And him asking me questions like, mommy, why is daddy in this box. Reporter 38 year old lopez was shot and killed by a State UniversityPolice Officer on eighth streit, just a few yards from campus. Investigators claimed one officer opened fire after lopez charged at another officer with a drywall cutting saw. But today, valadez says she has witnesses that say that is not true. I honestly believe its a cover up. Theyre trying to figure out how to cover it up. Reporter she says lopez may have been targeted because he was an undocumented immigrant. And now shes calling for action. I want the officers to be prosecuted. I want their badges and guns and to be tried like any other person. Just because they have a badge doesnt make them better than anybody else. They have to abide by the same rules. Reporter san jose University Police did not return our calls. San jose says it is still investigating the case and cannot comment. Valadez says she just wants the truth for herself and josiah. She says she will keep fighting to expose the truth. She has also asked the Mexican Consulate to open up an investigation into his death. And new at 6 00, a popular bay area theme park is under fire tonight because of whats under water at the lake. The person who posted this Youtube Video says it was taken just last weekend and proves that six flags in vallejo isnt doing enough to clean up that lake. Last year the theme park pledged to take action when it was accused of polluting nearby waterways. Some people are still feeling very frustrated six months later. Reporter they definitely are. The lake is a popular spot for families. In fact, these little baby trout are set to be released by area third graders. The third graders have assembled on the shoreline and are about to release the trout into the lake. This is certainly a beautiful sight, but some say the scene across the lake on the other side of the shore where discovery kingdom sits isnt pretty at all. Vallejos parks and recreation workers are busy sprucing up the lake, getting it ready for its annual fishing derby, but while th Park District is cleaning up its side of the lake, some claim the shoreline maintained by discovery kingdom looks far from the pristine. You look at their front yard, it looks great. You look at the back yard, it looks like squatters live there. Debris in the yard, its not indigenous to these waters. Reporter theyve been chronicling the situation on youtube. We caught up with him last july and saw for ourselves the mess along the shore line as well as pieces of floating platforms and debris in the lake. Back then they said theyd take care of it, again, its not been taken care of. Reporter while the park told nbc bay area last year it was working on a cleanup plan, fast forward seven months. Concerns remain, prompting him to take out the video camera yet again. What is this . Is this plywood . Reporter discovery kingdom spokesperson says they removed all the debris identified to them last september. And indeed, nbc bay area found the area quite a bit cleaner than last year. In a Statement Released this afternoon, discovery kingdom says, quote, we were apprised this week of the debris that remained which is not visible from the lakes surface or our property and was not aware it was there. The debris in question was being removed today. Well, this morning, pieces of what appeared to be floating platforms remained and dilapidated structures still lined the shore. Late today, we did see workers repairing the fencing. Darling says he wants discovery kingdom to not only clean up its back yard but keep it that way. We deserve a corporation on the other side of the lake that respects our property. Its not their lake. Its our lake. We live here too. Reporter and were back here live. And people who live in the north beach neighborhood are now saying rats are running rampant on the streets, but weve heard it before. Nbc bay areas Stephanie Chuang investigated another infestation, and it sounds like these two are linked in a very important way. Reporter thats what the thought is tonight. I do have official numbers. The department of health stays its gotten 83 complaints of rats. Both agencies show that the most recent ones have come from right here in north beach. And specifically centered around Washington Square park, which is very close to Construction Activity with the central subway project. People say here as soon as the sun goes down the rats come up and out. You can see about 20 or 30 of them at night. Reporter thats 20 to 30 rats. Miles spends days and nights here playing his guitar. He say there have always been rats in the city. But in the last year it seems the population has multiplied. Usually they come out at night. But you can see them running across the field and just everywhere around here. Reporter there used to be one or two and now youre seeing packs of them . Yeah. Its increasing. Reporter the question is why, and why now . The agency in charge of the central subway project says rodents are usually more active at the start of construction, the complaints began to rise as construction was winding down. People we spoke with says they cant think of anything else. Maybe its disturbing the underground. Perhaps the vibrations in the ground makes the rats come up. Reporter even construction crews working on a sewer line project say theyre having to live and eat among countless rats. Theyre stepping all over them because its so dark in there. You dont see them until you put a light on them. And they start running. Reporter rats out here isnt the big problem, but now theyre showing up where they really arent welcome his home. Im investing in traps because i notice food missing too. Reporter now back here live youre looking at one of the traps. The city has invested in them too. Theyve put out six bait boxes along the park perimeter. Its also sealed holes with wire mesh. Officials are expected to be back out here tomorrow along with the inspector from the department of public health. They are also asking the public not to leave food out. Yes, right during the dinner hour, thank you, stephanie. We have a warning for jewelry stores. Police say a woman stole out a diamond ring and switched out the diamond with a fake one. This happened last thursday. Officers say this woman, Angela Walker distracted the stores clerk and swiped the diamonds. The clerk realized what had happened after she left, but detectives were able to track down walker because she told the clerk she would like to come back and see more diamonds and left her contact information. Though lured her back into the store on monday and promptly arrested her. Detectives believe shes pulled this same scheme before at other stores. And continuing coverage tonight. A key figure in San Franciscos Corruption Case posted bail and is expected out of jail anytime now. A federal magistrate agreed to release Keith Jackson on 250,000 bail. The former political consultant is accused of funneling illegal donations to state senator leland yee who is among 26 people charged with the wideranging criminal probe. Jackson is also accused of attempting to sell arms to an undercover agent and participating in a murder for hire scheme. The release was ordered after the suspects mother put up a home for collateral. Jacksons attorney doesnt think much of the governments case so far. The government on this case, in terms of mr. Jackson, im not speaking about anybody else is delusional. They are delusional. and they speak in court, and i hear them, but its not so. All 26 defendants, including suspended senator leland yee are due back in court on tuesday to enter pleas. A grand jury indictment is expected to be filed in the next two days.
