He says if this is the true outcome, it wasnt that unexpected. In our somewhat unusual system that we have for prosecuting crimes in the United States, there are often two possible jurisdictions under which someone can be prosecuted. In this case the state of missouri, but all the federal government sometimes can bring charges. What made the case unlikely from the start was that in a case like this where a Law Enforcement officer shoots and kills a civilian, the barriers to a federal prosecution are higher than a state prosecution. So the fact that a state didnt prosecute him made a federal case less likely. The federal case was based on what, hate crimes that officer wilson violated Michael Browns civil rights . Civil rights cases, yes. The federal government can enforce the broader civil rights laws that say there cant be discrimination say, on the basis of race. So in addition to proving that officer wilson shot and killed Michael Brown with bad intent the federal case will require a proving some sort of malicious or even racial intent. And thats very hard to do to prove whats in someones head especially a Police Officer who in these circumstances already had a confrontation with Michael Brown in his police car before the fatal contact.
