It happened around 10 30 this morning near blossom hill road and snell. Two cars collided with each other, sending one off the freeway and through a chainlink fence, landing in the parking lot of a car parts store. Three people including a toddler and a pregnant woman were sent to the hospital as a precaution. The woman actually had to be extricated from the vehicle. They dodged about probably eight or nine trees in between where they left the freeway and to their point of rest over here. So luckily, they didnt go head on into one of those trees. Yeah, that is a good thing. And the people in the other car were not hurt. Well, she was the victim of a gang rape at a homecoming dance. Today, though, through a statement she told her attackers that she was forgiven them . Spite of the fact that she is still suffering from that brutal rape. And then two men convicted in her case were doled out harsh sentences. Nbc bay areas Jodi Hernandez was in the martinez courtroom today. She joins us with the latest. Jodi . Reporter jessica, the judge called this case beyond shocking. She acknowledged that the two defendants have been nothing but courteous and polite as this case has gone through the Court Process but says she cannot ignore what they did, saying the victim deserves justice. It is hard to reconcile that these two young men could engage in that kind of behavior. Reporter and judge Barbara Zuniga didnt go easy at all on the men convicted of the 2009 gang rape of a 16yearold Richmond High School girl. The defendants showed no emotion as the judge sentenced 20yearold Marcelles Peter to 29 years to life and jose montano to the maximum sentence, 33 years to life in prison. The conduct that the two of you engaged in along with the other young men that were in that group, you dehumanized her. She stopped being a human being to you. She became a thing for you to torture and play with. Reporter before sentencing the judge heard a statement written by the victim, who says she still has nightmares, flashbacks, and body aches. You both took a lot from me. More than you will ever know. And i just want to say to the both of you i forgive both of you. I forgive both of you because i deserve to be at peace. Reporter montano expressed remorse about what took place, acknowledging that nothing he can say will heal the victims pain. I cant undo what has been done. All i can do is apologize for my actio actions. You cannot engage in this kind of mob mentality, vandalism on a persons body, and get away with it. And some of the people who are out there who think that theyve gotten away with this, well, were still were still working on this case. Reporter so far six men have been identified in connection to this case, but as many as 20 men are believed to have been involved, and investigators are still working to identify the others. In other news, a breakin at tiffanys. A group of thieves made it into the store but had a hard time getting away with anything valuable. It aund around 5 45 this morning in walnut creek. Thieves in a stolen truck rammed through the entrance just blocks away from the police station. Once inside, four men in hoodies seem to have spent more time trying to break into the jewelry cases than actually stealing anything. Police say they did get away with a small amount of jewelry but nothing extremely valuable. They took off in what looks like a white chevy blazer and left the truck in the front entrance. Police are now looking at Surveillance Video to try and track down the suspects. A San Francisco cyclist was sentenced to one count of felony vehicular manslaughter today. He got 1,000 hours of Community Service and three years of probation. The 37yearold pled guilty to the felony, the first of its kind in the u. S. Involving a cyclist. Chris bukerre, in six months a judge will be able to decide if the conviction can be reduced to a misdemeanor. You may remember that in march of last year soo chi hui was on market and castro with his wife crossing the street when chris bukerre, who was riding his cycle through the intersection, hit hui. Hui sustained blunt force traumas, injuries that caused his death a few days later. Team arco played a small role in a boat emergency on the abay this afternoon. Around 12 30 San Francisco firefighters got a call about a man who fell out of a fishing boat. Before the coast guard could get to him another fishing boat came to the rescue. Thats when a member of team oracle either from the racing yacht or the chase boat jumped into the unmanned boat and switched off the engine. Its not clear whether the fisherman was hurt. A followup now. San jose police are looking at Surveillance Video of the attempted robbery at a south Bay High School yesterday. The School District says it has clear footage showing a man entering silver creek high and trying to rob a former student of her laptop. The students friend tried to intervene, and police say the friend was pistol whipped by the suspect, who eventually got away. Theres a Police Officer assigned to the school, and hes helping investigators find the intruder. These types of instances scares everyone because at any time, at any point unless you want to fence your entire schools off and have metal detectors these type things you just have to prepare for the best. The schools stepped up fa pa troelz around the campus today. Right now some frustrated neighbors at mallow alto are meeting with administrators at a private school to complain the school is overcrowd. On the corner of bryant and embarcadero road. The city capped its enrollment at 415 students but 448 girls are set to Start School Later this mop neighbors are unhappy about the additional 33 students. I think its just because much of extra parking. Thats the biggest issue. Theyve come around with petitions and stuff and i think theyll be at this meeting tonight to voice their opinions. In order to address Community Concerns the school invited neighbors to the meeting this evening. It also has submitted an application to the city to add the students. He says his brotherinlaw was shot to death in egypt yesterday. He says his commitment to democracy cost him his life. For weeks as the violence in egypt escalated so did ahmed regabs fear for his brotherinlaws safety pf he knew he was in rabah square protesting. He couldnt settle for having his vote stolen away in the way it happened on july 3rd. Reporter ahmed lives in santa clara. Yesterday he said his worst fears were realized. Relatives told him his brotherinlaw was shot and killed while protesting. We were told he was killed by a sniper shot taken from one of the choppers that was roaming around in rabah square. Reporter mohammed yakout was just 37 years old, a devoted father of two children ages 5 and 3. He was an engineer who worked during the day and joined protesters at night. He says at the time of his death mohammed was trying to stop a military bulldozer from taking over rabah square. My sadness doesnt stop at the loss of muhammad. Its at the loss of the whole nation, the whole egyptian nation and the way the Army Generals are driving the country into a black hole basically. Gruesome new information tonight in the case of a man who kidnapped a San Diego County teenager last week. Court papers indicate prior to setting his home on fire James Dimaggio tortured the girls mother and 8yearold brother and then killed them. He also shot the family dog. Information in a warrant also shows dimaggio exchanged 13 phone calls with the 16yearold girl in the hours before her kidnapping. She didnt know her mother and brother were killed until after her rescue. A family spokesman believes dimaggio intended to kill the girl. The l. A. Times reports in an eerie coincidence the suspects own father suffered a breakdown and committed suicide after he too became obsessed with a 16yearold girl. Final preparations are under way to imploez a landmark building in hayward. At 9 00 saturday morning demolition crews are set to destroy the 13story warren hall on the cal state east bay campus. The 42yearold campus building was deemed seismically unsafe. Demolition experts are placing 400 pounds of explosives at more than 1,000 spots in the building. Once the charges go off, the entire collapse should take about seven seconds. Were going to kick the legs out of the south side of the structure. Its going to start to incline that direction. And then the balance of the explosives charges going up through the building are simply to weaken the structure, allowing gravity to do a better job of bringing it as close to grade as possible. Got it . 1,500foot radius around the building will be closed off for safety. The u. S. Of course, that thick fog, areas of drizzle at the immediate coastline right up to our northern counties. And it looks like its going to stay in those very typical spots at the coast for our friday. From point reyes all the way down to half moon bay, a little bit blustery and a few areas of drizzle in that forecast. As far as temperatures go, not too many fluctuations from today. If youre out in the sun in palo alto its definitely going to feel like the upper 80s. And get this. If we didnt have this onshore flow for tomorrow, these upper 80s and low 90s would likely be low 100s. This area of upper low pressure thats going to be developing in the upper levels is going to sit around here for the next five days. No major cold air with it, but eventually some of this instability looks to kick up from the south and bring us the possibility of thunderstorms. Yes, it is a long way out. But if we get any kind of activity, thats big news in the bay area, and you can see by monday and tuesday we get a little bit of green here across the north bay, also the east bay.
