This is going to really help were in the budget crises now. Im glad to see that theres going to progressive tax on the ballot to help recover from this and push us forward. Im glad to see lot of this will go to covid19 rent relief as well as social housing which is really great. Im hoping that 8 million funds can be done to help for rent burden support housing tenants like myself. Thats all i want to say on this issue. Thank you very much. Im artem im with district six. Im strongly in favor of this proposal. I think that the landlords of the city have held way too much power for too long. The city help to further their power. Its time to reverse that trend. We need to take money from the rich in San Francisco and give it back to the people of San Francisco who are struggling terribly during a crises when the city is still its time citys money and landlords money to help the people of this city with rent relief, transitioning to social housing and all the things that these people desperately need in the face of struggle here. I know having worked on proposition g, that unfortunately, failed that have been one measure that would stop the speculation at a time when the tax was used to just to get people out and to create luxury units out of our rent control buildings. If we could learn from our past, going forward, what we need above all is housing stability. We do not need Holding Companies investors coming in to serve their own needs. This is really important. I am so grateful to supervisor preston for putting this on the ballot and we are having this public hearing. Thank you so much. Thank you. Next speaker please. Long time renter and member of disability action. I support the proposed transfer tax. I believe it provides a balance and very fair recovery from covid19 rent mortgage problems. I too worked on the prop g campaign. That was at the height of the evictions and that tax was aimed reducing the speculation that drove the eviction. It didnt pass. Now the covid is threaten to overwhelm us. This transfer tax is a recovery tax. To me, i call it the smart cousin of prop g. Its a winwin. Provides help for renters and small landlords and it reduces speculation by producing Affordable Housing. This recovery tax is easy way to ward off suffering of many. California has a real state speculation crises. Prop g fail to pass. This measure will alleviate some of the burden renters face in this state. Im calling in support of this transfer tax measure because now more than ever in this time of covid, we really take the time to protect our renters including folks like myself. Were nonprofit that does lot of housing counseling. Were very supportive of this measure. Weve seen our clients like so many others. Loss of wages is no fault of their own. This ordinance gets that rent relief which we really need. We need to start distributing capital to people who need it most. We can see what happened with the last recession and wall street took over the real estate market. I think at the end of the day, we tend to say we need people over profit. The real question its really which people are getting the profit. We see this time and time again, wealth being redistributed, profit redistributed to the people who really dont need it. I support the Ballot Initiative ordinance and hope that you do pass this on through to double the transfer tax paid by the seller. Particularly, nice about this, it the tax will be waived if the city or nonprofit for Affordable Housing. As you know, half the proceeds will go towards that covid debt thats hanging over the tenants head and the landlord have not been able to collect. People need to understand that this issue of buying and selling property without even caring how much it cost, just raising the value over and over again, is what drives big pump for the global failing economy thats not handled properly by international banks. This tax gets us on the first step to setting the tax, letting speculators know that this is unpopular and we dont want them to speculate on real estate. We provide counseling to tenants all over the city, especially to filipino resident who are constantly being harassed or pushed out the city. We are in full support of this ballot measure, especially the antispeculation and rent relief program. Right now were constantly seeing tenants being harassed by their landlord because they cannot pay rent due to loss of income. Even though we have eviction moratorium. Landlords are still going after their tenants and making it really hard for them to live peacefully, in addition we are seeing in the markets, lot of speculators and landlords trying to sell their building even though we have copa in place. I believe that the covid19 pandemic has disproportionately affected black and brown communities. I think this ballot measure gives us the infrastructure and the opportunity to make sure that our community can still live in San Francisco, the city is still liveable. Best way to do is by taxing these big Real Estate Companies that have exploited black and brown people, have evicted immigrants and black and brown people in massive rates. We enthusiastically support taxing the sale of 10 million buildings and such and using that money to pay peoples back ren and keep them in their homes. Housing is a critical right. Almost 70 of my income goes to rent. This is a race issue and a black lives matter issue. We need to support them especially this pandemic. The people in it city have a right to homeownership, or any housing. Tax the wealthy and redistribute the wealth to the community. Thank you dean preston. We hope you get unanimous support on this. This measure is an opportunity to lower the wealth gap and make housing for affordable for the people who live here in the wealthy deserve to pay their fair share. Calling in favor of this measure with the economic crises, health crises, the pandemic going on in this country in the city of San Francisco, this is something the residents need. This is something black and brown communities need. We know the wealthiest in our communities can afford to do this at the least. We urge this to be placed on the ballot. Thank you. [please stand by] the rise of Corporate Investors in the span of six years from 2011 to 2017. Ve ritas owned 250 buildings and 5500 households. For Investment Firms like veritas and they are far from the only big corporate landlord in town, the path to profit for these firms is premised on displacement, forcing rent control tenants out of homes and extracting the profit margin needed to satisfy hungry investors. When we talk about eviction and displacement and the crisis that low income communities of color have faced in the city over the past decade, the result has completely transformed the profile who calls this city home, we need to recognize the role that speculative Real Estate Investors anchorporate landlords play. Nationwide between 2009 ap2012 africanamericans lost 200 billion in wealth, a 201 ratio. According to 2012 National Fair Housing Alliance report, the largest logs of wealth for these communities in modern history. The story of the outmigration of communities of color from the bay area is tied to the market consolidation seen in the real estate sector. Fast forward to today, Real Estate Investors are preparing for a potential bonanza in the aftermath of covid19, as the wall street journal reported in april. A recent bloomberg report found private equity firms entered with 1. 5 trillions making these cash ready to take on new properties, exponentially nor so than in the Great Recession in 2008. If we avoid this devastating impact we need to take action. That is the intent of the measure before you today. The transfer tax increase speaks to address the harm you will effects of real estate speculation and consolidation in two important ways. First, it incentivizes the transfer of property from private ownership to entities that do not have a profit imperative. It accomplishes this goal by weighing the transfer waiving the transfer tax if the Property Owner sells the building to the city and county of San Francisco or nonprofit. In the case of a property value, for example at 10 million where the owner sells to city or nonprofit they see a cost savings more than a halfmillion dollars. To tip the scales from one Investment Firm to another. Both on eviction and displacement and incentivize sales for the purpose of creating Affordable Housing. Second, for high value transactions in the private real estate market, the city under this proposal will generate more revenue. The tax rate of sales increases from 2. 75 to 5. 5 . For properties more than 25 million the tax rate increases from 3 to 6 . It would generate 196 million annually. With the projected downturn with the amount of investment cash on hand one can estimate this will result in between 100 and 150 million additional revenue per year on the short term and 2 0 million annually in the longterm. What is before the committee and public today is a relatively straightforward change in the business and tax code to double rate of transfer tax for properties at 10 million or more. Voters will vote on this in november. It is part of a larger effort, the ferry cover repack fair recovery package to avoid the housing injusticeis i described and callers described of the recent past. The first use of those funds is through a rent resolution and relief fund by an ordinance we introduced in june coming before the full board soon and in committee. We proposed half the funds generated will be directed to rent resolution relief to provide grants to Property Owners that waived rents due during the pandemic. It will prioritize small landlords with 10 or fewer units and cover up to 50 of unpaid represent. Any funds not granted under that program will refer to existing back rent programs in the city. The other half of the gunneds generated by the tax would finance creation or acquisition of property for permanently affordable social housing including land banking, Community Land trust, ited equity coops, Municipal Housing or other housing efforts where the city maintains interest or grants control for the residents while providing Affordable Housing opportunities on site. This is what it looks like in my view how we can start to make housing a human right in our city by taxing the wealthiest real estate transactions and covid rent relief and dedicated resources to social housing. We must start by racing the revenue needed to promote housing stability. That is the aim of transfer tax before the committee before and in front of voters in november. I have been engaged in sort of an organizing effort along with you and many of our colleagues since the beginning of this crisis talking and demanding from our federal and State Government that they cancel and waive back rent for the residents of San Francisco and of the entire country. The homeless crisis that we are battling on the streets today is going to look simple compared to what we are going to see if there are not major programs put in place that provide relief to not only tenants but small landlords who have foregone rent during this period. The combination of how you thought out the different pieces of this legislation get at all of the different aspects and ramifications what is coming because of the covid crisis and the accompanying economic crisis that has come with it. I just want to give you my deepest appreciation. I am an enthusiastic cosponsor of this measure. After meeting with union, sheriff and Community Members i am happy to submit this final legislation with two minor changes that came from working with the mayor and City Attorneys office. It will give the mayor or board of supervisors three appointments and the board of supervisors will appoint it as requested to meet and confer. We have opposition from msa union. They requested we change this to use the same process as the d. P. A. This oversight needs to be stronger and independent from the Police Department. We have a letter from the department of Human Resources to msa validating we acted in good faith and dha rejects. The Deputy Sheriffs Association has participated in this as well as the sheriff who we will continue to work with as we move forward. Last night after Public Comment the message from the community is very clear. Law enforcement transparency and accountability is a must and this ismenmeant to give communia path. This Charter Amendment will set up a Sheriffs Department Oversight Board and a Sheriffs Department office of Inspector General. What we dont want is to continue to let the Sheriffs Department conduct their own investigation. Right now, we basically have a situation where the fox is guarding the hen house. We have a way to change that through this reform right now. I understand we want reforms and abolish and that may be something that we will possibly get to, but that wont be happening right now. And without this Charter Amendment, we will continue to give the Sheriffs Department 100 power to police itself. Im not willing to do that and we need this Charter Amendment for that change. As you know, we are working hard to close down the county jail, 850 and we are working hard to close Juvenile Hall and there are so many major reforms that we have been continuing to push on, on this board of supervisors. But make no mistake, if we do not put this Charter Amendment on the ballot, the sheriff will continue to conduct their own investigation. There are things we. Want to implement in in policy. Thank you so much to the committee and public who i really understand your frustration. I appreciate the work you put into this and i know you started with our former public defender who is in the jails on a daily base and has helped unearth some of the abuses like the gladiator abuse that is there. When someone is incar incarcera, their ability to address grievances are so limited. They dont have their freedom and the access to the media and the outdoors and all of the tools that we use to protest injustice, just like the callers are using this meeting to protest the injustice they see in society. So until we outlaw incarceration, it is the Sheriffs Department that staff oversee our jails. Weve been working for a long time to decarerate San Francisco. We are in the process of shutting down Juvenile Hall, the board before us rejected a grant from the State Government to build a new jail. We dont want new jails. We want to dismantle those that exist and we are on that involved and taking leadership in that process. But that is not something that will happen overnight. And so, in the meantime, i think that this is an incredibly important initiative, having that visiti civilian oversightr how they manage the removal of peoples liberty when they are iin jail. To me, its very important and having said that, i cannot support the amendment you put forward today. One of the reasons im excited about this measure is because, there is a majority board of supervisor appointment and i have found that many of the commissions, one of the reasons they have not been more effective is because they rubberstamp what the mayor wants and im not talking about mayor breed. Im talking about every mayor that has ever been. When theres an mayoral majority on an oversight body, it tends to be much less effective and when appointments are, you know, more beholden or accountable to 11disparate sou supervisors, thy tend to be much more independent thinking and to play a much more stronger, regulatory role. Supervisor walton, as much as i respect you, i hope it doesnt pass and im hoping we can take the two amendments separately. The one that is the clerical amendment and, of cours, but i e to support the change of appointments to the Oversight Board. Do any of my other colleagues have questions or comments . I support the proposal to the oversight of the Sheriffs Department and, yeah, i guess i am in agreement with supervisor ronen, that i would prefer to keep the original proposal around the placements to the oversight commission. As i agree that we have to have that responsibility, we have to make sure that theres an establishment of oversight legislatively and we have to do this in a fiscally responsible manner and to make sure this works and to make sure the accountant, we havaccount abili. Im number 3 is a Charter Amendment to amend the chatter to require the Police Department to submit a report and recommendation regarding Police Staffing levels to the Police Commission every two years and require the Police Commission to consider the report and recommendation when approving the departments proposed budget and election to be held on november 3rd, 2020. Thank you so much and welcome, president yee. This is your item, so if you would like to make opening remarks. Sure, thank you so much, chair ronen. And i know were spending a lot of time together. [ laughter ] and thanks to everyone for attending this hearing today. And thank you to the cosponsors of this Charter Amendment, supervisors ronen, peskin, fewer and walton and i would like to thank and recognise the Community Members and stakeholders who have reached out to support this effort and work hard to bring us to this point. I want to start off by acknowledging that we are at a Pivotal Moment in our city and in our country when it comes to the role of Law Enforcement in our communities. Communities are calling on us to change our course and hold accountable the systems that allow the perpetual oppression and continual act of violence against the black and brown communities. We must commit ourselves to real and tangible ways to region Public Safety and prioritize investments that keep all of our communities safe. In this moment, confronted with the failures and inequities of the criminal justice system, we must be unwavering in our commitment to implement Law Enforcement reforms, increase transparency and have everyone borsworn to protect our communities. We must make sure it reflects or commitments to the safety of everyone in the city. We need Public Safetys services that truly reflect and immediate the needs of our diverse communities. Ive been working to improve the citys process for setting Police Staffing levels for over five years and i first began to engage on this issue in response to the divisive conversations that the board about Police Staffing levels and the lack of comprehensive data to support decisions. In an effort to take the politics out of the equation, five years ago, i began working with the Police Commissioner, president , julia terman, to develop a strategy and together we work to establish a strategic Police Staffing task force, to develop an independent analysis of appropriate Police Staffing levels. Under the leadership of the Police Commission, the task force include a crosssection of experts, data analysts and Community Stakeholders includes the u. S. Department of justice, the office of community or Police Services and the San Francisco Police Departments command staff, the city controller, the department of Police Accountability, the office of citizens complaint, the Sheriffs Office and the department of emergency management. Over the course of the past two years, the commission put together the task force, hiring a consultant to do a report, staffing analysis of the department and develop a preliminary report. The process laid out the Charter Amendment for determining Staffing Levels as a result of this collaborative effort. And to briefly summarize the Charter Amendment, if placed on the november 2000 ballot for people to vote on, it would probably do two things. First, it would establish a regular process for determining reStaffing Levels in our city. The process would require the Police Department to submit an assessment of the overall staffing and workload to the Police Commission every two years. The Police Commission would consider this report and make a recommendation to the mayor and to the board of supervisors on the department Staffing Levels, where its review of the departments proposed budget. The report would include an indepth analysis of the departments workload, Service Objectives and legal duties. The second thing that it really does is it provides an amendment. This amendment would allow the city the ability to make decisions informed by the comprehensive staffing analysis and remove the requirement that sets an arbitrary minimum Police Staffing level now at 1,971, fullduty sworn officers. I think its important to spend a moment reviewing the history of the minimum staffing level so that we can all be clear about where the number comes from. 25 years ago, voters approved prop d and set a minimum staffing respiratory of 1,971, fullduty sworn Police Officers. 25 years thissu this number y on today was never based on the departments workload, but first appear as part of a Settlement Agreement for a discrimination Class Action Lawsuit in 1979. As a part of the Settlement Agreement, the city entered into an agreement with the department of justice that requires the city increase the sworn staffing to 1,971 and maintain that level of city level of staffing for three years to allow for more promotional opportunities for women and black latin x and api staff. This staffing level of 1971 had the department in the time in 1979. That staffing number reflected the demands of black latin x in order to transport our Police Department at the time. I also want to be clear that when you talk about Police Staffing levels, we arent talking about just numbers. That is far from the sole focus in the department. For example, staffing decisions impact which members have more officers than others and how quickly police are able to respond to emergency calls in different neighborhoods. Staffing decisions impact how well Police Officers know and understand our communities. Staffing impacts how successful Police Services are to our immigrant communities and Community Members with limited english proficiency. This department is tasked with a single goal to ensure the safety of our communities, accountability, transparency and investment in improving Public Safety services to ensure that all are safer. Simply having a minimum staffing number does not accomplish this goal. I wont be introducing amendments today. My office has shared these amendments with all of the members of the committee. The amendments are one, adding language to set regular process for determining the methodology with the Police Staffing report. Two, removing the 19931994 staffing number for Neighborhood Community policing patrol and investigation. And number three, adding a requirement that reports on the impacts of civilianation, civilians should solicit police into the chief of police and controller. And weve added that report weve also added that report should impact the delivery of the Public Safety services and services to protect the public in the event of an emergency. In placing the current requirement to consider only the delivery of Police Services or the ability of the Police Department to respond in the event of an emergency. This change reflects the importance of considerate impacts of civilization on Police Safety im sorry, on Public Safety more broadly and reflects the importance of coordinated responsive efforts to protect the public in a case of an emergency. I would like to thank the assistant chief and commissioner for being with us today. Colleagues, i hope you will support placing this on the November Ballot to allow voters to weigh in on this important issue. So thats also thats all i havd if theres any questions from my colleagues, i will entertain that. Thank you, president yee. I dont have any questions, but i do have a comment just to say, first of all, thank you, thank you for having the foresight of doing this Charter Amendment and you started this amendment before the George Floyd Killing and before the community has been outraged and mobilized and organized to come out and say, we need drastic change. If you hadnt put this Charter Amendment on the ballot, we would be stuck with this random number of 1,971 Police Officers that would really hamper our ability to think creatively and with a new vision for what it could be what we could do and what kind of structures that we can create to keep our Community Safe and avoid some of the tragedies and the violence that have happened throughout history from the Police Department. This gives us the chance and the leeway to think outside the box and to bring all of our collectives when i say collective, not just board of supervisors and not just Police Departments and Police Commission, but the hundreds and hundreds of voices that are calling in to speak on these items before the board of supervisors and there is a movement that is underway in this country, to radically change the way that we police our citizens and this Charter Amendment is going to give us an opening to do that visionary and imaginary work, to, you know, defund and region what a just and safe Public Safety system could look like in this country. So im, for one, extremely excited about this. And proud to be a cosponsor and very much appreciate them. I know we have both commander mosir here and commander, are you actually a chief now . Ive been on the Police Commission two years and this was a project that was ongoing and deep in the trenches by the time i joined. Supervisor yee was in many ways the preessence of the current moment in recognising that were not always going to know exactly the precise number. I dont think i can add much more except from my perspective as a commissioner. You know, were in a really important moment that i think everybody here has recognised and the public has spoken and weve all had very light nights recently and we have to recognise this moment. On the police excision departmed this with the support of chief scott, started a discussion of reallocating resources for homeless response and that discuss involves the killing of george floyd, Breonna Taylor and others into other responses that historically, we learned theres appropriate professionals to respond. The police are excellently and welltrained to respond to certain types of situations, crisis, violent crimes, but there are other professionals that can step in. So, you know, this is a really important measure and it has taken five years to get to this point. This is not a radical defund the police measure. This is a thoughtful, studied, measure that will work out over years of research, datadriven analysis and hard work and input from the community. They really listened to all of the community and the stakeholders throughout this process and followed the research and came to this amendment. So im honored to be here and to support this. First of all, we would like to thank president yee and the rules committee for providing us with the opportunity to collaborate in the Charter Amendment and the proposed Charter Amendment will remove the 1971 staff number and man katemandates a twoyear number r budgetary staff proposals. The department did provide several recommendations and suggestion changes that we felt better served the purpose of establishing Staffing Levels that were not included in the final draft of the legislation. Our main concerns were the requirement to provide a report every two years to the Police Commission on the current number of full duties sworn to the twoyear fiscal cycle on the twoyear cycle. And our second concern was the methodology that was going to be used for this reporting. The sfpd is ready to able to fulfill any requirements as written if enacted. Thank you. Thank you so much. I listened to the sfpds Budget Hearing yesterday and witnessed over 200 people calling in and waiting over five hours to share their demand in redirecting the Police Budget. What a powerful unified call to redirect our funds into the resources that our communities need. This cannot be done if there is a minimum staffing level based off of an archaic charter that no longer serves the needs of San Francisco. Keeping a minimum staffing requirement for reform is an inadequate justification. The progress reports for the collaborative reform reported that the progress is twofold and the failure to implement a greater number of recommendations is delaying the fulfillment of the promise. I am calling in support of the chatter amendment to eliminate the sftd staffing requirements. Police presence harms the black community. Black people make up just 5 of San Francisco population and 40 of People Killed by police. As a rule, i do not call the police when i see issues in my community because i am unwilling to contribute to the statistics and subject members of marginalized communities to abuse and murder at the hand of the police.
