One year ago President Trump<\/a> signed the First Step Act<\/a> with bipartisan support. As a result more than 3,000 inmates were released from prison. Critics were quick to point out that only addressed Prison Reform<\/a> and not sentencing reform. Six months later the Justice Department<\/a> announced that the federal government would resume Capital Punishment<\/a> after a nearly two decade lapse. A new movie called just mercy tells the true story of walter mcmillan, wrongly convicted of murder. He served six years on death row. He was exonerated with the help of a young lawyer. Now this movie is distributed by warner brothers. It will be in theaters starting christmas day. Heres a preview. They convicted an innocent man. I was always taught to fight for the people who need the help the most. I sat down with Brian Stephenson<\/a> whose book just mercy, a true story of the fight for justice inspired the movie. He is also an executive producer of the film. You take people to death row and give us some insight into part of the judicial system most people dont even want to think about. Right. Why tell this story now . Well, i continue to worry about whats happened in this country. We have the highest rate of incarceration in the world. We went from a prison population of about 300,000 in 1972 to 2. 2 million today. We have 6 Million People<\/a> on probation and parole in this country. Theres 70 million americans are criminal arrest histories, which means when they try to get jobs or loans, theyre disfavored by that arrest history. We have a criminal Justice System<\/a> that treats you better if youre rich and guilty than if youre poor and innocent. Thats not fair, thats not right. You know, the Death Penalty<\/a> is in many ways ground zero of a lot of the excess that has characterized how weve managed criminal justice over the last half century. For every 9 people weve executed in this country, weve now identified 1 innocent person whos been exonerated. The work youve been doing at the equal Justice Initiative<\/a> in the past 30 years, you have been able to get the release, the relief or the reversal of more than 140 people who have been either wrongly convicted or unfairly sentenced to death. That is incredible when you think about those numbers. What struck me about the movie and the one story you really focus in on, walter mcmillan, as somebody who is learning his story as the facts are revealed, its so obvious that he was wrongly convicted. And yet even as those facts are put out there, the truth almost didnt set him free. Thats right. How do you explain that . You know, i think we have allowed ourselves to be governed by fear and anger. When you have people pushing these narratives of fear and anger, people will begin to tolerate things they shouldnt tolerate and accept things they shouldnt accept. I actually think that fear and anger are the essential ingredient of injustice and oppression. In the 70s and 80s we said that people who are drug addicted and drug dependent cant aare crimi. These people have a health care need and we need our Health Care System<\/a> to respond. But revved up by all of that fear and anger and demonizing, it became impossible to talk strategically. Everybody wanted to be tough on crime. Everybody wanted to put people in prison and lock them up forever. In that sort of environment innocent people are going to be wrongly convicted. Is there any evidence that the Death Penalty<\/a> serves as a crime deterrent . No, no. If anything, we see increases in Violent Crime<\/a> in some of the places that are most actively implementing the Death Penalty<\/a>. I think for a lot of people, you know, if the state can kill, if the government can kill, it doesnt help advance the point that no one should kill. Theres a kind of illogic to the Death Penalty<\/a> in my view. We say were going to teach people that killing is wrong by killing someone. Most people who are in crisis, the mentally ill, the people who are in the margins of society arent going to be deterred by the threat of violence or death. Do you think there is any circumstance in which the Death Penalty<\/a> is warranted . No. I dont think that, as i said, for me the Death Penalty<\/a> is about do we deserve to kill. You know, if you focus the question on does someone deserve to die, you can come up with those scenarios. But if you turn the question to do we deserve to kill, we dont have a perfect system and the Death Penalty<\/a> requires a perfect system. If you make a mistake, you dont have the ability to recover from that. As you know, the Supreme Court<\/a> just halted the trump administrations effort to resume executions in federal Death Penalty<\/a> cases after a 16year hiatus. I think thats the right response. Whenever you try to use the Death Penalty<\/a> for some political goal, youre going to do things that are unjust. How do you square the trump administrations advocacy of the Death Penalty<\/a> with on the other hand the criminal Justice Reform<\/a> like the First Step Act<\/a> we saw passed last year or the pardoning or commuting of sentences like that of Alice Marie Johnson<\/a> . I think its progress that weve gotten to the point where you have people in both Political Parties<\/a> that recognize that reform of the criminal Justice System<\/a> is needed. It doesnt mean that people dont also say things that are echoes of this whole era of fear and anger. But its really important to remember that laid eleadership these issues is not going to come from washington. You know, our criminal Justice System<\/a> is a statebased system. 90 prn 90 of the people in our jails and prisons are there based on state convictions. Less than 10 of the prison population in this country is there as a result of a federal conviction. The president and even the congress no matter what kind of reforms they implement will only have a small impact of whats happening nationwide. Your work has taken on another layer as you continue to explore the history of racial inequality and economic injustice with your museum from enslavement to mass incarceration in alabama. What do you hope it accomplished . I hope we can create an era of truth and justice in this country. We are still burdened by slavery because the worst thing happened during that period wasnt the involuntary servitude. The myth that black people arent fully human and theyre dangerous. That created this ideology of White Supremacy<\/a> this racial hierarchy. Thats why people are put out of their homes. You can be talented, gifted, a doctor, a lawyer, but you still have to navigate these presumptions of dangerousness and guilty. Thats why i believed it was time to get out of the court and Start Talking<\/a> about these larger issues. Just seeing whats happened in other parts of the world where theres been the willingness to talk. You go to rwanda. They insist on telling you about the genocide. I go to berlin with the holocaust, you see the symbols everywhere that mark the places where jewish families were abducted. The germans want you to go to the holocaust memorial. There are no Adolph Hitler<\/a> statues in germany. They dont want to be thought of as nazis and fascists. We havent marked the places in this country where lynchings took place, we havent talked about this legacy. That has to change. That was the motivation for creating the Legacy Museum<\/a> and National Memorial<\/a> which is dedicated to thousands of victims of lynching. Thanks to Brian Stephenson<\/a> for that conversation. The witnesses cannot just be called at will by the prosecution or defense. If a senator wants to question a witness, they have to put that in writing and give it to chief justice roberts. That means that 20 of them would have to side with the democrats and two independents, assuming that all of those members will vote to remove him from office.
