FOXNEWSW The Daily Briefing With Dana Perino February 16, 2018 19:00:00
Packed hour. It was like a scene straight out of the americans on fx. Thanks for joining outnumbered overtime. Have a great weekend. Come join me and my friend david at 4 p. M. On fox business. Heres dana perino. Dana fox news alert. The
Department Of Justice
announcing just a short time ago a series of indictments against russian nationals accused of interfering in u. S. Elections. Hello, everyone. Im dana perino and this is the daily briefing. A federal grand jury delivering those indictments all charged with conspiracy to defraud the
United States
. Tin tkaoeugtment alleges that the russian conspirators wanted to promote discord in the
United States
and under mind
Public Confidence
in democracy. We must not allow them to succeed. The
Department Of Justice
will continue to work cooperatively with other
Law Enforcement
and intelligence agencies and with congress to defend our nation against similar current and future efforts. Dana chief intelligence correspondent
Catherine Herridge
is live at the
Justice Department
. You were called to that executive floor. There was not a lot of notice to get this information. What do you make of it . Reporter we received a call about 45 minutes before that
News Conference
that the
Deputy Attorney
general
Rod Rosenstein
would be speaking to reporters with some major developments. Now we know 13 individuals who are now being indicted along with three russian entities for interfering in
American Election
s. The indictment puts flesh on the bone, a lot of detail to what the
Intelligence Community
had already concluded, that russias goal was to intershow and show discord in the 2016 elections. What the indictment tells us, it began back in 2014 and ramped up in 2016 with the taking of 80 employees targeting specifically the president ial election. And they used ways to hide their identity from the american citizens and they even bought server space in the
United States
so their communications were traced, it would not lead back to russia. Heres the
Deputy Attorney
general from the last hour. Using stolen or fictitious american identities,
Fraudulent Bank
accounts and false identification documents. The defendants posed as politically and socially active americans advocating for and against particular candidates. Reporter the
Deputy Attorney
general
Rod Rosenstein
also told reporters that this interference was part of a bigger project the
Russians Code
named project latka. They also targeted other countries in their elections. We know this was also the case with the french and german elections. Dana mr. Rosenstein went on to talk about the americans and the
Trump Campaign
in particular and what did they know, whether they were dealing with russians able to go speak to prosecutors, discussion information, but this is kind of information off the books, if you will, for any prosecution. My information isnt quite what the other reporting is at this time. Dana maybe well have more on that by the end of the hour possibly w the way news is breaking today. Thank you. Reporter youre welcome. Dana we now bring in a former
Justice Department
official who served under both bush and obama administrations. Take me through what happened today. How unusual is it for a
Deputy Attorney
general in the middle of an investigation like this to publicly come out and do a
Press Conference Ability Indictments
. Well, im not sure its that unusual. Each of these indictments is in a separate silo. Manafort and gates is one chapter. What happened with the 13 russians and three entities today looks like an entirely distinct chapter. Pretty different chapter in a bigger book about russian activity. Dana what happens in russia today . Obviously these are people not in the
United States
. What sort of impact does it have . Would the
Justice Department
ever hope to have these russians extradited to the
United States
for prosecution . Yeah. Thats kind of the sad post script already. This indictment is dated today. That tells me that since it
Wasnt Under Seal
for a period of time, there was really no serious effort or belief that they were going to take any of these people into custody. So they unsealed this indictment today knowing that theres 13 people probably sitting pretty in
Saint Petersburg
russia that will not face extradition. Dana i was following some of the hot takes right after the press conference, or even during, with people from the far right and the far left saying this means trump should be really worried, and it also means that trump should think that this is over and theres nothing more to see here. Where do you see it . In between. The good news for trump is an indictment that goes out of its way to say
Trump Campaign
officials to the extent they were contacted, were unwitnessing. Thats an intentional placement to say they were not colluding. To act like that ends all the russia probe is a bit premature. Theres no way of knowing whether there are other cases to follow. At least todays news is not necessarily bad for
President Trump
. It looks more like the russians were kind of equal opportunity disrupters. Dana there was reporting this morning that mike flynn, who has plead guilty, is possibly being encouraged to change that plea and withdraw it based on something that a judge said this week. Can you explain that . Well, mike flynn is in a difficult spot because even if hes thinking about withdrawing his guilty plea, its not as simple as notifying the court. It is an uphill struggle for a defendant to convince a court after having plead guilty that there should be some reconsideration of that. Hes been cooperating in the probe. That much is very clear. So this would be a real abrupt about face. Its not by any means automatic if you pursue it. In fact, most of the time its almost an automatic no to withdrawing the plea. Dana
Andrew Mccarthy
wrote today that it appears sullivans order supercedes the
Plea Agreement
and imposes on the
Special Counsel
to reveal any and all evidence that flynn is innocent to the charge which he admitted guilt. Is he right on that . Hes right, but incomplete. Hes very knowledgeable, says good things about the criminal justice system. The reality is, judge sullivan, at least since the stevens case, where
Senator Stevens
indictment and conviction were overturned has had a
Standing Discovery Order
that he imposes on the parties. Our firm has a case with this where the prosecution is obliged to turn over information. That shouldnt be anything new to most prosecutors. If theres evidence of innocence, they have to turn it over. Dana we have other probes going on on the hill. Investigations, oversight investigations. Then you have the mueller probe. One of the things im wondering, as we saw yesterday. Steve bannon was on capitol hill testifying, or sort of refusing to answer some of their questions. We also know he spent some time with bob mueller this week. We know
Jared Kushner
has been asked to look at his
Financial Disclosure
again. I want to get you to explain to us one more time, why does that activity continue if
Rod Rosenstein
comes to the podium and talking about these indictments and says pretty clearly that if there was any connection, it was unwitting or that there was nothing that was there was no collusion, basically, is what he said. Right. It goes back to the very broad auspices of the independent counsel in this case. Muellers probe was not given a whole lot of obvious limits. It was kind of all things russia. The fact they indict today for
Noncollusion Russian
based
Activity Doesen
mean that theres not another indictment in the works or more things to be checked off before they decline to indict. Its too hard to know where the model is between rosenstein and mueller. Dana youre our favorite trusty lawyer. James trusty, thanks for being with us. Thanks. Good to see you. Dana white house responding to 13 russian nationals accused of meddling in the u. S. Elections. See me. Clear skin can last. Dont hold back. Ask your dermatologist if cosentyx can help you find clear skin that lasts. Dana fox news alert. We have learned
President Trump
has been briefed on the bob mueller investigation, including three russian entities and 13 russians for meddling in the 2016 election. Doug, what is the white house reaction to the indictment . Reporter weve heard nothing from the white house today as of yet. We do expect to hear something. Theyve indicated they will have a
Paper Statement
perhaps later in the afternoon. There may be a chance we hear from the president. He is expected to depart for mar alago. Weve all become familiar with his
Press Conferences
there. Perhaps he will step before the cameras. What the white houses take on this at this point is anybodys guess. Some say it is potentially damaging to the white house. Others say that its just the opposite. You point to some of the components of the indictment. One which has some defendants posing as u. S. Persons without revealing russian sources communicated with unwitting individuals with the
Trump Campaign
, meaning theres no evidence of collusion. I know youve been delving into that today. Others were asking what was putins motivation in trying to wreak havoc in the
American Election
system . And if you look at this in a historical context, dana, under a former iteration the soviets were very much involved in
American Election
s going back to the 1920s and 30s when there was a strong
Communist Party
in the
United States
of america. They were very much involved in the
Antiwar Movement
during the 1960s and 70s. Some soviet backed groups, protest movement during that era in this country. Under the putin regime, there is special impetus to be involved in trying to wreak havoc in
American Election
s. Going back to a front line special on pbs, they did a really excellent piece on this. Ill quote from some of their reporting that
Vladamir Putin
clashed with then secretary of
Hillary Clinton
in 2011 over her condemnation of russian parliamentary elections. More than 100,000 russians had taken to the streets demanding putins ouster after
Cell Phone Video
surfaced showing alleged stuffing of ballot boxes and
Campaign Officials
filling out those boxes in comments that spread across the internet, clinton weighed in saying we do have serious concerns about the conduct of the election. The russian people deserve the right to have their voices heard and their votes counted. Mr. Putin apparently took that as some sort of signal to protest groups to interfere with russian elections. He sought revenge. So we are now seeing russian involvement in
American Election
s. What the extent of this involvement is, i think all americans should take heart in realizing we have an incredibly diversified election system. No one precinct, no one county, no one state is connected to the other. I suspect there will be calls to go back to
Paper Ballots
for the midterm elections. Dana this has been a very busy and desperately sad week. Amazing how much news can fit into one week. The president is expected to head to mar a lago this afternoon . Reporter yes, he is, leaving at 3 00 p. M. If all sticks to schedule. The white house tweeted he will be going to the high school at some point in the coming days. Theyve been very nonspecific about when that will happen. The president did tweet, quoting it from, i will be leaving to meet with some of the bravest people on earth, people whose lives have been totally shattered. Im also working with congress on many fronts. So, that could potentially mean hes going to be meeting with the
High School People
today or perhaps over the weekend. As you know, dana, lot of logistical things to work out. Dana indeed. He will be an important comforter to them when he gets there. Thank you very much, doug. My pleasure. Dana indictments of russian nationals for interfering in our elections. Plus dreamers. What happens to them now after several bills go down in defeat in the senate . An update on the
Florida Massacre
as we learned about warning the fbi received about nikolas cruz just weeks before the

. I know when i hand them the keys to their first car its gonna be scary. But i also know that were gonna have usaa insurance for both my boys. has released a plea deal. He was paid 1,000 for doing so. We dont have any information about who he is and also who 1,000 does not seem like a lot. Theres probably more to that story. Its been a great infrastructure week. This has been the best infrastructure week ever. Dana do they think they are in the clear. Who was the fellow who just entered a plea . Stupid political discourse, how easy it was we remember the stupidity of the time. Russians were laughing at us because they exploiting our innocence about social media to make it worse. To make us dumber. Theyve been laughing at us. Now we are kicking them right in the teeth. Dana now we can laugh at them. Now its our turn. Theyre out of the olympics. In syria, we know whats going on there. And weve got new sanction movement. But also this. Whats worse than a sanction . Theres a billionaire, friend of putin. Senate Majority leader and president both told republican senators which
Immigration Package to vote for, one that would give dreamers a path to citizenship while also pumping billions into border security,
Limit Chain Migration and end the visa lottery program, it fell far short of the 60 votes needed to pass. Now
President Trump this morning said this, quote. Cannot believe how badly
Daca Recipients have been treated by the democrats. Totally abandoned. Republicans are still working hard. But the democratic whip dick durbin is fighting back now. He says this. Quote. Democrats made enormous concessions in order to reach not one but six bipartisan agreements to pass the overwhelmingly popular dream act in exchange for a dismally unpopular border wall. The president and his enablers in congress rejecting them all. Never once budging from their own partisan plan. Now, the deadline that
President Trump originally set to fix the obama era daca program which he believes is unconstitutional has been march 5th all along, since last year. Tpha may not be the day
Deportation Proceedings begin for people brought here illegally for children because of recent
Court Rulings where they said the president cant stop daca. Now people are wondering whether they want talks on immigration to stretch into the campaign seaso season. They dont want to solve it. Democrats, republicans. They want to keep it alive because they it this appeases their base and extreme politics. Reporter since the senate struck out with the president s preferred plan and a bipartisan plan the house will take a crack at fixing immigration. The plan most discussed over there is authored by the republican congressman bob\rgoodlap. Very similar to the senate bill the president likes. It does not include a path way to citizenship for dreamers. Dana. Dana all right peter, thank you. And were back now with chris stirewalt. Im going to read you wall street journal editorial page. Saying
President Trump may need a
Refresher Course in deal making after the senate. He could start by recalling whos president and stop giving adviser
Steven Miller a policy veto. Whatever happened to the art of the deal. If there trump isnt happy with everything in the
Collins Brown bill, why not engage and negotiate . Lets not talk about the policy implication. Im curious about the politics. You had yesterday senator cruz trying to get to the right of
President Trump on immigration. You had
Bernie Sanders willing to come and vote for funding for a wall if you could get to the dreamers. Basically it looks like its not going to go anywhere. With all deference to the\rwall street journal page, i cannot imagine a more destructive thing that donald trump could do is land in the middle of these negotiations. You are watching these negotiation take place. s bill failed. Compromised bill in the senate failed. It is up to the lower house, which didnt want to go first. Welsh house republicans, its up to you. The problem that the goodlap bill has is that its not that it doesnt have a path way to citizenship. Its only a three year extension. It had lots of curves. It had lots of curves on legal immigration. It is a big bet. Im not sure they will have enough republicans. But if they do, it will be close and they have to pass a bill. Theyve got to get it out of the house and try to put some pressure on the senate. Now it is over to them. Dana before i let you go, there were two announcements that mitt romney was going to run and ken kramer is going to\rrun. The
Senatorial Committee feeling good about holding both of those thoughts. Your thoughts . Im just happy that i get to see willard again. It pleases me. Willard. Dana well keep that in mind. But north dakota, do you think thats in play for the republicans . This is a big get. Of course, the better numbers that weve been talking about the republicans probably convinced kramer hey might as well get in this race, check it out. He runs state wide so his

What stood out . First thing is the indictment is within the core of
Robert Muellers mandate, which is to investigate russian interference in the 2016 election. As you know, theres a secondary purpose to the mandate and that is whether or not there was collusion with the
Trump Campaign. The indictment prominently, in a word, indicates that at least so far as we know and what is being disclosed through a grand jury indictment, the
Trump Campaign was unwitting in that process. Then the third part of the mandate deals with
Something Like obstruction of justice, false statements, perjury. Weve seen the manifestation in that with regard to things previously like the guilty plea by michael flynn. So i guess what sticks out is that this is front and center of the mandate that bob mueller was appointed to investigate. That is effort, sophisticated efforts apparently, by russian individuals and entities in a very coordinated way, including financing, things familiar for people in the trade very similar to cyberterrorism. Dana right. Those kinds of things. Thats an enormous under taking by them and, frankly, today, through charges among other things of conspiracy, meaning conspiracy against the interest of the
United States. That obviously is very serious. Dana rosenstein used the word warfare against. Yes. Dana when he says unwitting individuals associated with the
Trump Campaign, theres no crime in being unwitting . No. That means absence of knowledge. That had to be the subject of discussion in bob muellers office, both by investigators, agents, prosecutoprosecutor, in\rbob mueller himself. Dana theres the question about what happens next. We would make an
Extradition Appeal to russia . Theoretically that might happen as you know, however, any
Extradition Treaty typically provides the host country is not obligated to deliver up its own national. The assumption of these people are russian citizens, i would not expect the russian government would deliver up and hand over these people assuming theyre residing in russia to the
United States for prosecution. I mean, it does have, i guess, some
Material Effect that
Search Warrants were issued. If they would travel outside russia, they would be subject to be picked up. Dana no more trips to the south of france. It will be a damper on their ability to move around the rest of the world. Dana if i could ask you what i asked james trusty at the beginning of the show. If it was unwitting yes. Dana does this end today . Is this over for the
Trump Campaign and any of the officials involved . I think its particularly good news. It doesnt mean that word is not subject to change. At least on the
Available Evidence at this point in the investigation, i think the white house should breathe a sigh of relief, meaning that the secondary aspect of the mandate has not been proven. In other words, theres no evidence yet that has been developed. This indictment would seem to be consistent with that, that would inkate there was collusion by the
Trump Campaign in russian efforts to interfere and effect the 2016 election. Dana thank you for being here. Thank you for having me. Dana

Told my teacher i thought it was a shooting. I went outside. The police cleared for us to go outside. I started texting family, i love you. You never know if you will get shot or killed right then. Dana many students who\rescaped with their lives were left traumatized by an event thats far too common. Want to know how they can be helped. What do you think kids need right now if they were there . How do you help them get through this horrific incident. Dana, right now what these kids need, they need a safe place to cry, to express their emotions, to express how sad they are, to show they are upset. They need to release those emotions in a healthy environment and know they are in a safe environment. Thats the first thing they need. Then i expect to see increase in the amount of post
Traumatic Stress disorder, anxiety, depression,
Sleep Disturbances will happen. So we need to be prepared. Parents need to be aware. Teacher, adults and care givers need to be aware and look for science and symptoms of suicidal thoughts, irritation, frustrations. Try to help these children, these young teenagers know and understand that theyre safe, that theyre loved and encourage\rthem to express their emotions which can help them get through this horrific episode. Dana you have suggestions how parents can talk to their kids. One is to help kids express emotion through conversation or activity. I wanted to ask you more about that. Is it good for them to repeat the story . So if the child or the teen wants to discuss it, absolutely, allow them to express what they have on their mind. Let them talk about it. In addition to this conversation, other activities. Writing, engaging in activities with their friends, attending support groups. Very very important. One thing is important to know is make sure you do not force your child to talk about it. If they dont want to talk about it, dont force them to. Let them have their alone time. Never let them feel abandoned. Dont keep them in isolation. If they want to speak to it. Most kids want to talk about it. Important to realize not to\rforce them. Dana this is what the sheriff said yesterday at one of his
Press Conferences. Give police the power. If they see something on social media, if they see graphic pictures of rifles and blood and gore and guns and bombs, if they see something horrific language, if they see a person talking about, i want to grow up to be a serial killer, we need to have the power to take that person and bring them before

Mental Health in a young person . Mental health,
Mental Illness is so common. Almost 20 of americans have a
Mental Illness. Many people have it and theyre undiagnosed. Its not difficult to diagnose. The difficult part is getting them the treatment. Flu activity is still widespread in every u. S. State with the exceptions of hawaii and oregon. But there may be some good news. The percentage of people going to doctors with flulike illness is actually down slightly from the previous week. Heres what that may mean. Its the first week we have not had any increases in influ went sa activity. That may indicate the season is peaking. We dont know exactly yet. We do know seasons have lasted as long as 20 weeks. Were at week 12 now, so theres still a fair amount of
Influenza Disease for the next eight weeks or so. Because of the time frame, officials are asking people to get a flu shot. It is only 25 effective against the dominant h3n2 strain overall. However, when you look at children alone, the vaccine is much more effective, reducing their chances of getting sick by 51 . Vaccine offers better protection against other strains that are increasing in circulation. So in the remaining weeks of this flu season, doctors are saying go out and get that flu\rshot if you havent already, dana. Dana thats right. Its not too late. Jonathan, thank you.
