U. S. Citizens protesting as an enemy force. Thats right, deborah. These emails reveal the way and how the National Guard prepared for its deployment down there in ferguson anticipating that there would be protesters throwing molotov cocktails and a lot of disturbances and at the same time trying to be conscious, it seems, about not showing too much force and not being too public for fear that that would inflame tensions. They were trying to balance. These words, enemy forces adversaries, really are insulting to some of the people down there. Weve talked to people down there who said that its shocking that they were being treated that way and emblematic of the broader problem with the Police Department there. We have a statement from the National Guard which defends this language and says essentially that they were there to protect they were there to make sure that they could deal with potential threats is what theyre calling it. Document reference uses generic military planning format utilized in a wide range of military missions so the term enemy forces would be better understood to understand potential threats. At the same time they were getting criticism from local officials including the ferguson mayor who was very concerned that the National Guard wasnt more out there to try to protect businesses that were burning and heres what he had to say at the time. It appears we dont have the video. Evan i want to ask you there are a lot of questions. Obviously this kind of language is very inflammatory. It can quickly escalate a situation. If you are going into i think we saw it happen in katrina when they sent the National Guard in and the general at the time basically had to tell the National Guard to put their weapons down to holster their weapons because it wasnt a war zone. This was the United States of america. The documents that youre reviewing, it shows renewed concerns about how they acted. Granted, they were just using those terms generically. What do documents say about the mindset that may have created amongst those guards . You know its interesting. Just a couple days before we get to the grand jury decision you see the language change because internally they realize its a problem. Colonel david boyle sends an email saying were no longer going to use these words because they are potentially inflammatory. He said that from then on theyre going to stop using enemy and theyll start using the words criminal element. He caught on and realized what the problem it would be. All right. Lots to dissect. And switching gears, we turn to the reserve deputy who shot and killed an unarmed man in tulsa, oklahoma. In his first public interview surrounded by family and his lawyers, robert bates appears emotional. Hes an Insurance Company executive. At times he also seemed defiant saying this was a terrible accident because he reached for his taser and yet accidentally pulled out his handgun and fired. Oh my god, what has happened. The laser light is the same on each weapon. I saw the light and i squeezed the trigger and then realized and dropped the gun. This was not an intentional thing. I had no desire to ever take anyones life. And our ed lavandera is live in tulsa. Ed you know i read something that apparently he also before going into the Insurance Business that he was on the tulsa police force, is that accurate . Reporter he served for one year as a Tulsa Police Officer back in the mid 1960s. He spent the last seven or eight years working as a reserve deputy volunteering as a reserve deputy with the tulsa county Sheriffs Office. It is that relationship that robert bates has with the sheriff here of tulsa who has been the sheriff here for several decades. So its that relationship that has been under an intense amount of scrutiny. Allegations that because of mr. Bates donations he gave five cars and other equipment to the Sheriffs Department here in tulsa. He was asked whether or not these donations and his relationship with the sheriff here essentially bought his way onto the force here and this allegation that the attorneys for the family of eric harris used that he paid for play a cop. Mr. Bates reacted to that. That is unbelievably unfair. I have donated equipment as i saw fit when the need happened to arise to allow the task force and other areas of the Sheriffs Office to better do their jobs on the streets of tulsa. Tulsa has a drug problem. There is no question. Nobody argues that. I am willing to put up equipment to assist them. Reporter and the other question thats still swirling around this story is the question of what kind of training and was mr. Bates properly trained and continually trained to work as this reserve deputy. The tulsa newspaper has reported that some of those Field Training records were falsified and that several people in the Sheriffs Department were demoted for not agreeing to sign off on those records. The only thing that the Sheriffs Department here in tulsa has released so far is a summary of courses that mr. Bates has taken over the last seven or eight years. They refused to release the more specific details of those training records. One interesting thing during that matt lauer interview is he said he was the cleanup guy. He came in afterwards took photographs, but when the suspect who he says allegedly ran toward him is when he went into action. Do you know offhand is he protected under the kinds of protections offered to i hate to say it but actual deputies . Reporter absolutely. Just so people fully understand theres virtually no difference between his abilities and his duties there as a reserve deputy. Hes a certified Police Officer here or certified deputy in the state of oklahoma. So he very much has the same protections that a fullfledged deputy has. This is a volunteer position. Donating hours. Theres limits as to how long these deputies can work but they have the full range and full scope of protections that regular deputies do. All right. Ed lavandera for us there in tulsa, oklahoma. Bates remaining defiant insisting he was properly trained and then slamming the reporting as false. Thats not correct. I have a written piece of paper signed off to say i had done a good job and the law firm has been most interesting. They seem to represent all of the people that have been terminated by the Sheriffs Office. Without getting off on a tangent, you did the training and you can prove that you were certified . That is absolutely the truth. I have it in writing. We just spoke to tulsa world last hour. I would be interested to see this documentation that he has these hundreds of hours of training that the Sheriffs Office claims hes had. This can be cleared up very simply by the Sheriffs Office producing records or producing the two supervisors who are still employed at the Sheriffs Office who our sources say were pressured to sign off on training refused and were transferred transferred. How did bates mistake a gun for the taser when the gun was on the hip and the taser was on the chest. My taser is right here in the front tucked in a protective vest. My gun itself is on my side. Normally to the rear. People are going to look at that mr. Bates, and say how could you make this mistake . How could you think you were going for your taser on your chest tucked into that vest and accidentally pull your weapon . Let me say this has happened a number of times around the country. I have read about it in the past. I thought to myself after reading several cases i dont understand how this can happen. You must believe me. It can happen to anyone. Its interesting to see his Family Member behind him sort of stroking his shoulder. Bates claims that it was an honest mistake. Will it hold up in court . To discuss im joined by a criminal defense attorney. Brian, a couple things. Lets go to the heart of this. Do you think it was wise for him to actually do thisn the court of Public Opinion . Deborah, absolutely not. That was a lethal mistake on his part. It underscores the fact that he clearly did not belong on that Police Department. He had his gun, his revolver in a different position than where his taser was. When hes out there saying like this can happen to anyone what message does that send to the public . He should be saying this shouldnt happen to anyone. This happened in other places either. I am a civil rights lawyer as well. Ive been involved in a lot of officerinvolved shooting cases for the last decade. Ive never heard of this happening before. Another thing, too, i think were missing a defendant in this case. I think the sheriff in this case should be criminally prosecuted for allowing bates to be on the Police Department when hes not properly trained and hes not certified to use alet lethal weapon. Its interesting. It seems the Sheriffs Department is trying to uncover sources that these reporters used at the same time he himself, and his whole department could be the focus of an investigation. Is this ethical . Is it ethical . This is a mockery of law enforcement, deborah. This is not appropriate. Its unethical. And this man did not make no mistake about it. He did not belong on the police force at all. You would have to undergo rigorous training at the Police Academy to qualify as a deputy in the Police Department. You have to be certified annually using a firearm. You can produce any document you want. That doesnt prove it. You have to have people that train theseis guy come in and talk about that. He should not be on the police force. Its the training that prevents qualified officers from making these kind of mistakes and making these kind of accidents and certainly a tragedy for the family of eric harris who was killed and also for this man who thought he was trying to do good. What are we learning about his death and importance of it . He was number six in the lineup of saddam husseins regime. Important leader at the time. Since then he dropped off the radar but came up again when isis marched across northern iraq. He was a leader of the Baathist Party so hes not a member of isis per se. He was aligned with them at one point although those allegiances are shifting all the time. What we know about his apparent death is iraqi state tv are reporting that Iraqi Security forces along with shia militia actually went in on what they call a surprise operation in the mountains between tikrit and kirkuk. In that operation they say he was killed. They cant be 100 sure until dna tests are conducted but they are clearly touting this as a major blow to the terrorist organizations as they put it. Thats how they see this man. Has there been any word this is all breaking and developing right now but has there been any word that other leaders were with him and were they also killed injured or are we going to see what usually happens which is one guy is taken out and somebody else replaces him . We havent heard if any of his deputies were killed. We have to understand this is a guy who was almost a mythical figure. Not only was he the king of clubs to the u. S. Forces when they were in iraq but also he had this legendary reputation as being saddam husseins righthand man. He was very feared. As he was leading this group, it was never quite clear what his role was. He was more of a spiritual leader rather than operationally on the ground all the time. So its not clear what will happen next if there is somebody who could replace him in the baathist circles. Its also not clear who he was allied with at this point. Once upon a time it may have been isis but as recently as last week there were reports of an audio message from him calling for strikes against isis.
