Finding and the general plan. It is true, though, the intent of the finding was to get to a point where we are having a better geographic spread of these uses throughout the city. The finding itself does cover a lot of topic areas. It kind of should be split into multiple findings. The truth is when we look geographically at the city, the eastern neighborhoods, particularly the mission are overconcentrated. So while we do find that theres particular location and where its locating is not exacerbating an overconcentration on a microlevel, we need to address in the finding that at a macrolevel the city does have a concentration in the eastern neighborhoods. So it is a bit of a finding. Is that overconcentration reason to turn it down . Or is that a statistic you would use for additional regulation Going Forward . Its a policy the city is tr. I believe the City Controllers Office is going to be releasing a report soon that will go a little bit deeper into this. The finding itself only says the planning which i guess commission should consider the geographic distribution of the uses in the city. Its not prescriptive on how you should respond to that. The item before you is a request for discretionary review for a Building Permit to legalize a change of use of approximately 2,850 square feet on the ground floor at the mezzanine level of an existing twostory building to change the use from Automotive Repair to amusement game arcade and restaurant uses. The business doing business as redemption. The project includes interior alterations to the ground floor and no work on the second floor which is occupied by a professional service use. The project site is located at the intersection of 19th street and is a twostory industrial building. A request for discretionary review was on july 25, 2019 by kevin of the cultural action network. That discretionary review application which includes his concerns and proposed alternative it is is attached in your staff report packet as well as a response from the discretionary review response from the project sponsor. To date the permit has received eight letters of support for the project as well as a letter of opposition to the project in support of the dr. The departments recommendation is for the approval of the project as the proposed arcade, general entertainment use and restaurant use are principally permitted within the umu zoning district. Okay. So i have asked to recuse myself from this item when you continued it, because it was a lastminute request, and i didnt want to be the person we had such few commissioners. But i need to disclose that the requester and i work together. I do not feel like that relationship will in any way influence my fair hearing of this item or my vote. So im going to participate. Im a San Francisco native born and raised in the Mission District. I filed a discretionary review for 3252 19th street for a multitude of reasons. The first reason is joey the cat has been illegally using the space for over five years. The timeline dates the amount of time that he has actually used his space unpermitted for private event tech parties even after notice of enforcement in 2018. So he was the timeline shows he had a meeting in 2014 to actually have a meeting to change the use and then he withdrew the meeting. After that point in time, he was given a notice of enforcement in 2018, july 26 from the Planning Department to knock it off, stop it, you are not allowed to host private event parties here. At which point in time hes had multiple events stating he is the host of private event parties including an alcohol permit he requested from abc to have a private event party. So that was in march 2019 of this year. So this is not im a small little Business Owner, he has been breaking code even after he was told no knock it off, multiple times for the last five years. That is not a goodfaith actor. If you look at where the review below, in the multiple, you see he requested one alcohol permit afterwards but the yelp reviews showcase he has been hosting private event parties further along down the way and including having a chance to throw a private event party with children involved. So you talk about this being a familyfriendly space but hes had alcohol around all of that and we dont know how many parties hes had. So i would ask the commission to ask joey how many onrecord, how many parties hes had with alcohol and after the notice of enforcement. That would be my first request. Second being i want to shift the narrative very quickly, no one is going i work with High School Use on a daytoday basis and i think having a Family Friendly arcade place is awesome. If you look at the pictures, that is not what the use is being used for. Its hosted for private event tech parties that are for uber, lyft, airbnb and the average rental is 25 00. If he is able to get approved with a license that would restrict the hours of operation where he would be able to have alcohol. Thats not a familyfriendly space. We dont need another mission bowl where monday through friday you are not allowed to have children in the space. And its great you brought like ive seen the pictures of nuns and having these folks come in and they are going to bring the kids. I want a Family Friendly space. I dont want another bar. We have 389 alcohol permits in the Mission District. A special use district is being ignored and within the process of changing and fixing the loophole right now. So i would urge the condition to take that into consideration. And regardless if you approve this i would ask that you limit the hours of operation to make sure this is not a night life destination coming in because of the fact that this comes in i want to see hes turned time and time again that he has been asking for alcohol permits without it. I dont think hes responsible enough as an owner to have an alcohol permit if hes going to be hosting private event parties. What is the impact going to be when it cops to traffic . You need 24 7 access for pg e around those areas as well as the Fire Department across the street. So we dont know about the actual traffic impacts and i think a study should be put in place with that. So, yeah. Also urban mixed use and the current use is actually for production distribution. So hes asking for change in use to entertainment. But pdr is our most valuable space we are losing at a rapid rate and we need to preserve that. Not to mention he had illegal signage for joey the cat and the auto body shop was still on there. He removed the signage when the discretionary review was put in place. This is within 500 feet of an Elementary School and 600 feet within a high school for john on connell high school. We are talking about proximity to schools. We dont need our young people walking by that and seeing these negative images unless that space is going to be solely for a familyfriendly event. So no one is asking to shut down that place. I want to make that clear. But we dont want corporate event parties like the one he hosted in march illegally. And so not to mention i want to bring up the fact that ive heard this is going to clean up the sidewalk and this is going to make everything safer. Someone was shot on this block. Thats something we need to keep in mind. I dont think having an increased Police Presence come on 19th street is going to be good for black and brown communities, especially for the homeless folks that are there time and time again. So i think that shows theres a lot of lack of understanding of the Police Encounters with black and brown communities in this community as a whole. So im really worried about those because of the high increase of calls that are going to be coming in with that. So, yeah, i think that all of that are really strong reasons on why we need to come into play and uphold the dr review but the restaurant is being up held right now currently. Kids are such a great because. But im all for it if you want to do kids. But lets get the alcohol and shut it down at 9 00 so it really is a kidfriendly place as opposed to using kids to have a really big party place. The academy of art, now we have this place. Is that what people do is they run around and open up illegal places and then the city says no and they keep going and finally they decide, okay, im going to legalize this and the city says okay. You cant do it. You need to lets respect the umu and the fact that its a pdr space that something we need to keep in the mission. And lets please deny this. So i just looked at the review and this is so offensive to me that not only are they talking about keeping the riffraff of the neighborhood out, but then this type of where its just not acceptable in 2019 in my society. And that is my society right there. In 1984 i moved in on 20th and shotwell. Im on 20th and bryant now. The 2500 a night corporate rental fee, thats my neighborhood. So i support what marie is saying. If this is going to have pictures of nuns bowls and kids frolicking then lets make a familyfriendly place. Lets not make it like urban bowl which has hours kids cant go there because they are serving booze, lets see it as a family place that will be a good place for gaming and to keep kids occupied, similarly to what mission rec is. Its a safe place and doesnt serve drinks. So this whole pictures ive been showing you which i will turn in though i thought i sent it to you by email. There are game machines there but its a bar. And using the loophole of bonified restaurant which we are changing now in map 2020 because of the loopholes, we were talking about the oversaturation of alcohol in the neighborhood. This is less than 600 feet from the schools. Theres also an Elementary School at the Church Within a couple of meters away. And theres 250 a day fine. Have they paid it . Because theres evidence online and at the abc that theyve been partying since theyve been told by the Planning Department not to. So id like to see them fined and i dont want to see this bad actor being rewarded in the same way that you just denied merging a two unit into one because its rewarding. I dont want to reward joey to keep going. And i dont trust him that its going to be really a restaurant with alcohol on the side. I think its going to be a restaurant as an excuse to serve alcohol. I parked in front of this place nearby. I go to odc which is kidfriendly about 700 feet away. I want to remind you they have taken over the st. Charles school and so now we have two schools that are very close to this. Its been illegally operating with alcohol as an event site for a good four years. I should also mention my kids used to take dance classes up there in the same facility. And its a long time ago. And its been a school but its not a kidfriendly site now. Evidence of his using it as an event space, in march 12, 2019 a permit was received and then granted for activity on march 22, 2019 with an alcohol license. And yelp shows at least three other events that have taken place since the order was written by this Planning Department for him to sort of cease and desist this activity. Joey the cat should be renamed joey the liar. Im sorry. He has not been playing straight with the city. And we know very well on a statewide basis that restaurants, bonified restaurants are an excuse to turn things into bars. And we oppose this. I would be glad to give you the Public Disclosure records i just received from abc for the six permits that were pulled in the last six years of activities. Some of them within the time period where he should be fined on a daily basis. Please do not approve this. If i could find my notes, i would wrap up.
