More than two weeks after a monster earthquake killed more than 8,000 people and then today, another one. The 7. 3 quake striking nine miles deep along the border with china. At least 68 dead more than 1,200 injured. Well take you to cat plan you do in a moment. But first, we are getting more information about the u. S. Marine helicopter that is considered missing currently in nepal. We can tell you that six marines and two nepalese were carrying out Disaster Relief outside of the capital when apparently their helicopter vanished. First Barbara Starr at the pentagon. And barbara, it is after midnight in nepal. Incredibly mountainous region communication difficult in general. What are you hearing from military from dodd . Reporter well, what the pentagon is saying is they hope to resume the air search for this missing marine Corps Helicopter in the Morning Hours at first light. Its been suspended in the evening hours. In the dark members of the Nepalese Army were trying to make their way on foot to where they think maybe the helicopter might be. It had been out of contact for it two hours and was declared missing. Once they realized and calculated, it would have been out of fuel, it must be on the ground somewhere. The big question of course what happened to it. They are hopeful. That is the way pentagon officials are using hopeful. At first reports theyre hopeful the pilot may have run into a problem and put the helicopter down in a remote area that hopefully everyone is okay. And they will be rescued at first light. A nearby helicopter flying at the same time reported radio chatter that the american said theyd run into fuel problems. This are other reports of spotting the american helicopter in this over our region. An initial air search an hour before darkness fell did not turn up anything. Should have been easier to find them. One of the problems is the rough terrain in nepal with these steep High Altitude mountains. If the helicopters on the ground surrounded by mountains, their Communications Gear may not be working properly. They may not be allowed to get a signal out. That may be what is going. On that is what the pentagon hopes. Theyll put helicopters and aircraft back in the air and try and find these people. Okay. Lets remain hopeful. Barbara starr, thank you very much. Communication can be a challenge. Can you walk through and and if these reports accurate they could be worried about fuel just the challenges there. What you would be thinking as the pilot . Sure. Right now, that altitude where these guys are flying is challenging, not for the pilots but the aircraft themselves. Its burning a lot more fuel. Its challenging aircrafts capability. One of the things, if they had a fuel problem, the pilots know how to put them down safely. Can be a hard landing, but nay know how to put it down safely. If theres injuries, theyll they have with the injuries. If theyre not, if they can get to high ground get communications up. The best thing is to stay with the aircraft, with everything they have there until a search party can come out and continue to look for them tomorrow. Would they have any emergency signal or beak son . Thats one of the things. Right now the blue force tracker, the type of beacons that the aircraft are carrying right now, ive got to believe that you know pacific command, the joint task force that the aircraft came out of out of the philippines is using all of the type of satellite everything to look for some type of aircraft distress signal, whatever theyre having, and personal beacons for distress signals that the aircraft and the personnel carrier. Panic, people rushing out of there, fearing that obviously the walls, the roofs could come down on them. [ crashing ] this massive earthquake flattening homes and buildings and triggering landslides like this here. And a reminder, when the quake hit, there were people still sifting through the rubble searching for possibly missing or dead after the april 25th quake hit killing more than 8,000 people. Incredibly the quake is technically considered an aftershock. 7. 3 magnitude. Lets go to my colleague, will ripley hes just arrived in the capital of kathmandu. Rubble all behind you. This is one of the money buildings around kathmandu that were partially damaged in the first earthquake. The walls were cracked, but nay came down as a result of the huge aftershock today. Just terrifying for the people who live here, describing 30 seconds of pure panic, people screaming during the earthquake they couldnt even move. The ground was shaking so much. Just a couple of days ago, people started to feel safe to sleep in their homes, now as we were driving from the airport, we looked and saw a golf course. It was back full with hundreds of people sleeping outside. Weathers good now, but the monsoon seasons coming up the heavy rains coming and if the aftershocks continue, its going to be a really tough situation for people because they still dont even is temporary shelters built for them, brooke. When you look at the intensity, 7. 3, and for comparison the initial quake killed more than 8,000 a couple of weeks ago, that was 7. 8. Perspective wise, how who is the rarity for this to happen a couple of weeks from one another . Well, the likelihood of a magnitude 7. 3 after a magnitude 7. 8 aftershock is not incredibly small. Its not an unexpected event. I hear you have maps to show me . I do yes. I have a map of the distribution of the aftershock that occurred after the. 8. In the region there have been 100 aftershocks since the april 25th event. This magnitude 7. 3 aftershock has had several aftershocks of its own since last night. So if were technically referring to this recent one as an aftershock does that mean just going back to geology 101 . Is this the same tectonic plate shifting or is this in a separate area . Yeah. The term aftershock is semantics. Means this is an stlaen is associated with our april 25th event. In approximately the same plate boundary area as the main shock. This event occurred at the eastern end of the part of the plate boundary that moved in the april 25th event. I was talking to a seismologist recently about convergent zones and lets get a little wonky here. I am curious. You have the convergence zone in the himalayas where the indian and eurasian tectonic plate collide. Does that explain why this part of the world could be capable of so many quakes and so close together . Exactly yeah. This is a major collision zone where the plate is colliding with eurasia. Its throwing up the high himalayan mountains. This is capable of high earthquake. In the past its had large earthquakes as large as magnitude nine and is capable of similar sized events in the future. The events weve seen no, forgive me, but you cant predict them correct . We cant predict them but we can observe whats happened in the past. We can use that to inform bus what might occur in the future. Speaking of the future, what does the future look like final question . We expect more aftershocks of the magnitude five six range. They would be common and will probably be felt in the kathmandu region as they have been over the past 12 hours or so. The likelihood of larger aftershocks is small. Bush made, was that the right decision . Jeb bush didnt directly answer the question. I asked it to governor christie. Heres what he had to say. No, it wasnt. I believe president bush made the best decision at the time given the Intelligence Community was telling him there was wmd, and were there threats there in iraq. But i dont think you can honestly say that if we knew then that there was no wmd that the country should have gone to war. So my answer would be no. But i think you know, what we got to avoid is continuing to backwards in this country. And maybe focusing more on New Hampshire where his candor his Straight Talk as john mccain called it, might endear him to the independent republican voters. He said thats not the case. Hes traveling all over. And i do think there is something to be said about him having a good chance of at least the best chance of making waves in New Hampshire. And there really isnt an airheir in the Republican Party to the statement. Mitt romney not running, hes from neighboring massachusetts. There isnt anybody whos a natural republican fit for New Hampshire. In could be a place where he brings his candidacy back. What about candor Straight Talk or people, definitely critic have called him a bully. We talked yesterday about doing the town halls, hed be doing town halls which, yes, he can excel, but also critics again saying bullyish. You remember this . Massive crowds there. We will soon find out if the madison Police Officer who shot Tony Robinson will be charged. His family and friends talked to a wisconsin newspaper, they did say that robinson may have taken hallucinogenic mushrooms. This is back march 6th the day of the shooting. Police say robinson had no weapon when he was killed. He was just 19 cnns brian young has more on Tony Robinsons final hours. A glimpse into several 911 calls made just before the shooting. Look for a male black, light skin tan jacket jeans outside yelling, Tony Robinson. Reporter another call said robinson was trying to strangle someone. Officer matt kinnie, first officer on scene reports hearing commotion inside the apartment and forced his way through the door. The officer indicates a fight started. He was hit in the head by robinson. 30 seconds later. Shots fired. Shot fired. Reporter robinson died after being shot. He was unarmed. Thats going to make this all the more complicated for the investigators, for the public to accept to understand that deadly force had to be used. Reporter this isnt the first time officer kinnie has been involved in a deadly shooting. In 2007 kinnie shot and killed a man in what the police chief described as suicide by cop. Kenney was exonerated of any wrongdoing. And ryan young joins me now from the scene of that shooting shooting. Were minutes from hearing from the d. A. As to whether or not hell bring charges. Have you seen crowds preparing in town . How are people preparing . Reporter a lot of people feeling the charges will not come for this officer. You can see the crowd thats already started to gather here. People want to be in this location for the announcement. Now the home where the shooting happened is just over there. You see the white house with the porch that direction. Thats where a lot of the memorial and the candles were left behind. Of course, weve been covering the story since the beginning. And you remember this the 911 call went out, the officer arrived, heard noise inside the house. Went on the inside and a struggle ensued. He says he suffered a concussion. That was reported later. He pulled his gun, fired three shots. And just this afternoon, his aunt talked about the pain of losing Tony Robinson. My chemical weapon is did you really feel that there was no other solution . Did you really feel that there was no other option other than to pull the trigger as many times as you did and riddle my nephew with holes . Reporter brooke you know thats been the Big Conversation since the shooting happened. Whether or not the officer had to pull his gun. He did have a taser on him, of course a lot of people ask why didnt he use a taser. Here in madison an officer cannot pull his taser unless he has backup. So the gun was the next step. Especially he says he was being attacked on the inside of the home. Weve been waiting for the details involved in this case. Of course that News Conference is coming in a short time. But people want to know exactly what happened or what the report has found out. The independent report as soon as the officer walks on the inside and faces Tony Robinson. Can you tell me a little, ryan as we see the live pictures as well see the District Attorney Ismael Ismael ozanne. Can you tell me about him . Reporter been in this area and doing the investigation. Look, this state here is one of the first in the country to have this set up where an independent Authority Comes in and look at what happened. Now, of course, its going to be his job to tell everyone what the investigators found. For the first two days after the shooting you have to commend the police chief for coming forward, doing the oncamera interviews they said they not only would be open to the investigation, but they also apologized to the family because they obviously didnt want this to turn into any of the other situations across the country. And we did see those largescale protest especially with people taking to the street. We were here as they took over the State Capitol as they closed down the streets for a short time as they protested. And even in the last halfhour or so police have shown up and added these no parking temporary police order signs around the area because for a few days this street was shut down after the shooting. This is outside of a home in which at the time 19yearold Tony Robinson shot and killed this incident happened in march involving an officer. Responding to a 911 call. Walked inside this home struggle ensued. He shot and killed this unarmed teenager. On the right side picture of a podium with we should be seeing any second now the District Attorney in madison, wisconsin, out of dane county will be standing there and announcing their findings and whether or not he is choosing to bring charges against the Police Officer who shot and killed the 19yearold. Massive crowds at the capitol. And crowds gathering. Although i can say i talked to the aunt of this young man. Shes not anticipating charge, but she was also calling for peace. Let me bring in danny savalos and sunny hostin. Well see the District Attorney say whatever hes planning on saying but he wont be taking cases afterward. My taking questions afterwards. My question is will he walk through his you know why he came to this conclusion . I think thats the question on everyones mind. Will we hear the kind of statement that we heard from Marilyn Mosby in baltimore. That statement was very unique in my view ive never seen anything like that. Typically prosecutors will let you know the decision but may not necessarily give you all of the background. These investigations are typically ongoing. We know that his office has had the investigation since march 6th. This is more in line and what weve usually seen a several month investigation than culminating in either charge or not. So i dont think were going to hear that kind of statement. I think thats really unique unto itself. I think this is a difficult decision for any prosecutor especially for this prosecutor. Why . Weve seen all of these events over and over. Prosecutors have really come under fire for either bringing charges or not bringing charge. Hes been a prosecutor a career prosecutor, is my understanding. He has a lot of experience. Hes tried murder cases, tried Domestic Violence cases. Hes tried felony cases. Hes been the lead prosecutor in wisconsin since 2010. But is the first africanamerican prosecutor in wisconsin. So with that you know heavy is the head that wears the crown. With that, certainly comes a lot of responsibility. And i think when youre thinking about policeinvolved shootings, frankly they are held to a different legal standard. And those cases are very difficult to bring. So i think this is going to be a difficult decision. Can you talk about that, the legal standard, what theyve been doing since march 6th and today looking into this independent investigators, et cetera. What have they been well jumping off from where sunny ended what you have to ask, whats the upside why give a lot of narrative as to the decision . Under wisconsin law, they have to release records. Theyre going to come out anyway. Theres really not much point at a press conference of adding any of his personal opinion or thoughts because under the law, it will be released. Brooke the report . Yeah the information is going to be released. And wisconsin in a substantial minority of states that actually have a law that requires transparency. That transparency. All states have some variation of it. But anyways, the issue thats going to come up here, that i think is going to be fascinating, is the issue of the officers entry into the home, right . We have reports that there may have been drug use. Did the officer know and did he not . I think critical in this case is the Community Caretaker exception. Police exercised two primary duties. One, we are more familiar with. It is Law Enforcement. The other one is when someone is injured and needs help. They are the Community Caretaker. And i think theyre going to scrutinize ultimately his reason for entering obviously without a warrant. Was it under that Community Caretaker exception . Was his interest in entering the home complete lyly divorced from the crime or thinking perhaps somebody had odd on drugs, somebody was in need of assistance. I not these are fact that are i think these are facts that are going to be critical. If people are upset with the decision one way or another, theyll care less about the constitutional analysis and well see protests. Again, hopefully they will be peaceful if, in fact we know weve seen crowds gathering around the home where the shooting happened a couple of months ago. I have to get a quick break in. First of all, he noted that the Text Messages that he cited in the report that weve all been talking about these past few days said thats not circumstantial evidence. He said thats direct evidence. He said he believes in the bottom of my heart, that not only was there fraud here committed by the patriots but he believes that tom brady knew about. He explained that that probably language that more probable than not was meant to directly meet the nfls standard. And weve talked about this on the show a couple of time. Thats what the nfl rules say. Thats what they say is their standard of whether you violated something or not. So that is why he used that language. Then he got into the idea of impeding the investigation. He gave a couple specific examples. He said with the patriots, he said that he interviewed jim mcnally this is a key guy who took the footballs into the bathroom and that he interviewed him once. But then after that interview is when he found the text message where mcnally referred to himself as the deflator. He wanted another interview with jim mcnally. And he said the patriots not only refused that interview but they refused to even tell mcinaly that wells wanted to speak to him. Then when he addressed tom brady, he said brady did answer all has questions in the interview. He went on to say that he asked for electronic communication from brady, he specified, look, we did not ask to take tom bradys cell phone. We understand thats an invasion of privacy. Someone as famous as tom brady. We basically asked his lawyer and agent, you go through the cell phone. You just tell us anything you think might be relevant that youre willing to give us you vet it yourselves then hand us printout. As wells said they didnt even want to do. That he thought that giving them that much trust and benefit of the doubt and still being refused, that qualified as impeding the investigation. And theres no doubt when troy vincent handed down the punishment that impeding the investigation, that was a big deal in why it was four games for tom brady. Okay. They say think the error is not a big air in footballs is not a big deal. They think bradys legacy is still intact as far as forgive me. I want to continue this conversation. I got to go to madison wisconsin. Heres the District Attorney here about to announce whether or not he is going to charge an officer in shooting and killing a 19yearold from an incident back in march. Lets listen. Ey. I am here to render the decision in the officerinvolved shooting that took the life of 19yearold Tony Robinson jr. On march 6th, 2015. On march 6, 2015 a young man last his life far too soon. Now whether we are policing teaching or parenting, when we use violence to control, we do so at a tremendous cost to the person to our community and ultimately to our humanity. Although Tony Robinson jr. Was over 6 feet tall he was just past the age of majority. We must remember he was still a young man. I have privately extended my condolences to any robinsons mother andrea irwin, and i do so now again today. I am so very sorry for your loss. I am a lifelong resident of dane county a husband, a father of two intelligent beautiful and caring daughters. I am a person of color from a biracial marriage. I am the son of a black woman born in anniston alabama who at the age of 16 became the youngest member of the Student Coordinating Committee and participated in the freedom. I am the son of a black woman who still worries about my safety from the bias and privilege and violence that accompanies it. I am a man who understands the pain of unjustified profiling and i am the first District Attorney of color, not only in dane county but in the state of wisconsin. I make note of this because it is through this lens that i approach and accept my leadership responsibilities. Those responsibilities involve an oath i took to youp hold the constitution of the United States of america and the constitution of the state of wisconsin. In this matter my role and obligation is to weigh the facts and determine if officer kenny should be criminally charged. I am cognizant of the very real Racial Disparities and equity issues which exist in this county. In the past eight weeks i have met with the following people in groups. Andrea irwin, the mother of Tony Robinson jr. , who wants her son to be seen as a human being. And as her child who was loved open and cared for. High School Students who express an interest in justice but are mistrusting of Law Enforcement and the criminal Justice System. Many told me that they will not pursue careers in Law Enforcement. When that is precisely where their views and experiences are needed. I have also met with a Neighborhood Watch group and heard their frustrations. I have met with black leaders in our community, many faithbased who are asking to be included in reform. I meet monthly with the Dane County Police chiefs and i hear their challenges with recruiting persons of color to apply for jobs. Finally, i serve on the dane county Racial Justice improvement committee. These are all important voices in our community. These are all people who want the same thing. To feel safe. We must also remember Law Enforcement represents these same voices and these same people. My decision will not bring Tony Robinson jr. Back. My decision will not end the Racial Disparities that exist in the Justice System in our Justice System. My decision is not based on emotion. Rather this decision is based on the facts as they have been investigated and reported to me. This decision is guided by the rule of law. And the oath i took to uphold the constitution. Theres one preliminary determination i am required to make that is whether wisconsin state 174. 47 concerning the review of deaths involving officers has been complied with. The law requires that each Law Enforcement agency have a written policy regarding investigations of officerinvolved deaths that involve officers ploidsemployed by the agency. The policy must require an investigation be conducted by at least two investigators, one who is the lead investigator and neither whom is employed by the Law Enforcement agency that employs the officer involved in the death. In dane county there has been a written policy in place for officerinvolved incidents. That includes deaths prior to the package of 175. 47. In this case the city of madison requested the division of criminal investigation, dci, from the department of justice to lead the investigation. The city of madison has used dci in this capacity for all officerinvolved shootings which have occurred since the implementation of dane countys written policy and the passage of the new law. In this case i conclude there has been compliance with wisconsin statute section 175. 47. Now as to any robinson jr. And my decision today. In making this decision i hold myself to the reasonable doubt standard. In other words, what can be proven beyond a reasonable doubt. To begin i reviewed the follow evidence the scene on the evening of march 6, observation of the initial Law Enforcement response on march 6th Police Reports including dcis, the wisconsin state patrol and the city of Madison Police department. Medical examiners report and autopsy, Wisconsin Crime Lab reports, citizen interviews paramedic, emt and firefighter interviews officer interviews including officer kennys interview, Surveillance Footage from the spirit gas station, Police Squad Car video, officer recordings examination of Radio Communication and 911 calls, photographs, video of the scene itself 814 pages of reports and documentation released by the city of Madison Police Department Due to open records requests a 911 call released by the Dane County Dispatch Center due to an open records request, and followup interview with one of the residents of 1125 williamson street apartment 22 conducted by the District Attorneys office. At the conclusion of this review the question to be answered is whether criminal charges are warranted in the death of Tony Robinson jr. I begin with the known undisputed facts. There were three 911 calls within five minutes prior to officer kennys arrival on the scene. The first call came in at 6 28 p. M. From a friend of Tony Robinson jr. , who was a resident of 1125 williamson street number 2. It was reported tony was tweaking chasing everybody and is really outrageous right now. The caller and his girlfriend are scared. Tony is a lightskinned african american. He is not wearing a shirt but has a jacket on that is tan in color. It is not believed tony is armed. Tony had jumped in front of a car but doesnt appear to be hurt. Tony is chasing the caller as they drive off. Tony had punched another friend prior to this call but everyone has left as things are really bad. Tony is going crazy. He took sha rooms or some type of drugs. Caller said he couldnt talk to any, said he couldnt get through to him. Tony is acting insane right now and it is scaring the caller. The second call came in at 6 31 p. M. It was reported that a man was attacking pedestrians and had punched the caller in the face. The attacker was light skinned, not wearing a shirt at this time which description fit that of Tony Robinson jr. The incident occurred near 1125 williamson street across from the gas station. The third call came in at 6 32 p. M. It was reported the
