The question has been whether to enforce or suspend President TrumpS Immigration ban, and thats what the ninth Circuit Court of appeals right here across the street will be deciding. On friday when james robart, a federal judge in seattle, issued a broad order blocking key parts of President TrumpS Immigration order, he set into motion a chain of judicial decisions for the ninth Circuit Court of appeals in San Francisco. And right now the state of washington has made a pretty good showing of inrep rabble harm. Reporter he says the Trump Administration is facing an uphill battle to convince the judges they should allow the travel ban to continue. On saturday the ninth circuit judges, who are in San Francisco, phoenix and honolulu, denied the Trump Administrations original request to vacate the stay. The Trump Administrations final appeal was released right at todays 3 00 p. M. Deadline. Theyre saying trust us. Congress gave us the power. No court can review it, end of story. Reporter steve mayer is a constitutional attorney in San Francisco and says the Trump Administration argues that Congress Gave them the power to exclude people from the u. S. In the interest of national interest, but he says the constitution provides a counter argument. I mean no congress could give the President Authority to violate the constitution. So the issue there is can a court look behind the plain language of the order and say even though it doesnt single out muslims, it is a muslim ban and, therefore, violates the establishment clause. Nearly 100 Tech Companies filed a court brief claiming the ban would hurt their business and is unconstitutional. Abc 7 News Reporter david louie has more. Reporter its a virtual whos who of hightech giants that signed this brief, arguing that the president S Immigration order hurts them. They get top talent of engineering students who come to the u. S. For advanced degrees. Theyre being funneled into the m. I. T. S, the harvards, the stanfords, the berkeleys, the engineering schools. A sheriffs deputy is now back to work following the offduty shooting death of a man. The Sheriffs Office revealed the deputys identity. Hes vetter lee and was fired last year. Alameda police say lee was off duty when he shot a man during a Home Invasion robbery at the deputys home last wednesday. The coroner today identified the man who was shot as 19yearold Marques Warren of vallejo. The trial began today for a former Police Officer facing a number of charges in connection with the sex scandal that rocked several Law Enforcement agencies. Former livermore Police Officer daniel black is accused of participating in prostitution, lewd conduct and providing alcohol to a minor. Those charged involve a young woman named jasmine who said black is just one of the many officers she had sex with when she was underage. A richmond Police Officer will keep his job despite involvement in this case. Reporter well, chief brown tells abc 7 news that the department has taken these allegations very seriously from the beginning. Today abc 7 news also sat down with the city manager who explained why he recently changed his mind about one of the officers who will now keep his job. Richmond Police Department investigated 11 officers in connection with jasmine, who said she had sex with more than 30 officers around the bay area, some while she was under age. For the first time richmonds police chief is speaking about the departments investigation. We got wind of stuff and we started digging right away. Reporter investigators examined thousands of text messages, phone records and social media pages in addition to the girls testimony. And if a member is doing something they shouldnt be doing, then we want to find out about it so we can step in and correct it. Reporter in september chief brown recommended one officer be terminated. The following month city manager bill lindsay overrode that recommendation and called for a total of four officers to be terminated. The officers were entitled to hearings. Recently richmonds fire chief, adrian sheppard, the hearing officer, recommended two of the four officers retain their jobs, lindsay partially agreed. In one case there were some compelling reasons why i could do Something Different and in another case i didnt find those reasons to be compelling. Reporter the attorney for the officer who will now keep his job tells abc 7 news that officer received a onemonth unpaid suspension instead. In essence the process worked the way it should work. Reporter kens dad started the business in 1988, but it looks like it might be going under. The hat guys just received an eviction notice because theyre several months behind on the rent. He tells us the long slide into financial problems has been partly due to years of protests. From occupy to the recent womens march. I totally agree with protests and everything, but they didnt they dont realize what they have been doing to these little businesses down here whenever they do it, because they block the streets and everything. In oakland, carolyn tyler, abc 7 news. Senior citizens and businesses displaced by a fire last friday in San Francisco could be back in their building faster than expected. The fire started in the basement of the twostory building on stockton street damaging several businesses and apartments for 19 low i income seniors. Fire inspectors say the building wont have to be demolished, only repaired. We also learned today that the academy of art has agreed to supply residents with temporary homes. We now have 15 rooms for the midterm to take care of these folks. The units are very close to the community. All of these folks will be able to stay together, so weve got good news. Local leaders say the response to help the victims of the fire has been overwhelming and highlights the spirit of generosity in San Francisco. We have some breaking news now out of hayward. No trains moving through it because police are investigating a suspicious package there. Now, b. A. R. T. Says trains are not running through at all, theyre being stopped at bay fair station in san leandro and at the south hayward station and being turned around. An ac transit bus bridge is being set up to get riders between the stations. But as we pull out, you can definitely see nothing happening there.
