Prestige opened its doors when we were having violence in the city and one of the only places to open the doors for us to meet. And this is an amazing establishment and the people who are amazing. The security is amazing. I heard the lady speak before me me. Ive been there and i know the security does their best to move people along so that theres parking and so do i respect her views . I have to humbly disagree with her. Im sure that she could speak with the owners of the establishment to come to a reasonable resolution where both parties are happy. Thank you for the support. Im a longtime resident of San Francisco is a member of local ten, iowu and we have had a few events there and this is a beautiful venue and i think it would be such a great asset to San Francisco and its more than just a club. Its an establishment for, you know, businesses, for people to come to and engage with each other, an upscale type of event and i heard a couple speakers before and, you know, i sympathize what they say theyre going through. But ive been there several times and never witnessed that. However, im in full support of the cua for prestige. Thank you, sir. Im a San Francisco native who works at the Medical Center and i support prestige. The staff is professional. I had a totally great experience and i support prestige and the application for a cua permit. Speaker good afternoon, im chico wells, a longtime resident of San Francisco and ive been to prestige on several occasions. Ive even brought my mother to prestige and thats how confident i am in the club and i have to Say Something about the young lady who said something about, who is a resident from that area. Theres no noise coming out. Theres other clubs around that area thats noisier than prestige. One thing about the staff at prestige, they make sure that youre in and out in a safe manner. They keep all the noise down. Theres no noise coming out. So i dont understand why they dont see that or trying to stop it from reopening. It brings a lot to that area of diversity. Prestige is more than Just Entertainment and nightclub. They do Different Things in the community. They serve many people. So its more than just that nightclub. They do way more than just that. Speaker hi, im donna. I am a senior and have lived right next door to the place and i am totally against it. I have been working as apara with special ed kids and i need my sleep. You dont live there. I can hear every sound you make. It disturbs my sleep. It should be a place for chimp witchildren with needs and a ple to hang out. Not a club that makes noise until 4 00 a. M. In the morning. If you were in the community and lived there, you would not like this at all. You are finding a place to make noise. You can smell smoke, marijuana. I call the police department. They come out and you continue to do it until 4 00 a. M. In the morning. I do my work and i serve the community. It is noise. Its not a safe haven. The smoke goes into our house and it goes around the area and people are not safe there. You have cars piled up in the middle of the block, double parked and believe me, you cannot sleep in that noise. Thats why im totally against this. Something else that is good for the community, thats safe, yes, but not this, believe me. I dont know where you came up with this. Im fully in favor of prestige sf getting its permit and i think its great for the local economy and it helps stimulate job, not only at the nightclubs but in the neighborhoods with uber drivers and im fully in support. I totally oppose opening that club. Its fine during the day. I have no objections with that, but after midnight, there were so many people and marijuana smoking and garbage outside and i dont see how they can say its safe and good for the community. I pushed my button early on and i would like to state in this project has remarkable broad support and i would like to put on notice, instead of writing form letters for situations like this, a large segment of the community will spend the time to talk to us is giving another level of support for this particular venue. In the conditions of approval, it is specifically mentioned that the latenight permits that the Entertainment Commission sometimes grants to be open until 4 00 is not available to them and their hours of operation are limited to theyll be closing at 8 00 p. M. And on saturday, 1 30 a. M. And sunday at 10 00 p. M. I appreciate you reading that into the record so people have an idea and barometer to watch, indeed, whats going on. Im very much in support of whats in front of us and i also appreciate mr. Johnson and former supervisor weiner and london breed, now our mayor, to speak to the legislation in 2015 and the efforts which have been made on behalf of these venues. Thank you for that. That prestige opened without the respiratoried use permit and they did not have ye opened without permits to have a general entertainment use. So that was the initial enforcement action and then, in working with the Department Since to get back. So yes, enforcement action without proper notice or application. So this cua is a result of that enforcement action . Yes, this cu is effectively going back to legalize the business that they had already started and they since have pursued a path to get the permit and this cua is the result. And you know, one of the biggest issues here is as compared to the broadway strip, is that this area, this particular block is somewhat residential in nature. From staffs point of view, how do you see the conditions working to be able to deal with that in terms of the two uses, entertainment use and residential use coexisting . I think the reason that they can coexist is partially due to the restrictions that prestige is under. That this isnt a bar that is allowed to be open until 2 00 a. M. Any day of the week. It should be less prone to people pulling up as happens in public venues. I think the fact that its in a basement is conducive to sound proofing. Ive talked with the applicant about the curtains theyve put in and the extra layers and talked with the Entertainment Commission. They cannot have alcohol unless its a catered event. We ner heard in a venue multe appeals and a couple of the other clubs on broadway and one of the things that came out of those discussions and conditions was that we wound up eliminating amplified music, period, after 12 00. And it appears to have helped in dealing with some of the residential uses that occurred near those clubs or even adjaceo those clubs there. Any opinion on that . I think this is a possible solution. To increase the comfort the neighbors with the risk of noise. I might as well state that i would be prepared to support this conditional use but would they change that the with the addition of a condition that there will be no amplified music, period, after 12 00 . Commissioner fung, you broke up and i assumed you were going to say after 12 00 a. M. . Yes, 12 00 a. M. Theres only one thing in the way and that is a 1 30 on a sunday. No, thursday through saturday. I would agree with that, with that condition. Can you tell me what public action permit theyre submitting . And then, who is the entity or which entity is suggesting additional noise measures . And to what standard is it that this entity is requiring the applicant to meet . It just feels a little vague to me and i would like to understand more specificity. And so the Building Permit that will be filed is a change of use. The applicant is not supposing any work at this time and so, they dont have, you know, plans for walls, demolition, et cetera. But in order if they are approved, in order to memorialize, they need to provide plans with that and in those plans, you will need documentation of the noiseproving measures. And so the measures they had are the curtains and other measures as applicable will be in there and then your second comment was about . Which standard do they need for noise . So the standard for noise is more under the purview of the Entertainment Commission in the police code. They is been in touch with the Entertainment Commission to make sure i addressed all of that. I just want to chime in and let you know that in addition to our conditions, the project sponsor is subject to Entertainment Commission permits and they go regularly out to sites and make sure that theyre abiding by what has been laid out for them and its in the Entertainment Commissions best interest and their staff to make sure that these Entertainment Venues are, you know, being Good Neighbors to the residents nearby. Is there a standard or some other noise measure to which theyre measured to make sure theyre adhering to that . They do. They have that and thats why weve been working the Planning Department has been working with entertainment staff, Commission Staff to theyre the ones who regulate it and we also have conditions in our approvals and so that was a little bit awkward and so we sort of deferred it to them. And i dont have that dba standard off the top of my head, but they to go out with a noisemeasuring tool to make sure they abide by whatever level thats been set up. I was able to dig up the standard. Its Police Code Article 29. That commercial is industrial noise limit, no person shall produce or allow to be produced any machine or device, music or entertainment or any combination of the same on commercial or Industrial Property over which a perp has ownership or control, a noise level more than eight dba above the ambient outside of the property. And so then i have a followup question for commissioner fung. And that is, are you proposing that even if they meet the standard, you still want them to not have amplified music after midnight on thursday through saturdays . Yes, i was going to respond if staff werent away of some of the specifics of Entertainment Commissions noise requirements. I just see here on page 6 that you shall not include competition between midnight and 6 00 a. M. , so i wanted to make sure that is part of what were i saw it differently, that there that amplify was allowed if it was appropriate. Can you clarify that, please . Yes. So when i wrote that the idea was more of the interpretation that the electronic amplification is not necessarily a blanket that no Electronic Devices can be, but that if theres, you know, if theyre having a music performance, that speakers and everything is not okay, but the background music is potentially acceptable.
