And in just the past halfhour, kpix 5s joe vazquez learned some new details about the horrific crime. Joe. Reporter i just spoke with the attorney for the family of 9yearold jordan almgren. The family will make a brief statement tomorrow thanking the public for their overwhelming support during this awful ordeal and he told me a few details about the murder that we hadnt heard before now. There had been a sleepover, a neighborhood sleepover, with children staying at the house. The mother went to bed around midnight and teenagers still up until around 2 a. M. Sometime after that the family believes one of the guests William Schultz, sneaked into jordans room and stabbed him to death while he lay sleeping. And that it was jordans own mother who discovered his bloody body early the next morning. So prosecutors today in the courtroom said they were going to three throw the book at him. After laying out the charges against 18yearold William Schultz the prosecutors decided no Death Penalty for the suspected murderer of 9year old jordan almgren. He is charged right now with special circumstance, he is on notice at this point in time we are not pursuing this as a death case. Reporter we learned monday that his family had referred him to sheriff officials for a psychological evaluation the day before the murder. But neither a sheriffs deputy nor a doctor thought he was a danger to the community or to himself so he got out of the hospital within hours. Theres no question that Mental Illness was behind this. Yes. Reporter today schultzs defense Attorney Says saturday was not the first time his parents had reached out. Family tried desperately to get help for their son who was exhibiting symptoms and signs of Mental Illness, yes, they tried very hard in the weeks and months leading up to this event. Reporter schultz was in court this afternoon for an arraignment. He did not plead guilty or not guilty. They decided to go ahead and continue or delay the proceedings for another three weeks. He is now living near palmdale with a 24hour Security Guard but is in trouble for letting his ankle monitor run out of battery twice. Spencer got through to his father in petaluma to say he was okay and was being airlifted off the mountain. It turns out he had left base camp the day before the avalanche. He is currently stuck in a small town called lukla waiting for transport but he is alive and well. So we are just so grateful that he wasnt at base camp and just how lucky for him in particular that timing was because it could have been a whole different story we are telling you right now. Reporter Santa Clara City Council member lisa gillmor helped put the brakes on the 49ers proposal. No, no parking lot reporter after youth soccer players turned out in force for last weeks Council Meeting concerned that the deal would leave them without a place to practice or play. My son plays sports now. He would have no place to practice or play. He would be displaced. Reporter initially, the 49ers offered the city 15 million in rented which they could use to build soccer fields somewhere else but the team undervalued the land and underestimated the opposition. Sounds like youre saying that this was a sweetheart deal, a back room deal. It would have been a back room deal except for the fact that we refused to go in the back room so we took a stand and it would have been, and it is a sweetheart deal the way it was proposed. It was offering a fraction of the value of that property. Thats going to induce some rapid warming the next couple of days we are going to see some low 90s inland both tomorrow and friday. Near record territory i dont think well break some record highs but it will be 15 to 20 degrees warmer than today coming up tomorrow afternoon. So mostly clear tonight.
