The u. S. Government is now facing a troubling decision. As it considers Lethal Action against an american citizen suspected of working with alqaeda. President obamas stricter drone policy states that an attack may not be possible because the man is a u. S. Citizen. Last year the president addressed the use of drones. For the record, i do not believe it would be constitutional for the government to target and kill any u. S. Citizen with a drone or with a shotgun without due process. Nor should any president deploy armed drones over u. S. Soil. Reporter only one american agency, the Defense Department can give the go ahead on such drone strikes, but if its to go after an american citizen, the Justice Department first has to build a case against him. Jay carney didnt speak specifically on the case but referred to it. When a u. S. Citizen goes abroad to wage war against the United States and is actively plotting to kill u. S. Citizens, and when neither the United States nor our partners are in a position to capture him before he carries out a plot, his citizenship should not serve as a shield. Reporter the man in question is reportedly in a country that doesnt allow u. S. Military action. Officials say what needs to be determined is if the man is dangerous enough to warrant an attack. What do you make of this . I dont think as an an cyst of International Security i dont think it will be u. S. Policy that were going to kill a lot of americans this way, but i think the principals are very, very point. Traditionally we have given u. S. Citizens, special privileges and rights that we have not given to foreigners, and were changes the rules of the game, the president outlined that before. What is different about this . To me what is difference is this principle that we have had terrorism and war as long as there has been a United States of america. We have had it here and abroad. We have traditionally treated these as separate topics. Americans enjoy even although we found out not quite as much as we thought, more rights for nsa surveillance than a foreigner living abroad, and as those things begin to melt together, the question is does this become a precedent for Something Else . And the other thing that i think really stands out about this is how are we how is this happening . Is there transparency, accountability, review . Those are the safeguards you need, and im concerned that those safeguards are not in place. Its also how the United States is viewed around the world, right . Absolutely. And one of the standards we might use as we think about this very difficult problem is how would americans view this if a russia or a china went and used a drone to kill one of their citizens in a foreign country, even the us. I think we would probably object to that. People are worried about terrorism, but im not sure there is a real discussion about the costs and benefits. What is the difference between a drone or a shotgun . There really isnt a difference. I know we focus on the drones, but the issue is not the drones. The issue is if you are an american citizen and you commit a crime, you are supposed to be arrested, brought back, and put on trial. And the evidence is to be brought against you, and you have a chance to respond to that evidence. This is a person who may commit a crime in the future, and there is no real judicial review of the charges against the person, or their ability to respond to them. So thats very different territory. So the United States becomes judge and jury and decides automatically that this person deserves to die, and then ho is tracked down by a drone. I guess part of the problem is the drone, the use of the drone, because there has been so much criticism of the use of the drone, because as richelle mentioned, its not always accurate. Yeah, there where several things with drones, accuracy is one. Political imrepercussions, such as in pakistan. And there are ore principles of International Law here as well. But your core point was right earlier. The drones the reason why were wrestling with this, is you couldnt use a shotgun to kill some guide hiding somewhere and now you can. All right. Thank you. President obama is now delaying some deadlines for certain businesses to implement the Affordable Care act. Mike viqueira joins us more on that. John, this is mediumsized businesses. And it comes on the heels of last summer when the administration delayed the employer man state, the requirement that everyone who owns a business supply Health Insurance to their employees with the exception of those with 50 or fewer employers. And now mediumsized businesses get a reprieve for another year. Now those are 50 to 99s employees will have the mandate delayed for another year. Republicans are jumping all over this, saying this is more evidence of the president and the administration to make up the law as they go along. A majority still oppose obamacare as it is called. The Administration Says just 2 of all businesses, these mediumsized businesses, and also it will be phased in for larger businesses, those with more than 100 employees, phased in over the course of 2015 and 2016. John boehner has been very harsh in his condemnation this evening, we have a fuel screen. John one thing that is unusual about this, its 11 months before the mandate was going to kickn for the midsized businesses, the administration figured you might as well rip the scab off. And its just ten months until election day. Obviously the administration wanted to get this out of the way. Yeah, more trouble with the healthcare plan. In charleston West Virginia some residents say the water is still not right. A Congressional Panel met to investigate who was at fault. Robert ray is here with more. What happened at the hearing today . New regulations discussed. New information about the chemical tanks on the elk river. The word safe not being used to describe the water by officials, and residents giving a chance to speak their mind at the hearing, hoping they can get back to drinking the water and life as they knew it. A subcommittee field hearing was held monday morning to see how the chemical was spilled into the water supply in west washington. We were on the front end of this. But its a wakeup call for the country. An inspection three months before the spill revealed that the storage tanks did not meet industry standards. They heard testimony that this entire situation would have been avoided. In october 2013 at the request of the company, tank engineering and Management Consultants conducted a review of the tank terminals. The substance stored in tank 396, consisting of hauz ardous materials. Not in attendance freedom industries. The company blamed for the disaster. One Committee Member said they had no courage. West virginia representative said there is an odor emanating from the industry, and it is not licorice. When asked by federal lawmakers if the water was safe, not one person could say the world. Instead the Committee Heard this. Am i confident in the science . Im as confident as i can be, given what we had. You know, i believe the water based on the standards we have is usable for every purpose and that includes drinking, bathing, and cooking. Reporter and this is the Water Company president. State and federal investigations continue as new regulations are being introduced trying to maketure a Chemical Spill like this never happens again anywhere in america. John the chemical board has responded to two separate Chemical Spills since the year 2008. They made recommendations to the state of west wa virginia, as to new programs that could be implemented, they said they never heard back from the state. And the state of georgia is now bracing for another major winter storm. Ice and snow expected to hit atlanta starting tonight parts of the state could get as much as 8 inches of snow. Atlanta Public Schools canceled classes for tuesday and wednesday. And the governor has already decla declared a state of emergency for 45 counties. Were not looking back, were looking forward. The next three days will be challenging. And we want to make sure that we are prepared as possible. Officials are hoping to avoid a repeat of the chaos two weeks ago when two inches of know and ice paralyzed the area. People were trapped in their cars. Others abandoned them on the high waiys. John this is going to be a bad one but not just for atlanta. As you can see, we are getting rain, and icing and snow in many locations. But in atlanta it will be the freezing rain that will be the big problem. People are not going to work tomorrow afternoon or on wednesday. And all of the warnings and advisories are out there. One of the places im extremely concerned about is what is going to be happening across south carolina. In the carolinas, jon, they are expecting to see one inch of freezing rain. So that is very heavy. The branches are coming down. The power lines are coming down. As we go from wednesday night to thursday in this location, there will be thousands of people without power. So major stories here. If you go to North Carolina in that particular area, we are looking at anywhere between 12 and possibly 14 inches of snow in the west area. So this is a big storm with a very big scope. In britain, the river thames flooded its banks today. The military has been helping residents evacuate after attempts to hold off the water failed. Now to syria, there is a desperate attempt underway to evacuate civilians from the countrys Third Largest city. Aid workers have been trying to help hundreds of civilians flee homes. Stephanie decker has the story. Reporter we just had an official statements saying that over these last four days 800 people have been evacuated from the old city which has been besieged for a year and a half now. And they have officially said that this ceasefire which was supposed to last three days will now be extended for a further three. Today we spoke to the governor and he said the evacuation on sunday was so successful they managed to get out around 600 people, that it seems to have given people the confidence to come out. Because no one really knows who to trust. These people dont know what is going to happen them once they come out. But talking about extreme hunger, and very, very difficult times, so the United Nations determined to get everyone out who wants to. In federal prisons samesex couples will have visitation rights. He could soon be the first openly gay player in the nfl. Michael sam came out yesterday. Michael eaves is here with that story. This is a huge announcement for the entire sports world. And it could change the culture of sports locker rooms all across the country. In making his announcement last night, he said it was a huge relief to sar something publicly which he already shared with his missouri teammates last fall. An experience he says give him the confidence to come out before the draft. Less than two weeks ago, [ inaudible ] said some players wont like showering next to a gay player. It really plays on the old stereo type that gay men are sexual predators. There were people who used the same arguments about why africanamericans and whites couldnt serve in the military together. Blacks and whites werent going to shower together, things like that. To me its just a very naive homophobic remark, and by the way, they have and they are showering with gay men. They may not be open, but thats the reality of the world. Firemen, policemen, all over this country are showering with gay men. There has never been a problem. This is a madeup problem. Former nfl player wade davis with was also part of the support group. I asked davis what the timing of this announcement says about michael. I think it says that he is so courageous. I have never met a person that has walked through fear the way he has that showed his heart and vulnerability. And i think hes going to be an amazing leader in the nfl for many years to come. Reporter from your standpoint having been in professional football locker rooms, how proud are you that very likely in 2014 there will be an openly gay player playing on the field on sundays. I cannot wait to go to michaels games to have friends over to my house to turn on the tv and point to somebody who is not only a friend of mine, but someone who is a pioneer. Someone who is going to change the way the league is. The nfl has recently released a statement reading in part, quote,. What does that league support do for michael sams transition to the nfl . I think it reaffirms his true trust in what the nfl stands for. I think oftentimes we imagine the nfl being this homophobic place, but what were learning that it is truly not. Its players, you know, are used to being in places where players from different races, different classes, different religions, and transcending all of those fears and saying, hey, these are my brothers, and if you can help a team win, if you are going to be a standup guy who is not afraid to show courage. And thats what he has done. He is projected to be a third or fourth round draft pick. Are you completely confident that this will not cause a team to want him in i dont know a team who is as courageous, open, and vocal as michael sams is. One thing i heard coaches always talk about is they wanted guys who were courageous, and that should be his middle name now, you know . Because he has done all of that. I think there are teams out there that want michael sams more than we can even imagine. What impact do you think this will have on younger athletes . His visibility is truly what is going to be the transformtive thing. Michael is not looking to become this lbgt rights advocate, because he wants to focus on football for the next couple of years, right . But just by seeing him on the Television Screen is a transf m transforming thing in itself. So that will tell so many boys and girls that whatever they want to become in the area of sports that they can be that. Its worth noting that michael sams is really, really good.
