Live, from the cbs bay area studios, this is kpix5 news. People forced to flee the valley fire want to know when can they go home . Tonight, they finally get some answers. Christin ayers is in calistoga tonight and she has more. Christin . Reporter yeah, the big news tonight was the lake county sheriff telling people here the death toll on this fire could ruse even as firefighters start to get control of the flames and get closer to getting evacuees back home. For days they have been waiting for answers for permission to return home. Tonight, people evacuated from the valley fire got grim news. As many of you know already, we have had three confirmed fatalities. I hate to say it but i expect to find more. Reporter followed by perhaps the best news many had heard all week. We are going to repopulate the next 24 hours. [ cheers and applause ] reporter a time line for when people can finally go home. We are looking at seven days. We are looking at seven days. The command team, the management team, we are looking at it. Reporter but there are many questions that could not yet be answered. For the people who lost their homes, is there going to fema brought in . We are going to get you in as soon as we possibly can. Reporter that answer, not enough for some people who simply refuse to wait until their homes are deemed safe. I have news for you. You can put it on the media, us middletown boys are going home. Reporter firefighters caution against that. It is dangerous. Reporter while admitting there is little they can do once people cross the checkpoint. In the state of california, if you refuse to leave, we will not forcibly remove you. Reporter so firefighters saying approximately seven days before everyone here is going to have access to their homes again. We also learned tonight that school will start again for people in this area for young people in this area. It is expected to start october 1. Reporting live in calistoga, christin ayers, kpix5. Tonight, the valley fire is holding at just under 74,000 acres. It is now 35 contained but nearly 7500 homes are still threatened. And at least 585 have been destroyed along with hundreds of other structures. That number is expected to rise in the coming days. Two more bodies were found yesterday. Tonight, the Lake County Sheriffs Office says one is believed to be leonard neft, a retired reporter for the San Jose Mercury news. This used to be his car. It was town burned an abandoned. Family believes by the time he tried to evacuate it was too late. The other victim, bruce burns known as uncle brucey lived at a trailer here. He was probably sleeping and never had a chance to get out. And the third victim, 72year old Barbara Mcwilliams died saturday. She was a disabled woman with multiple sclerosis and was trapped inside her house. Tonight, there is a sign of hope in the town of middletown. Emily turner shows us the one place keeping its light on for the fire victims. Reporter as you can imagine, a town decimated by fire, everything is shut down before dark even except for one place. That is the Grocery Store which has just reopened and is very necessary for a town trying to rebuild. Today, the roll has never been more vital. They just got power on this afternoon. And it has been a mad dash since to get the store ready. They donated tall food that was about to spoil to the community. Now they are stocking up on extra generators and hardware they dont usually carry in anticipation of residents returns. We have been itching to do what we can to pick up the pieces. And now that we are up here, hopefully, we can help facility that. This Grocery Store is important to the people around here. The minute they start coming back here, we have to be there for them. Reporter in middletown, emily turner, kpix5. We learned crews out assessing the fire damage had to call in the bomb squad today. They came across an old military shell. Bomb technicians had to come up and blew it up off highway 29 outside of middletown. Well, these three bay area men were accused of trying to loot evacuated homes in the burn area. A deputy spotted them driving around the Hidden Valley lake area. They had masks, gloves, burglary tools and a loaded gun. All three are in jail tonight. Fire investigators looking into a pg e power line as the possible cause of the butte fire. It has scorched 75,000 acres in calaveras county. It is now 55 contained. People with signs are lining the streets to thank firefighters beat ling the butte fire. The show of support came as the firefighters returned from the fire lines. They posted this video today with the hash tag truly humbled. A kidnaps case that vallejo called a hoax could cost them big time. Maria medina explains. It is mr. Quinn and ms. Huskins that owes this community an apology. Reporter immediately after Denise Huskins was found alive, the police immediately called her kidnapping and rape a hoax. Now six months later. They filed this claim today. Reporter their San Francisco attorneys are filing a legal claim against the city of vallejo insisting the statements made by police have kept denise from landing a job and ruined the couples reputation. They were painted to the world as having been involved in a terrible hoax. Reporter in the legal claim hand today the city of vallejo leaders today, when aaron quinn called police for help, they believed he was lying and they didnt want to hear about any claimed intruders and they knew aaron had really killed denise. Even taking the incredible step of putting her phone on Airplane Mode after he told investigators the kidnapper would be calling for ransom. He was kept behind the locked door that was to be remained closed at all times and this continued for 18 hours. Reporter meanwhile, his fiance was being raped repeatedly. He was eventually released. Her alleged captor Matthew Muller arrested not too long ago. Now victims attorneys say he is not the only perpetrator in this case. So are the police. Denise and aaron were victims of horrific crimes and they had the right not to be victimized by the vallejo police. Reporter maria medina, kpix5. The city leaders have six months to respond to the legal claim before it could become a lawsuit. Tonight, the driver of this truck is recovering after he crashed into a home. It happened this morning in vallejo. The homeowner found the man trapped inside the burning truck and doused the flames with a garden hose until help arrived. Investigators say the driver suffered from a medical condition. Tonight, Santa Clara County is suing the contractor it just fired after this. Get out a worker nearly broken out of an underground vault while testing a steam pipe system. He wasnt badly injured. It is just one example of the quality of issues that have put the project three years behind schedules. The county is now seeking tens of millions of dollars in damages. Well, for the first time ever, dreamforce hosted a womens leadership summit and betty yu tells us that one of tonights speakers used the opportunity to make a big announcement about her own company. Police say he was standing in a bus lane and refused to get up on the sidewalk. Another passenger recorded the video, the struggle that followed. The Police Officer called for backup. Then came nine more Police Officers who took emilio to the ground. I feel traumatized be that. And i felt like i was beaten and slammed on the floor. In the video, our officer had his baton out, but the suspect was also grabbing and holding onto the baton. Emilio was cited for resisting arrest and trespassing. This time lapse video of the Santa Cruz Harbor shows the water rising and falling as much as a foot in ten minutes and voters and fisher machine say they have noticed unusually fast currents. Now we are going out to sea. Now we are coming back. They are very strong currents and tides associated with tsunamis. Reporter this graph of a tidal gauge in monterrey normally has a smooth red line, but the earthquake in chile has caused wild fluxuations seen here with jagged edges but it is nothing like what happened here in 2011 when tsunami waves from the earthquake in japan caused heavy damage to several docks in the Santa Cruz Harbor. The official tsunami advisory for this earthquake extended all the way to ragged point to the south of the big sur area. In ant cruise on the nightbeat, im mark sayre. A popular bay area lake is closed to swimmers because of toxic algae. Park officials closed lake anza because of the high levels. Dogs can die from consuming that algae. People can get bad rashes and intestinal problems as well. Warning signs are going up around the lake. And in the park. There is no indication when the lake might reopen. Time to get a check of the weather. Paul deanno has an update on el nino right paul . Yes. We have the predictions coming in. The outlooks coming in from the climate prediction center. They look at season ins three month chunks. For the first time in a long time, we at the bay area, we in the state of california are in the wetter than average range when it comes to a threemonth outlook. That begins in december. See the green there . That is a typical el nino track. We will hit the southern part of the country. That will likely include San Francisco, the bay area, northern california, but especially southern california. We are above average rainfall is likely. Likier than not, december, january, and february. So here is what that means because december is a long way from now. This means there will be a minimal impact through thanksgiving. That is a couple more months but the potential for a wet december, january, february, and march, just like what happened in 82 and 83, and 97 and 98 when we had the strong el nino, it was back loaded after christmas. Fingers crossed. Fremont 57. Clear skies, 55. San francisco, clear and 59 degrees. We are clear because our low pressure area, our rainmaker which put a lot of rainfall on the ground. That is now gone. Building in is another big strong ridge of High Pressure that will be with us four or five days including your week. The roads begin to turn more northerly tomorrow. Smoke from the butte fire and valley fire and send it into our north and east bay valleys. It may be hazy if you are out and about tomorrow. High pressure inching its way closer. 80s near the bay with 90s inland. No record highs but it will get warm. Clear tonight, tomorrow, sunny skies with the exception of that haze. Especially up toward northern napa county. Warming trend continues right through the weekend. Tomorrow, very, very close to exactly average. 82 in san jose. Upper 70s for san mateo. Antioch, sunny, warm, 86. Nice day in San Francisco. 69 degrees with sunshine. Mill valley 78. Novato 82. Lake county getting warmer. Not in the 90s yet. We are going to be warm over the weekend. We will get temperatures cooling off next tuesday. Back to average. All in all, we are back to the dry stuff. But we got the rain yesterday. And not terribly hot as it comes up toward the weekend. Starbucks obviously bought this chain to get rid of it. Reporter that is just a taste of what local foodies are thinking. I called up starbucks and they denied it. They are very unsympathetic. Reporter John Steinberb detailed the deal and believes starbucks bought the chain for 100 million for its recipes to get better food in its stores. The bakery itself is taking a bite out of it bottom line. That is kind of the name of capitalism unfortunately. I think it was a very underhanded thing to do. Reporter it is leaving a bad taste in her mouth. Local foodies said goodbye to a favorite bakery. They took home gift baskets from the staff. As the door closed on another local favorite. This is a typical huge takeover. I used to hang out on polk street every morning after i dropped my kids off after school. I cannot be there anymore. They made great food. Mom and pop bakery.
