Theres a lot of stuff that we have seen in the public records that suggest i think you bring up a good point because most will just say its oversight and democrats are over reaching but no oone talks about. What may be the reason he wont do it if theres nothing to hide, which i think is a very good questions. I want to bring you in because the treasury spokesman tell Washington Post that senior Staff Members never reviewed this memo. What does that mean . As a former career justice appointment lawyer the fact the memo wasnt signed does sort of make me curious about who wrote it and at what level within the agency it was written. So if the chief counsel didnt know about it,en t then i would consider it an authoritative memo that would have been advice given to the treasury sec areitary. It seems this was drafted at lower levels. Career executives or staff. But it wasnt an authoritative decision or opinion that was made by the agency and that is relevant for considering the analysis thats unit. But from the perspective of the executive branch, the opinion thats going to matter legally is the opinion coming out of the Justice Department and we know that is going to support the president s position. Will that hold up in court you think . Well, theyre going to litigate on the statutory part. I do think their main argument is the administrations argument is theres not a legislative purpose to this request and i feel like that is actually pr pretty easy to overcome. One could be congress analyzing or considering whether or not they want to pass a law requiring the president and Vice President or even candidates to release their taxes publicly. Thats a valid ledge slottive purpose. So i think that will be ea high hurdle for them. The president has vowed to fight all the subpoenas. Thats a quote. This could be evidence in court. What do you make of the fact that its got out to the press . Well, i think this is a further sign that there are a lot of career Civil Servants that are pretty unhappy about the way trump is obstructing justice and congress and so thats why i think youve seen a consistent patdern of leelks going back to the beginning of the administration. In fact what i would call dedicated Government Employees who want to protect the constitution instead of donald trump and the fact i mean this memo is seems to me im not a lawyer but its a pretty clear reading of this 1924 statute which says that the Treasury Department shall furnish upon request the returns of any taxpayer. It doesnt say will only furnish the tax returns i
