We spoke with a woman who says shes lived in this area since 1948 adding she and her neighbors have been left out of the conversation despite the many concerns about impact to their health and demand for conventional demolition. Because we were saying why dont they give us a chance to community a chance to do what we want to see happen out there in that area . You feel they wont listen to you . Theyre not going to listen. Now the candle stick demolition is set to make way for new development more than 12,000 homes, more than 3 million square feet of office space set to produce more than 12,000 permanent jobs according to lenar which says its completed an assessment last august. That did find things like asbestos containing material and lead based paint. But also saying abatement is underway right now set to be done in february. Also says an onsite environmental consultant is monitoring the hazmat work methods, procedures and containments and says that its also tracking air quality levels. On top of that, the department of health has approved a dust control plan thats supposed to minimize dust exposure. Theyll hear briefly from the judge in the case then fill out this basic questionnaire. The toempbs will eliminate those clearly ineligible to serve. Next, the task of narrowing the group to 12 jurors and six alternates. We try to produce a jury that can fairly imand partially render a verdict and give a punishment that considers all options, including the Death Penalty and life without parole. Federal prosecutors have notifyied the court they will seek the Death Penalty if tsarnaev is convicted. Hes pleaded not guilty to the bombing that killed three and injured 260 during the Boston Marathon and to the murder of Police Officer a few days after that attack. This morning, police are investigating a deadly officerinvolved shooting and we are learning that the suspect was carrying a fake gun. Police told him to leave and shortly after, they realized he was still there. Thats when officers approached him. They exited the car and went to approach him, hey, you cant be here. He went to his waistband and drew the weapon. Fired, the suspect hit three times. Turned out to be an air soft pistol or a bb gun. The man was taken to the hospital but later died of his injuries. Earlier in the day, police say the same man approached other officers asking what type of weapons they carry. Meantime, the police chief says the department will hold a meeting in the next coming days and will likely show that weapon or a picture of it. Police searching for a man they say tried to run over an officer. Theyre asking the public to be on the lookout for this man. Stacy hawthorne. Detectives say they were called to a motel 6 because two men were fighting and when they arrived hawthorne jumped from the second floor of the motel, almost fell on top of an officer. Hawthorne then allegedly stole a car from a nearby dealership and tried to run over an officer. The car found nearby after hawthorne crashed through a locked security gate. But he was nowhere to be found. Two of the four men involved in a Violent Bank Robbery and shootout with police in stockton this summer will face a grand jury today. The indictment charges against 20yearold ramos were unsealed in the superior court. A grand jury also indicted 21yearold pablo who was suspected of driving the men to the bank. Police say ramos and two other men barged into the bank of the west on july 16th and took three women hostage, then got into a gun battle with police. Two of the suspects and one hostage were killed. New at 11 00, jerry brown has made history becoming the first california governor to be sworn in for a fourth term. Two terms at the end of the 70s and into the 80s and two now. Residents in san jose where a tree damaged a water and gas line are hoping today will be the day they get their hot water back. The gas line was damaged tuesday by a falling tree. The city spoke spokesman tells nbc bay area that when the supervisor showed up on friday evening, the repairs werent done or ready for inspection. Meantime, the residents are stuck in the middle. Well more relief is coming today for the victims of flooding in last months big storm. Heavy rains flooded several peninsula neighborhoods, including redwood city Mobile Home Park december 11th. Today the office of Emergency Services will open inan Assistance Center to provide information and services to victims of that flood. The Assistance Center is scheduled to be open for two days. The city of oakland officially starts a new chapter today. Libby schaff will be sworn in as mayor this afternoon. Shes the 50th mayor of oakland. One of her Top Priorities will be adding Police Officers and reducing rising crime rates. She has also spoken out against the recent acts of vandalism in oakland during protests over police tactics. Another new mayor of san jose will be sworn in tomorrow night. Well it is a stinky situation for some residents trying to prevent the expansion of a landfill located off Dixon Landing drive and interstate 880. A decision on the expansion is expected later this month. And hundreds of residents have launched a social Media Campaign called milpedas odor campaign. Asking city leaders not to allow the expansion. Almost every day, weve been smelling the stinking odor and we cannot open our windows any time we want. Its so bad that often times im thinking about leaving. Now, Republic Services runs the landfill. Its applied for a revised permit to increase the height and capacity and expand the expected closure date from 2025 to 2041. We have not been able to reach republic for comment, but previously officials have said theyve worked control odors coming from that landfill. Well hundreds of travelers are back in the bay area this morning after they were stuck on a flight from abu dhabi to San Francisco for more than 24 hours. Their 12hour flight delays added to the 16hour flight time was in the end a 28hour ordeal. Get this, passengers say their 12hour wait included no food and no information about that delay. It was only after seven hours of growing pressure from passengers as the flight crew started handing out sandwiches. One passenger we spoke said passengers had to get information from the internet to find out why the flight was delayed. The information started to get up that the entire airport was closed. Everyone started to get frustrated because it became clear to us that when we had been told oh you know youre leaving within 30 minutes, 45 minutes, that was just sort of a lie. The airline eventually sent out a tweet saying bad fog in abu dhabi delayed flights and caused congestion. The cabin crew was switched out and food onboard was restocked before that plane finally took off. And the airline would face steep fines as a result of this tarmac delay. If this had happened in the united states, fines would start after three hours on the tarmac for domestic flights, four hours for International Flights and could go as high as 27,000 per passenger. Its not clear whether that airline will owe passengers anything since the delay happened in the middle east. Well this morning, state regulators considering writing a big check to bay area billionaire to assure Public Access to a public beach. Owns a piece of land near Martins Beach in halfmoon bay. Modern law says he has to allow access to the beach. That came with rights that date back to the time of the treaty with mexico. And those laws say he can access block access rather to the beach. This issues been through the courts but now the mercury news says the states getting involved to buy Public Access to that beach. Happening right now, dangerously cold temperatures are spreading across much of the country, and while we think its been cold here nearly everyone east of the rockies could see temperatures hovering from anywhere, 0 degrees into the teens. We should start to see that air quality improve. And a good temperature drop between the two days as well. Down to 68 degrees by thursday. And then looks like were going to get a little bit of rain not much, but enough to really improve our air quality. Katy tur, nbc news. And now an amazing story of survival. A 7yearold girl the only survivor of a plane crash that killed her parents, her sister and the cousin. Federal investigators want to talk with her. She was onboard when that small plane carrying her family crashed in kentucky. Her parents, her sister and her cousin died in the crash. But she managed to walk nearly a mile to a nearby home for help. Family friends say her father was an experienced pilot. The family was flying back from key west after visiting their son for the holidays. Investigators are now trying to talk with that 7yearold lone survivor. Having someone that is a witness always helps us in the investigation. Gives us kind of a story line and its helpful in any situation. Investigators say they have just begun to examine the wreckage and a preliminary report will be released in about ten days. Youre looking at a reunion four decades in the making. She was 8 years old in 1969 when she came from tijuana to the bay area to have surgery. I remember that one. Pat sherman and her family took her in to recover. Be willing to take in these children before and after the surgery. Well, how can they be so lovable with somebody they dont even know . Im going to love this kid for the rest of my life. But after several hospital visits and bonding with the people she called her second family she went back to tijuana and lost touch with the shermans for 40 years. No i love hope. Broke my heart. I thought about her for years. Until facebook. Hi. I hope you remember me. All these years later, they found each other through the social network. And i took the phone i started, no yes. Oh, my god. Thats her. That was the happiest moment of my life. They looked through old pictures and introduced new family members starting again where they once left off. It sits there suspended. Now, if you live above that layer, youre getting good air quality. Near the coast, were getting a little bit of wind. But everywhere you can see that, even in San Francisco. The worst air quality according the bay area air Quality Management district is right here in the Santa Clara Valley and we will likely be sparing the air through wednesday. Now, the good thing is our overnight lows have improved because it is illegal to burn that firewood. I think overnight, well see temperatures in the 40s whereas we had the 20s and 30s for most of last week. We thawed out significantly. Our winds have completely shifted. They are moving offshore. You just saw all those arrows pointing from land to sea, whats happening is got this big ridge of High Pressure in place, and thats taken a storm track well to the north of the bay area. For us, youve got that sinking air. And as a result of no mixing you just have that particulate matter out there suspended. What we need is the wind. The onshore wind to clear it out and that is in the forecast. Later on this week but right now, pretty nice out there. 54 degrees, still chilly in San Francisco, 47 degrees in the north bay, a nice day coming your way, 67 later on today for you, and that goes for us here in the south bay, as well. With just a few high clouds. But its hard to make out. I mean you only have about 5 to 6 miles visibility with that thick layer of haze. Heres the deal High Pressures going to amplify. And as a result were looking towards warmer days tuesday into wednesday, with temperatures approaching the mid70s here in the south bay. Let me put things in perspective for you. Our average high is about 58 degrees this time of year. Were going to be well above average. Actually rivaling some temperature records. It just doesnt usually get this warm with our short days in the wintertime. Thursday and friday the situation when it comes to your air quality really improves although were not expecting a lot of rain. Well get enough of an onshore flow and enough moisture coming through the bay area to give us good air quality. Especially up in the north bay and looks like along the peninsula where we are expecting the highest totals. Totals guys not looking too good. Talking about. 05 to . 25.
