite consumption. As the project complies with the planning code and the policies of the general plan, staff recommends approval. Thank you very much. 171 square feet. Thats pretty small. Yeah. Okay. Do we have a project sponsor . Good evening. 171 square feet is pretty much as big as this. Weve been approved before the Cannabis Retail at 2934 chavez Equity Program. The building is owned by my family. Has been for over six years. Im a San Francisco native, born and raised in the bayview, spent a lot of time in the mission. Over the last few weeks ive hosted multiple neighborhood meetings and heard many neighborhood concerns. Im going to try to address some of the few concerns that theyve had. About three meetings ive met with calle 24. And weve addressed almost every single one of the meetings so far, every single one of the concerns. One of the main concerns everyone had was parking. In San Francisco we know how difficult it is as a resident, i know how difficult it is myself. We proposed to them that theres an existing out front that we would be trying to convert that into a green zone so we wont be taking additional parking away and have dedicated parking for our customers. Of course a Security Guard is required so that guard will double as a parking enforcer in a way. And then also while that wasnt enough for some of the neighbors, weve also proposed that our team members will double as watchmen during peak hours to patrol the neighborhood if anyone is double parking or blocking a neighbors driveway. Beyond the parking concern there was also a concern of the overall image and crime and whatnot. Working with the Community Members and calle 24, we have agreed to include murals and other things, murals and local artwork by local artists, including cultural aspects of the mission neighborhood. Other than that, no major exterior work is being performed. The way it is, its meant to be that way, and we are going to keep it that way. So you cant even tell really if theres anything there. And one of the other concerns was smell. And i think a lot of Community Members are not very well aware of the smoking aspect. Weve advised that they are not allowed to smoke inside or outside. And it was just lack of information that people dont have. Weve tried to advise and educate our neighbors as much as we can but we can only do so much. Other than that, weve tried to stay involved as much as we can, hosting multiple meetings. We havent had a super great turnout but for the ones that have turned out, theyve acted as community ambassadors. Theyve reached out to other Community Members and told them what the situation is. We continue to host more informative meetings, stay connected with the local neighborhood as much as we can as well as the local organizations. Ive tried to resolve all the Community Members concerns, all the neighborhood concerns, and i feel ive gone above and beyond trying to meet those needs to be a successful business. And i hope that satisfies some of those or all those concerns. Thank you. Thank you, sir. So i do have several speaker cards. Please come up when i call your name. Michael chan, nora, alexandra lawrence, sayed, angela white, elaine watts, shayk, and edgar i cant read this. Anyways, come on up. One minute, please. I want to mention a lot of our friends who are here, they have left by now, but there are a few. So since pretty much all these are in support, if you could keep your comments to one minute, we would really appreciate it. Come on up. Hi. My name is michael chan. I have lived in the neighborhood for 27 years with my wife and two kids. I am for the following reasons. The cannabis spot will be next to a bar. Smoking and drinking will cause fights and malice. An Elementary School. So maids caulk by the store when they walk so kids may walk by the store when they walk to school. For these reasons, i am against the opening of the store. Thank you very much. Thank you. Next speaker, please. Any come on up, if you need to speak, please come on up. Thats it. [off mic] it doesnt matter. If you want to provide a comment, please come on up. Thank you. Addressed most of the concerns as far as parking, smell, loitering, patrolling, double parking, parking in the driveways. And i support this cannabis to be approved, please. Thank you. Thank you. Next speaker, please. Hello. I live threedoors down from this proposed store. San francisco has been wanting to keep the families in San Francisco. Putting Cannabis Stores in residential areas particularly in the mission where so many families live there, i dont think its appropriate. The families that couldnt be here signed the petition, sent the letters. This place hasnt been a retail place at all, at least for the 20 years i know. Its 170 square feet but only 150 square feet are for retail. Its not safe. Its a very small space. The bar next door already had a fire. 150 square feet, you know Security Guard the driving on that street is crazy with the bicycle lane. Its just we create a lot of stress in the neighborhood in the residential neighborhood. Thank you. Next speaker, please. [speaking spannic] is it okay if i translate for him . [speaking spanish] my name is torres and im here to support my neighbors. This place is not appropriate for the folks that live here. [speaking spanish] because of the families that have children. I dont think its appropriate for children to look at all this. We already have too many problems in this district. We dont want anymore. Thank you. Next speaker, please. Hello. I live almost 18 years on this street. Im going to read this. Im speaking for many of the Latino Community that couldnt make it today. Scheduling a hearing on the weekday and we dont have time is a disadvantage for people to take time to show up to the hearing. We have the signatures opposing the opening of the Cannabis Retail. As you know, we have schools, im going to skip that one. I have an eightyearold that comes to my house twice a week. We need to keep our family together, our children without being exposed to that environment. We dont need people loitering outside this proposed cannabis store. It is illegal to consume a smaln Public Places but people still do, even driving. How are they going to enforce this when the customers decide to use the driveway . They say they will hire a Security Guard. The use of the Security Guard is to guard the location and check id. They are not going to be monitoring the block. Calling the police is out of the question because they wont show up right away. We need to be able to get in and out at any time from my garage without getting out of my car and trying to find whoever is blocking my driveway. As i recall, at one time the applicant himself blocked my driveway. Im wondering if he will use his own company to tow away his customers cars when they block our driveways. Your time is up your time is up. Thank you. Thank you. Next speaker, please. Next speaker, please. Yes. He addressed the parking situation. Thats good. Im a retired Police Officer for 30 years. Ill tell you whats come to this place when you open up a Cannabis Club across the street from my house. Its not going to be good. Youre taking a nice residential area. We have two other Cannabis Clubs. One at 29th and mission and one at 22 and mission. If thats too far for these guys to go, they need to smoke a little faster. We also have a park down the street. You have kids going to that park. Theyre going in front of the Cannabis Club on the way. You have several schools. While they might be beyond your 600 feet, theres still a bunch of kids on this street, passing this Cannabis Club to get to their schools and come home. I see families all the time coming to and from across that street. These kids are going to be seeing this stuff. Explain to your kid what is going on there and why drugs are still bad, you just get to sell them now and explain to your child why it really is bad and no, these guys are exempt from that. Is that it . Thats it i got more. [laughter] next speaker, please. Hi, my name is sac. My father is a business owner. We are from the district by the mission. And i want to support the business they are trying to open up and i want to correct the sir that was here just earlier, cannabis is not a drug. If anything its healing people and people are using it for medicinal use. Its not like that. If thats the case, the same thing we can add a cannabis storefront, we should be able to tell our kids the same thing when we look at a liquor store because there was a prohick pro prohibition era for that. Its very concealed. The Security Guard is not just to check id. His job is to make sure everything is secure. Members are happy because ifening nig goes beyond, the Security Guard is going to if anything goes bad, the Security Guard is going to lose his job. Thank you thank you. Next speaker, please. Good evening. My name is heidi. Im an existing dispensary operator. Ive been operating my dispensary for 15 years now. Im one of two women, the only woman of color currently licensed. I can tell you as a licensing requirement, ive been working with equity applicants and these two gentlemen have attended my fireside chats where theyve learned about running a cannabis business, ive seen nothing but compliance with them and wanting to learn how to operate a Cannabis Club. And theyve also held outreach, which ive attended, and ive seen they have been working with the public to try to comply with the concerns. They are definitely looking to operate as it should be. And i think that you should support them in their application. Thank you. Thank you. Next speaker, please. Good evening. Im brian. Im a local resident of San Francisco with my wife and two children. I used to live in the vernal heights neighborhood. Im here in support of the applicants. I believe this application falls directly in line with the goals of article 16 in the Equity Program in terms of sporting local residents and local business entrepreneurs to both launch businesses and employ equity and local Community Members. One of the things we should have learned from the recent vape crisis is legalization provides testing and quality products to the community and keeps those away from harmful products away from children and adults who would otherwise purchase them on the black market. The other item i wanted to mention is for seven years ive been the neighbor of a commercial building aft same family, and they are a strong member of the community and very family and helpful neighbors. Thank you, sir, your time is up. Theyll be the same with this business. Thank you. Thank you. Next speaker, please. Good evening. Planning commissioners. I know its been a long night so thank you for pushing through and representing us. My name is kevin. Im with the united to save the mission. United to save the mission has been in direct talks with this project sponsor. And so right now we are not opposed. But i do want to urge you to look at policy standpoint. We just had a really great racial and social equity platform that came up and thats going to be adopted with the Planning Department. Then why do we have 60 percent of dispensaries located in four neighborhoods . We need to start analyzing the oversaturation of dispensaries in black and brown communities. Specific mission, soma. We need to make sure we have party across all neighborhoods and the west side is doing their fair share because its not fair they are targeting our communities and making a profit off it, especially when folks have been marginalized historically for that. Thanks for your time. Thank you. Next speaker, please. Ill make this quick. Im not into drugs and alcohol myself but i feel this person has not been a bad actor. Hes jumped through every hoop thats been asked of him. Hes come to calle 24 to listen to our concerns, and hes been very responsive to them. You have questions about the school being nearby but its not going to be a lounge or a bunch of people hanging out. Its going to be serving the neighbors. I dont see it as a destination people will be driving to. I think people will be walking over. So i support it. Thank you. Next speaker, please. Hi. I live on tenth and mission. And theres plenty of Cannabis Clubs around me over there. I see nothing but more liveliness in the neighborhood because theres more eyes out there. Theres a Security Guard watches. So i dont see the concerns of having more any kind of additional problems. If anything, more businesses need to come into the areas to serve the people. And it brings better productivity as long as they are legal businesses. Thank you, sir. Next speaker, please. My name is kathrin and im a local native born and raised. Ive been to a few hearings and something that brought my attention more was i use cbd for my pet so when i go to the hearings i can see something that it can be for pets and i know locally theres a lot of pets in that neighborhood that could benefit from that. I can second the fact that these are local businesses that are looking to grow and implement the calle 24 which is not bringing something external into the community. Its kind of innovating the community so i support it. Thank you. Any other Public Comment on this
