Natalie calvo is back with family members this morning. Police are questioning 43yearold david douglas. They have not revealed what charges he faces. They earlier identified him as a person of interest in the girls abduction. Calvo was taken from her mother at gunpoint in front of their home on hummingbird drive around 6 45 last night. Douglas allegedly followed them home from a Walmart Store on loan tree way. They were unloading groceries when he grabbed the girl, pointed the gun at her mother and dragged the girl to his car. A woman flagged down a passing car. I went to my car and honked the horn to stop the car. The car that stopped was a Police Officer under cover. I kept honking the horn and he jumped out with the gun. We had a similar incident yesterday at the walmart where a mother was with her daughter and this individual who has been idd is a person we have in custody, approached her daughter and also approached her and noted he worked for social services and asked the daughter to come with him. Antioch police know douglas from previous encounters but say he is not a registered sex offender. The flu is being blamed for the death of a Santa Clara County woman in her early 40s. Reporter Health Officials believe the flu season is just Getting Started and the death of a 41yearold woman along with the hospitalization of seven others here is raising red flags. Both the woman that died as well as the cases that have been in icu, theyve all been people in their 40s, 50s, fairly young people. Reporter the dominant strain so far this season is the h1n1 virus, also known as the swine flu, the one responsible for the womans death on december 23rd. The centers for Disease Control says it hits the young and middleaged harder than older people who may have developed some immunity after facing a similar strain in the 1940s and 50s. It is a cause for concern. Reporter many people question the vaccines effectiveness. Some years we take it and theres really we get sick anyway. Other years we dont take it and its the opposite. Reporter still Health Officials say it can reduce your chances of getting the virus by 50 to 70 . In san jose, alan wang, abc 7 news. 25 states seen here in red on the map reported widespread flu activity last week, up from just ten states the week before. The states in orange including california have significant flu activity but only in part of the state. Experts say so far it has been a typical flu season and h1n1 has been the most common strain. A new court ruling clears the way for the family of jahi mcmath to move the girl whos been declared brain dead out of Childrens Hospital oakland. Nick smith has the latest from oakland. The judge ruled that Childrens Hospital can remove jahi mcmath from a ventilator on tuesday at 5 00 p. M. But her family is fighting to move her before then to another facility that will continue medical care. Im just happy that i know now that the courts theyre making it known the parents do have right. Reporter a 7 1 2hourlong settlement conference laid out the steps necessary to move the 13yearold. We will bring our own ventilator in. It will be a transfer to a ventilator. Jahi will exit the facility. Reporter the two procedures needed for jahi to be transferred will not be done at childrens and he isnt saying when or where theyre moving her, only that it would be as soon as possible. A superior court judge okayed the move as long as jahis mother assumes all responsibility for what happens during the transfer. She has surgery on what her family said was a routine tonsillectomy. Attorneys for the hospital say the two sides reached their agreement at superior Court Earlier in the day. By the terms of that stipulation, there is the possibility for jahi mcmath to leave the hospital and childrens is committed to that stipulation. Reporter the clock is ticking. A federal hearing in the case is set for tuesday at 1 00 p. M. Where the attorney for the family may ask the judge for an extension if jahi hasnt been moved. At 11 00 this morning, volunteers will gather to rebuild the shrine of flowers, signs and candles vowing to make it better than before. Lopez was shot and killed by a Sonoma County sheriffs deputy on october 22nd while holding a toy gun designed to look like an ak47 assault rifle. In san rafael, police are investigating a fatal dump truck accident. 67yearold Olga Rodriguez died at the scene. The collision happened just after 12 15 yesterday afternoon as two people crossed heatherton street near third. The truck driver told police he didnt see the people. Officials say drugs and alcohol are not believed to be a factor in this accident. Authorities are investigating a Police Shooting in san jose yesterday afternoon.
