He refused to hand over the full Mueller Report and the evidence that comes along with it. Thats one of the big headlines we want to get into with the first attorney general for the obama administration, mr. Eric holder. Welcome to primetime. Good to have you. Its good to see you. How have you been . So we talk about how do we keep the democracy safe . Mueller went out of his way to talk about it. Nobody seems to be doing anything about it. You say its not just about russian interference, its about how we get in our own way with the system gerrymandering. How so . Well, its the system by which one party gets more representation than it deserves based on the number of votes that it receives in our state legislatures and our congress as well. It leads to polarization and gridlock and cynicism by the American People. People wonder what is gerryhanderigerryhan gerrymandering all about. If you care about the three heart beat bills in ohio, missouri and georgia those are one of the three states in the country and thats a very tangible result. Two points of push back. The first one is it comes from him. He did such great things working on the constitution but gets killed from moving around districts to assure he would keep getting elected. The point is this has always gone on. We struggled with it from the beginning. Why should we care now . The fact that it has gone on for as long as it has is a historical fact but the reality is that just because something bad has been going on for an extended period of time means that we should let it go on forever. This is a time for us to stop gerryha ger gerrymandering and return power to the people. Politicians are picking their voters instead of choosing who representatives ought to be. If you look at what happened in 2011, princeton did a study and said the gerrymandering done by republicans was the worst in the last half century and thats had an impact over our civic life over the course of the past decade. You want to make sure that people are getting fair representation where they live. The National Democratic redistricting committee. 2018, all the money that you put out there to help was to help democrats. So is that what this is . Is this just about you helping your own . No, this is not an attempt to gerrymander or favor democrats. What we need is a fair system. If we have a fair process in 2021, democrats and progressives will do just fine but i want to emphasize that more than anything else. This is not an attempt to gerrymander for democrats. I welcome that support. I did an event with former governor Arnold Schwarzenegger about four or five weeks ago in washington d. C. He supports the creation of independent commissions to do redistricting and take it out of the hands of politicians whatsoever. But he is a loan voice in the republican party. So the pledge that you want everybody to take, if you were to find out that democrats had gone sideways and they were playing the same game, would you call for democrats to be primaried by other democrats if theyre not doing it the other way . Not playing clean . Ill tell you this, in new jersey democrats try to use the power they have there to gerrymander in new jersey and i said that was something that was inappropriate and something i was opposed to and along with Governor Phil Murphy we were able to push democrats away from that which they were intending to do. This is bad for republicans. Its bad for democrats but more importantly its bad for our nation. Were going to keep our eye on the pledge. See who makes it. See who doesnt. I appreciate you being here for that. Fairness matters to us. Segway question. Whats fair to the president of the United States . Do you believe starting an impeachment inquiry or proceedings would be justified on what you understand the facts to be . Would that be fair to the president of the United States . I think it would be fair on the basis of the Mueller Report. That was clearly a referral from bob mueller to congress for congress to use its constitutional powers and i think actually do its constitutional duty to examine that report and make a determination about whether or not the president should be impeached. Now i look at that obstruction section of the report and it seems to me that there are at least 6 out of those 10 specifications of obstruction that would serve as a basis to impeach President Trump. What do you think about process . Do you think it will just keep going along this way in terms of what theyre doing . Yes theyre fighting with the a. G. Right now. Youre no stranger to that game. Should they keep it this way or do you believe that impeachment is the right route or do you agree with nancy pelosi that its the wrong route . I think in the shortterm i would keep going in the way that they are. Have really significant oversight. Id speed up the process, though. Lets send out the subpoenas. Lets get the response times, cut those down and speed up the process so that we form what is to happen and if we dont get responses from people in the cabinet then you have to move to an impeachment inquiry. Thats where you are. They sent out the subpoenas. The a. G. And other interested parties say no so they go to court and get a couple of rul g rulings and now theyll appeal those so its not over yet. If they were to go impeachment inquiry do the judges accelerate the process . Actually, congress in using its Impeachment Authority is at its height when it comes to the power that the house of representatives has. If it went to an impeachment inquiry it would see the Judicial Branch more responsive and then perhaps it would be in pure oversite but judges have been moving pretty quickly. We want to move as quickly as we can and establish facts as quickly as we can. I dont think that Political Considerations should be a part of that determination. Do you think that the current attorney general has followed that last comment that you just made there. I have to tell you. I have been sorely disappointed. He has protected the president. He has mischaracterized the Mueller Report. Hes not cooperating with congress in a way he should. I said in a tweet that i dont think on the basis of his performance that hes fit to be attorney general of the United States. People hit you with the same stick as you know. They say holder was obamas wing man. What about the fast and the furious and he fought all of those subpoenas. They just settled the case like two weeks ago what did you do as a. G. To president obama that you believe is better than what were seeing now . Fast and furious i testified 10 times before the senate and the house talking about fast and furious and we made available all the witnesses that congress wanted to hear from from within the Justice Department. The only things we held back were materials that talked about how we were going to respond to congress. Not with regard to substance. All of those were released by attorney general sessions and there was nothing in there of any significance that we were holding back. We were fighting for a principle. The question of making sure that deliberations could occur in the executive branch out of the sight of the legislative branch but the total way in which barr and other members of the Trump Administration refused to turnover documents and refused to testify, it is inconsistent with the duties they have as members of the cabinet. Lets talk about this more and i want you take on what you think must happen in this upcoming election. What do you think has to be the state of play . You know, i ran the Justice Department making determinations based on the facts and the law presented to me. I made determinations and decisions not necessarily supported by people in the white house. When i made the determination for instance to reopen the ininquii inquiry with regard to cia abuses. That was not supported by people in the white house. An independent attorney general is critical to our system. I appreciate you putting that on the record. It will be helpful going forward. So Jared Kushner. He gives this interview today. He talked about a couple of things that should have been layups but they werent. First thing i want to your take on. He was asked about whether or not hes ever seen the president do anything racist. Was birtherism racist . Look, i wasnt really involved in that. I know you werent. Was it racist . I wasnt involved in that. I know you werent. Was it racist . Look, i know who the president is and i have not seen anything in him that is racist so i was not involved in that. Did you wish he didnt do that . I was not involved in that. That was a long time ago. How does he not say, yes, it was racist. He shouldnt have done it. He learned from it. Hes moved on from it. How did he not give that answer . Whats your take on that . I dont think he can give that answer. Theres no way that he could say of his fatherinlaw that in any instance he had done something that was racist in nature though i think and this is a word that im very reluctant to use but i have to say with regard to the whole birther controversy that that had race at its base and President Trump knew what he was doing when he talked about president obama in that way. Why kushner doesnt have the ability to do that is obvious. He simply cannot agree with the notion that is just factually there that his fatherinlaw engaged in an activity that was inappropriately based in race. The trump family, hes up there in the seat of power being asked to do things he has no experience in. But one thing, an email like you got in the campaign to get dirt from the russians, what would you do . He says i dont know. Now doesnt his security clearance mandate that he report Something Like that . Let alone his common sense . Both in terms of your security clearance, your common sense, and your fundamental patriotism if a foreign power offers to give you information that would be useful in a campaign, i would think that the instinctive reaction that you would have would be to call the fbi and to call somebody in authority. Somebody in Law Enforcement and somebody in the National Security sphere to report that. Not to take advantage of it and the fact that he is unable to say that even now is really kind of breathtaking. Its really breathtaking. Look at the democratic field of 23 or 24 right now. Are you wishing you jumped in . There are times when i have pangs about that. But one thing i would say is that if i were running i would be signing this pledge which is what were asking all the candidates to do. Have you done it . We have gotten favorable responses from a number of them. But we want them to sign this pledge to end gerrymandering and map manipulation. But were also asking regular citizens to sign this pledge as well. Well, that will be easy. Citizens want the game to be fair. When youre in it. You said favorable responses. Has anyone signed the pledge yet . No one has signed the pledge yet. We have not physically given the pledge to anybody but im sure we have heard in the roll outs, to be fair, mayor pete talked about this. Beto orourke talked about this all during their roll outs. We want people to be more vocal about the need for a fair redistricting process in 2021. What about biden . Im sure the Vice President will sign this as well. I know him and im confident that hell sign this pledge. What do you think of that field . Its a good feel. We have a lot of qualified candidates . Too many . Yeah. Well at this point we have too many now. Through the debates and through the iowa and New Hampshire caucuses it will be down dramatically. 7 or 8 people there have a realistic chance. Do you think in order to win this is a great question. Its becoming a parlor game for democrats. What do you need in the man or woman or both that you pick . What particular message is it . I keep hearing from people all over this country the same thing. They have to be able to beat trump. They have to be able to go toe to toe and take him on. How real do you think that sentiment is and how real do you think it will ring in the ultimate choice that democrats will make . Or do you think theyll defer to checking boxes as you guys sometimes do . Its interesting that you say that because thats been my experience as well as i have gone around the country. I talk about issues and things that i think our nominee should stand for and people nod their heads and say they agree with that but the thing that is uppermost in the minds of democrats that i talk to is the fact that they need a candidate that will defeat donald trump in 2020. Now my view is that we need to select a person that we think would be a great person. And will also maximize our chances of replacing donald trump in the white house. If we focus on those two issues, not only electability but who has the skills or temperament to be out there and be a good president will come up with a winning candidate. Everything you accomplished in your life and you still have a long way to go. When you were thinking about getting in the thing i heard from most people, i like where holder is from. Hes an outer borough guy. He can go toe to toe with somebody like donald trump. Everything you have achieved, the quality that you had from birth is what they looked at most. It would have been interesting to see two guys from queens going at it. Right. He comes from the rich part of queens and i come from the hard part of queens. Thats what my father used to say all the time except he ought to say it about me. The cause to even the Playing Field when it comes to elections and redistricting is a good one. We support it here.
