He says it was just this one time, and now we find out there are seven cases, and now we have the fbi admitting that it is a precedentsetting standard that they want. So i think he has lost all credibility, you know, on what hes talking about, and hes lost all credibility that he has any real desire to defend the constitution. And thats why i think apple is a much better defender of our liberties than our government at this moment. Liz apple wants congress to decide. You now have the white house in the last hour saying its going to take a long time. It will not be a quick attempt to create Something Like this that involves highly technical discussion of which im sure youd agree, a lot of people in congress dont have the knowledge of. But do you trust congress to understand both the minutiae technologically and the big, i guess, implications constitutionally . Its hard to trust anybody, but i think id trust the congress because there might be somebody there that has a strong belief than i would the fbi. And also congress has already spoken to this. They have given the authority to use encryption. Matter of fact, they like it when apple develops encryption so they can use it. But what they want is monopoly control of it. They dont want the people to haven description to protect themselves against the snooping of government, and thats where the real problem is coming in. But the authority is there. What worries me is a little bit what youre alluding to. It goes back to the congress to reassess this law, can we depend on the congress . Its a shame, but we shouldnt even be worrying about that, because the constitution is rather clear about this. Liz can i push back that our pryce should be protected. Liz let me push back on something you said. You said fbis comb hawaii has, quote, lost all credibility. You know, he hasnt with some americans who feel very strongly that, yes, they love their privacy, but privacy has its limits. Believe even Warren Buffett said that to cnbc just yesterday when asked about this very case. You know, youve got terrorists who are willing to do great harm to us. They would chew hydraulic lines to bring down a plane. You and i both know that. Why would he lose credibility for sticking up for at least that part of the conversation . Well, he will with people who know and understand the constitution. But, you know, the constitution is there to protect us, not to be distorted. So i think he, the whole reason that we have encryption is because the people really wanted it. This came out of Edward Snowdens revelation that the government was illegally remember, the government denied they ever were watching us until Edward Snowden proved to them that they were. And thats when apple got busy and tried to protect the people from the encroachment of government in the sense that the government was actually the enemy of our privacy. Liz well, doctor, what is i guess the final question is whats the compromise . What do you foresee happening here . I dont think you ever have to give up liberty for safety. They said there should be always a balance. No, i think there should always be a bias. If theres any question at all whatsoever, it has to be a bias toward liberty. And right now i think the bias is away from liberty and the sacrifice of liberty, and people get scared to death. You know, everybody has to be terrified of whats happening. We happen to live in a country now where violent activity is going down. We happen to realize that as far as terrorism goes, there were ten cases between 2005 and 2015 im sorry, 14 people killed. So its a serious problem. But its not enough to justify just throwing out the constitution and the issue of privacy. You know . Because somebody says, well, were going to make you safe. The word safety doesnt exist in the constitution. The constitution exists to protect our liberties, and we should protect our privacy, so we should have the right of encryption rather than its sort of like the gun issue, you know . The guns were there originally to protect us against a tyrannical government. Encryption is there to protect us against a tyrannical government thats going to spy on every single thing that we do, and we shouldnt throw the constitution out just for this socalled security. Liz ron paul, sticking up for the constitution. Well see what happens. There is a lot of fear, and thats why some people would like to see this phone opened. Texas is a key state here. Its extremely focused right now, but all you hear are lots of insults flying back and forth. Whats the most important thing to your state . Well, ill tell you, really what citizens want to hear is how is this going to benefit me. You know, half of the population of the United States is 30,000 citizens and up. So the urban areas are critical and as well they are here in texas. Its about infrastructure, its about water, its about policing, its about home values, its about job creation. Those are the things that are, ultimately, important at the local level. Liz sure. Enough with the idealogues. Lets get it down to the basics and tell me why i should vote for you. Its an important issue in texas because were kind of the hotbed of the tea party, and ted cruz is going to be seeing if he is, can win his home state, whats happening with the tea party. Liz well, yeah. Thats big. So its a big issue here in texas and dallas. Liz let me get to mayor bernero, because looking whats going on in michigan, mayor, youve got some really nice numbers today coming out of the Auto Industry, and it shows the Auto Industry is back. So youve got a better economy there, but what do you need to hear from these candidates . Because a lot of people are complaining theyre not hearing what they need to hear. Yes. Thanks for echoing the great news of the recovery of the Auto Industry. That is michigan, gm, fort, chrysler headquartered right here. We make the things that make america great. You know, the chevy camaro is being made in lansing, the motor trend car of the year. So manufacturing is huge here. One of the things of course, its about jobs, like mayor rawlings said. Really here in michigan its jobs, jobs, jobs, frankly, and its manufacturing. We want to see a manufacturing initiative. We want to see a plan to sustain manufacturing. Im tired of hearing about manufacturing leaking off, going to china and other places overseas. We need a plan by the government to make sure that our Manufacturing Sector continues to thrive. In other countries you see the government gets behind manufacturing. Liz right. Here it seems like our government is content to see it seep away. And we want a plan at the state, local and federal levels to insure that manufacturing not only survives, but thrives. Thats a huge issue here. Liz yeah. I would think. And, mayor stodola in arkansas, weave just heard about all kinds of problems that come in the mud west where midwest where you do have a little bit of a lag there. What arent you hearing from these candidates that you need to hear . Well, i think all were hearing is a lot of criticism that theyre giving to each other, number one. Liz yeah, true. I hope after super tuesday we get a chance to hear some real substantive issues, you know . The issue of how we provide a quality education for everybody, how we take from the cradle to the college and to career to make sure that people have an affordable opportunity to go to school and to go to college. These are the issues. The Innovation Technology jobs of the future are really some things we have not heard from the candidates at all. And i think thats where its at. Our people want to hear about that. Liz yeah. Its about the issue of safety in our neighborhoods and, certainly, the decaying infrastructure system that weve got. Liz i need to whip around here, because we only have a little bit of time, but i want to ask each of you to name a candidate on both sides. You all happen to be democratic males, but i need candidates you could live with on both the democratic side and the republican side. Mr. Mark rawlings. [laughter] its a challenge, i know. Mayor rawlings . Look, im a senator clinton fan and john kasichs been great. Hes talking about bringing the country together. So those are the two that im interested in getting in some serious conversation about. Liz okay. What about you, mayor stodola . Yes. I support secretary Hillary Clinton. Ive known her since before she and the president were married. I think shell do a great job as the first woman president of the United States. If she doesnt win, on the other side in terms of the people that are left, john kasich. Liz okay. I think hed be the most possible. Liz mayor, you and i have spoken in the past together. I know you, obviously, want somebody who understands the midwest. Who are your candidates on both sides . This sounds like the me too chorus, obviously, im for hillary. Hillarys the way to go. Shes going to make a great president. But if i had to pick a republican, hands down, no question, john kasich. Hes the only one qualified, and hes run something other than his mouth. The s p up 41 points, the dow up 317, almost 2 . The nasdaq, the outperformer, technology is right behind financials in terms of Sector Performance today, up about 2. 5 . The leading issues on the dow, youve got jpmorgan and goldman sachs. You basically have a situation where some of the earlier data was hard on the inflation front. People are starting to think because of this better Economic Data we may see later this year Interest Rates going up and, as you to know, higher rates mean better profits for the banks. On the downside, the number one and only losing issue on the industrial average today is the one you see there on your screen, united technologies, down about 1. 9 off 1. 83. If youve been following utx, you know its been tangled with this deal with honeywell in the Aerospace Sector and, basically, utx isnt interested in playing ball to do a deal there. So utx is the only loser on the dow. Were just about 15 minutes 10 minutes, 12 minutes away from the closing bell, and it looks like a good start to the new month. Liz i would say. So a court ruled it was an improper usage of the term university. Liz okay. Todays ruling does two things, it makes the statute of limitations going back six years, thus, it ramps up the damages. Thats number one. Number two, whats really crazy is that trump they dont have to prove fraud, intent to defraud be to basically get a guilty plea out of this. Thats big. Thats key. If you dont have to prove intent, it makes the prosecutors case a lot easier. Liz what about the experiences what people had here . Put trumps statement on the line, because hes going to vigorously liz is this his lawyers . His lawyers. Donald needs we should have his say up there, because this is really important. Particularly as i describe some of it. Basically, theyre saying theyre going to fight this thing to the end. There theoretically could be depositions during the president ial election. I think thatll wait until next year but, clearly, if donald trump wins the white house, this case is going to be playing out, and hes going to be deposed. Here are some of the cases. People have said, and there are at least two private litigations on this. People have said they paid 15, 20, 30,000 for courses that were not, were not taught by Real Estate Professionals despite the fact that they were told they were taught by real estate liz well, who were they taught by . Lets just say nonReal Estate Professionals. [laughter] you know, you could go back liz not donald trump. Were they promised that they would have classes with donald trump . No, they were never promised donald, but they were promised donald would hand pick the professors, and apparently he did not hand pick the professors. And we should point out this notion of a university. In new york state to be a university, you have to file with the state. They never did that. So we should point out that a court has said, therefore, youre operating illegally as a university. Um, i think, you know, listen, Hillary Clintons got a lot plenty of legal issues shes facing as well right now. You would think theyd cancel each other out. But thisll be an ongoing cause during the election. Its unclear if the email scandal will be an ongoing case. For all i know, jim comeys not going to recommend charges. Liz can you imagine if you had two front runners or two nominees both of whom have a massive cloud over their head that involves legal issues . Right. We should point out this is a civil case. Hillary liz yes. Which is not criminal. Hillarys would be a criminal case, Hillary Clintons. You know, listen, yeah, were in another dimension here. I mean, listen, ive covered this stuff a long time. I dont remember candidates running for office that are under this sort of cloud of investigations from not just listen, bill clinton gave depositions, and he might have lied under oath. He was impeached. But you remember, he wasnt running i dont know that he was running while all that stuff was going on. This is pretty interesting stuff. Liz well, it continues. And weve got a major market move here, charlie, up 313 points. A good first day of march. I was just talking to to one of your guests, and im sure hell be on and arrest this as well and say this as well, whats prompting this . Well, a lot of hedge funds caught short as the markets pop, as oil prices rose, and now their covering their short positions. Those are bets that the markets going to go down. Liz we look at oil right now, oil is the highest since january 28th, and youve got you know jen corp. s ceo, hes saying that commodities have hit the bottom. Okay. So that takes the market up. When you a short seller youre a short seller, you borrow shares from someone, you sell it. Just so the average viewer knows what a short sale is. You hope the shears go down so when you have to pay back the borrow, you pay back at a low price, and you make the difference. Now you think your bet is wrong, its going up, you have to buy. So youre being into an updraft liz right. And you push the markets higher. A Short Covering pushes the market higher. Liz gasparino university. You know . Consumer Construction Spending came in really good for january with a nice revision for december. Liz okay . Go ahead. So now we had this nice pop today. Were trying to hang onto 1971. That would be a nice confirmation for this market if we get it, and id like to see us between 7179 going out. Liz 1971, a good start of the disco era, right . [laughter] there is a lot of dancing going around in the markets at the moment, but let us look at some of the leaders on the s p, and maybe we can just cycle through these. As you look at what is, apparently, a broadbased rally except for utilities, risk on, right . And that seems to be the sentiment. Yeah, sure. I mean, right. You said utilities are down, gold is down, the vix down, treasuries are down. So the safety dance well go to the 80s. [laughter] liz i remember that song too. Yes, of course. Men without hats. Financials now, lets take a look at financials. Theyre the strongest sector, right . Theyre popping. We saw cpi, core cpi strong last week, core cpe strong last week. What does that tell you . The fed, which is controlled by the banks liz right. Are probably going to raise rates again sometime this spring. Liz although bill dudley of the new york fed, and hes always a voter, said today in china he sees risk and a tilt to the downside. Thats what he said. These are names like coach and tiffany and michael kors where you spend when you have extra money, correct . So doesnt that depend on a great economy . We only have 1 growth right now. Well, depending on three things; confidence, lower gas prices which sub 1. 50 gas around the country is meaningful, but then also with respect to whats going on with the economy continues to recover, and i think nobodys positioned accordingly for that. Remember, we have some great Consumer Companies like amazon, media stocks, we think are very, very attractive. Liz we have to talk about apple. This stock, would you argue it has a bit of a dark shadow over it, considering what is going on right now . I dont know if we dip in show you video on capitol hill. But apple is going to vehemently say it must not be forced to write code that would open up the iphone. Does it affect the stock . From sentimentwise, it probably does, liz but from a fundamental perspective has more cash than many countries. They continue to appropriate that cash and this is blemish. Liz we havent seen too many people jump on ban using iphones, boycott there, right . Who among us from the iphone 7 comes out wont be first in line . Exactly. Liz looking ahead we see march can be a you tough month. It can be a tough month. Remember january was horrible month. One of the worst januaries in history of the stock market. Liz shocked a lot of people. Fourth quarter of 2015 when we typically see strong gains in the Fourth Quarter was pretty weak. I think seasonality factor could be waned a little bit, liz. Meaning it will be pushed out. I worry about summer months we head into some of the conventions and a lot nor messier news on the election front.
