Moving along, number 4, which is report from our executive director weiland. Thank you Vice President bleiman and good evening commissioners. I missed our last hearing and i just wanted to take a moment to congratulate Vice President bleiman and president cu mineo on their elected positions on the commission. I want to thank staff so much for being in charge while i was away and special thanks to Deputy Director azvedo. My only update is in regards to a action that Deputy Director azvedo took in my absence relevant to the brick stn we have been keeping apprised of during enforcement updates. Pursuant to section 1060. 20. 2 of police code, Deputy Director issued the brickson a 15 day suspension of limited Live Performance permits on july 21, for three permit violations during a 90 day period. They had prive Business Days to appeal the suspension, which they did not do, therefore the 15 day suspension is currently in effect. It went into effect july 28 at 5 p. M. And cease august 12, 5 p. M. Saturday 29 inspector did a site visit and conformed the business was not hosting entertainment at that time so they were in compliance. We will conduct another site visit this weekday to insure compliance and from there conduct further random site visits to check compliance moving forward. It is not agendized, i believe you are all aware of the fact our suspension hearing for stratos scheduled for this evening has been continued. President commino approved a continuance so that will occur two weeks from today august 15. Let me know if you have any questions. Welcome back. Thank you. I just want to give a shout out to Deputy Director azvedo running things so smoothly in your abstance. We are happy you returned though. Thank you for returning. [laughter] youre welcome. Is there any Public Comment on the directors report . No Public Comment for this item. Alright. Well move along to number 5, which is report from Senior Inspector. Thank you Vice President bleiman. We received 34, 311 complaints since the last hearing. I have one update, please let me know if you have any questions. My only update is neck of the woods at 406 clement street which holds a poe. Neck of the woods received 2, 311 complaints july 16 stating excessive noise. Responded july 22 at 950 p. M. Observed a dj downstairs and band upstairs. The she took a sound measurement which showed the dj in compliance but up stairs was 97. 3dba and 107. 3dbc which the allowable limit is 91dba and indiscernible they were operating 6 decibels the dba and 5 above the dbc limits. When inspector spoke with the sound engineer he stated he did not have control over the equipment. The manager was aware of the doors and windows being open and did not close despite asked to do so. Lastly, inspector learned the meter being used by the business was reading average dba and dbc level opposed to live readout and therefore no way to insure compliance. Neck thof woods issued a notice of violation july 25 for violating the sound limit and operating entertainment with the doors and windows open. An july 29, visited neck of the woods. Upon arrival he observed the front door open and loud dj music coming upstairs. He noted the sound curtains were not closed on the upstairs windows causing sound it bleed outside. Took a sound measurement at 87. 1dba and 104. 7dbc. The reading was about 3 decibels above for upstairs which is 91dba and 102dbc. Inspector spoke with onsite manager for 24 reason for the visit. Asked them to close the front door and close the sound curtains which they did. He also spoke about the valium of the dj and worked to bring the volume into compliance. Then inspector returned a few hours later 12 30 a. M. Due to together sound compliant. When he arrived the front door was open and dj music clearly audible outside. Took another sound measurement which showed the volume at 91dba and 102. 8dbc. The approved sound limit is 89dba and 97dbc. Issued citation for violating the Good Neighbor policy number 7 which requires businesses to keep doors and windows shut during entertainment and for exceeding the allowable limit on two separate occasion s that night. Staff plan to work with the owner to insure compliance moving forward. Thank you. Any questions for the Senior Inspector . Just i notice that scn west shows up a bunch taking their first sound permit out for a drive and going over the limit, which is not a great start. Anything else you want to say on that or . As far as that is concerned we had inspectors visiting in real time as much as possible. They do hold events and we dont have inspectors in the field. We have a list of special events, many of which are sunday. We did send an inspector out recently to one of those events and she did find i believe they were over their limit. Was able to work with them to bring them back into their limit, so we are in contact with them. We have been responding in real time as much as possible. Yeah. Thank you. I have something to add commissioner thomas. I have been in touch with the permit holder regarding the complaints and in touch with the complainant and one of the suggestions that the neighbor had made was being able to view the calendar of evepts on the website and so they dont have that but after speaker to the permit holder that is something they are rectifying and within the next month they will have a calendar of events and did have a event of pop up on the website with a phone number to contact someone in real time and link to the event. They reached out to the two residential buildsings that we know of that have a lot of residents with a link to the event and contact information, however it sounds that is potentially want disseminating among the tenants. So they went to the property manager and good faith effort to try to get the nrfshzsent out. Since the event saturday where the violation happened, the permit holder has put in touch directly with that neighbor and another group of folks who want direct contact from the venue and are going to be doing that. Good things came but they were in violation of the sound limit. Thank you and thank s for the update. Anymore questions . Any Public Comment on the Senior Inspectors report . No Public Comment for this item. Alright. Close Public Comment. For the record, president caminong is here and arrived during the inspectors report. Thank you. The next item is 6, hearing and possible action regarding the applications for permits under the jurisdiction of the Entertainment Commission and Deputy Director asvedo will be introducing these. Thanks vise president bleiman. We just have two applications for indoor llp permits on consent. There is no opposition for either permit and sfpd did not have added recommendations so recommend you approve the consent with staff recommendations listed. Any questions . So moved. We have a motion. Second. Is there any Public Comment on either of these items . No comment on these items. We can vote. [roll call] congratulations to them, especially the 2211 club that is one of the best spots in town in my humble opinion. Next on the list we are moving to the regular permits and believe Deputy Director will be doing these as well. Thanks vise president bleiman. Okay, buckle up. The final permit on the regular agenda is llb for indoor entertainment for mikroblack at 2323 Market Street. Microblack is a Clothing Store and seeking the llp permit to host indoor entertainment, dj, drag performance and fashion show to promote products. The business is also seeking ability to host outdoor amplified sound to play recorded music. The applicants are seeking no more 6 hours per day and the hours are included in the recommendations. Ec staff sent internal sound limit for the space listed as a recommendation as well. As you may recall, mikroblack appeared at the hear ing june 20and due to opposition from the neighbors you voted to continue to july 18. At that hearing they requested continuance to do more outreach and i also requested continuance based on news about the lease agreement. In your file you see a subfolder for this item. In the folder i included the original application along with separate pdf with the communications between june 20 and july 18 hearing and july 18 to together. There are numerous emails included so to make it easier i prepared a timeline for reference which is in the own pdf which dates back to the first inquiry we received about mikroblack in february of this year and brings us as recent as yesterday. The neighbors were unwilling to meet with mikroblack they agreed to email them directly so long as i was on the thread and i will say initially the exchanges were contentious but the last 2 weeks i feel we made a lot of positive progress and the two parties were able to Work Together to come to somewhat an agreement. Ill read what the two parties have both agreed to, which is having outdoor amplified sound mondaythursday 28 p. M. , friday and saturday 39 and sunday 17. Approved at 78dba and 73dbc maximum. This will make more sense in a moment, but in addition to the entertainment sunday the permit holder is allowed to hold entertainment additional 15 times 1 hour total 19 p. M. The permit holder host live musicians so more 6 times then calendar year and shall send the events to Entertainment Commission and interested neighbors at least 7 days advance. The point they could not reach is frequency of the sunday dj events. Was to host sunday 37 p. M. While the neighbors want once a month sundays. Done on trial basis once a month for 6 month jz can discuss increasing frequency. Both agreed it is the Commission Decision on which route to take when it comes to sunday dj events. I include a list of commitments mikroblack promised to the neighbors. I explained these are not permit conditions but want you to see what they committed. Those are included in the staff memo to review. I included two sets of staff recommendations listed as a and b. List a is what mikroblack is seeking and b is what the neighbors are requesting. You may choose to go a different route. Sfpd Mission Statement did not have added conditions and here to speak tonight is the owner jewels and general manager nathan. Unless you have questions for me about that before they come up. I do recall last time there being a issue with landlord authorization, has that been cleared up . Yes, as of now it has been cleared up. Okay. Am i okay to start . Great. These are not included in your file. Dylan is about to pass out letters of support recently submitted and not included in the file, so three additional letters of support. Dear members of the Entertainment Committee and dear neighbors. Let me reintroduce myself. My pronouns are she, her, they them, indiscernible immigrant in this country. I come from a academic as well as show business background. I have seen many peers in the creative world suffer forced to give up lose livelihood disappear in the last 3 years. Starting with the outbreak of the war in ukraine and watching many peers flee, the idea adding a Queer Social Club was born. A social club in a place where the community can gather, do benefit events, have talks and etmooings to bring attention to those in need. It is important to me as a Business Owner and minority to create a platform for artist specifically other creative minorities to make a living, provide with places to meet and talk about their needs. In the castro there are far too few places for that. For example, specifically create a welcoming environment for transwomen, transmen, poc queer performers and other minorities. I would like it to be that place in the castro. I would like to provide that space. It is not news women owned businesses are not welcome in the castry castro and experienced the saiment. I tried my best in good faith to invite the neighbors verbally with very little success. I feel im being pushed out due to personal vendetta. My business was a victim of arson. Complaints made to nearly every Regulatory Institution making this a fight every single step of the way. I would like to add that every time checks were sent in, we have been in compliance. I am trying to bring diverse new clientele for the castro to be a thriving neighborhood. When it comes to the only remaining point still in debate between us and the residential neighbors, the demand for 6 p. M. Shut off is dictating our store hours. The demand for so called, quite retail and that is a quote from one of the neighbors letters, it isnt something that most businesses cannot afford to accommodate, especially in the current economic climate. We need to be unique, forward and interesting for people to come into the castro and stimulate the economy of our neighborhood. Thank you. Thank you. Alright, thank you. I think why dont we do Public Comment first and then we can talk about motions. Everybody good with that . Lets open up to Public Comment. If you are in the room
