Garrett tenney digging into some very Interesting Data for us tonight. Good evening. To speak of the coronavirus may not be as deadly as researchers and officials initially believed. Thats according to new projections from the cdc. The agencys new best estimate is that covid19 kills less than. 3 of americans who are infected. Under that scenario, which assumes no additional measures are contained for the spread of the virus, roughly 4 million patients will be hospitalized and 500,000 would die over the course of the pandemic, those figures are far below many of the earlier estimates that came out as the nation started to shut down. Including one from researchers at Imperial College back in february who projected the coronavirus would be ten times deadlier than the seasonal flu, killing 2. 2 million americans in a worstcase scenario. A month later, dr. Anthony found she made that same claim. Speak of the seasonal flu that we deal with every year has a mortality of 0. 1 . If you count all of the cases of minimally symptomatic or asymptomatic infection, that probably brings the mortality rate down to somewhere around 1 , which means it is ten times more lethal than the seasonal flu. We go one big reason for the change in projections is the massive increase in testing revealing a much higher percentage of americans who had the virus without any symptoms. But a number of researchers are skeptical of the cdcs new more optimistic figures and expressing concerns that the agency is responding to pressure from the white house to paint a rosier picture. Carl bergstrom, biologist at the university of washington tweeted these numbers are so far out of the Scientific Consensus that this strikes me as a effort to manipulate, not only federal modeling, but the broader scientific discourse. The cdc did note that they could change as researchers found out more about the coronavirus and added that the pandemic is the lightly worse disease than the numbers show, because many deaths are never confirmed as covid19. And they say that there appears to be no statistical connection between the economic pain of the nationwide shutdowns and the number of covid19 cases or fatalities. Let that sink in for a moment, given that we were told that we have to lockdown america to flatten the curve and save lives. What are you seeing as you sort of assess the steps that we take and how this is playing out in the impact, not just on physical health, but Economic Health as well. I think it fits together with what was just reported, so much more symptomatic spread, by the time the country was locked down, there were already hundreds of thousands of cases around that we did not know about. And why that is significant is because lockdowns really work best when you see something coming, when you are ahead of it. Like australia walking down the whole continent. New zealand, same thing, keep in the case numbers very, very low. What we did is we essentially closed the barn door after the horse was already out, so then we saw a lot of community spread. If you compare, compare south dakota to montana for example, montana has been lockdown for almost two months. South dakota, not at all. 50 deaths in south dakota, 16 in montana, very comparable, actually, except that montana has a lot more calls to suicide hotlines. A lot more people depressed and anxious. Businesses are closed, they are open in south dakota. So israel just came out of a locked down, shannon, and you know what they found . The numbers did not go up, 1020 cases per day despite the fact they have been out of the lockdown for weeks. So i think the lockdown as he pointed to has a very, very big impact on Mental Health, on physical health, on other physical problems petrine beside covid19. And as long as we can maintain social distancing, its key that we come out of the lockdown in many areas. Shannon it is interesting of the very lengthy report in the New York Times breaking down which parts of the country were affected and how. Very interesting, and says the coronavirus is deadly and thats where democrats live. They are more likely to live in counties where the virus has rabid the community, where republicans are likely to live in communities unscathed by the illness, but they are paying the economic price. And richard, it is an interesting conversation throughout the article about whether this is driving the political split on reopening are not reopening, because the urban concentrated areas are more democratic and those are the ones that are hit hardest. Its no question that states like new york and new jersey have been hit the hardest, but heres what we know. We know that there are porous borders, so when new york reopens and they can travel to other parts of the country, the disease can spread as dr. Siegel pointed out so widely, we were behind the eight ball, the horse was out when we close the barn. Thats not a critique on the white house, but this is a lesson we should learn and we hear and they predict a second wave in the fall, will we be prepared and will there be enough testing . Will there be enough solutions, kits, will we have enough tracers so if somebody tests positive we can find out who they have come in contact with . Thats more important than anything else. I want the economy open like the next person, but i dont want 100,000 more americans to die in the process. Shannon the week before we reported the Washington Post found that there were several states where there was so much testing and not enough people showing up at the governors were frustrated and begging people to go get tested, because the testing kits were outpacing the people. Doctor, very quickly, what are the odds are of a second spike or something new that is relative to what we have seen in the fall . I will answer them in a second. I would say that testing is key and we need more testing of antibodies to see who has a then who is over it and can return back to work, in terms of the fall, right now we dont know. I am concerned about brazil. Im keeping my eye in brazil, shannon, because they are going out of control and im glad that we are starting to cut off travel to brazil right now back from brazil, thats where the second wave may come from as south america. It is their fault, and they are having cases. We have to watch out carefully. Not a guarantee that there will be a second wave, but we have to keep a lookout. Shannon lets catch people up if they checked out over the holiday weekend, judge sullivan said get rid of the case, his head, no, i will get some outside briefing and let people tell me whether we should get rid of it or not. Then Sidney Powell went to the d. C. Circuit above judge sullivan and fired the risk saying that he has to act, but now the d. C. Circuit has ordered judge sullivan to answer within a matter of days of why he is not getting rid of the case or what his explanation is, how do you see this going down . I think the problem that judge sullivan has is the same problem a lot of people analyzing this have, which is that the political dimension of it has in some ways i think paralyze peoples way to look at what is very a simple legal equation. Only the Justice Department, only the prosecution, which is an executive function in our system has the power to commence a prosecution or to continue it, to sustain it. A judge has no power to force the government either to bring charges or to continue charges. There is a rule of criminal procedure that says when the government wants to dismiss charges in the middle of a case it has to have the leave of the court to do that. Constitutionally that is a dubious provision, but at most what it means is the court has to protect the Due Process Rights of the defendant so that if the Justice Department is trying to dismiss a case in a way that games the system, that tries to deplete the resolve of the defendant to be able to fight the charges by dismissing and reindicting at a later time when it is more judicious, the judge is supposed to stop that. They have no right to continue a case where the judge thinks the defendant is guilty. Thats not part of the equation. Shannon that gets to the case coming up which is from the circuit from 2016. And it is the executive charging authority and bracing decisions about whether to initiate charges or prosecute, which charges to bring on whether to dismiss them once brought, it has long been settled that the judiciary who lacks authority. The secondguess of determination, much less to impose the charging preferences. So basically it sounds like that decision could be interpreted to say judge sullivan does not have the power to do what he is doing, how do you read that decision . Thats exactly right. Its very straightforward. And he does not have the power. And i think that they gave him an opportunity to fix it on his own. And they said, look, you have ten days, here is the case that is right on point, and that was an opportunity for him to stand in. I still hope that he takes it. And i would point out that sometimes the system works the other way too. There are situations where when the government or the prosecutor gets to the end of a jury trial, you present your whole case and do you think you have a very strong case, and the judge can dismiss the case, and basically say that the defendant is acquitted because the judge has decided that the evidence is the solution, as a prosecutor you may think that that is an outrageous decision in the public may think that it is outrageous decision. The judge has the discretion to do it and it is not reviewable. It is mostly a great system that is the envy of the world, and sometimes people to make decisions in their discretion that people absolutely disagree with. It does not change the rules or the outcome, and hear the judge has to defer to the Justice Departments decision to dismiss the case. Shannon well, for now, the general flynn case continues. We will see how much longer that goes on with the higher court now ordering judge sullivan to explain what the heck is going on.
