First, tell us about your personal experience january 6 when you spoke obviously before the crowds arrived occupied the capital. Where did you write out . Thanks for having me. It was an unbelievable day. I remember working at my desk on my remarks because i was planning to oppose the effort to deny the electoral states of pennsylvania certainly had perhaps one of the state. While i was going through drafts of my remarks in between drafts, i have the president rally on tv. I was increasingly horrified at the things he was saying but never imagined wed end up where we were. Then an hour, couple hours later, there we are on the senate floor and we are processing the objection to the arizona electorate. I gave my talk about why i thought this was a bad idea. Then i think it was while senator James Lankford was speaking that things started to get a little strange. We saw secret service come in and whisk mike pence out of the presiding officers chair but at first, that didnt strike me as alarming because we expected he might not want to preside over the entire debate so i kind of expected at some time hed duck out and Chuck Grassley would, senator grassley from iowa would take his place and thats what happened initially but started to become clear that something wasnt right. Somewhere along this, i think it might have been, i think it was before senator langford began to speak, senator romney saw on his iphone that protesters have gotten into the capital but that was all. I could have met two guys in the capital, we didnt immediately understand that was a significant threat. Paul amazing experience. Just addressing the president s objections, do think the pennsylvania election was settled fair and square. Whats your case . Pat where to begin . This has been evaluated many different ways. Most important, my courts, courts i have confidence in and i think we should all. The middle district of pennsylvania senator heard the campaigns case and threw them out for complete lack of evidence. One of the problems is the Campaign Officials go on tv and make all kinds of shocking allegations of fraud. Then they go to a courtroom where there are consequences for lying to a judge. They dont make those allegations anymore. Its because they have no evidence to back this up. One of the many tragedies of this is that people have been told lies, things that are not true about these elections. Theyve been examined, good decent people did their job. The campaign had a chance to go to court. By the way, after the conservative republican in the District Court said theres no evidence, they appealed to the Circuit Court of appeals and drew a threejudge panel which was three republicans including one appointed by donald trump and they completely agreed with the trial court judge. These charges have been adjudicated, litigated and found completely lacking in evidence. Paul where you, what you make now, obviously we have had the fallout from this and now there are calls in the senate and house by democrats to remove the president immediately 11 days to pat i dont know the answer, i have to say i do think the president s behavior this week doesnt disqualify him from serving but weve got ten days, 11 days left. Hes not going to be serving after that time. Well have a new president. I dont know whether logistically it even possible or practical and im not sure its desirable to attempt to force him out a day or two or three prior to the date on which he will be finished anyway. Im not clear thats the best path forward. Paul i guess if the house pushes for Impeachment Vote this coming week, that puts the ball in the senate hands and if the democrats force a vote because theyll be in control, i assume, then you have to vote, correct . Pat what i dont know is what kind of procedural opportunities we are required to give the president of the defense for instance. As you recall, he had a whole team of lawyers who came in during the last impeachment and they had a whole case to make. Are we required to do that . Is that something we did in the last time but not required . Theres not a lot of precedent for this. Some of the procedural things, i dont know the answer because weve never been here before. I do think the president committed an Impeachable Offenses but i dont know whats going to land on the senate floor, is anything. Dan i think hes got a significant legacy in terms of the economy, what happened in the middle east, something president s have been trying for a generation. I think what happened this week will overwhelm much of that is the opposition to try to shape no difference between Donald Trumps personality persona, these events and the substance of his politics. Having said that, i do think it will make it very difficult to have a large presence in the country going forward. I do not think he could win another president ial election will get more than 50 of the vote. Having said that, arguably what he did was an Impeachable Offense but i would emphasize arguably, he raised the question of whether its a good idea to do that at this time but the house is proceeding and the question is, is even President Trump going to get due process from the house or, as some of the reporting suggested, they would technically just rush through. As the smell of a political lynching, lynch mob rather than impeachment process. Paul kyle, seems to be two questions. Where they Impeachable Offenses . Is it good for the country to impeach at this late stage . What you think . Kyle i think senator toomey is right, theres reporting now that because of the senate rule, they may not be able to start the impeachment trial until the day before inauguration. I think its a question of whether its worth doing if you do it the day before Joe Biden Takes Office or even after but as far as impeachable question goes, id throw in that President Trump tried to engineer a constitutional crisis to retain power by pressuring mike pence to essentially unilaterally reverse the electoral college. Paul kim, i think thats an important part, it wasnt just that he said all right, lets march on the capital and what happened, happened. It that he said mike pence, lets measure mike pence to return the votes. I think by the way, the Vice President comes out as a real hero in all of this for standing up to the president and representing his constitutional duty. Kim i agree in terms of mike pences conduct. I would just say in terms of this question of pressuring him, there is actually out there, it is unclear what the boundaries are in terms of the Vice President , its not been tested in court. I think that gets to the bigger part, i believe about impeachment is that it should be held out in the rarest of occasions and circumstances where the high crime and misdemeanor is absolutely clear. It is such a drastic. Thats why we have a trial so both sides can argue their side. Im not quite sure can hold out any of this evidence beyond a doubt and thats especially adding growing gasoline on fire in terms of the anger it would provoke across the country. The fact that it may not get done in time, we got how many days left . It just doesnt make any sense whatsoever. Paul dan, the case for impeachment is less about resident trump himself, in my mind. I guess the counterargument would be, how much damage are we willing to allow the political system to endure right now . Is country is in heat emotionally over this. If Something Like the 25th amendment were invoked to remove trump from office, many of his voters would think that was effectively a coup. You have the country in a state of mind where virtually half of them are trying to simply dismiss those constitutional arguments and go into the mongers. We dont need more gasoline thrown on the fire right now. Donald trump is leaving, i think hes going to form a political exile in this country. I think your part about the constitution, the message has been sent, this is a line that cannot be crossed. Paul kyle, i think that is a good part. Now we are told big tech is saying nope, unless you center it exactly the same way twitter does and the same way facebook does, then we will disable your app and destroy your business which has already happened. So i think it brings interesting questions about these platforms and the incredible role they now play in public broadcasting in getting information out which challenges these longstanding questions about their private ownership. Paul kyle, the Business Model is to be twitter. Thats what they say, how they attract customers to the site. It not allowed to be not twitter, assault on it Business Model. I wonder if there is not an antitrust issue here from the view of what apple is doing and i know the private companies can do what they want in regards to free speech but does this trouble you at all . Kyle well, i think there is a troubling part particularly with the Trump Twitter then. I think its a little harder because some of the comments under is pretty bad. Kyle i understand but i can understand why apple would not want that in its app store. The app store is a place where kids are going and downloading games. Its important to say if you have an apple phone, you can go to the website on the apple phone, they are not blocking that. Were just not going to allow that in our app store. And what happens if a big chunk of the public arbitrarily 50 , disagrees with the band and wants to express itself in find they cant do that on these major forms, what happens to the voices . I suspect they dont go away, they go underground or other nastier sites and maybe they end up in the streets, protesting because they dont feel they have any other platform. Dan i agree with that. I think it makes complete sense. The question is, why cant the Tech Companies themselves, or even the American Press sees the logic of where this is all going and rather than trying to continue to suppress these voices, give them some space to express themselves. They just took the gasoline and increased it and response ability and now we turn around and discover they will ban donald trump, people like him and try to ban sites like parlor that are set up as alternative to the status quo. Not going to hold up, it cannot stand. Paul kim, briefly, how much of this timing is of this related, not just to wednesday in the event of wednesday but democrats will soon be running all of washington, this is an attempt to appease them. Kim that is exactly what is inspiring this, i think. All the Tech Companies suddenly no they do not fear resulting senate were a trump justice department. Moreover, they think it might be to their benefit to make these moves against conservatives in a way to suck up to the new Democratic People running the shots in washington and maybe protect themselves a bit from future legislation. Pat i totally disagree with that but for as long as i have paid any attention all most of my adult life, democrats have promised more money and handouts and were hogans have said no. Republicans with the chair of elections especially in a place like georgia. The idea that we should send 2000 checks to people who have had no lost income, people who have sixfigure incomes and 2000 for every Family Member<\/a> so could be of over 10000 people who have sixfigure income, i think most voters understand thats ridiculous. You can make a case for concentrating benefits for people who are in bad circumstances and we have a lot of that in america but that idea of these universal 2000 checks was always a bad idea but i dont believe for a minute it costs us those two bases. Paul youre going to be in the minority with the democrat running the chair it Mitch Mcconnell<\/a> going to continue, does he have support to be minority leader . Pat i think so. I think Mitch Mcconnell<\/a> has been handling some very difficult circumstances as well as anybody could. Im not aware of anybody who will attempt to challenge his leadership. I think hes done a good job. Paul that includes the handling of this last week particular Donald Trumps<\/a> challenge in the election . Pat i think generally, yes. All things considered, he was dealt a really bad hand. I think he handled it pretty well. He knew it was a very bad idea to go down this road of rejecting electors that state duly authorized and he made the case for why we shouldnt go down that road but he doesnt control individual senators so they did what they did but not Mitch Mcconnell<\/a>s fault. Paul you think some of them were senators responsible for some of the, some of what happened this week with essentially, as you said, telling americans that somehow they have been cheated out of this election . Pat look, i think there is a lot of soulsearching that will have to happen people have perpetuated the big lie that donald trump won in a landslide its been stolen from him, thats not true. We know thats not true there are compoundings of dishonesty is like propagating the idea that somehow wednesdays proceedings could result in different outcome and therefore, it was reasonable to pressure lawmakers to do this, that was never possible. To willfully mislead people about that, that is a real problem. Pat something i am worried about because as you correctly say, most legislation requires 60 votes in most will get 60 votes for bad policies but there are categories of legislation that dont require those foods.
