Happening at this moment in georgia, a formal hearing for Jeffrey Clark who is looking to get his election subversion charges out of state and into federal court. The lawyer for clark is making same arguments of mark meadow, and a lawyer for donald trump is inside. Katelyn polantz just stepped outside of the court. What are you seeing . Well, Jeffrey Clark, himself, he is not here, and so he is not going to be testifying today, john. We did not expect him to necessarily, because he has already submitted a sworn statement to the court about what he was doing after the election saying it is part of his job, and he was not doing anything on Donald Trumps behalf personally, but this is a important hearing, because we went through this with mark med dose and that was rejected and moving up to the Appeals Court about whether he could move his case, and that was politics and the role of the white house, but this is a bigger question today, and one that may be harder for judge jones, a federal judge here in Northern District of georgia, and the question is whether the state prosecutors can look into what the Justice Department was doing at the time after the election. Jeffrey clark was serving as the head of the Civil Division of the Justice Department, and a pretty prominent role in that entity and that agency, but he was in touch with donald trump, himself, and something that he was not authorized to do in that position and he also wanted to send on the Justice Department letterhead, a letter to the State Of Georgia the give them cover to look into the Election Fraud when the Justice Department knew that there was not a reason for them to look into this, and that there was not widespread fraud, and that the federal government knew that, and they were telling Jeffrey Clark not to do this, and not to do this, and his attorney Harry Mcdougal and one of the things that he was saying is that the draft letter that he prepare on behalf of the Justice Department that was never sent, and that it never left the office at the Justice Department, and if that can be part of the states case against him is a big question, because kit have implications for donald trump himself, and his attorneys are here to see how the proceedings are going, and it is come down to how much protection Jeffrey Clark and people like him may get because they were serving as federal officials after the 2020 election with the things they were doing, and now accused of being crimes in the State Of Georgia. Well, it is helpful for prosecutor, because he said, this is my intent here to try to reverse the election, and i was calling the shots. Jack smith wont have any problem to establishing that, but it is nice to have him looking into the camera saying that, but this is the overall defense, and he is going to argue, i am telling you that there is no evidence, and others are saying, that there is evidence, and so i made the decision to press forward and useful piece of evidence for the prosecutors on the whole. And for Jeffrey Clark not to go to court today, and if we split screen this with the last request from mark meadows, and mark med dose testifying, and took the risky move for testifying, and it did not work out for him, and why would he not want to testify . Well, mark meadows is exhibit a of why Jeffrey Clark is not testifying. He is a lawyer, and he has his own lawyers, and they told him, you dont want to be anywhere near the courthouse or in the State Of Georgia. Now, if you are making the motion where he says, i want to take my case out of state court and over to the federal court, you have to prove that he was doing his job. So he could take the stand, but also, he could submit a written affidavit, and so what he is going to do by his attorney is saying that affidavit is the strength of his testimony. And what evidence does he have to have to have his case moved from state to federal . It is some untrod territory here, and he has a weakened case, because he is a doj official, and i didnt have the same job, but i have a good familiarity of what you are supposed to do there. And what he did is to draft a letter from the department of justice and to the State Of Georgia saying that we have found fraud, and this is a fraud, and this is opposite that you are supposed to investigate with good faith, and reveal the findings of that investigation, and so i am not seeing that what he did is within the scope as a doj official. And what we are hearing from Katelyn Polantz from the courthouse who is ip side of the court as we are hearing is that it actually never left the office or the Justice Department, and so why should state prosecutors be able to look into something that never left the office. Do you see how is this different if at all from mark meadows in terms of the actual jobs and roles of the federal government . Well, it is interesting argument from Jeffrey Clark, if i drafted it and going to save it on my computer if we found some fraud, that is one thing, and the fact is that Jeffrey Clark wanted to get this letter sent out of the buildings, the superiors of doj said no way, and the same judge here as in the case of
