Bart management began negotiating with two unions representing about 2,500 people april 1st. Workers went on strike for 8. 5 days in early july and Governor Brown had a 60 day cooling off period that expired last thursday. Then there was a 72 hour strike notice issued. You go in and talk about how rational the total decision will be with these components and then you start to process them. I am hoping everybody buys in the the thought. How do you knockout the irrational. The last time you went in to settle a bart strike they were screaming about everything, from the pay raise, to whether or not bart should pay for raincoats for people that work outside as as opposed to people that work inside. Phil, what you really have to could is go in with a sense of humor, period. You also go in with your own reputation on the line. You go in with your relationship with the riding public and that you sell more than anything else and you get rid of the debris quickly. Okay. How much do you have to so, you are basically i would say at this point turning to bart and saying come up with one or two more percent on your offer and they are telling the unions knock off some of your requests and get real. Is that it . You dont say it exactly that way. If you say get real, you may insult somebody. Most people think their recommendation is the best of everything. You have to be very careful, very clever, very political and very sensitive. Egos become almost a component of the ultimate settlement. Do deadlines help or hurt . Well, deadlines help because people cant seem to quit until there is a deadline because they just want to keep the fight going. Absolutely. It takes on a life of its own. You cant give in. Right. And i always find it interesting, you know they are heading for the big sell when the talk goes from the deal to we will just have to avoid a strike. When that becomes more important than anything else. And that becomes important only because the public has said no strike. So, how do you go in and say you will make it good with bart to cover this increase . Well, you can go and address things like the training program, the safety program, the Inspection Program there are a number of thing that is you can do with state dollars that you cant do other places, freeing up local dollars. Here is one thing we can both know that will definitely happen. No matter how this turns out you will be right back here in four years. Possibly. However, if quality leadership is out there, phil, they will start the process of establishing guidelines for a conclusion long before the critical strike day. It is so frustrating for the people caught in the middle. Hundreds of thousands of people. Right. And this is also the time where they Start Playing the shell game. We want to settle this so there isnt a strike, isnt a strike, and you start hearing this back and forth about the actual deal. That is because what they start doing is saying all right, we will give you a raise maybe on your 3 or 4. What they tell the public is one thing and the union is another. They start moving things around in a complicated way, which already covering this deal is tough, right . Yes. Last week there is a situation where bart made a deal and the unions were about to agree to it, then suddenly there was a miscommunication. Or they say they will give them a 10 raise but use 7 of that to pay into their pensions. They will be paying into their pensions. It goes around and around in the idea of somebody saving face and trying to get the deal done. Either that or we wind up with another strike. And it affects so many daily lives.
