Is this talk or are lawmakers serious about getting work done. If they can do this, what does it mean for tax reform . Were on it. First back to our top story, President Trump tweeting on friday, quote, i am being investigated for firing the fbi director by the man who told me to fire the fbi director, witchhunt. His lawyer doubling down today saying that the president is not under investigation. Watch him here. Have you been he notified of an investigation . The answer as i said yesterday is no. The situation on friday that created the press coverage over the weekend was in response to a Washington Post story that had five Anonymous Sources. So in one sense, could you imagine if the president didnt have the opportunity to respond . He should have have the opportunity to respond of course. Trish joining me right now fox news anchor and former defense attorney gregg jarrett. Gregg, the president tweeted out im being investigated for, and then his attorney is saying no, he is not being investigated for anything. What is it . Well i think it is reasonable of the president was reacting to this huge Washington Post story in which they had alleged based on five sources i believe, anonymously, that he was being investigated for obstruction of justice. Then there was media hysteria over the whole thing for several days. The president was just reracketting to those allegations. I dont think anybody knows except Robert Mueller and rod rosenstein, the acting attorney general on the matter whether he is being investigated for obstruction. Maybe he is, maybe he isnt. Tris wou at some point it would get back to trump . No, it would not, unless you receive a target letter. It is questionable whether you can charge a president while in office. The law on that is rather ambiguous. Trish it is possible they could be digging around, not tell him about it . Could be. Trish so it is unclear what is going on . You do have all the sources telling the Washington Post one thing, we should keep if mind, important thing to address with you as well, you have sources deep within the government that have no interest in seeing this president succeed and want to do everything they can to make sure he is investigated in their view. Look, the Washington Post and cnn both got big stories completely wrong. Then it turned out it was proven so. So you cant always rely on the media to get it right. Nobodys perfect, but when you go with Anonymous Sources really not identified in any way, that raises a big red flag in my mind. So, im not sure we even know whether it has gone to obstruction. I dont think there is a case for obstruction if you look at statute. It cant possibly be. Trish certainly what we saw from comey, did not seem to indicate any way there was a case for obstruction. I would just go back to this simple thing. What i dont understand, if james comey believes the president of the United States was standing in the way of an investigation, trying to obstruct justice, didnt he have a duty to do something about it . Shouldnt he have raised his hand, hey, instead of waiting to get fired, raising red flag. It is if you fail to report it to your superiors, department of justice for comey, youre creating a miss prison of felony. That is a crime. It tends to suggest to me comey really knew that the words of the president didnt rise to the level, specific intent of obstruction, bear in mind the president vigorously denies he ever had that particular conversation with james comey. That he did not tell him, i hope you can see your way to letting flynn go. Trish let me ask but the tapes. There has been a lot of questions whether or not there are any tapes. Of course you will recall trump tweeting out essentially there were. Sure. Trish we heard from james comey, he said in his testimony hoped there were, because gosh darn it, he wanted people to hear it. Were supposed to get clarity were told by trumps attorneys on that this week. Do you think there are tapes . I doubt it. I think the president was using a little hyperbole, a hypothetical to kind of taunt comey. Look if youre the president , and you fool like comey just lied about a central issue in a conversation he had with the president at the white house, you know, you would probably be angry enough to say, youre such a liar you better hope there arent any tapes of that conversation. Doesnt mean there are any tapes. You know, i think the president was maybe playing around with comey to see how he might react. Trish well he certainly reacted shall we say. We obviously got to fix this. We made the promise. People in arizona are really hurting. More than maybe any other state . Terms of those on the exchange. Just completely unaffordable. And tax reform this year . Tax reform this year. Thats the biggie. I do think we will get tax reform this year. We have to. Democrats are plotting ways to slow down the Senate Action to pros it what they say is a closeddoor process. Democrats are upset that the gop replacement bill is being drafted by 13 republican senators and wont allow democrats to participate. Several Top Democrats sent a letter this morning to gop leaders writing, quote, the American Health care act would fundamentally redefine health care in our country. To draft it behind closed doors and pass it without even one hear something nothing short of legislative malpractice and a repudiation of all what the Senate Stands for. According to senior democratic aide, democrats in the senate will slow the process down by debating health care on the floor late into the evening in a series of speeches, by beginning to object to unanimous consent requests. And by objecting to force a housepassed Health Care Bill to committee. Meanwhile republican sources on capitol hill today, theyre expressing confidence the bill would be put forward next week. Their plan though must meet strict requirements of reconciliation, which means it cant bust the budget. As a result, it is likely not all of the 21 taxes imposed by obamacare will be removed. Most likely to stay, 0. 9 medicare payroll tax and 3. 8 surtax on investment income, both imposed on wealthy taxpayers. Trish, even if Senate Republicans are successful getting the bill out to vote, they face an uphill battle getting it passed. The gop majority in the senate is razor thin at 5248. Trish. I think words im looking for are sense of urgency. I have not seen that sense of urgency up until now. The threat of having to stay through the sumter get it done is beginnings of seeing paul ryan and Mitch Mcconnell finally understand if they dont get something done here they will not be leading either one of the chambers in about one year. So if this does get done, does it then pave the way for other stuff . That is one of the critical components to it all, right . I know youre very much for tax reform and you want to see that happen, but, we kept, we have been told over and over again, you need the tax savings from repeal and replace in order to get any kind of meaningful tax reform through. Right. This is tricky stuff. Let me just begin to say, that they have really dug a hole for themselves because i think, trish, the source of the problem is they got the sequencing wrong. They should have started with something they could have built momentum around like infrastructure, got some consensus from schumer and some democrats. Trish even though it meant spending money. Absolutely. This is washington, we have 20 trillion in deficit. Now is not the time to become worried about spending money, right . Trish im always worried about what were spending. I dont like the idea we have 20 trillion in debt. I dont know what kind of hangover were leaving for our kids al. I know you want to get things done. My question would be better if we work on these simultaneously, because it is sticks and carrots and carrots in this case are infrastructure and get folks like pelosi and Chuck Schumer on board for that, you give us this we give you that . I would run health care and infrastructure in parallel. I think there is a deal somewhere. The democrats do not want obamacare to collapse. President trump should have waited for it to collapse. There is deal with Infrastructure Spending and health care they could get done. Both sides declare some sort of victory. You leave the big fight for tax cuts. Trish they doesnt do it, right . But theyre hope is people are getting fed up with donald trump and getting fed up with republicans. I think it is a pretty big hope though. Walk us through what you anticipate happening and, you know, if they dont win this one, because, i dont know theyre going to despite millions of dollars they spent, what signal does that send back to the democrats. My colleague, i agree with her, if democrats dont win, it will be pretty expensive loss quite frankly because i mean, money on both sides is coming in from all ovethcountry. If i were e republicans would be more concned e fact ossoff raised about 20 million on his own from small donations. That is always important. It doesnt mean youre going to win. But heres the deal, every race is different. The fact that the democrats are even in play here is incredible but theyre are no emotional victories in regard to the midterms and litmus test media and money has made this. So, the strategy here is that Donald Trumps core supporters are going to vote republican. The challenge for the democrat is, those electorate base, moderate republicans part of that 30 of approval or the 60 disapprove donald trump is doing, are they going to be that disappointed in donald trump, that embarrassed to go with a democrat this time . If so trish i will be completely objective here. I think he still has a base is, is out there for him, and will show up. That said, when you look at some of the early voting, gina, which typically tends to favor the left, early voting is off the charts. Theyre seeing a lot of people have come through. That is something that could work in the lefts camp but, you know, i would be awfully surprised here if she doesnt actually take it . Yeah. And i think that the voters dont like this idea that outside money and in this particular case, were talking about 97 of the money can buy their vote. I think that, i think that voters have continually sent a message back to washington, d. C. , that they want to handle their own elections and their own, you know, they want their own representation in washington, d. C. They dont want to be bought. And so i think a lot of times when we see this disproportionate spending on part of democrats to try to buy a seat the voters push back. That is not true, trish. Republicans and superpac are literally dumping money into trish everybody is spending a lot of money. Talk about why that is. Scott, theyre spending money, the left is spending money there, they need this, they want this. They want to get people excited again. This is what they have lost, right, excitement . This is is being largest embarassment for the republicans since donald trump was elected. You know the first ones not being able to Pass Health Care and passing it on two or three efforts. Trish wow.
