If its going to flood anywhere in San Francisco, its going to flood here. It used to be a waterway actually. So back in the day before development that was the center of a little marshland. Reporter which is why its also the center of city sandbags, 2,000 of them delivered by the Public Utilities commission. Thats a nice move say business owners, but come on. How about a real fix . The pipes here are too small to handle that amount of water when all those pipes coming downhill are full. Reporter and at hans arts Auto Repair Shop when a big downpour hits the highest point in the city, twin peaks, the water flows right under his door and sewer pipes arent big enough to handle it. Its a sewer overflow. Its a sewer backup. Thats what it is. Reporter thats why every once in a while there is raw sewage in places like this stable cafe down the street. This was 2012. Its happened four times since then and theres no promise it might not happen again. No sewer system can handle storms of all magnitude. So we design our system to a certain standard and when it gets above that, you know, theres nothing we can do. Reporter one fix . Paul is back in about 10 minutes with your full forecast. They are the cops, the San Francisco police chief wanted to fire. They were accused of sending racist and homophobic texts. Kpix5s phil matier on why the officers will end up keeping their jobs. Phil . Reporter at least for now. Now these texts were truly horrific for the department and the city. They likened African Americans to monkeys and worse, but today a judge said no matter what were in the texts the way the department handled it wasnt right. Heres the story. The judges ruling could not have been more clear. The department was aware of the allegations of misconduct. They were aware of what had transpired and yet they specifically set that aside and did nothing for many years. Were disappointed. No consequence no, discipline. These officers will get off the hook. Were now looking at around 4,000 cases that were impacted by those 14 officers, about 1,600 involving prosecutions. Reporter at issue . A slew of racist and homophobic messages between 10 officers. The messages were uncovered as part of a federal corruption case, but the feds told the locals not to take any action. You have to let the criminal investigation play out before you go forward on the administrative. Reporter by the time the feds were done with their case and the locals made their move the statute of limitations for firing the officers had run out. That was their choice and the consequences is exactly what happened here. I think people are going to look at this and say what is happening with our system . I had suspended without pay. The Court Ordered that they be paid. Reporter whats next . I cant think of a place where i could put such officers inside the police department. Moving forward those officers cannot provide any testimony. So theres no question that we would never use them. We just cant. Our clients were not ever accused of ever behaving in a racist fashion on the street when they were doing their duties. Or certainly in court where they would have any credibility at all. Taxpayers are getting saddled with a huge bill. Reporter legally its as if nothing ever happened except for this and some big payments. By the way, in addition to getting their pay, the city could also be on the hook for Legal Expenses which could be 300,000 or more and could also be liable for up to 25,000 for each of the charges against the officers. A man pulled out a gun and shot a woman leaving with three friends. He got away. The victims are expected to recover. Police found a body identified as 22yearold jeffrey engler, a former cal Student Living in san leandro. Police discovered his body saturday morning at the pi kappa phi frat house. Preliminary investigations suggest that he died after falling from a significant height. The Police Originally called his death suspicious but now say there was no indication of foul play.
