At the San Francisco zoo, sergio quintana, abc 7 news. 49ers defensive lineman ray mcdonald will not face Domestic Violence charges. Thats the decision by the Santa Clara CountyDistrict Attorneys office. Prosecutors say theres insufficient evidence to charge him. The d. A. s office says mcdonalds fiance struck him first during an argument at his home and he then tried to restrain her. The minor injuries are consistent with restraint and a struggle. How much force was used during that struggle, thats something that were not going to know. Because we didnt have the photos from 48 hours later. Or her cooperation beyond that. Hes played all season despite outside pressure on the 49ers to bench him. Coach jim harbaugh says he wanted to let due process play out before making a decision about mcdonalds future with the team. These are peoples lavz lives. Let the facts and information lead to the decisions that we would make as an organization and then ultimately the authorities would make. And they had a process. Mcdonald responded to todays decision with a written statement. I am relieved that the d. A. s office has rightfully decided not to file charges. I want to thank everyone who was supportive during this difficult time. Abc 7 news report er Leanne Melendez is in the newsroom. Reporter we would expect organization thats deal with Domestic Violence to react to the news and they have. But this was such a highprofile case that many city officials and others were criticizing the 49ers for keeping mcdonald on the field. And today everyone agrees the case has played itself out, and now its time to move on. Ray mcdonald had been celebrating his 30th birthday at his home with teammates and friends. Sometime around 2 00 in the Morning Police received a 911 call from his fiance. In that 911 call she was asked if ray mcdonald hit her. And she was very clear that she said hes trying to throw me out of the house. She never used the word choking, grabbing, punching, anything of that nature. Reporter when police arrived, mcdonalds fiance admitted she had struck him first. Police also noticed she had several visible bruises. But following that initial contact, the fiance, known only as jane doe, refused to cooperate with investigators and the d. A. s office. Without any eyewitnesses or statement and without photos, the d. A. s office says it did not have enough to charge mcdonald. Organizations against Domestic Violence are outraged. There has to be a lesson here for him. No doubt, he will go out and do it again. I mean, thats the nature of batterers. And theres no accountability for him. Reporter many had asked that mcdonald be put on leave while the investigation continued. But like the 49ers, San Francisco mayor ed lee said mcdonald deserves the right to due process. It was strange not to have a charge right away after the police made the report. Reporter in september the board of supervisors unanimously called for the 49ers to keep mcdonald from playing until the outcome of the investigation. It was a nonbinding proposal. Today the supervisor behind that effort said its time to move on. I think for me personally as a lifelong 49ers fan, im definitely pretty disappointed in the leadership. Reporter meanwhile, the nfl has come under fire for the way it handled several it has handled several recent Domestic Violence cases.
