If somebody told you in 2016 that democrats would one day be supportive of a conservative like liz cheney would not have believed it but that is what is happening and how enduring do you think any support from democrats could be . Reporter i dont know if it will change the fate of her seat in wyoming tonight but the fact that she has stepped up to put not only her country before her party but her country before her professional career, she was potentially the first republican woman to serve as House Speaker and potentially the first republican woman president from a dynasty the cheneys in wyoming and her political experience as a daughter to dig cheney and she simply had a go along and she refused to do that. I think because of that she becomes the most consequential house member at least in our lifetime and maybe for a long time. As i said, i think she has a future as a person of great influence. Because she is placing the democracy over every party and policies that hes in wyoming sog for the Republican Party as a r whole . Party theld the dear and that she fought for for decades. Reporter i think the Republican Party is poised to reject her in wyoming and trump had his biggest margin in that state in 2020 of any red state in the country, but i do think that she is in a minority in the Republican Party and largely it is supportive of donald trump. As i said, she can affect the nominating contest in 2024 if she stays on that side and makes all of the contestants answer for what the former president has done and i think she would still have an effect. This would be an unsealing of the probable cause affidavit while a criminal investigation is going on and that is virtually unprecedented and the department of justice couldnt find a case where that had actually happened and sometimes it is unsealed after charges are brought or after cases over but the concern here is the unsealing of that affidavit, which lays out everything the government knows about this matter, could interfere with this Ongoing Investigation. And as they point out, it could also interfere with future investigations of any type because witnesses and agents would be concerned that anything that goes into that search warrant affidavit maybe unsealed by a federal judge against their wishes immaturely. That could interfere with the investigation and it has a Chilling Effect on future criminal investigations. That is the concern and i think they want to hear from the parties and wants to see whether something in redacted form could be released, but it is hard for me to believe that this affidavit will be released in its entirety. He can simply plead the fifth amendment and the right not to incriminate himself and i think that is frankly what will happen but if he does decide to go ahead and testify, yes, he can claim some privileges including if he does in fact or able to show that he was in fact the president s lawyer, he can claim that certain things were covered by the attorney by privilege but the Attorney Client privilege doesnt mean that anything that he and the president have ever said to each other is privileged.
