Here locally at any moment, Court Workers in San Francisco could walk off the job. Union members overwhelmingly approving a strike over pay. Nbc bay areas Stephanie Chuang joins us live in San Francisco. Stephanie, you spoke with the union. How likely is it they are going to walk out right this minute . Reporter well, scott, thats the question in the air right now. They are discussing when, saying not an issue of if, but when, and only if Management Changes its tune would it change that fate. Imagine taking a day off to handle court business, from paying a traffic ticket, filing papers for a lawsuit, you get here, no ones at the counter, no ones here. Thats what happened two years ago when local 1021 held a oneday strike. That effectively shut down much of the San Francisco court system. While the court said it was able to continue on carrying criminal cases, most everything really came to a halt. Courtroom clerks who handle paperwork, those who file documents and help people get copies of records all walked out of the job and on to the picket line. The Court Announced a 5 wage decrease. The workers have been going without wage increases for years. Theyve been facing furloughs, layoffs, and increases in the health care copays. San francisco is the most expensive city to live in in this country, and people are being driven out of San Francisco. Reporter and on that note, the final vote count came in last night over 91 of Union Members authorizing a strike. At issue now is the unions demand for more pay. It says the court has acknowledged 16 million in reserves, much of it must be spent and workers want some money to go to a 3. 5 raise starting january 1st. Last wednesday dozens rallied here at the civic courthouse. He is running for reelection last year. He says he knows how hard the people worked and stands with them and their struggle for fair wages. Last time two years ago the unions seemed to come out on top. Not only was the wage decrease lifted, but they were able to negotiate a 3 increase for 2013. It remains to be seen what will happen this time around. We have not heard back from Court Management so far this morning. Live in San Francisco, Stephanie Chuang, nbc bay area news. All right, stephanie, thank you. Just in this morning, a man accused of killing his wife in 1989 clear of murder charges for now because of an inappropriate relationship between the original prosecutor and the criminal in the case. District attorney dismissed the charges against david zimmer and his Brother Robert in the killing of cathy zimmer, whose body was found wrapped in a quilt in the back seat of her car. The d. A. s office reopened the 25yearold cold case in february, leading to the brothers arrest a month later. Today in a statement the d. A. Said his office is reevaluating the case to make sure an inappropriate undisclosed relationship between the prosecutor and criminal is not compromised in the case. David zimmer is out of custody, his Brother Robert is said to be released immediately. A College Student on her way to class this morning recovering after she was hit by a car near anthony Dorsa Elementary School in East San Jose. The teen was taken to the hospital, shes expected to survive. The accident happened when a driver turned the corner and was blinded by sun and did not see the teen in the crosswalk. Fairfield Police Officers are patrolling an Elementary School after a threat was posted on a website. Officials say someone went to the oak brook Elementary School pta site yesterday, saying he or she was thinking about harming people at the school, but the person didnt provide specifics. As a precaution, officers are at the school today to investigate that threat. Police in petaluma are looking for a man who tried to lure a teenaged girl into his car yesterday around 3 45 in the afternoon near miwok Elementary School. The 15 year old was walking on st. Francis drive when the man drove up next to her. Officers say he got out and asked if she wanted a ride, opening the passenger door, inviting her to get inside. Police say the girl did not know the man, refused, and told him she was going to call police. The man got back in the car and drove away. Hes described about 40 years old, standing six feet tall with a stocky build and medium length black hair and neatly trimmed hair. He was also wearing a black tshirt and blue jeans at the time. The car was a black fourdoor honda, possibly an early 2000 model. The search is on for a gunman in San Francisco. Police say he confronted a group of men, demanded their valuables, and shot one person in the chest before taking off. This happened just before 3 00 this morning a couple of blocks from the civic center plaza. The victim remains hospitalized. No word on his condition. Were getting our first look at the suspect who is the subject of an intense man hunt in palo alto. After searching for four and a half hours last night, Police Arrested Dominique Tabb of San Francisco. Investigators say he tried to make a fraudulent transaction at a bank of america in palo alto but took off before police arrived. After setting up a perimeter and searching yardtoyard, officers found him hiding, but heres the unusual part of the story. They say the whole time tabb had actually been inside the home of a man who found tabb in the backyard, and the home owner apparently invited him inside. Tabb is suspected of fraud and has a warrant out for his arrest. Two men accused of setting seven fires in alameda could be formally charged today. Andrew gutierrez and Steven Peterson were arrested over the weekend, accused of setting seven fires within a sevenblock radius, but people who know peterson say officials must have the wrong guy. They say hes a peace loving man and doesnt make any sense for him to do Something Like this. The fires displaced four families and caused an estimated 3 million in damage. Most of the damage along park street, alamedas Main Commercial strip. Apartments on san antonio were also hit hard. Investigators say the two suspects do not know each other. Today we could hear from the man accused of beating a man to death inside a south San Francisco gym. Lawyers expect the man to enter a plea this afternoon. Police say he beat another man earlier this month with a piece of gym equipment inside a bally total fitness. She wasnt at the gym when the attack happened. Ebay announced this morning it would spin its paypal division into its own company, meaning paypal could chart its own course. You can pay for paypal at home depot, for instance, but the move allows paypal to flex its muscles. This is the new battleground, your wall etd, the next hot thing, like social networking a few years ago. Paypal will hire an executive from American Express to run the company and the split should come early next year. The Oakland Raiders could reveal today who the teams next head coach will be. Dennis allen was reportedly fired over the phone this morning after the raiders lost to miami. The raiders have ten straight losses and started this season with an 04 record. There is speculation that tony sparano, the teams offensive line coach, could take over, though nbc sports reports thats not true. Other news outlets are reporting the raiders are seriously thinking about bringing back jon gruden, who was the head coach of the raiders from 1998 to 2001. Heres some good news for all football fans. The Commission Voted to do away with the nfls long standing blackout rule, which was put into place to make sure fans went to games instead of watching them at home, but that is no more. Todays decision now eliminates that rule. Defiant protesters in hong kong stockpiled prepares today, when the holiday, tens of thousands blocked streets in four areas of asias biggest financial hub. Reporter on the eve of chinas national day, this is one powerful message from hong kong, tens of thousands of people on the streets tonight demanding real democracy, demanding the right to choose their own leader. Protesters continue to stay calm and keep locations orderly and peacefully as soon as possible. This is live video as students and faculty members are streaming out of the building there at a high school in louisville, where there is reportedly at least one person who was shot and rushed to the hospital after a reported School Shooting there. We have seen students walking out with their hands up across the campus, across the parking lots, and through a baseball field to where a spot where they are then putting their hands down. We know that police are there on the scene. Ems personnel also there on the scene, and again, at least one person has been taken to the hospital. No word on who the shooter is or how many shooters there are, but we know the investigation is ongoing. Well, we continue to watch that, the most decorated olympian of all time has been arrested for drunk driving in maryland. Michael phelps arrested early this morning for driving under the influence in baltimore. The 29 year old was charged with excessive speeding and crossing lanes, as well. Police say phelps was driving 84 miles an hour in a 45 mile an hour zone. You may recall he was arrested in 2004 for drunk driving and sentenced to 18 months probation. Phelps has won 22 olympic medals, 18 of which are gold. Lots of questions today for the director of the secret service, a congressional hearing will focus on the agencys handling of white house security. This comes after new revelations that the man who jumped over the fence earlier this month at the white house actually made it far into the building before being stopped. Secret Service Agents originally said Omar Gonzalez was stopped inside the front door and was unarmed. Agents later admitted he was carrying a knife. A farm worker turned astronaut gets a big honor here in the bay area. A local pool will be named in his honor. Yes, were live at the new Alpha Jose Hernandez middle school here in East San Jose. You can see the kids, theyve been sent back to class after the ceremony, but you have parents and staff out here partying, not a bad time. Just moments ago, the schools namesake helped dedicate the school in his honor. Hernandez grew up working with his family in the farm fields of the central valley, didnt learn english until he was 12, but knew he wanted to go into outer space, so he went to college, became an electrical engineer, then an astronaut for 128 Space Shuttle missions. He told the students this morning, many of whom are striving to become firstgeneration College Students themselves, he sees so much of himself in them. Doesnt matter what your social economic status is, what levels the Playing Field is an education. So keep working hard and dont give up. Nasa rejected me 11 times before i finally got selected. We want to find out what its going to take to dig out of this California Drought and i think i have answers youve been looking for. That in just a minute. I want to show you san jose, nice and sunny, quite the contrast in San Francisco. Plenty of clouds still lingering. Throughout the day today, watch whats happening today. You can see whats going on via the flow of the clouds. You can see they are wrapping around a big ridge of High Pressure. We have a trough over us and that means its nice and cool for today. 84 degrees in the north bay, 71 in San Francisco, 74 for the east shore, 75 on the peninsula, and beautiful san jose, our last day of the 70s. Were going to boost your numbers up by a good ten degrees for tomorrow and keep the climb going for thursday, into friday, peaking in the mid 90s. A return of summerlike weather, but it will be short lived. Well start to drop temperatures into the weekend. Lets talk about whats going on out there, why the big warmup, and are there any rain chances. First and foremost, High Pressure is firmly in control of our weather pattern and will be through the upcoming weekend. Temps in the 90s, triple digits in the warm spots. Look what happens, we stop the clock for you as we get into next wednesday. This is a week away, but it shows the storm track coming back to the bay area. For us, thats exactly what we need. How dry are we . We are actually one full water year behind. We need at least an average year, so that would be 20 inches of rainfall in San Francisco and 15 inches in san jose to escape the drought we want to stay at average, we dont want it to worsen, but to escape the drought, we are talking about 40 inches of rainfall necessary in San Francisco and 30 in san jose. So basically, we need to double our average this year to get out of the drought. Do we think thats going to happen . Probably not, but i can tell you this, as long as we hit that average, we will be doing much better off than we did last season and the two before that. This is the most catastrophic event ive ever seen, this is synonymous with taking a drone and bombing the place out. Reporter today, five days later, many travel plans still in disarray. I want to go home. Reporter it will take at least two weeks to essentially rebuild chicagos center from the ground up. Visualize 29 racks of computer equipment, thats what this system entails. 20 of these need to be replaced. Reporter suspect brian howard, a 36yearold contract employee, appeared in court monday. The criminal complaint against howard points to a Facebook Post in which Authorities Say he said, leaving you with a big mess. The faa chief told nbcs tom costello the agency is beefing up security nationwide. Weve increased patrols to the number of personnel we have focused on security at all of our air traffic facilities. Reporter but with more than 4,000 flights already cancelled, some question why more supervision wasnt already in place. Definitely a big wakeup call. We had one person on their lonesome doing work on very sensitive equipment. Reporter as for stranded travelers traveler insurance is not going to cover it. Reporter many have had to spend hundreds of dollars and waste hours, if not days, simply trying to get to their destinations. That was Kevin Tibbles reporting. The estimated cost of one miss or cancelled flight per passenger, 1,400 in lost productivity and expenses. Imagine 4,000 packed flights cancelled, hundreds of millions of dollars. Wow. California is now the first state in the nation to ban singleuse plastic bags. The governor signed the bill into law, putting a ten cent price on reusable plastic bags. Opponents said they will work to get referendum on the ballot so voters can overturn the law, but 90 california cities already have similar bans, including many here in the bay area. Also on the governors desk, a law to allow family members or Law Enforcement to get a 21day restraining order for people considered to be a danger to themselves or others. And thats for them having guns. Supporters say this could have made a difference in the isla vista shooting. Parents called Law Enforcement locally saying he was threatening violence and suicide but there wasnt much more they, nor Law Enforcement, could do at that point. It would prevent gun owners from seeking Mental Health or Substance Abuse help for fear of losing their weapons. 69 california governors have signed a letter of support, nearly half from bay area communities, including mayors of san jose, San Francisco, and oakland. The governor can veto it, sign it, or do nothing, in which case ab14 takes effect in 2016. Happening today, official word on the safety of new rods on the bay bridge. The final results of the 20 million study will be shown to the bay bridges Oversight Panel today. More than two dozen steel rods broke when they were tightened during construction last year. Those failures prompted an investigation of more than 2,000 other fasteners on the bridge to determine if they are also at risk. A palo alto intersection not making the grade. A new city report gives an f to the intersection of page hill road and foothill expressway. The report says the intersection has significant delays, suggests improvements be made. The citys chief transportation official says one solution would be to widen page mill road and increase signal time. The Planning Commission meets tonight to discuss that report. Ride Share Companies in one east bay city could soon face new regulations. Tonight the Berkley City Council will discuss a recommendation for Companies Like uber and lyft. The city manager says regulations would help the city collect fees for services and Business Licenses from those companies. They say regulations would also provide Safety Standards for drivers and passengers. Well, still ahead, how san joses mayoral candidates are trying to show voters they are the better leader of the season city. Today in this city. San jose lost over 400 Police Officers in the last five and a half years. Robberies are up in some neighborhoods, and many people say they just arent feeling safe in a city that used to be called the safest city in america. But crime wasnt the only concern for residents. Downtown residents, homeless issue is very, very busy. He says he wants to put Homeless Veterans as a priority and liccardo wants an impact fee on developers for a source of funding for affordable housing. Jobs also taking center stage in the question of how to lure startups away from other cities and back to silicon valley. We need to create that vibrant urban option here in san jose. The urban atmosphere is great, its wonderful. Im running for mayor of san jose, not just mayor of downtown. The person who can demonstrate the leadership and bringing san jose back at least close to its status of being the safest big city in america is going to win the vote on election day. Christina was saying that in order to have a normal year, 20 inches of rain in the bay area. To have a year that would bust the drought, 40 inches of rain. I cant remember the last time it was that rainy, christina. Yeah, you know, were actually looking through records right now trying to figure out if it has, in fact, ever happened within the last one hundred years, but as of right now, it doesnt look like it. Nonetheless, its feast or famine here in the bay area. I think you know that by now if youve lived here for any duration of time. Today is a day were going to get spoiled with beautiful conditions, but all good things must come to an end. Thousands of people will flood San Francisco over the next few weeks for a myriad of events, like hardly strictly bluegrass and fleet week. Picture perfect events, of course, and police say thieves are focusing on the cameras that take the pictures. Reporter the sights in San Francisco are a photographers playground. Golden gate park and marine area. Reporter tiffany leo is showing friend from china the highlights. They are surrounded by people with expensive camera equipment, but robbery doesnt cross her mind. No, never think about it, actually, yeah. I live in union square, and i avoid tenderloin district, i think im safe. Reporter police say a photographer was robbed here at gunpoint sunday morning. The department is investigating five robberies in just the past week, where thieves stole camera equipment at or near tourist destinations. Police say people are listening to warnings about keeping smartphones out of view, but cameras are out. I think the criminals are looking for other things that they can easily access, so youre looking at things like cameras, backpacks usually contain wallets and other items in it, ipads and so forth. Reporter the shift in focus is a surprise for some people who live in San Francisco. I was traveling. I was very worried about my possessions, my camera, my phone, traveling abroad, but here in the city i probably wouldnt think twice about bringing it out. Reporter police are urging people to think about their surroundings, a hope to keep popular destinations picture perfect. Its good to know, you know, its a very big target. Its expensive. Other business news, ebay pushing paypal out of the nest so it can fly on its own, spinning the company off into its own entity. We know this will happen early next year and a former American Express exec will run the new paypal. Ebay will promote from within. The ceo of the new ebay, they are going to promote to have a new ceo. The current ceo stepping down, moving on to the board of directors. Wall street loved the idea of a new paypal. Investors are eager to get their hands on shares of that new independent paypal and they do that by buying ebay shares. Trivia for you, paypal has traded on the stock market before for a short time in 2002, then was bought by ebay a few months later. That ipo and the purchase, made billionaires all over the valley. Microsoft planned an announcement in San Francisco today to show off the successor of windows 8. Well, very few people are talking about. Not with the paypal announcement. I dont want this announcement to get lost, we understand they have contributed an enormous amount of money to help the immigrant children in Southern California and texas. He, of course, one of the most generous men in california. Hes donated 100 million in ucf Childrens Hospital twice. The second time they named the hospital after him. I think the third time they make him an honorary doctor. New water costs have hit the streets and we are going on foot patrol to see what can get you into trouble. Insurance companies are spending millions of dollars trying to mislead you about the effects of proposition 46. Well heres the truth 46 will save lives. It will save money too. Im bob pack, and im fighting for prop 46 because i lost my two children to preventable medical errors and i dont want anyone else to lose theirs. The three provisions in 46 will reduce medical errors and protect patients. Save money and save lives. Yes on 46. Well, this year, as we all well know, going down in the record books as one of the states driest ever. Now, its the end of the water year. That ends today. Wrapping up with less than 60 average rain. The department of Water Resources said there is no indication the water year that begins tomorrow will be any wetter, so there are folks on the water beat, new boots on the ground, searching for new water wasters. The Santa Clara Valley district hired special inspectors to go door to door and remind you to conserve. Marianne favro followed an inspector to see what kind of issues they are finding. Reporter water flowing on to the sidewalk and down the drain in san jose. This is exactly what susan is trying to stop. Shes one of five new water waste inspectors with the Santa Clara Valley water district. When people report water waste to the district, suzanna checks it out. Everything from this leaking fire sprinkler device, to irrigation runoff. People have been receptive to the inspectors, a lot of people dont realize they are wasting water, so when we let them know whats going on, they are thankful. From what we hear, they are making changes. Reporter if no one is home, suzanna leaves a conservation flyer and contact phone number. She also visits businesses and made one Company Aware of a broken sprinkler. I went out, took a look around, sure enough there was a broken sprinkler, so i called the Property Management group and left a message and they called me back about an hour or two later and when it was fixed, they called me back to let me know it was fixed. Reporter earlier this year, the board asked all users to cut back use by 20 . So far theyve only managed to save 11 , so the district hired water waste inspectors to get people to commit to conservation. No one was home at the location suzanna visited, but neighbors say if an inspector knocked on their door, they would be okay with it. I would hope my neighbors would come and talk to me first about it, but i would be okay with the water cops pointing out what the issue was and showing me how to fix it. Reporter fixit ideas, yes, fines, no. The water waste inspectors have no authority to issue fines or citations. They just hope a friendly visit will get more people to view wasting water during a drought as a crime. Marianne favro, nbc bay area news. H2ono you didnt. How about that . Thats better. We could use some water. Yes, he did. Yeah, we know we do need the water. We definitely know that much, but you know what, weve really been racking our brains, grappling with this data coming in because were trying to figure out how much do we need to get out of this drought. Lets put it in perspective for you, we are one full water year behind, and an average water year we get about 20 inches in San Francisco and 15 in san jose. To escape the drought, weve got to double our average water year and pick up 40 inches in s. F. And, yeah, over 30 inches in san jose. Just to put things into perspective for you, remember how much rain we got last wednesday, well, its going to take 50 storms like that over the course of 284 days to get out of this drought. Is it impossible . No. Do we think its going to happen . Its very unlikely, but what i can tell you is, as long as we hit that average, were not going to be talking about mandatory restrictions, which we will be having to talk about if we dont hit that average, so its really important that we get the water that we need this year. Now, october 13th through the 16th is our next best chance for rain, but whats really interesting is right here on your satellite imagery, you can see weve got green offshore in San Francisco, so heres the deal with whats going on in our atmosphere. Were getting some really cool stuff. You can see the clouds arcing up and around the big ridge of High Pressure. For us, we have a trough here in the bay area.
