It would take a historically wet year to get us out of the drought in one year, but what we can hope for is hopefully to have an above average year this year, and then hopefully that patter would continue again next year. Hydrologist here today were cautiously optimistic. They are hopefully that the pattern sticks around and we continue to get lots of snow. But at the same times. Today hes charged with open murder, but this case is going to chart new legal territory. Kolo 8 news nows ed pearce has been looking ed, what makes it different is the defendants age. Hes just 15 years old. Until recently that wouldnt have made much difference. Recent changes in the law mean this case will follow a new and different track. 00 29 29 45 451 25 last tuesday a dispute ended in the northeast reno park ended in gunfire. A bullet fired into a car struck a 16 year old youth in the head. Two Days Later Police arrested a 15 year old they say fired the shot. Saturday the victim died and this afternoon the 15 year old was rebooked on a charge of open murder. It wasnt that long ago that his age would have been an issue. Nevada law dictated even juveniles charged with murder would be tried as an adult. But the 2013 legislature changed that hicks if a juvenile is 16 or 17 automatically the same law applies but if hes between 13 and 15 and 364 days we now have to do a hearing where the burden of proof is on the state to convince the court that he should be tried as an adult. That means a hearing with the case out of Juvenile Court and into adult criminal court. Its a change the District Attorneys Association opposed. Hicks anytime we have to add another layer of putting on witnesses it makes it more difficult. Its more difficult on the victims. Its more difficult on the witnesses and it slows down the process. But this week hicks will begin the process. Hicks the facts are dramatic. Theyre egregious. And they warrants Going Forward as an adult. Taking him as an adult for what he did. And we have a 16 year old whos passed away because of this. The last legislature made one other change regarding juveniles charged with murder. Hicks says if convicted the 15 year old defendant in this case will not face life in prison or even the minimum penalty for an adult. The most he can receive is a sentence of 15 a Storey County deputy is recovering after being shot while responding to a Domestic Violence call. It happened around four30 saturday afternoon in the Virginia City highlands. 51yearold Charles Stutts was arrested. Investigators say stutts fired a rifle several times, hitting one of the deputies and another person who was in the area. The deputy returned fire, and stutts surrendered. The deputy, the other victim and stutts were taken to a hospital for treatment. All are expected to be okay. Stutts faces several charges including attempted murder of a peace officer. The deputys name has not been released. Reno police are looking for the people responsible for a shooting, at a downtown bar. It happened just before 4 oclock sunday morning, outside the oneup bar on west commercial row. Police say, the two victims were taken to the hospital with non lifethreatening injuries. Witnesses say the victims were arguing with two hispanic men before the shooting happened. Those men are now wanted by police. Wearing a dark blue sweatshirt at the time of the shooting. The other was wearing a red San Francisco football jersey, and is about 5footfiveinches tall. If you know anything that can help police, youre urged to Call Reno Police or secret witness. That number is 3224900. A 1thousand dollar reward is being offered for information. President obama is making a move on gun control; bypassing congress to take action on what he calls an epidemic of gun violence in america. Although, we have to be very clear, this is not going to solve every crime in the country. Its not going to prevent every mass shooting. Its not going to keep every gun out of the hand of a criminal. It will potentially save lives in this country. The president is expected to take executive actions tomorrow. His administration believes they will make it more difficult for the mentally ill, criminals and terrorists to get guns. The white house wants to tighten background those on the nofly list from buying guns. The divisive issue already has president ial candidates weighing in. Sen. Ted cruz, rpresident ial candidate we dont beat the bad guys by taking away our guns. We beat the bad guys by using our guns. Sen. Bernie sanders, d president ial candidate criminals or people with mental issues, Mental Health issues, should not guns. I think thats what the president is trying to do and i think that will be the right thing. Gun Rights Groups are promising to take legal action. But white house officials maintain the president s orders will stand up to a court challenge. The fbi is now investigating an intense standoff, involving armed ranchers who have taken over a Federal Building in southeastern oregon. Because we have allowed our federal government to step outside the bounds of the constitution. Theyre coming down into the states. And taking over the land and the resources. The ranchers are protesting a new sentence, handed down to dwight and steven were convicted of arson for setting fires on federal land in 2001 and 2006, and served some prison time. But in october a judge decided their terms were too short and ordered them back to prison. Their sentences have been a rallying cry for the group who say they want to turn over the land to local authorities. Protestor complaints are finding support on the president ial campaign trail. Keith goldberg was murdered nearly four years ago. His body dumped in a National Park near las vegas. His family found a trained volunteer search and rescue group to find keith. But the park wouldnt let them in. The parksworried about liabiliaty issues refused to allow volunteers in to look they required the goldbergs to get 1 Million Dollars in Liability Insurance to enter to the park. In all it took fifteen months to begin the search. And once inside only four hours to find keith. Senator mark warner says bureaucracy shouldnt get in the way of finding missing people. His legislation would require premits for volunteers be issued within 48 hours of applying. Sen. Mark warner, dvirginia you shouldnt even have to pass a law to make this happen. God willing next time someones lost in a National Park well be able to get these teams of experts in. This bill has been making its way through congress for a couple of years now but now that its passed through the house warner is hoping the senate will soon follow suit.
