Well as protected by the 2nd Amendment it's also protected by the original Constitution one section a client in 16 aren't built to 2nd to cause want this is a seamless web if you will the Bill of Rights is not something independent separate of separate from in defense of the Constitution it's really there to prevent misconstruction abuses of the powers that exist in the original constitution and so you see the 2nd amendment is clearly designed to buttress and to promote those powers that exist in the original Constitution 1st to recognition by the Constitution of these things called the militia of the several states they were institutions that were there before the Constitution was even thought of little of before it was written or ratified and then to make affective the powers of the Constitution delegates to Congress to call forth the militia to be employed in the service of the United States or 3 basic purposes execute the laws of the Union special directions repel invasions pretty good. List of homeland security functions so it's all tied together and I'm sure the founding fathers were concerned that what might happen. Is that somebody might attempt either to. Turn the militia into moribund institutions simply say well would I do anything with them or to bifurcate them into a so-called select militia small group of people who were properly armed and trained and organized and then everybody else kind of left out in the cold with the understanding that small group would be answerable to particular political figures and they had seen that kind of thing happen certainly in the ancient world are many examples of that all the way up to the Praetorian Guard stright of the Roman Empire vampire. So being students of history they were very clear on trying to prevent that kind of event so what we see today is exactly that happening has happened from 1903 when Congress created 1st grade this concept what we now call the an organized militia Georgia called the reserve militia and the other aspect of that structure the National Guard and if you actually study the National Guard look at the way it's organized its composition you realize that it's not the militia notwithstanding that area statutes refer to it as the organized militia is not a militia at all and the 1st reason of course is National Guard is in the compulsory organization made up of everyone from 16 years on to whatever you know you get too old to serve it's not compulsory at all it's a volunteer organization and secondly it is part of what can be called into. Service with the regular armed forces so it's a part of the standing army and on the face of the Constitution you see those are 2 different things the militia is mentioned I mention article one section because 15 and 16 and the standing Army and Navy are in causes 1413 and 12. 1 Section 8 So the founding fathers really of these were 2 different things 2 different types of institutions and yet now they have been melded. Together and statutes deriving are originally from 1903 legislation so where is the National Guard in this structure Well it's Article one section because 3 it's the troop ships or the states may keep in time of peace with the consent of Congress so the states have consented Congress pass statute States consented to this primarily by taking money look at the original statute no one's following if the states don't abide by the regulations of Congress they'll get the money so it's another one of those bribery situations because the states that consent. But that's the reality that actual god of course that the Constitution has those 3 structures as regular Army and Navy as our one Section 8 that has the state say troops or ships of war that may be kept with the consent of Congress Article one Section Gen was 3 and that it has the militia of the several states as everyone is a member of one of those 3 if you don't volunteer for the army if you don't volunteer for National Guard then by hypothesis you remain in the militia you're able bodied person capable of serving that's the structure and it's a very sound structure because in the ultimate analysis who's going to protect the security of your own political community if it isn't the members of the physical community themselves if you depend upon someone else to protect that security that someone else sooner or later will figure out that they have the power to control that community without necessarily asking for the consent of the members of the community that's been the history of standing armies if you will what they ally with tyrants or they become tyrannical themselves because they no longer have support from the not composed of the body of the people in the in the regular community so we don't have an organized properly organized Constitutional militia anywhere in this country days far as I've been able to determine and yet the Constitution says it's necessary so we have a contradiction and if the constitution is right and I imagine a constitution is more like the right than our you know our politicians the. We have a very serious problem because in the long run in the long run is getting shorter and shorter the security of a free state is becoming endangered if it has no proper protection doesn't have the things Constitution says is necessary to that security then obviously the Free State will go under and be superceded by some other kind of state a police state for instance would be the opposite of a free state totalitarian state a communist state even though a number of adjectives there that would be contradictions of the concept of freedom and there you can see that right now with the development of this huge hole and security apparatus the top down typical pyramid all bureaucratic top down power structure all the decisions and wisdom of the all seeing eye at the apex of the pyramid and power flows down to the base with the you know the masses milling around taking orders from their superiors and higher levels of the pyramid exactly that structure Well that's the pyramid of ancient Egypt that's the pyramid of Babylon that's the pyramid of ancient Rome on to the front of the Empire and so forth and so on and why history to that our system is different I wouldn't argue here the music of the background letting us know we had a break bones forgot Botha with his father ram state. For most of these statutes refer and I would guess that all of them referred some point to the on organized militia because that's the language that came out of the statutes that were passed before World War one of this organization that created the National Guard the organized militias everyone who's not the National Guard basically National Guard is the organized militia so-called. And that's the problem of an organization the Constitution gives Congress the power to provide for organizing arming and disciplining the militia take that for us where organizing has a power to organize it doesn't have a power to disorganize it doesn't have a license to on organizer to refuse to exercise that power why because the militia of the several states are state institutions which may be called by Congress to provide services in these 3 vital areas execute the laws suppressions or actions repel invasion So if Congress doesn't provide for organizing arming and disciplining in good faith to some degree then these state institutions could be incapable of performing that basic function for the United States and that's a contradiction on the other hand these are state institutions and the militia of the several states they are not the institutions of the general government they can be employed by the General Government but they're not part of the general govern the same way that Congress is or the army of the Navy are and so so the states have their own interest in organizing arming disciplining training their own militia in order to deal with. Problems that might arise in the states executing their own laws perhaps suppressing erection suppressing directions within their own territory. Possibly dealing with the invasion Article one Section 10 clause 3 specifically states that the states have the power to raise to essentially to raise troops to repel invasion they don't need to go to Congress for this so it's obvious that they have the power to organize and arm and and discipline their own militia so the states could do it on their own to the extent that Congress hasn't provided any organization which Congress hasn't and they could do it specifically with respect to state purposes state quote unquote homeland security if you will and there are plenty of those that go beyond the concepts of executing laws and suppress insurrections and retelling invasions all sorts of activities and what would be the advantage of that number one it would prepare large numbers of people to deal with local emergencies. Natural disasters and just real accidents famine spur Hampshire would be coming into that in this country breakdowns in the economic system what if we had massive bank failures along the lines of 131-3233. Congress couldn't call forth the militia to deal with that but the states could organise could have organized people to deal with the economic consequences of that kind of failure in the financial system one thing that interests me most about this is because we have an educational system that is totally dysfunctional this country is churning out generations of morons snaily things they seem to be. Educated in Coquet to the end as it were isn't a Marxist pablum of political correctness and you see this all the way through high schools colleges and so forth and so on well if you had an organized militia where would you start well people become. Members functioning members of the militia from 16 years on up that certainly is the historical pattern but. Individuals have to be basically trained in some way educated in some way in preparation you don't just go into the militia not knowing anything so while you're in that well a high school middle school maybe upper elementary school 12 years old 30 years old 40 years old 50 years old you should be taking courses in school that would prepare you for participation a much what with those courses be American history constitutional law but basic concepts of a free state one of militias why we have it why isn't it on and on we go all the things that are derided today right American education would become compulsory subject and not only in public schools but also in private schools private colleges because these people would be going through all of those years in those education institutions while he The preparing for or serving in the militia this would turn the whole educational system around. No doubt about it yeah if we view the educational system today the presidential system as one of the greatest dangers to the preservation of our freedom I would say that it is then we need to do something about it and here's a way to do something about it at the same time that we're reinstituting these institutions it can be used in many many other ways around other example is if you have a militia structure at the state level why do we need homeland security anymore at the federal level. Now when you know the functions of consequence are going to be performed at the state level anyway so they could write training manuals and some other kind of your credit paperwork and send these down to the state militia offices with suggestions but we wouldn't need this huge top heavy bureaucracy coming out it wasn't easy and in fact they would have no authority because if you read Article one Section take clause 16. The States appoint the officers to their militia the only officer of the militia who is not appointed by the states is the president states he's made the committee for the militia by the Constitution now actually the individual is in a sense appointed by the states as of election and so electoral college but I mean the formal sense so all those other officers are appointed by the states well does that mean that a officer in the Department of Homeland Security can function as an officer of the militia and give orders for the militia I'm a state will know is not appointed by the state he's appointed by the president was confirmation by the Senate or maybe he's just been hired now even an appointed official he doesn't officially say militia so immediately we have a 10th Amendment break as it were a 10th Amendment bulwark between the state militia and these bureaucratic agencies in Washington to think that they can give orders reaching down to Main Street in Smalltown USA and most of these 10th Amendment proponents out there don't seem to realize that that is probably the most effective way to enforce the 10th Amendment because if you think of all the things that properly organized militia would be doing. From a Homeland Security perspective you want to use that terminology within a state and how that would exclude those structures would exclude control from Washington d.c. I don't know how you could want a more effective no data no that will work so I and wouldn't if Virginia really small revitalized its militia and then fed a certain segment of that militia must have possession of using in practice on a regular basis with an a r 15 or an Am think.
