Well ut dow posting its biggest oneday gain since early february. All ten s p 500 groups are higher with Energy Leading the way. Weve got bob pasani on the nyse floor, dominik right here at hq. What can key Technical Levels and josh lipton on the very tough month for tech. Bob, you first. Blastoff around the globe this week. China from the outset ended near the highs. Germany starts early today. U. S. Starts at 9 30 eastern time. Theres a pat he were here. Global buying. You can blame it on comments from the peoples bank of china officials. Whatever. Theres the s p futures. We actually gapped up twice. Once at 330 when europe opened and once at 9 30 when we opened. Were at the highs for the day. In terms of sectors, i have been of the opinion that we are seeing some end of the month rejiggering since the beginning of last week. Were seeing it again today. The biggest losers for the quarter are Energy Financials utilities, and industrials. Those are the only four sectors down on the quarter. The biggest gainers today are energy, financials utilities, and industrials. How about the big gainer for the quarter . You all know that. Its health care and biotech. Whats the biggest laggard today. Its still up, but its health care, and biotech. Theres an indication. Finally, they keep trying to buy energy stock. How many times we been going over this story for two months . All of these stocks you see are actually up on the year. They have been quietly in a stealth rally for the past couple of weeks. Ill show you some more examples in the next half hour. Tyler, back to you. All right. Bob, thank you very much. Steve liesman now has a cnbc rapid update on the economy. Steve. Hey, tyler, whatever leaves behind this rally, its not the economy or the economic data. Economists see in the u. S. Economy in the First Quarter come the stall speed. The q1 tracking. The cnbc rapid update of all the tracking forecasts out there. Declining by 0. 4 . Down by 1. 4. Thats the low for the quarter with a range of zero. Yes, there is a goose egg among our forecasts to 2. 2 on the upper end, but they do see a rebound in the Second Quarter. 3. 5 with a range of 2. 4 to 2. 9. Steven stanley, securities he is saying this is turning into a recurrence of last years nightmare First Quarter when weather drove the gdp figure deep into negative territory. He does see a bounceback in the next quarter. Take a quick look at where the economists are. Bank of tokyo, goldman at 1. 2. Moodys analytics at 0. 6, and theres peer pot at zero. Sdronk personal income number and a Consumer Spending number that was below expectations and then factoring in inflation, which is how it carries over to gdp. Down 0. 1 for a savings rate folks, of 5. 8 . The best number weve had since december 2012 or mandy, i guess if you want consumers to spend, that savings rate is the worst number weve had. You can look at it both ways cant you . Glass half full glass half empty. Lets bring back bob and also katie, director at oneil securities. What do you make of these latest forecasts from steve . Once with you get through the end of the quarter and we start april 1st then you have to be concerned that the market is in fact going to pullback. Correction . Not really. 10 would have to take us down to 1900. I dont see that at all. Certainly a pullback and a correction. The only good news is the markets are reflecting this in the lower earnings estimates. Remember, were negative on earnings estimates from the First Quarter. One economist after another says i know you hate this mandy, but they say that its the weather thats responsible, and we do know that february had some record cold temperatures around the country. One other point i would make is that betting against the weather reasoning, last year was a bad bet. Loser. You can bet your Bottom Dollar that the two biggest themes were going to hear about in terms of blame, the blame game in this earnings season weather and also the strong dollar, right, bob . Absolutely. Thats why i want to watch the guidance. Thats why i think steve is right. I think theyre not going to be as pessimistic in their Forward Guidance as people think, and thats why i think the analysts overshoot. They have got sown pessimistic on the earnings recession, that they really drop the numbers. Not just in energy, but a lot of other sectors. I think theyre going to do a little better. I think you have to also wait to see what the real impact is of the stronger dollar. 12. 8 billion dollars by United Health. For United Health its really going to strengthen its pbm. Pharmacy benefit managers, you can just see where the value is. This is getting taken out at 16. 5 times earnings four years ago express scripps brought medco. Four years before that you saw cvs by care max at about 12 times earnings. Herrizeson buying hype ear yon. Both those deals sending those takeout candidates to new highs. Youre not seeing the biggest bump from those deals today in the biotech space. The biotech index is up 1 . You would have tlaut it would be higher, and thats because even with last weeks big plunge biotech is still the outperformer for the month. Back to you. Talk about a merger monday. Thank you very much, bertha. It has been a really volatile trading month. The dow on track for its 15th triple digit move, and if you are trying to find an entry point in this market what are the trends you should be watching . Well dominik has some ideas up his sleeve. You think tracking it sir. Any number of factors that market technicians, the chart watchers look at fundamental analysts look at. The batting averages for the market. Here you can see the s p 500. The pink line that you are seeing right there is the 100 day moving average. You want to think of that as something more of a medium term batting average for the overall market. You can see here after we dropped 8 last fall thats midseptember to midoctober we rallied back and consistently bounced off these levels here, and we bounced off it again here. Thats reason why some traders are more optimistic if we can close out this particular quarter with some gains. Maybe a little bit of momentum as we try to retake those record highs. Now, lets take a look at another one. If you move to the s p 500, the dow jones, that same kind of move has happened as well. That big midseptember to midoctober drop. Then all of a sudden a little support here as well as the medium term batting averages. The nasdaq composite has been bouncing off these levels but even with the pullbacks that weve seen recently were still trying to take out that 5,000 level up here. Tech is one of the worst performers in the s p 500. Analysts think that you immediate to rethink your call on technology or their call on technology and investors jump in and buy at these levels stay away. At least seven strategists have buy on tech but those pros now now be rethinking their call. What is pressuring tech . Strategists pin the blame on a weakness on that rising dollar as a seconder. Tech generates nearly 60 of its sales from overseas. More than any other sector in the index. Stronger dollar could impact sales by making the price of u. S. Products more expensive to customers overseas. Rick sherland says that could be a head wind for the last five quarters. He points out, for example, that oracle took a 6 hit to revenue because of a stronger dollar in its most recent quarter and that it could see as much as a 9 impact in its may quarter. Of course, tech still has plenty of fans. They point out that the sector is trading at about 17 times earnings, which is in line with the market and cheaper than where historically trades. They also point out the sector is expected to boast Earnings Growth of 5 this year. That is far stronger than the overall market. Tech investors might have a better sense of where the dollar heads from here when we get fridays jobs report. Dollar bulls say that if that report is Strong Enough it could provide more fuel for a rising dollar. Mandy, back to you. Thank you very much for that. Josh lipton. Well, we were mentioning a moment ago that Energy Shares are doing well in trade today, but lets take a look at what the underlying commodity oil is doing because prices have been on the back foot today. Were currently down by 1 at 48. 44. Wti is the deadline is approaching tomorrow. There was strong key data on a forward looking measure on the American Housing market. Diana ohlich is in d. C. With all the details. Hi diana. Hi ty. Look, it was a big surprise to the street. An unexpected jump in pending home sales given all that fingerpointing at the bad weather, but ill point right here to two sold signs. Buyers were out shopping in february and signing on the dotted line. Contracts to buy existing homes rose 3. 1 month to month and were up 12 from a year ago. Thats the highest level since the summer of 2013. Sdmroop the retail numbers are interesting. You see sales in the midwest took a huge jump. Again, whether or not much of an issue. Just a slight drop in the northeast and south, but strong gains in the west and thats where the Home Builders have been most active. Supply could be playing a big role there. Supply is going to be key going forward. While the Sales Numbers are improving, the number of homes listed is still tight in markets across the nation, and thats pushing prices higher. That could be a strong headwind to sales going forward. First time buyers though still not back to normal pace. Manned where i. Very much diana. Well, blog nanke is taking to the internet. Her private equity firm being accused of fraud. Robert frank spoke with lynn earlier on today about those charges, and what is she saying here robert . She actually spoke with her a couple of weeks ago prior to this in anticipation of this chart this morning brought by the s. E. C. Against lynn. One of the richest and most high profile selfmade women in america. The s. E. C. Says tilton the turnaround financier and found are of Patriarch Partners defrauded clients by failing to properly value assets to her investors. This relates to the clos or collateralized loan that she uses to fund her companies and that were sold to investors for three separate friends. Now, the s. E. C. Alleges that these improper value wags in rich tilton and her firms by nearly 200 million. In a cnbc exclusive tilton told me earlier this month that she is shocked and saddened by the charges. Shes going to fight them hard. Take a listen. My people need to know im standing in front of them. My people need to know that i am fighting for them but i also want to live in a country where i can fight for truth without assuming that because its the government that im guilty without the battle so as someone who has always fought for truth and protected her integrity and her intent and have prevailed i expect to do that. Tilton calling this a battle of good against evil, light against dark, and that the sophisticated investors in her funds knew the risks of turning around distressed companies. She said this will have no impact on her more than 70 companies, which include dura automotive, steela cosmetics and dura helicopters, and, mandy, you know lynn. She has faced a lot of obstacles in her life. To her this is just another one that she will prevail, but very tough language and tough charges from the s. E. C. Okay. Thank you very much for the developing story. Thank you. Robert frank. Ty, over to you. The former fed chief ben bernanke has a new title, blogger. Today he spoke about why rates are so low, and he talked a little bit about europe and senior economics reporter steve liesman. He is here with more. Hi steve. Good afternoon. Its not just a blog though but also a rare public speech by ben bernanke the former fed chair, on the economy. He has made only limited economic comments since he left office last year but in a d. C. Speech today bernanke said that Interest Rates may not remain this low forever and could rise as europe recovers and better growth takes hold in emerging markets. The downward pressure on global Interest Rates would probably moderate somewhat continue to moderate somewhat over time and the pressures for the trade deficit in the United States will probably moderate somewhat over time. I think those are positive factors that need to be taken into account thinking about growth. As of now, bernanke said that europe is in a depression basically, but up until now bernankes comments have been reserved for private speeches where he garners some pretty good speaking fees and insisted that attendees treat his comments as off the record but that could be about to change. He launched a blog today where he said now that im a civilian again, i can once more comment on Economic Issues without my words being put under the microscope by fed watchers. I dont know ben. Were still listening pretty closely. In his first blog bernanke tried to explain why longterm Interest Rates are low and said it was part of a longterm trend. Not an appear rigs. He added that recent low real Interest Rates, that is adjusting for inflation are not the result of fed policy. Except in the short run. Real rates are determined by a wide range of economic factors, including prospects for growth not by the fed, bernanke said. Kind of defending those low rates and his policies in the past. All right, steve. Thank you very much. Mandy. Thank you very much. Well what does patriots Quarterback Tom Brady do after winning the super bowl for the fourth time . Yep, thats him. You still see global clients moving money to the United States. Particularly to the u. S. Stock market. Is it their preferred geographical area . It represents a very very safe bet relative to other markets. Two is that the u. S. Has got i think the strongest economic story. Especially with the oil tail wind and lower Interest Rates on the horizon for us in a relatively accommodative fed. Then, of course for foreign investors, they like the fact that they get the dollar return as well. Its a real trifecta for people moving money to the u. S. Now. You mentioned the fact that oil prices are providing a tail wind to the economy. Not just here but globally as well. David, to what extent are your clients interested in Energy Shares . You heard bob pasani and how many people are picking them up . Our clients are very interested in Energy Shares, and so are we. Its one of the areas that were recommending right now as a special focus, and the reason is that the more well capitalized companies with strong Balance Sheets are going to be able to pick up good Energy Assets and reasonable prices. There should be consolidation in the industry. You know favoring the better Quality Companies and City Private Bank feels that over the longterm, even though Interest Rates im sorry. Even though oil prices are going to be low now, if we look out two to three years, we think the supplydemand and balance will favor those people that buy shares at this time. Mike come into the conversation here. What three things are on your radar for this week . Well first of all, i think the employment report will be important. We have High Frequency data that has sent mixed signals about the health of the economy. I think the underlying trend is still a strong trend. Thats going to be validating. Were looking for a nonfirm payroll up 260,000 and the Unemployment Rate to depp a bit lower. The second thing thats going to be a focus is obviously going to be joo political issues. Look this ongoing drama with greece is certainly not ending this week and its probably not going to end for the next kwchl weeks. I think well have some back and forth within the your wroe zone and then lets also understand that we got the situation in terms of the negotiations with iran. You think it might be transitory, and bob has talked about the trend for earnings decline. Let me pick up what you are saying about the pay roles. Is it possible that if we do see an upbeat a good report out of payroll this is friday that it might actually be negative for the stock market . In fact, i think the last four times the jobs report has seen stocks move lower because obviously it brings potentially forward the time frame for the first from the fed. It could, but i would take my cues more from what janet yellin said last friday as posed to the reading in the payroll report this friday. I think what you are seeing is the fed is going to take an incredibly pragmatic approach towards raising rates, and theyve sent clear signals to us that this is not going tobacco set railed. In my opinion, unless you have something extraordinary on friday that radically changed the feds thinking, i think what you are going to see is good news is actually good news this time in terms of the equity markets. Good news is good news. Okay. Mike and david, thank you very much for joining us. You can also go to power lunch. Cnbc. Lets bring up this board behind us at the s p 500. Right now ty all ten sectors are moving higher and its interesting the way Energy Shares are the leaders out of the ten sectors today, despite the fact that wti i was is moving to the down side. A bit of a stronger dollar play there. Were sitting at 2,085. A gain of 2 . A month of amazing moves. Triple digits practically every day or at least every other day for the dow. Apple in there. Thats it for the first hour. Im going on stick around because brian is off for a few days. Ill see you around the neighborhood. You are second hour duty all week. The iron man is ready to roll. Ill just exit out this way. Have a good show. Great to be wrush we have a rally on our hands, folks, as we were just saying. Stocks are solidly higher to kick off this shortened trading week. Good friday wraps it up. There will be no trading that day. But there will be interestingly enough, a jobs report that day. You are looking at all 30 of the dow stocks right now. Is there anything that is in the red . Yes. One and one only. That would be intel. Down about 1 . Everything else is in the green as the dow is up very strongly 275 points or so. United health having the biggest impact on the dow right now. We will have more on that and its deal in a moment. Brian sullivan and melissa lee are both off today. I am going today by sar why eisen at nasdaq. Whats moving in midtown . Were keeping an eye, tyler, on the nasdaq because its also pushing higher in this broad market rally. Right now we are looking about a gain of a little more than 1 for the nasdaq. Triple cues also moving by the up side. About 1 . We talk a lot about biotech on this show. Check out the biotech etf. Ibb is the ticker. Solidly in the green. Almost a full percent with less than two hours left in had the trading session. Also, weve got Semiconductor Stocks on the move. Jumping today on deal chatter. Were going to talk about deals in both health care and potentially in the chip stocks. All right. Sar why, lets get more on todays rally. With us now, eddie perkins, chief Equity Investment officer with eatan advance. Its been a bumpy First Quarter with more volatility than weve been accustomed to. As you look ahead to the Second Quarter, the remainder of this year, is what weve just seen in the rear view mirror, what were going to see in front of snus. I think it is. As you just pointed out, weve had a number of triple digit moves in the dow over the last month. The First Quarter has been a very volatile quarter. Thats been good for the investment banks. Were seeing numbers move higher for the investment banks who benefit from that volatility but earnings estimates broadly for the market i think are still too high. The s p earnings estimates are for a gain of 5. 5 this year. I think between what will get out of the Energy Sector and also the drag from the stronger dollar, i think it will be a win to come in flat for the full year. Is the for overall earnings, is it likely that the in terms of earnings that the First Quarter will be the worst quarter . Hard to say. I think youll certainly see, you know we had tough weather last year. I think many some parts of the northeast weve had tough weather again this year in the First Quarter, so it will be interesting to see if the retailers and some of the other consumer stocks blame weather again, but, you know i think earnings will gradually get better as the hopefully the affect of the strong dollar works itself out. That will be with us another couple of quarters, and then well start to lap that late in the year. Earnings i think will trough kind of midyear and then start to hopefully improve so that 2016 can look better from an Earnings Growth perspective than 2015 ends up looking. Eddie, diving into some of the sector that is you like right now. Interesting that you want to hold utilities, Consumer Staples, expensive stocks because they pay dividends that have been popular in the low Interest Rate world, but the Federal Reserve is preparing to raise Interest Rates. Why do you like them . It traded at a premium to the broad market multiple but youve got a lot of m a and particularly the food and beverage sector that we saw last week, and i think that continues in that sector so between the opportunity for cost cutting, m a, and just being in the low Interest Rate environment, i think you want to own all three of those sectors. A contrarian case for some of the dividend paying stocks. Consumer staples and utilities. Eddie, thank you very much on this market rally. Meantime United Health having a big impact on the dow. The stock flying on deal news. Unh saying it plans to buy pharmacy benefit manager cat marchan for 2. 8 billion in cash. Meg terrell, a big play here on pharma benefits. Too these pharmacy benefit managers, what they do in part is negotiate drug prices on behalf of Health Insurers and unh is a Health Insurer, and its consolidate, but it owned its own benefits manager. What im hearing from people today is this is further consolidation in this industry giving these pbms a lot more power. Were even seeing them use this power on drug prices. The biggest pharmacy benefits are now express scripps, cvs, and United Health combined with catamaran. There are a couple of implications on the deal here. Express scripps its not just combined with a Health Insurer or pharmacy which cvs is combined with. Will we see a potential combination there for express scripps . The second is on Drug Companies stocks because if these pbms get more and more powerful as they get bigger at the top as this deal does theyre going to get more drug pricing negotiation power which weve seen play out in hepatitis c. Clearly, the scale helps. What you are saying is there are not a lot of independent operators that we could see further m a as the Companies Get bigger. Catamaran was wrapping up a lot of the smaller players already. The question becomes what does express scripps do from here . Of course, last week we were talking a lot about are we in a biotech bubble, and are we going to see the end of this biotech bull run . Weve been seeing so much m a. The other two deals were talking about are horizon and hype earian. What people are saying is m a being so healthy is one of the things thats going to keep these valuations going up. Two different implication sfwlooshz we are in a bubble. Its not over, is that what you are saying . It might continue. Yeah. Yes, we are seeing the entire biotech index today soar. Tyler, on the back of some of the deals. All right. Thank you very much sarah. The uproar continues to swell over indianas socalled religious freedom bill signed into law late last week by the governor there. Opponents say the legislation gives businesses the right to discriminate against gay people. Supporters say the law protects the religious freedoms of Indiana Business men and business women. Our own Mary Thompson is now live in indianapolis with more. Hi, mary. Hey there tyler. You know the i understand chamber of commerce calls the law unnecessary and it has created a firestorm of criticism on both the local and national level. Now, here in indianapolis store owners have taken to hanging signs proclaiming that they dont discriminate. An extra necessary and frustrating task to florist amy watts who says shes just here to sell flowers. The law also an unhappy event for many ceos. Tim cook warning other states considering similar laws if they put that they are putting their economies at risk. Sales force. Com saying it will stop investing in indiana and hometown firms eli lily saying its bad for business. Comments saying its disappointed in the law. Indianapolis based angies list says its suspending expansion plans and would have added 1,000 jobs to the state. Lawmakers saying they are looking at ways for the intent of the law. We dont know the time lien on that though but we want to note that not all businesses are unhappy with this law. We did locate one northwest in lebanon, indiana, samson leather. It says it doesnt discriminate. It just wants the option to refuse business that it is uncomfortable with. It also says that it knows of other businesses that share its views, but they are afraid of making those views public. Tyler, back to you. All right mary. Thank you very much. Lets bring in two voices with very different opinions on this controversial new law out in indiana. It takes effect july 1. Tom sears is founder of out leadership, the first global gay business organization. He opposes the law saying its bad for business and Ryan Anderson is a fellow at the Heritage Foundation who supports it. Gentleman, welcome to you both. Mr. Anderson, let me start with you, if i might. Who needs this law . What is it designed to protect . Who is it designed to protect against . Sure. Great question. All americans need this law. This law at the state level is based on a federal law that weve been living under for 20 years. It passed unanimously in the house of representatives. It passed with 97 votes in the senate. It was sponsored by then representative chuck schumer, and senator ted kennedy. It was signed into law by president bill clinton. 31 other states have this same regime of legal protections. It needs a balancing test, and it has to be for a compelling government reason in the least restrictive way possible. This is a law that benefits all americans because it says if government is going to violate religious liberty, it needs to be held to a High Standard of proof and the way that weve worked out this proof for 20 plus years in the federal courts and in 31 state courts is to say compelling state interest, least restrictive way possible. Is what you define a compelling state interest or societial interest working against discrimination based on age, gender race sexual identity, and where could you draw the line on Something Like this . It obviously the most controversial part right now is how it might be used to help say, a Small Business owner or to enable a Small Business owner to site religious freedom as a reason for not catering a gay wedding. I can well imagine that if i were a muslim a very devout muslim Business Owner who feels that christians are all infidel and i cannot serve them in good conscious, that i could ban them or i could ban a female who does not come into my establishment wearing a covered face. Where does it end . Well thats whats the nice thing about this law is that it allows each one of those claimants to have their day in court. They might win. They might lose. Lets take the example. You mentioned race and you mentioned marriage. I think government has a legitimate state interest in eliminating racism and so i think it would be completely legitimate for the law to try to eradicate racism. I dont think the law has an interest in preventing muslims, Christians Jews that believe that marriage between a man and a woman from running their business in accordance with that belief. What if that marriage what if they believe, for example, that the intermarriage of people of different races was against gods word . Would you defend their ability to deny an interracial couple service in the establishment . Well no because i dont see how race has anything to do with what marriage is but, again they would have their day in court. I dont see why the government needs to be coercing small Business Owners a 70yearold grandmother in Washington State, into providing flower arrangements for a samesex wedding. There are plenty of florists who support samesex marriage and who are interested in making money. Why do we need the government to coerce every florist, a 70yearold grandmother, into violating her beliefs . It seems like we could have live and let live. Why not have civic peace, pluralism, diversity. Lots of different florists lots of different bakers and photographers. The government doesnt need to coerce any of these people. Lets bring todd into the conversation thats standing with me patiently. How many things do you feel are wrong with what was just said . Let me clarify a few things. First of all, he is completely incorrect about the fact that this is exactly like the federal law. The federal law actually prohibits discrimination based on government intervention. Ie a muslim in a federal prison wanting to have a beard. It actually does not protect interpersonal private matters. For example, the indiana law is actually the most expansive of these laws, and it permits someone who simply has some sort of religious objection and, by the way, it doesnt even have to be a real religious objection. It can be a religious objection they think might happen from discriminating. Its entirely different from the federal law. In that respect its the same exact language. Its a sincere religious belief thats been substantially burdened by government action. Same exact language in the federal and its the same exact language in indianas. Sincere religious belief thats sashlly burdened by government action. Let me ask you this todd. Same exact. Governor mike pence did come out on the talk shows this weekend. He did. He said they were looking at a clarification in legislation that could come as soon as this week. Thats right. Unclear, though on whether its going to prevent discriminate nation. Theres a lot of misinformation. He actually compared his law to illinoiss law saying its no different. Well illinois actually has statewide nondiscrimination for lgbt individuals and citizens. This is an entirely different piece that he is talking about. He actually six times refused his his point was that his religious liberty law is the same as illinoiss religious liberty law. The same religious liberty law that obama voted for, and it is the same. Stroo entirely different from what obama voted for. Obamas law that he voted for when he was in illinois actually would not prohibit discrimination based on lgbt citizens because they were protected by a statebased nondiscrimination law. Neither will this law. This law doesnt touch lgbt nondiscrimination law because they dont have a discrimination law. You are trying to solve a problem that doesnt exist. The religious liberty law itself is the same religious liberty law, which is why this should be noncontroversial. Why do you want to coerce a 70yearold grandmother why would you want to look at the business communitys response. Look at the op ed from tim cook of apple, along with many other. Tim cook is a hippo credit. He wants the freedom to run his business in accordance with his values. Tim cook has the the most valuable company in the world. Theres something wrong with that. He gets to run apple in accordance with his belief. He has denied apps to the app store, christian apps that he say violates apples because they discriminate. If he gets to run his business in accordance with his values, why cant the grandma run her business in accordance with her value. If you take it to the extreme, its about to be a terrible thing for the state, as were already seeing. Were not going to allow freedom to Small Businesses. This is kronyism. This is big business saying it wants freedom. Todd, let me ask you this. Then youll get your shot at it as well here. 20 states have laws like this. Whether they are identical or not, lets set that aside. There is a federal law like this. Whether it is identical, lets set that aside. There must have been claims on either side of these laws over time. What have the courts said . How have they interpreted it . Have they stood for or against the denying of services to people in the affected categories, whether it is gay, whether it is female elderly, or whatever . What very they said todd . In the courts theyve completely made it much more inclusive and expansive, such that 19 congressional leaders swooul actually no longer support federal who voted for it 20 years ago. People are actually understanding the negative impact that these laws are having and changing their viewpoints as are many of the states who are actually considering passing those laws. Georgia tabled their law. Montana has tabled their law. Were hoping texas will table their law because theyre suddenly realizing there are huge unintended consequences from trying to solve a problem that didnt actually exist in the first place. Its bad for business. Its bad for the economy. You get the last word here on the question of what the courts have said and how on which side have they typically decided these kinds of claims . Sure. So far weve seen court cases in arizona, in colorado in Washington State, in new york state, in which small Business Owners, not the beg business corporations like apple, small Business Owners people who run photography studios, bakeries photography shops, a farmer in new york state have been fined in the court of law for simply wanting to run their business in accordance with their belief that marriage say union of a man and a woman. The courts havent defended them. The courts have prosecuted them. The attorney general in Washington State brought charges against a 70yearold grandmother, and she lost that court case. This is unreasonable in america. Were a free society, and theres no reason why the government should be harassing and coercing and penalizing people simply because they believe marriage is between a man and a woman, and they wanted to be free to run their businesses in accordance with that belief. The only people imposing viewpoints here are the left trying to impose their values on small Business Owners. All right. Gentlemen, thank you both very much. We have to leave it there. Im sure this discussion will continue over the next few days and weeks. Big interview coming up on the closing bell. Former hewlettpackard chair and ceo Carly Fiorina will join kelly evans live. Sarah, National Association of business economists otherwise known as neb putting out an optimistic report on the economy today. It was very optimistic. So optimistic that some are asking now was it too optimistic. Steve, youve got the details for us. Youre going to square this with our own survey. It wasnt so obvious. In fact tyler for less than authority than the president of neb on squawk box this morning says he thinks his own members are too upbeat on the economy. Especially given the way we just talked about in the last hour how estimates for the First Quarter appear to be syncing. Strong jobs. Ease off a little bit. President john sylvia was asked whether he thought 3 was over the top. Me personally yeah i think 3 is probably too aggressive. In terms of the longterm trend growth of the u. S. Economy. I think two and a half two and threequarters is probably what it is, and thats based upon as you know the fund memtss which is the productivity growth and labor force growth. Now, here is what we reported last hour. First quarter tracking. These use incoming data to adjust the gdp forecast. Down 0. 4 on those weak spend and income numbers. Sorry. Back to you, ty. A beautiful but dirty happy ending there. Yes, exactly. Youre right. A big move in oil as we move to the close. Swraky deangeles live at nymex. Hi, jack where i. Hi tyler. Remarkable action into the close here. I think were going to settle somewhere around 48. 60. A buck rally in the last ten minutes of trading. Traders are thinking right now about the iranian potential for an iranian deal. Let me say with the United States. Grovl a fundamental deal was reached, the thought there is that we would see more oil on the market. That would depress prices. Thats why we were down all day, but now some people are thinking about saudi arabia and its whole role in this. Obviously, saudi, that is fighting a price war right now, is not going to want to see iranian oil come back online. These political talks and these negotiations are very tentative and very crucial. No one really knows whats happening behind the scenes, but if you look at oil prices, they would indicate that traders are being cautious about this right now. Back to you. All right jackie. Thank you very much. Turning to stocks now, they are up strong to kick off this week. Its today and tomorrow left in the First Quarter. Bob pasani at the new york stock exchange. Just off the highs for the day. I just want to show you why i think were rallying. A lot of people have been surprised by this strength of the rally. I think theres several factors. Number one, china talking stimulus. That held a global rally started early this morning. Europe talked about confidence indexes that were quite strong. Jerl anne strong again today. Were at the end of the quarter. April a seasonally strong month. We have a big discrepancy between the winers and losers. Just take a look. Health care up 7 . Utilities and energy down. This is for the quarter. Usually you get these kinds of discrepancies for the year. Theyre buying losers selling some of the winners. Look at oil stocks. Onethird of the Energy Sector. The np is now on the up side. Thats remarkable. Finally, we are in april going into april. This is seasonally the best month of the year. Up 1. 9 on average. Back to you. All right. Thanks very much. Ill pick it up. Biotech. Thats interesting. One of the things im looking at is the nasdaq for the month is almost even versus the s p and the dow, which are down close to 1 . The big reason why is that small caps have really come roaring back this month. Part of that reason is the fact that you have the smaller stronger dollar. Theres a lot of folks that look at the small caps and say they have less exposure. Take a look at some of the names that have really rallied this month. Diamond foods up 21 . Hawaiian holdings, some of the Smaller Airlines up 19 . Wisdom tree up 16 . Some of the small cap banks as well moving up this month, find soming lot of after having been out of favor. Of course, biotech is the big reason why. Even though we saw a huge plunge last week, biotechs are up three months in a row. Having notwithstanding todays deals, not necessarily pushing the biotechs higher as much as you would have thought. Perhaps, but still the momentum is there. Bertha, thank you. The most successful asset gathering etf during the First Quarter of this year has actually been the wisdom tree europe hedged equity. Its a currency hedged way to get exposure to european stocks. Todd rosenbluth joins us now, and, todd you are saying it is time to pump the brakes on some of the european etfs. Why . Well so what we found is theres been strong in flows into hedj and some of the peers. When we look at the hedge product from wisdom tree we at s p capital iq we think the stocks inside are over valued. Its heavily leyden with Consumer Staples companies that are seeing slow growth actually, Slower Growth initially and historically and the costs are hurting them. Also todd just the thesis in general. We have Portfolio Manager and strategists coming on cnbc all the time saying europe looks cheap versus the United States in terms of stocks and that is why a lot of the money has been flowing into these stocks. What would you do with that kind of assertion . So what we think actually think europe is a place to go but if we like the currency hedge products from i shares or Deutsche Bank we think theyre more diversified across sectors and more diversified across individual stocks and want as dependent upon Companies Like inbev or anheuserbusch. Inbev we think is overvalued and is seeing Slower Growth and getting hurt by the strength in the u. S. Dollar as Aluminum Prices go up. As a key component for costs as barley prices go up. Tell us how to play it in the United States if this is not the right etf for you, the hedge . We truly think that the i shares product he sdmr u, against the emu index is a better way of getting exposure. We think the stocks inside are more attractively valued when we look at the underlying holdings. Some of them are the same as was intrigued, but the waitings are different. We think thats a good way to be able to go. We think hedging makes sense as we think that the euro is going to be under pressure. That hash one of the hottest trades. Thanks for joining us with the advice. Todd of s p capital iq. Lets go to mandy with trading nation. Yeah thanks very much. Great day for the banks. The banking stocks are up 2 today making them the best performing industry group. Is it time to get into this lagging sector . Lets bring in the trading nation. Aaron gibbs, equity chief Investment Officer with s p capital iq and todd gordon technician with trading nalgsz. Com. Great to see you both. Aaron, would you be buying into the banks here . Yeah. These guys still look good. Both from a valuation perspective and Earnings Growth. Right now the banks industry is about 11. 5 times forward earnings versus 17. 5 for the index. For growth for q1 theyre looking at about over 25 growth for q1 versus negative three for the s p 500, so some big differences definitely some positives. The one thing i would say is that most of those Earnings Growth is really coming from lower costs versus Revenue Growth because as we all are expecting, maybe the fed might raise rates, there might be a steepening of the wreeld curve, and maybe theyll be more profitable, but for the most part were expecting flat revenues. What were really seeing are lower legal costs, Higher Quality of loans, lower loan costs, and that is really pushing the earnings up this year and still trading at very attractive prices. Well todd do you have one particular banking stock that you would like the most now . I do. I do mandy. I fwrae with what shes saying. Jp morgan is the leader of the bunch. Let me put it in context. Aaron brings up incredibly insuitful analysis. Were not seeing that manifest in charts. If we look at what the nine major sectors great representation with the overall market is doing. That xlf, financial etf, is actually in the bottom onethird. Compare that to, like discretionaries and health care up 5 and 4 respectively. Theyre down about a half a percent. The airbus plane came down hard in a blizzard lost a wing a motor, and its tires. Passengers quickly left the plane and thankfully no one was seriously injured. On the way down turns out the plane clipped a powerline cutting power to the airport, delaying other flights. Cause of the crashlanding, still not known, but tyler, Authorities Say the weather for us acceptable during the time of landing. All right sarah. Lets turn now to the latest on the investigation into the germanwings crash. The focus, as it has been for days now, on the copilot andreas lubitz. He had been treated in the past after doctors observed suicidal tendencies. Last week investigators found torn up doctors notes including one that would have excused him from work on the day of the crash. Investigators say he did not have a socalled or organic illness. Meanwhile, in france a road is being cleared to make the crash site easier to get to and lab workers are trying to identify the remains of the passengers so far. They have isolated 78 unique dna. Justin green is an aviation attorney in new york city. Good to have you with us. Very briefly, walk us through the laws here. What is the basic law that obtains, and then, of course we have a situation of a germanowned aircraft that went down on french territory carrying passengers from many countries, including spain, germany, and even the United States. Who suz where if they do sue . Those are very good questions. The first thing that everyone has to understand that this is an international flight, so International Law called the Montreal Convention actually governs the liability of the airline. The Montreal Convention actually gives the airline some protections, but it also gives the family some rights. One of the things that the Montreal Convention says is the airline is strictly liable for a certain level of damages, and that comes to 160,000. Each family has to prove what their damages are, but if a family has 5 million worth of damages and the airline proves that its not at fault, then the airline only has to pay about 160,000. The families only have to prove that an accident occurred and while you might say, well this is a mass murder its not really an accident. The Supreme Court here in the United States has basically interpreted what an accident is to include an event like this. The onus is really on the airline if it wants to try to enforce the limit of liability, which is in the Montreal Convention. The airline has to come in and say were not negligent, were victims too were not at fault. What do you think will happen here and is there any precedent from the allianz thats the lead underwriter. Its an air egypt crash where a pilot dove the plane into the ocean. Well egyptair was liable under the law. They did ultimate compensate the families fully. They tried initially, i think, to enforce what the Liability Regime the defense that they had at that time but ultimately they basically gave up the fight. Remember, this is all insured i think the best thinking for lufthansa, the best thing for germanwings is to compensate the families, and the one thij that they have to look out for in europe especially in france is this idea of corporate corporate liability, which as a plaintiffs lawyer im want a big fan. I dont think there are many big fans of this but its a thing that happens in europe and i think it would be unfair in this circumstance to try to prosecute the airline for this terrible act. Last hour we talked about this idea that people have been kind of at least taking this opportunity as weve seen some of the support coming at this these medium term averages to kind of put on positions here. And maybe thats going to be the case, and maybe the market is going to move higher. Its going to move beyond the record highs that weve seen that this move can have legs to the upside. If we take a look at some of the sectors, the transportation stocks have gotten a lot of attention. This idea that they may or may not have validated the record highs we saw earlier this year. And remember if you look at this chart we kind of hit this area of resistance right here. This is the dow jones transportation index and the etf that tracks it. We saw the big leg lower just over the past week and a half or so. Whether or not this bounce here is one that actually takes out these levels that remains on the seen. But certainly transport for a lot of investors. If you move forward to what is possibly the most focused on sector for a legal of people who are looking to time bottoms right now, its this sector overall, the Energy Sector right . Everybody wants to know whether or not this is a viable opportunity, as we have seen kind of here. Weve had a number of times, at least two of them over the last month or so two months where people have bought this idea of a bottom only to have it kind of go down further. Weve seen some momentum here. But again, a lot of traders and a lot of technicians are saying whether or not or trying to see whether or not the Energy Stocks can find any semblance of a bottom especially the Oil Prices Keep going lower. Energy a focus here. For the next one were going to do this one here transportation stocks and Energy Stocks. This is the semiconductor etf the. The big bounce because of possible alter ra talk that moved these higher. Carl snyder at garden state securities says this is maybe not yet the place to buy these utility stocks. One of the worst performers this year to date quarter to date. He would like to see it take out some of the levels in midmarch before we see this move higher. If it can go above that, maybe it goes higher. Would you sign that chart for us . Thank you. Dominic chu. Well sell it on ebay. Time for street talk.
