Its sprinkling for now much to the relief of drivers, many who are just getting off of work right now. If you take a look, you can see just how wet the roads are. The gray skies are certainly a reality. As we take a look at some video, this was the scene not too long ago in downtown san jose. A very wet afternoon. We typically see more people walking the streets but that definitely wasnt the case earlier today. In terms of those we did see outside, some of them were smart enough to bring their jackets. Others werent as lucky as they got rained on without an umbrella to protect them from the elements. Theres no question we need the rain because of the drought but today the weather really affected downtown businesses especially local restaurants and bars that are used to seeing a late lunch crowd. Some are wondering what it will be like tonight. Its going to be bad for bar business. Were not going to have a lot of people here im sure tonight. But students im sure are bummed because if theyre done with finals, they want to go out and its raining. Reporter and shes talking about the students at san jose state university, who are wrapping up the school year. Now, these guys came downtown to visit the brand new gamer lounge on santa clara street right next to the farmers union, but they came a little early and unprepared for what Mother Nature had to offer. All of them trying to stay out of the rain and trying to keep warm. Back here live were taking a quick look on west julian street on the approach to highway 87. The body of 17yearold max bush was found just before noon around jesse bethel high school. The shooting was not on campus but the victim was a student there. His parents say he was a good kid that would have turned 18 in july. This is the worst day in our life. Its a nightmare in the daytime you hope that youll wake up from but you wont. Never. Max is a good kid. He got robbed of his life. Robbed of his life. No details have been released about the suspect or a possible motive. Both the high school and nearby elementary were locked down as a precaution as police searched for the shooter. Livermore police have arrested a man they say opened fire on an officer early this morning. 25yearold Miguel Alvarez was taken into custody this afternoon after a 12hour search. Just before 1 00 this morning officers were responding to a report of shots fired at chestnut and north l streets. North i street, i should say. When officers approached alvarez, they say he fired on them several times. Fortunately, nobody was hurt. San jose police have a 16yearold in custody in connection with a brazen home burglary in the citys evergreen neighborhood. Surveillance video caught two people armed with knives breaking into this house on friday. The family inside ran to the master bathroom and called police. A 17yearold turned himself in yesterday. We are learning more tonight about that deadly amtrak crash in philadelphia. The death toll stands at eight now after another body was found in the wreckage today. One of those victims has ties to the bay area. Abid gilani used to live in walnut creek and work for wells fargo. The engineer brandon bostian, who had previously been a contract engineer for caltrain, has just agreed to talk to the ntsb investigators. Today the ntsb said video shows the train suddenly accelerated right before the derailment. Mere seconds into the turn we could see the train tilting approximately 10 degrees to the right and then the recording went blank. Two of the most heavily damaged cars are still on the scene. You know, you do so many of these stories and quite often neighbors have really nice things to say but in this case abid gilani was so loved by his friends and former neighbors here in walnut creek he leaves behind a wife and two grown children and of course a community that admired him. Abid gilani always called the bay area his home. He and his wife still owned this house in walnut creek hoping to come back some day. The family who now rents the home are here because the gilanis helped them refugees from there kosovo, move to the u. S. We lived in this house since 2008. He was a really good person. Not just for us for whole community. He was helping kids. When id see him out doing yard work or hed go for a run, you know he was always good morning, hows it going. How are the kids . Reporter his kids attended northgate high in walnut creek. Some of my friends called me yesterday. Since then it has been shock. Reporter dalal has known the family for 15 years. Shes a close friend. They did dinners every month in oakland for the homeless. Richmond richmond, too many people. Reporter gilani worked in San Francisco until 2008. He and his family then moved back east where he worked for the hotel giant Marriott International and most recently wells fargo. He and his mother, who lives in toronto, had attended Funeral Services for an uncle in virginia. Gilani was returning home to his wife. He was a kind family man. A cruise ship that docked in San Francisco got a complete scrubdown today after dozens of passengers got sick during a 14day voyage. Abc news was on the embarcadero as passengers disembarked. 135 passengers and 16 crew got sick with norovirus a few days into the cruise. The ship eliminated buffet eating to prevent further cup tam nation. The state Senate Passed legislation that mandates vaccinations for all schoolchildren. It removes a longstanding exemption that allows parents to opt out of immunizations. That could face a tough fight in the assembly. Laura anthony joins us from sacramento tonight with more. Laura. Reporter hi, cheryl. Well, it looked for a time a few weeks ago that this bill might stall in a senate committee, but today the full Senate Passed it. A win for sure for supporters, but total victory is still a ways off. This bill is essentially about answering the call of parents and i believe the silent majority who supports vaccines. Reporter supporters say its about protecting a Larger Community from a potentially deadly disease, but opponents of sb277 claim its about much more than that and cuts into the very foundation of american society. It seems to me to be unconstitutional to deny a child the right to an education. Reporter the bill does support education for unvaccinated students, but they must use independent study or be home schooled. Ayes 25 nos 10. That measure passes. Reporter it wasnt even close as the California Senate voted 25ten to pass a controversial vaccine bill that now moves on to the state assembly. It will halt the continuing spread and rise growth in numbers of unvaccinated children and people in their communities. Reporter senate bill 277 would eliminate both the personal belief and religious vaccine exemptions for all california schoolchildren, as they have throughout the process, parents who opposed to sb277 showed up in red and vowing not to give up the fight to keep the bill from becoming law. When they start taking away informed consent from a parent, i mean thats tyranny. Reporter sb277 grew occupy a Measles Outbreak in california earlier this year. Now, this vaccination bill gaines steam following a Measles Outbreak traced to disneyland back in december as youll recall. Since then there have been 136 confirmed measles cases reported among california residents. At least 57 of those cases were people who were not vaccinated not protected. Governor brown unveiled a record 115 billion budget proposal. Its 7 billion bigger than the plan he released in january and thats thanks to surging revenues. There are several big winners. State schools oversee 68 billion. 3,000 per student more than four years ago. The plan would freeze instate undergraduate tuition at the university of california for two years and it would establish a new state tax credit for up to 2 million californians. The plan now goes before the state legislature. The labor unrest between the Oakland Unified School district and its teachers may be coming to an end finally. The district announced today that its reached a tentative agreement on a new contract with union leaders. There are no details so far. The district says some points are still being worked out. Union Officials Say oakland teachers have only received a 3. 25 wage increase since 200 throw. They had been asking for a 14 to 17 raise over the next three years. Patriots Quarterback Tom Brady is appealing his fourgame suspension for his role in the nfl scandal over improperly inflated footballs. The appeal was filed this afternoon just ahead of todays deadline. The san mateo native is accused of using deflated footballs during the afc championship game. An nfl investigation found brady was at least generally aware of plans to prepare game balls to his liking below the leaguemandated minimum. Bradys appeal will be heard within ten days. A bay area landlord and his family dont feel safe in their own home because of the man who lives downstairs. There are smartphones, smart tvs, even smart watches. And now there are smart appliances. Consumer reports says some of them could put your privacy at risk. Brewing coffee from bed adjusting the temperature on your slow cooker from anywhere. These are just some of the things you can do with connected devices and an app on your smartphone or tablet. Randy shire uses her wifi connected baby monitor to keep an eye on her son when shes home and even when shes not. If i leave him with a babysitter, i like to know whats going on. Reporter the Consumer Reports says wifi monitors and other cameras are at risk for being hacked or viewed by strangers on the internet. Recently Consumer Reports found a website thats dedicated to streaming cameras that arent password protected. An unprotected camera is worse than no camera at all. You need to protect it with a password and that goes for any device out there that collects personal information about you. Reporter there are many connected devices that collect your personal information and send it over the internet. Coffee makers and crock pots know your brewing and cooking habits. Activity trackers know how much your move and could even know your location using gps. And Smart Thermostats know when youre home and when youre not. Some of this may not see troubling, but a burglar armed with that information could know when you leave the house. While theres no evidence criminals are using this kind of data yet Consumer Reports says you can reduce the amount of your information thats collected. If you dont plan on using the connected features on a product, buy the nonconnected version or just dont set it up on your wifi network. Remember, if its not hooked up to a network, its not sending your information out to the internet. Reporter Consumer Reports says you should turn off connected devices when youre not using them because if theyre not live, then youre not sending your data to the internet. Good to know. Thats right, we have to track this storm. This spring storm a pretty good one here in the bay area. Believe it or not some spots like San Francisco average about 0. 7 of an inch around this time of year. Not exactly our wettest month but take a look at live doppler 7 hd. It has been a very wet day for some parts of the bay area. Radar is still tracking some moisture as you take a look on the peninsula here. Down to street level east palo alto, University Avenue were getting light to moderate returns. On the peninsula and out towards the east bay as well from newark, thornton avenue, fremont, fremont boulevard seeing moderate returns as well. Lighter showers down in the south bay around san jose and up to the north watching some spotty showers developing around the napa area. In the sierra nevada, we have been seeing snow but it hasnt been at lake level, its been really high snow levels. As you can see here just a few light returns. Watching this lake tahoe cam and just a short time ago watching raindrops mixing in with snowflakes, you can see maybe a few flakes, but this is up above 8,000 feet. Look how brown it is. I mean its just really depressing there. Temperatures 60 degrees in San Francisco right now mid60s around oakland, 50s for san jose morgan hill. Heres a live picture from our mt.
