FOXNEWSW The Daily Briefing With Dana Perino July 28, 2020

They are mothers, veterans, and veterans federal courts are under attack. Since when is it okay to burn down a federal court . Is that okay now . No, the u. S. Marshals have a duty to stop that and defend the courthouse, and thats what we are doing in portland. We are at the courthouse, defending the courthouse. We are not out looking for trouble. Dana and we have Fox Team Coverage for you. William la jeunesse is standing by in portland where he has been with federal agents. Lets go to the white house, chief correspondent john roberts. He is live on the north lawn. John, as we wait for this hearing to get underway again, with the big take away from the White House Point of view . I think you see the attorney general out there who was fiercely defending the use of these federal troops in portland. Not troops, but federal Law Enforcement officers and agencies. We understand from reporting from the Washington Post that the u. S. Marshals service will likely be sending about 100 more deputies into portland to augment the 114 who are already there. Its possible, we dont know yet i dont know that the decision has been made that more customs and Border Protection agents will be going out there, as well. I think the white house is very happy with the way that the attorney generals defending the federal response, saying, look, its all about the federal courthouse there in portland. If we were to take down the fence and vacate the area, its likely that courthouse wouldnt last very long. The attorney general also being asked about roger stone, and the president s commutation of that sentence. As well, the general flynn case. We do know that the u. S. Attorney for st. Louis district has been looking into the flynn case and was the one that recommended the Justice Department dropped the charges against flynn. Listen to this back and forth between doug collins, representative of georgia, and the attorney general. Do you believe that there is a brady violation there in this case . No, there wasnt a brady violation they are, i think what the counsel concluded was that the only purpose of the interview, the only purpose, was to try to catch him in saying something that they could then say was a lie. So come entrapment . Therefore, the interview was untethered to any legitimate investigation. Speak all right, dana, the hearing will begin again. Lets toss it back to you. Dana john roberts, thank you. Lets get back to this hearing. We will listen as bill barr resumes his testimony. The 2016 president ial election, in sweeping and systematic fashion, to benefit donald trump. Mr. Mueller promptly sent you a letter calling you out for your mischaracterization, and you never corrected it. He then delayed the release of the full report, leaving the American Peoples doing with your misleading summary in support of President Trumps bogus claim that there was no collusion, no obstruction. You repeat these claims today. That there was no basis for this investigation and it was politically motivated, by calling it the russiagate scandal. In december 2019, the Justice Departments Inspector General, you are department, found that the investigation had been initiated properly and without putting up eyeless. Isnt that correct . No. That was not mr. Horowitzs finding . No, he said you are wrong, mr. Attorney general. He found the investigation had been initiated properly he said im reclaiming my time without political bias. Reclaiming my time, mr. Attorney general. In april of this year, the Republicanled Senate Intelligence Committee unanimously found that russia interfered with our elections, and attempted to undermine american democracy. Correct . I said so, too. Is it ever appropriate, sir, for the president to elicit or expect assistance in election . It depends what kind of assistance. Is it ever appropriate for the president or president ial candidate to accept or solicit foreign assistance of any kind in his or her election . No, its not appropriate. Speak okay, sorry you had to struggle with that one, mr. Attorney general. Lets go to the First Amendment. Americans all across this country have been exercising their First Amendment rights to peacefully protest Police Brutality against black people. I have read your statement, i listened to you this morning, and im aware of certain individuals who engage in violent acts. We all agree thats wrong. But there was a lot missing from your statement. For example, as im sure youve also seen, the vast majority of protesters are peaceful. Despite that, and identified federal agents have attended to prevent these mothers, veterans, and peaceful americans from exercising their First Amendment rights, even using unmarked vehicles to grab protesters off the street and using tear gas and munitions against them. You forcefully condemned protesters this morning, but let me ask you, sir, why have you not condemned the federal officers you are sending it to cities without proper training or attempting to take away the Constitutional Rights of americans peacefully protesting . I havent condemned protesters. Protesters are good. Demonstrations are good. They are part of the First Amendment. What im condemning is people who commit crimes. We agree. Do you think its every appropriate, mr. Barr, for officers to use force against Peaceful Protesters . Yes or no . Not against Peaceful Protesters. You also dont mention in your statement today, or your testimony, the federal officers have even teargas elected represented is. A county commissioner confirmed last don ike first hand, last night i was teargas. I saw them throw canisters of poison without warning into a nonviolent crowd, including elders and the vulnerable. On july 23rd, the mayor, ted wheeler, was teargas. He called the tactics of the officers of the orient. These were elected representatives with grave concerns that officers are using abhorrent tactics including tear gassinnonviolent elderly americ. You think its ever appropriate to use teargas on Peaceful Protesters . The problem is these things sometimes occur because its hard to separate people my question is very specific. Do you think it is ever appropriate to use teargas on Peaceful Protesters . Yes or no . It is appropriate to use teargas when it is indicated to disperse on Peaceful Protesters . Unlawful assembly, unfortunately Peaceful Protesters are affected. I will show you visio tell my video evidence, as well. I will ask you to look at this video. This is a video that is capturing the nations attention this weekend. That was of christopher david, a navy veteran, being beaten and tear gassed by the officers. Do you think that was appropriate . I didnt see him teargas to. There seems to be gas in the area. I dont know what kind of gas it was and i dont know whether it was directed at him. Do you think it was appropriate, mr. Barr . Do you think he deserved to get pepper sprayed and beaten to the point of broken bones . The Inspector General is going to review the incident. As the top lawenforcement official in our country, do you believe americans who show up to peacefully protest should expect to be beaten and pepper sprayed and have their bones broken by federal officers . I dont think it was happening immediately around the courthouse was a peaceful protest. Thats not my question, mr. Barr. Thats where that my question was reclaiming my time, mr. Barr, my question is if you think, as the top Law Enforcement official in this country, that americans who show up to peacefully protest should expect to be beaten, pepper spray, and have their bones broken by federal officials. Yes or no . I dont think Peaceful Protesters should face that. Thats correct. Isnt protecting the First Amendment freedoms of americans at least as important as protecting a building from vandalism . We have fought for democracy for the right to speak freely, and you are attempting to take that away. Whats worse, you are doing it for the sole purpose of furthering the president s political agenda and generating footage for Trump Campaign commercials. The Justice Department is responsible for protecting the Constitutional Rights of americans, not just serve as the president s personal bully or political director. Speaking of protesters, it is worth he room bring every suffragette, every abolitionist, was a protester. Protesters arent chaos, they are deeply american examples of values. The desire for this country to be at its best self. They are righteous, sometimes necessary. One of americas most beloved protesters, john lewis, lies in state a thousand feet from here in a deserved place of honor. Sarah, your failure to respect the role of peaceful protest in this country is a disgrace, its unamerican, and its important to remember what these protests are about. Black lives matter. Abuse of the hands of police by black americans i want to let you see now a video that represents Peaceful Protesters happening all across america from that you conveniently omitted from your testimony and your statement. There was a nine minute video shown by the other side, so its only part of it. ]crowd chanting] all [crowd chanting] mr. Chairman, just real quick, i dont think we have ever had a hearing where the witness wasnt allowed to respond to points made, questions asked, and attacks made not just in this hearing on this committee, but every committee ive been on. Particularly when you think about the fact that weve got the attorney general of the United States here. The gentleman does not have the time. I dont want the time, i want the attorney general to be able to have enough time to respond to accusations and questions asked to him, and you guys not cut him off. What you want is irrelevant. Its irrelevant to the rules. You are recognized. Mr. Chairman, am i going to get an additional two and a half minutes that mr. Cicilline had . The gentleman is recognized. General barr, thank you for your service to our country and your continued service to make sure our country safe. I encourage you to ignore the mob. These attacks from democrats in the leftwing bias mainstream media. Be strong and courageous, for the vast majority of the country supports you and supports you rooting out corruption and the fbi, and keeping our country safe from rioters, looters, and anarchists. I, for one, and very happy you are at the helm of the doj and supporting the rule of law and fighting for justice. I want to touch on something that mr. Jordan spoke about in his opening remarks. I want the focus on the Inspector Generals december 9th report on the fbis unlawful surveillance of Trump Campaign associateassociate carter page. Is it true they found the fbi under the Obama Biden Administration made 17 significant errors in fisa applications to surveilled candidate Trumps Campaign associate, carter page . I think thats right. How many errors are acceptable in the fbi is targeting americans . None are acceptable. There is the complete failure of the fbi operated under during the obamabiden administration. The Inspector General found that 51 assertions in the phis application to surveilled page lack supporting documentation, the supporting document did not support the fbis factual assertions, or three, the document showed it was inaccurate. The Inspector General testified there should not have even been one error, yet he found 51 errors. Why is it so important for surveillance targeting americans to be proof . Especially under fisa, which is a counterintelligence tool, and doesnt have the same builtin protections that the criminal justice process would have. Its very important, because youre going to be spying on americans therefore, there is a special burden on the investigative agency. In this case, the fbi, to have Accurate Information as to the basis of their surveillance. I think the bureau has been working very hard to correct those problems and to put in place a much more effective system of guaranteeing that the information is accurate. Isnt it true the fbi, under the obamabiden demonstration, ignored facts that cut against probable cause . I dont want to characterize it, this is part of what is under review. Some exculpatory information was not passed along to the court, lets put it that way. I will yield the remainder of my time to mr. Jordan. I thank the gentleman for yielding. Mr. Attorney general, do you deploy federal Law Enforcement to enforce federal law . Yes. Do you deploy federal Law Enforcement to protect federal property . With the Federal Building in portland be standing today if you had not deployed federal Law Enforcement . I dont think so. There had been multiple attempts to set it on fire. I have to say, i dont understand why a small contingent of marshals inside the court poses a threat to anyones First Amendment rights. They set up a fence on federal property, i am told, around the court. When people are arrested, it is because they are trying to come into the fence. These are not Peaceful Protesters. They bring power tools to cut through the wire, and so forth, to get in. This is a very strange occupation, when you have 100, 120 federal people behind the fence trying to protect the building, and all these people are trying to cut their way in. That is the occupation of the city. Thank you. Did the chicago fraternal order of Police President ask for your help . Did who ask for your help . The head of the fraternal order of police in chicago. Did they ask for your help . I think they did. Previous exchange, they talked about mr. Horowitzs report. Is there anything youd like to add . You didnt get a chance to respond to that. My understanding of my recollection of the report is that it didnt find there was no bias. He made that clear it, in subsequent testimony. What he said was he couldnt find any documentary or other evidence demonstrating bias. It would be helpful if maybe mr. Horowitz could come in front of this committee, the individual who is raising their concern with you, could ask himself about what he found in that report and subsequent reports that we have not yet had a hearing on. Speak of the gentlemans time has expired. Mr. Raskin . Thank you. Sarah, did i hear you correctly to say that the purpose of unleashing this federal agent assault with tear gas and rubber bullets and pepper spray on 2,00 nonviolent protesters in Lafayette Square was to secure and defend the st. Johns Episcopal Church . Is that the purpose of it . I didnt say that. I made very clear that the purpose was to move the perimeter to i street, which, as far as im aware, have been all day. It was legitimate and that im talking about june 1st. The june 1st assault including my constituents, and we can bring them to your office to talk about it. I dont think it was an assault. They will told by loudspeaker that the park police were prepared to clear the street. I think you said something to the effect of the st. Johns Episcopal Church would have been overrun that was on sunday night. Are you aware director of the church, the episcopal archbishop of washington the presiding bishop of the Episcopal Church nationally come along with a Catholic Bishop of the archdiocese of washington, all denounced the Police Assault on the civil rights and Civil Liberties of the people . Did they do that before or after the fire was put out . All that i know is that they denounced what you did. If you read with the archbishop of washington wrote, he said that using police force to clear nonviolent protesters without notice in order to conduct this grotesque photo opportunity was antithetical to the principles of christianity. What i want to ask you about was covid19. We now lead the world in covid19 case count and death count. President trump, of course, promised the disease would magically disappear. He advertised quack medical cures like injecting people with disinfectant. He told his people to slow down all the testing and refuse to wear a mask. Last night he tweeted a number of messages that dr. Fauci misled the American People by dismissing hydroxychloroquine as a cure for the disease. Now we have 150,000 dead americans, 4 million infected, 40 million jobless. We lose more than 1,000 people every day, one american every 90 seconds. But you called his Public Health leadership superb you through the weight of the Justice Department behind his campaign to shut down state Public Health orders in march and april. If you look at the screen, you will see two tweets from the president of the U
