Vic lee broke the story and joins us live with todays development. Vic . Reporter well, ama, here is the issue, the bottom line to this story. If a beat cop, if a Patrol Officer cant even get a free cup of coffee without violating the gift policy of the duty manual, why should the top brass get free 49ers tickets to see a game . Now this is the memo that the city manager drafted today. It was sent to the mayor and city councilmembers that says that the city manager and the City Attorney will begin reviewing the gift policy of the city to make sure that everybody everybody understands it. Last month abc 7 news reported that two top command officers received free 49ers tickets, apparently in violation of the police gift policy. Assistant chief eddie garcia attended two events. You see him here in this picture at a game in Candlestick Park last year. The second was this august at levis stadium between the 49ers and chargers. At the pointy chief jeff morosic was also invited to the same game. But under the Police Duty Manual officers cannot accept any gift at all. Sports tickets included. The department told us the chiefs reimbursed the nine he is for the tickets so there was no violation of the gift policy. We found out later the two chiefs sent their checks only after abc 7 news began inquiring about the tickets. Now it turns out chief of police lay larry escovel also got free tickets to a 49ers game. The department did not return our calls but sources tell us he also reimbursed the niners after we asked about the tickets. We learned today that the city manager met with the three chiefs. So the conclusion of your 0 office there was a breach or violation . There was an error made. Though the individuals involved have reimbursed the cost of the tickets, the policy says it should not have is happened. Reporter but others want an independent investigation. Pastor moore is a member of the San Jose Police community board. He wrote this letter asking the state attorney swrgeneral to investigate. Whats the policy on taking a gift . Well, the future of San Franciscos fire chief may be decided tonight. Right now the Fire Commission is hearing testimony on the performance of joanne hayes white, criticized for poor ambulance response times. Earlier this year rank and file firefighters took a no can confidence in her ladiership. They may hold a closed door session to evaluate the chief. Hayeswhite was asked to step down. A San Francisco man is in Critical Condition after being hit by a tree this had morning. It happened in the mission district. It was one of three ficus trees that came down. The others were in north beach and steiner and eddie. Abc 7 News Reporter Carolyn Tyler joins us on the latest what caused these trees to come down. Carolyn . Reporter ama, the primary factor is age. Hundreds of ficus trees including the one that fell behind me were planted on San Francisco sidewalks back in the 60s but all that stopped in the 90s when city officials realized the roots were buckling the sidewalks and the trees were prone to fall. Even a little bit of rain and wind can topple an aging ficus tree. This one in the mission fell on a man this morning pinning him and the branches and taking down a muni line. In my professional opinion, most of these trees should be removed. Theyre too tall and theyre too hazardous. Reporter there is a plan in the works to replace at least 200 of the oldest ficus. The cost, 500 to 1,500 per tree. Its really critical. Were seeing a huge number of trees fall this year compared to other years and so theyve gotten to that age we really need to start addressing the concern. Reporter residents in the western edition say three of the trees have toppled in their neighborhood so far this year. Including the one this morning that crashed browns car. They used to trim them every year, take the like that tree behind you, they took half of it down. Reporter the citys Tree Maintenance Program is well behind industry standards because theres not enough money leading to the controversial decision to shift responsibility on to some homeowners. Supervisor scott weiner believes whats really needed is reliable funding. Perhaps a parcel tax. The fund would be legally dedicated to taking care of trees and the parcel tax would be condition ed on the city taking back responsibility for all the trees. Well, to the weather, we desperately need the rain but it did make for a slippery drive across the bridge. The storm front made its way through. The rain fell steadily across the bay area in the overnight hours. This is how it looked in downtown walnut creak coming down pretty good. First, late last night we had a good field of it move through the bay area and then early this morning as the morning rush was getting under way another batch of rain moves through and it brought healthy amounts once it wraps up in the mid morning hours. Take a look at rain totals across the bay area. San francisco coming in with 0. 3 of an inch of rain. We havent seen that much rain in two months. Oakland coming in just over a quarter of an inch. The same in redwood city. In the mountains near one inch of rain. Elsewhere you see about a tenth of an inch. Everyone saw some rain but we do need more rain. Take a look at season to date. Many areas well below where we should be for this time of the year. San francisco, the airport, even oakland only about half the amount of rain we typically see by this time of the year. Well, a really rough commute tonight for anyone driving on interstate 880 in oakland after a big rig clipped a freeway overpass and then flipped over. Sky 7 hd shot this video about an hour ago. The Highway Patrol briefly closed all southbound lanes of 880 near 23rd avenue. That was to get a big tow truck into position. They say theyre checking for any possible damage to the roadway but no word yet on what theyre finding. Two of four southbound lanes are still closed and the chp says they could be closed for another two hours at least. In san jose right now, traffic is starting to move again after an accident on highway 101. You can see the scene from sky 7 hd. A truck carrying dirt blew a tire around 1 30 this afternoon. It crashed and lost all of its load. It took more than three hours to clean up that mess. The truck driver was trapped for about 20 minutes. The San Jose Fire Department shared this video of the mans rescue with us. Were told he has minor injur s injuries. Well, remember last months bay bridge backup caused by steel plates on the upper deck of the western span . Caltrans has found a way to do the work it needs to do. Starting tomorrow caltrans will start work to replace the aging joints on that section of bridge. This time they will not use the steel plates that cause cars to really have to slow down. Tonight Concord Police identified the carjacking suspect killed by an officer last night as 26yearold jose alv alvalos of bay point. They say he stole a car and led police on a chase around 9 00. Investigators say he ran to the nearby Shopping Center where he carjacked another vehicle and used it to ram into another police car. Thats when officers opened fire. Avalos was killed. He was on probation. 20 years ago today the death of a San Francisco Police Officer changed the way the Department Arms itself. Officer james six shot revolver was no match for a shooter who had several semiautomatic weapons. Tonight fellow officers and his family are remembering him at the place he was killed. Lyanne . Reporter i dont know of any other fallen officer remembered like officer geltz. Police officers gather here, the spot he was killed, the same location, the same time, 6 00 when he was shot and killed. On november 13 officer james geltz convicted victor beltwell transferring ammunition and guns from one stolen car to another. Officer geltz had a six shot revolver which is what officers in San Francisco carried 20 years ago. As he was reloading the shooter wearing body armor unloaded his semiautomatic weapon killing the officer. It was an intense shootout between police and the suspect who was later killed. Tony ribiero was San Franciscos police chief at the time. He had a bulletproof vest, a kevlar vest. Jim didnt really have much of a chance. Reporter police discovered the shooter had two assault rifles, three semiautomatic handguns, ammunition, clips, fuses, powder and military gear. This Convenience Store is nearby. When the man bought the store 18 years ago, the previous owner showed him a bullet hole from that day. Every year he stays to watch the memorial for the officer. I have 18 years here and every year i see them. They do always every year, once a year. Reporter there was such an outcry from the police and community that two years after the shooting, the department changed to semiautomatic handguns. Five years later in 1999, a law was passed in california that said violent felons could not purchase or possess body armor. But ten years later that law was overturned. Why does a private citizen need body armor . I mean, you know, i cant see the logic of such a constitutional argument. A plot with his name and picture hang at the station. Tonight at 11 00, the dad who went to visit his dayold child, a preemie, and found a stranger about to breastfeed his new son. Another push of cloud cover moves in in the afternoon and evening as an onshore flow kicks in. More sunshine than we did see today but the whole day will not be sunny. Some encouraging news as we take a look at the wider pacific. The water vapor loop and how much mauer there is in the atmosphere. You take a look, there are kinks in the atmosphere.
