Outside the redwood city courthouse with the charges this guy is facing. Devin. Reporter yeah. He is facing three counts of vandalism and he had an opportunity today to accept a plea to admit guilt and to agree to repay his alleged victims but he flatly refused and emerged from court defiant. Sorry the vehicles have been damaged. Reporter he refused to answer questions as he came out of court this afternoon. He had also refused to deal from the d. A. s office that would have seen the East Palo Alto landlord plead guilty to one count of vandalizing his tenantss cars. Could be up to three years in prison, depending on that. But it is what we really wanted was the flee the one felony count as well as the restitution. That was our goal. Reporter the man has been charged with three counts of criminal destruction of property. He is accused of breaking the windows of cars of low income tenants in an effort to force them out of their rent controlled apartments. The District Attorney says the crime tears at the fabric of a community. To make a few bucks the willingness to cause people to try to get them to be thrown out on the streets, um, thats why the the conduct is far more egregious and warranted felony rather than misdemeanor treatment. Reporter residents say they have been the victim of a campaign of fear and intimidation for years. The only difference this time, they say, is that the crime was captured on the complexs security cameras. Now, a potential deal breaker with this settlement is that it didnt include any stipulation about possible jail time, leaving the defendant open to the maximum three years behind bars. And so now his case will continue to grind through the criminal Justice System. He will be back in court in mid december. In redwood city, devin fehely, kpix 5. We just got new video of a San Francisco documentary filmmaker being released from jail. Kevin epps was arrested for the shooting death of a man in his glen park home monday. Prosecutors say he was freed because of a lack of evidence. Epps had been accused in the shooting death of this man, marcus polk. Kpix 5s Jessica Flores talked to kevin epps a short time ago. What is he saying about what happened, jessica . Reporter well, liz, kevin epps says it was a very emotional day. He says its been a very emotional past 48 hours. But wont talk about what specifically happened inside his home, although his lawyer does tell me that his client was acting in selfdefense. Can you talk about what happened that night . Did you shoot mr. Polk . [ pause ] my attorney has advised me to as it relates to the matters of this ongoing case, i really cant speak on that, period. Good to see you back, man. Reporter San Francisco filmmaker kevin epps posted his release from jail on instagram after police said he shot and killed a man in his home. That man, marcus polk, sr. , used to be married to epps current wife. This is a blessing. Reporter the San Francisco d. A. s office says they have insufficient evidence to chargers in the fatal shooting. Im just really blessed that San Francisco, you know, Justice System can work and justice can work for, you know, a black man in america. You know. And this has been very traumatic. Reporter i have talked to your friends and colleagues who say this is not him, he is not violent. I have to ask, what happened . Epps not answering. But his lawyer says he acted in selfdefense. The circumstances were such that the victim entered the home unwantingly unauthorized and made threats. Reporter do you feel any sense of regret . Im just going through a myriad of many emotions, just been such a traumatic experience. I cant this is a inhuman experience, you know . And im just processing that and just really trying to focus on my kids and my family and continue with my life work. Reporter and epps says he wants to continue to make documentary films about his community, about the criminal Justice System. As for the d. A. s office, they say they are continuing to investigate what actually happened inside epps home. In San Francisco, im Jessica Flores, kpix 5. For the third day in a row a major computer outage is impacting dozens of dmv offices all across california. Instead of the usual long lines at the dmv, some offices look like this. Empty. The outage was expected to be fixed by the morning but instead, many drivers were turned away at the door. The dmv has released a statement saying the repairs have taken a lot longer than anticipated. 21 of the 122 offices that women packed are back up and running. 17 of them are partially operational. A dead whale has washed ashore off the coast of daly city. We are being told this was a male blue whale. It washed up near mar vista stables on thornton state beach. Reporter on wednesday, the secretary of defense said whale the pentagon looks for a long Term Solution it will postpone collection efforts within the California National guard. Today, i ordered a series of steps to ensure fair treatment for the California National guard soldiers who may have received incentive bonuses and Tuition Assistance improperly as a result of errors and in some cases criminal behavior by other members of the california guard. Reporter those improper payments stemmed from overzealous recruiters trying to reach their enlistment goals. The pentagon says as many as 6500 soldiers in the California National guard were asked to repay their bonuses. That included robert richmond, who carried out missions in the notorious triangle of Death Outside baghdad. When he didnt pay back the 15,000, he says the guard reported the debt to credit agencies. It felt like betrayal and i want nothing more than to not resolve it for myself but resolve it for every soldier thats got that recoupment letter. Reporter the pentagon says it will sort through all the cases by next july. The Defense Department is working to set up a onestop place for impacted soldiers to go and get a review and a hearing. He teaches American Government classes to seniors at Sequoia High School in redwood city. I value their voice. Their voice and opinions are important. And at 18, i think they should be sharing them. Even if it means thinking outside the books. In here, like, we dont even use a textbook we just learn about Current Events and how that relates to how, like, the constitution is written. He wants young people to act so he is creating a political hall of fame where kids who become active in the election will get their names posted in this showcase. And thats not all.
