Police say the driver was reckless and speeding before crashing into the pedestrian and a fence. Tonight, police say the suspect is chavez, driving on a suspended license, on probation, charged now with murder in the case. It happened off of west leyland report. Reporter investigators say the woman walking op the sidewalk never had a chance, struck by a speeding car, a driver who flew past a Police Cruiser seconds before, well above the speed limit. The officer tried to pull him over. He activated his lights. As the officer did that, the sole occupant of the vehicle fled at a high rate of speed. Reporter by the time the officer got to the top of the hill, he saw the camaro had burst through a fence striking a pedestrian, identified as a 65yearold pittsburgh woman who was walking on the sidewalk. She was killed instantly. The car kept going, onto the delta view golf course, stopped on a putting green and the driver got out and ran. He was captured a short time later in an adjacent neighborhood. A very tragic and traumatic event. This should not have happened. This individual was driving recklessly and it cost someone their life today. Reporter this is the third time a speeding car has burst through the fence on this stretch of west leyland in recent years. The city of san jose is set to vote on a strict new rent control ordinance tonight. Reporter according to the chp report, the lift driver swerved to avoid another discabled car, before colliding with the tree. I was holding his body in my arms. Reporter initially lift saying they comped a ride. The next day lift emailed their condolences. And in a third email, lift said it would cover the cost of bradys medical care. A year and a half later, attorney Kevin Morrison said the company has not. Instead of stepping up and taking responsibility for the incident, they claim the driver was an independent contractor. Reporter the lift driver did not have proof of insurance. In an emailed statement, a lift spokesperson offered condolences and said the investigation and litigation arising out of this accident are ongoing and liability has not been determined. However, in the meantime, lifts insurance policy is responding. The familys Attorney Says evidence shows the driver was going 75 miles an hour. Its unclear if they tested the driver.
