CNNW New Day July 6, 2016

Much differently on both sides it could have been handled differe differently. Sglr sglr reporter the local congressman calling for an separate investigation. And this is now the third officer involved shooting in the east batten rouge perish and were expected to hear from the mans family later today as theyre expected to speak to reporters in a couple of hours. Lets bring in people to discuss what happened. Host of vh 1 live and cnn Law Enforcement analyst, director of policy for the decalb county Police Department in georgia. This is all going to be about the cell phone video that was made. We have a portion of it that will end right when the gun fire starts because from then on its not relevant for the analysis and its disturbing. Lets watch it unedited and then well discuss. [ bleep] [ bleep] [ gun shots] cedric, all the years on the job, understanding these incidents and what the progression of the analysis will be in figuring this out. Help us understand what you see on this. Heres what is very key to this whole piece that we have here. It is certainly a pretty graphic video. But in all fairness to the community and the officers, this is still very early in the investigation and i think whats going to be critically important is not just the video but forensic evidence that is going to suggest how and why the shooting took place the way it did. But to the average viewer thats out there and environment were in today between police and community, it certainly does raise a lot of questions. Is one thing thats going to be very important and you heard that from batten rouge Police Department is that theyre going to have to be very transparent in keeping that community in contact with them and sharing information as it becomes relevant to this investigation. Thats going to be critically important based on the video we just saw. Obviously the protests and the out rage are for good reason. A guy on the ground shot in the back. We need to look at forensics and talk to witnesses. Sometimes we can look at so many things that we forget what happened in our own eyes. A man clearly subdued not accessing his weapon. We should find out more information. Lets not confuse this. We begin to dig into the persons background. What did they do when they were 18 or 12. Then we raise all these other questions that have nothing to do with what happened in that incident. Its a long pattern of black men in particular and black women and in batten rouge were seeing evidence this is a pattern. We need investigate but not deny whats in front of our own eyes. Lets look at a shorter version. Sandoval said this is the third shooting in a relatively small amount of time. This is how they got him on the ground, okay. So, obviously the officers felt he wasnt responding to those commands and they wind up in a tusal, putting him down. This is where the analysis gets tricky for the layman, someone who doesnt have the forensic experience because once hes on the ground, isnt it over . What are the different variables, even if someone seems subdued . This is what we see on the video from the angle being shot. We dont know what the other side of that car, which we cannot clearly see and what was taking place, what was in officers mind when he yelled gun, gun, gun. Its our understanding from the initial reports that he did have a gun in his position and heres where i have to be very careful and i think its important that the community and the country at large will be careful is that we will know more as more is revealed but we have a few seconds of a video thats very graphic and i will reemphasize it again, the fact that in this particular shooting, it appears that he was down. We dont know where his hands were. We dont know why that officer shot but hes going to have to articulate and clearly articulate. Its going to have to come down to where his hands were. Because the eye witness testimony is that they saw the officers taking the weapon out of his pockets. And his hands were never at his pocket. But you have eye witness testimony. You have two things that are going to be impressive to people on both sides of the equation. This is my guess. One is good thing you got videotape. We dont know if the body cams were working properly. Without it, its an entirely different analysis, certainly for the public and on the other side its going to be why did he resist . Why did he create a situation . You know everything goes against you once that happens . Hold on, cedric. Of course, yes, videotape is always great. If theres no videotape, theres not a chance we have this conversation with this. Because the assumption is police do nothing wrong unless we have video. It also helps the cops. Helpful for them to see it took two of them to put on the ground. Perhaps. Resistance is something that is not a lethal offense. Eric garner has his hands up in the air, he still dies. Mike brown approaches, he dies. We could go down the list. Walter scott runs away and gets shot in the back and magically these body cameras dont seem to work when the evidence is stacked against the police. Yes, we should wait for the investigation but the public has to have some sense of trust in the investigators. And for a long time weave had o reason to do that. I know it seems obvious from looking at the videotape but they did something that was going to change their lives. It obviously this mans life was ended by this. As you said, its early out of the box. Mark, thank you very much. Cedric, as always. Turning now to our other top story. Donald trump accusing Hillary Clinton of bribing Loretta Lynch after the fbi recommended not charging Hillary Clinton over her email practices. We have this 2016 race covered the way only cnn can. Give us all of the latest. Reporter well, good morning, allison. Donald trump was trying to stay on message, hammer Hillary Clinton, drive home the message that in the wake of not of the fbi not recommending any charges that system was rigged in favor of the people like the clintons but he couldnt stay all the way on message after complimenting Saddam Hussein. Donald trump landing a searing attack against Hillary Clinton. Stupidity is not a reason that youre going to be innocent, okay. Its not a reason. Today is the best evidence ever that weve seen that our system is absolutely, totally rigged. Reporter trump attempting to cast clinton as a corrupt politician after director james comey will not charge Hillary Clinton while offering pointed criticism. There and evidence that they were extremely careless. She sent vast amounts of classified information, including information classified at top secret. She was extremely careless and frankly, i say grossly incompetent. Reporter even suggesting clinton may have bribed her way to this outcome. She said today we may consider the attorney general to go forward. Reporter thats after a New York Times story, not clinton herself, sited unnamed democrats, saying Hillary Clinton may decide to keep Loretta Lynch as attorney general. Trump took aim at obamas pension for golf. Golf more, more, learning how to chip, learning how to drive. He says isil and its almost like he does it to make people upset. Reporter and his demeaner in the white house. We have a person in the white house thats having a lot of fun. Its like a carnival act. Reporter but as trump tried to stay on the offensive, he offered his accolades to former iraqi dictator, Saddam Hussein, a man who maintained a vise grip on power. We shouldnt have destabilized. Saddam hussein was a bad guy, really bad guy. But you know what he did well . He killed terrorists. He did that so good. Trumps comments about Saddam Hussein were played the more awkward because he was campaigning along side bob corker, this is one of the folks he was interviewing for a vp spot. He said i dont think the voters will forget the rigged system that allowed crooked hillary to get away with murder. Come november 8, shes out. No mention of emails as president obama took the stage with clinton just hours after the fbi announcement. We have cnns michelle live at the white house with more. Reporter the white house completely punted on this. They would not respond to the fbis announcement. So, why not say anything of all days, yesterday . I mean, this good news for Hillary Clinton is hardly all good but somebody had to Say Something about it, i mean, this happened. So, it was the campaign that did it as cleanly as possible. They put out a paper statement and boom, Nobody Needed to say anything else. Not wanting a shadow over this big day on the campaign trail. These are the pictures Hillary Clintons campaign has been waiting for, the arrival with the president on air force 1. Then side by side on the stage. Hillirarhillary, hillary. This, my friends is a president who knows how to keep us safe and strong. Compare that to donald trump. Reporter this is president obama returning the favor after the rivals back in 2008, then united in new hampshire. We stand shoulder to shoulder. Reporter but this i believe in Hillary Clinton. Reporter came after a surreal day in politics. Where youd never know here that Hillary Clinton was now not facing criminal charges. Not a word mentioned of it as if it hadnt been the story of the day or the fbi story hadnt happened cuwince dentally two hours after taking off with each other. Hes made difficult, even unpopular decision s for the god of our country. There has never been any man or woman more qualified for this office than Hillary Clinton. Reporter a chance too, to hit republicans plenty of times and once again, even now the president would not say Donald Trumps name. Even the republicans on the other side dont know what the other guys talking about. You ask them, theyre all like i dont know. Reporter president obama now out on the trail showing the energy hes known for. Im ready to pass the butato. And i know Hillary Clinton is going to take it and i know she can run that race. Reporter at times he was shouting in a horse voice and he got everything in that speech. Climate, energy, immigration, guns. Hes expected to be very busy on the campaign trail from now on. Allison. Michelle, thank you for all that reporting. Youve given us a lot to talk about, which we will do. Donald trump blasting the fbi and singing the praises of Saddam Hussein. So, we will discuss all of it next. The earth needed to find a new waytury, to keep up with the data from over 30 billion connected devices. Just 30 billion . She was guilty. And it turned out that were not going to press charges. Today is the best evidence ever that weve seen that our system is absolutely, totally rigged. Its rigged. All right, that was donald trump responding to the fbis decision on Hillary Clintons email and he says it proves the system is rigged and hes accusing her of bribing the attorney general. The political battle over clintons emails is far from over. We have sarah murray, political commentator and anchor of Time Warner Cable and reporter from the New York Times, alex burns. Al, i want to start with you. So, the fbi director comy did not recommend any charges and he did not say that Hillary Clinton was not culpable of a series of problems. Let me play the most damming statement. Although we did not find clear evidence that sec aretary clinton or her colleagues intentionally mishandled, there is evidence they were extremely ca careless in their handling of highly sensitive information. Based on what he said, i remember people hearing yesterday, people converted that into she lied. The partisans have said this was intentional and she did this and that and they start 350piling o reasons. What it suggests to me is that people who cannot be convinced, are going to take what they want from director comys statement and run with it. Wasnt she dishonest about some of the things . I mean, he went through the points where she said one thing publ publicly and they found Something Else privately . When she said i never sent or received anything that was marked as secret or top secret. He said thats not true. You have to make a decision. What she being inaccurate . Was she being knowingly deceptive . Trump has said its a lie, a rig, a set up. But the facts dont suggest that. They dont suggest a crime. The fallouts going to be bad for this. Because everybody thinks that she committed a crime. Now she can say look at what the fbi said and hes going to say there are things that are done wrong. She didnt ask for permission. She didnt. Theres a whole list of things. Does this go into the bucket of this is what they do. How the clintons take care of themselves first. I think thats the biggest piece of fallout. I think shes been trying really hard to win a second look from voters that are fundamentally distrustful of her and her husband and the culture that surrounds them and this is a giant wild card that blows up that effort. Was it over as soon as bill clinton entered that plane . It doesnt help. Even if you take that meeting totally out of the picture too, to have the fbi director whos above politics as anybody calling a major president ial candidate saying they have a culture of extreme carelessness around them, thats pretty damming. Those words extreme carelessness. The republicans say why doesnt that rise to the level of charges . And extreme carelessness, that sure sounds like violation. Thats right. And i think we should not be surprised to see republicans want to step this one step further especially in light of those extremely careless comments. And theyre going to latch on the judgment. So, she may not have committed a crime and no charges Going Forward but what does this say about a person who is going to be handling top secret issues. We saw donald trump begin to do it last night but as donald trump wanted to do, he set off other controversies along the way. Its not the standard for him. Carelessness is not a criminal standard, let alone applicable to the statutes. Theyre saying define the difference between extreme carelessness and negligence. Hes looking for criminality. He has to find a level of negligence that rises to criminal responsibility and proof. If thats the easy part of the analysis. The hard parted is how do i feel about your carelessness. Thats what were seeing with trump who doubles down and plays hyperbole with it. But did he do her a favor by pushing it too far . As always. This is always the trap that clintons opponents fall into. They over state it. Its not as if she got a clean bill of health. Director comy, who used to be a prosecutor, he was tough as nails. He was appointed by the bush administration. He has a 10year appointment so he survives any given administration. He was pretty rough on her and instead of taking it as it is and moving on to another issue, now you have people saying were going to turn on the fbi director. If he wanted to be tough, he could have charges her. This is a life long prosecutor, not just an fbi director. So, its the hammer they usually like to pound people with. But as he said if you cant make it stick, theres no point in doing it. Its a bitter pill to swallow. I think theyre making a benghazilike mistake by trying to make this the issue of the fall campaign. Every poll shows it is not the issue. Lets look at the moment where donald trump went baurney the moment and accused Loretta Lynch of being bribed. The attorney general is saying if i get hillary off the hook, i got four more years and if she loses, im out of a job. Its a bribe. Rafr its a disgrace. There had been suggestions that said interested in retaining Loretta Lynch. And all the optics of the meeting with Loretta Lynch, it doesnt look good but i think most conventional candidates would have taken that as an open attack on her character. And the fbi, for all their faults have remained one of the more trusted institutions. And what is she hoping to get out of it and how real a boost do you think there is there . Well, i think its certainly helpful to her because president obama has a higher Approval Rating than Hillary Clinton does at this point and it lends an air of authority to arrive on air force 1, to be behind the president ial seal makes her look president ial at a time when republicans are calling that into question and you look prezmp chous and everythings already working to her bene
