Here locally at any moment, Court Workers in San Francisco could walk off the job. Union members overwhelmingly approving a strike over pay. Nbc bay areas Stephanie Chuang joins us live in San Francisco. Stephanie, you spoke with the union. How likely is it they are going to walk out right this minute . Reporter well, scott, thats the question in the air right now. They are discussing when, saying not an issue of if, but when, and only if Management Changes its tune would it change that fate. Imagine taking a day off to handle court business, from paying a traffic ticket, filing papers for a lawsuit, you get here, no ones at the counter, no ones here. Thats what happened two years ago when local 1021 held a oneday strike. That effectively shut down much of the San Francisco court system. While the court said it was able to continue on carrying criminal cases, most everything really came to a halt. Courtroom clerks who handle paperwork, those who file documents and help people get copies of records all walked out of the job and on to the picket line. The Court Announced a 5 wage decrease. The workers have been going without wage increases for years. Theyve been facing furloughs, layoffs, and increases in the health care copays. San francisco is the most expensive city to live in in this country, and people are being driven out of San Francisco. Reporter and on that note, the final vote count came in last night over 91 of Union Members authorizing a strike. At issue now is the unions demand for more pay. It says the court has acknowledged 16 million in reserves, much of it must be spent and workers want some money to go to a 3. 5 raise starting january 1st. Last wednesday dozens rallied here at the civic courthouse. He is running for reelection last year. He says he knows how hard the people worked and stands with them and their struggle for fair wages. Last time two years ago the unions seemed to come out on top. Not only was the wage decrease lifted, but they were able to negotiate a 3 increase for 2013. It remains to be seen what will happen this time around. We have not heard back from Court Management so far this morning. Live in San Francisco, Stephanie Chuang, nbc bay area news. All right, stephanie, thank you. Just in this morning, a man accused of killing his wife in 1989 clear of murder charges for now because of an inappropriate relationship between the original prosecutor and the criminal in the case. District attorney dismissed the charges against david zimmer and his Brother Robert in the killing of cathy zimmer, whose body was found wrapped in a quilt in the back seat of her car. The d. A. s office reopened the 25yearold cold case in february, leading to the brothers arrest a month later. Today in a statement the d. A. Said his office is reevaluating the case to make sure an inappropriate undisclosed relationship between the prosecutor and criminal is not compromised in the case. David zimmer is out of custody, his Brother Robert is said to be released immediately. A College Student on her way to class this morning recovering after she was hit by a car near anthony Dorsa Elementary School in East San Jose. The teen was taken to the hospital, shes expected to survive. The accident happened when a driver turned the corner and was blinded by sun and did not see the teen in the crosswalk. Fairfield Police Officers are patrolling an Elementary School after a threat was posted on a website. Officials say someone went to the oak brook Elementary School pta site yesterday, saying he or she was thinking about harming people at the school, but the person didnt provide specifics. As a precaution, officers are at the school today to investigate that threat. Police in petaluma are looking for a man who tried to lure a teenaged girl into his car yesterday around 3 45 in the afternoon near miwok Elementary School. The 15 year old was walking on st. Francis drive when the man drove up next to her. Officers say he got out and asked if she wanted a ride, opening the passenger door, inviting her to get inside. Police say the girl did not know the man, refused, and told him she was going to call police. The man got back in the car and drove away. Hes described about 40 years old, standing six feet tall with a stocky build and medium length black hair and neatly trimmed hair. He was also wearing a black tshirt and blue jeans at the time. The car was a black fourdoor honda, possibly an early 2000 model. The search is on for a gunman in San Francisco. Police say he confronted a group of men, demanded their valuables, and shot one person in the chest before taking off. This happened just before 3 00 this morning a couple of blocks from the civic center plaza. The victim remains hospitalized. No word on his condition. Were getting our first look at the suspect who is the subject of an intense man hunt in palo alto. After searching for four and a half hours last night, Police Arrested Dominique Tabb of San Francisco. Investigators say he tried to make a fraudulent transaction at a bank of america in palo alto but took off before police arrived. After setting up a perimeter and searching yardtoyard, officers found him hiding, but heres the unusual part of the story. They say the whole time tabb had actually been inside the home of a man who found tabb in the backyard, and the home owner apparently invited him inside. Tabb is suspected of fraud and has a warrant out for his arrest. Two men accused of setting seven fires in alameda could be formally charged today. Andrew gutierrez and Steven Peterson were arrested over the weekend, accused of setting seven fires within a sevenblock radius, but people who know peterson say officials must have the wrong guy. They say hes a peace loving man and doesnt make any sense for him to do Something Like this. The fires displaced four families and caused an estimated 3 million in damage. Most of the damage along park street, alamedas Main Commercial strip. Apartments on san antonio were also hit hard. Investigators say the two suspects do not know each other. Today we could hear from the man accused of beating a man to death inside a south San Francisco gym. Lawyers expect the man to enter a plea this afternoon. Police say he beat another man earlier this month with a piece of gym equipment inside a bally total fitness. She wasnt at the gym when the attack happened. Ebay announced this morning it would spin its paypal division into its own company, meaning paypal could chart its own course. You can pay for paypal at home depot, for instance, but the move allows paypal to flex its muscles. This is the new battleground, your wall etd, the next hot thing, like social networking a few years ago. Paypal will hire an executive from American Express to run the company and the split should come early next year. The Oakland Raiders could reveal today who the teams next head coach will be. Dennis allen was reportedly fired over the phone this morning after the raiders lost to miami. The raiders have ten straight losses and started this season with an 04 record. There is speculation that tony sparano, the teams offensive line coach, could take over, though nbc sports reports thats not true. Other news outlets are reporting the raiders are seriously thinking about bringing back jon gruden, who was the head coach of the raiders from 1998 to 2001. Heres some good news for all football fans. The Commission Voted to do away with the nfls long standing blackout rule, which was put into place to make sure fans went to games instead of watching them at home, but that is no more. This is live video as students and faculty members are streaming out of the building there at a high school in louisville, where there is reportedly at least one person who was shot and rushed to the hospital after a reported School Shooting there. We have seen students walking out with their hands up across the campus, across the parking lots, and through a baseball field to where a spot where they are then putting their hands down. We know that police are there on the scene. Ems personnel also there on the scene, and again, at least one person has been taken to the hospital. No word on who the shooter is or how many shooters there are, but we know the investigation is ongoing. Well, we continue to watch that, the most decorated olympian of all time has been arrested for drunk driving in maryland. Michael phelps arrested early this morning for driving under the influence in baltimore. The 29 year old was charged with excessive speeding and crossing lanes, as well. Police say phelps was driving 84 miles an hour in a 45 mile an hour zone. You may recall he was arrested in 2004 for drunk driving and sentenced to 18 months probation. Phelps has won 22 olympic medals, 18 of which are gold. Lots of questions today for the director of the secret service, a congressional hearing will focus on the agencys handling of white house security. This comes after new revelations that the man who jumped over the fence earlier this month at the white house actually made it far into the building before being stopped. Secret Service Agents originally said Omar Gonzalez was stopped inside the front door and was unarmed. Agents later admitted he was carrying a knife. A farm worker turned astronaut gets a big honor here in the bay area. A local pool will be named in his honor. Yes, were live at the new Alpha Jose Hernandez middle school here in East San Jose. You can see the kids, theyve been sent back to class after the ceremony, but you have parents and staff out here partying, not a bad time. Just moments ago, the schools namesake helped dedicate the school in his honor. Hernandez grew up working with his family in the farm fields of the central valley, didnt learn english until he was 12, but knew he wanted to go into outer space, so he went to college, became an electrical engineer, then an astronaut for 128 Space Shuttle missions. He told the students this morning, many of whom are striving to become firstgeneration College Students themselves, he sees so much of himself in them. Doesnt matter what your social economic status is, what levels the Playing Field is an education. So keep working hard and dont give up. Nasa rejected me 11 times before i finally got selected. Perseverance is another trait. I teach them that, its okay to fail, dust yourself off and try again. We want to find out what its going to take to dig out of this California Drought and i think i have answers youve been looking for. That in just a minute. I want to show you san jose, nice and sunny, quite the contrast in San Francisco. Plenty of clouds still lingering. Throughout the day today, watch whats happening today. You can see whats going on via the flow of the clouds. You can see they are wrapping around a big ridge of High Pressure. We have a trough over us and that means its nice and cool for today. 84 degrees in the north bay, 71 in San Francisco, 74 for the east shore, 75 on the peninsula, and beautiful san jose, our last day of the 70s. Were going to boost your numbers up by a good ten degrees for tomorrow and keep the climb going for thursday, into friday, peaking in the mid 90s. A return of summerlike weather, but it will be short lived. Well start to drop temperatures into the weekend. Lets talk about whats going on out there, why the big warmup, and are there any rain chances. First and foremost, High Pressure is firmly in control of our weather pattern and will be through the upcoming weekend. Temps in the 90s, triple digits in the warm spots. Look what happens, we stop the clock for you as we get into next wednesday. This is a week away, but it shows the storm track coming back to the bay area. For us, thats exactly what we need. How dry are we . We are actually one full water year behind. We need at least an average year, so that would be 20 inches of rainfall in San Francisco and 15 inches in san jose to escape the drought we want to stay at average, we dont want it to worsen, but to escape the drought, we are talking about 40 inches of rainfall necessary in San Francisco and 30 in san jose. So basically, we need to double our average this year to get out of the drought. Do we think thats going to happen . Probably not, but i can tell you this, as long as we hit that average, we will be doing much better off than we did last season and the two before that.
