The latest police chief in oakland kept a low profile on his first full day on the job. Acting interim police chief Paul Figueroa says he is focusing on positive change for the department as it tries to overcome a sex scandal involving several officers. His appointment comes after the mayor fired acting chief ben fairow for an extramarital affair ten years ago. Fairow was on the job in oakland for five days. It is another setback for the department that was trying to end more than a decade of federal oversight. Kpix 5s da lin joins us live from oakland where theres a new hurdle to restoring public trust. Reporter i think were past embarrassment. Now were looking for consequences for the Police Department. A federal judge may expand his control over the Police Department. All the decisions made in this matter were the chiefs and ours. The monitor has concurred with those decisions. Reporter that was how mayor libby schaaf explained chief sean whents resignation. The monitor she is talking about is this man, robert warshaw, who is overseeing the reforms at the Police Department following a Police Scandal 13 years ago. Now civil rights Attorney John Burris is asking a federal judge to expand warshaws powers to oversee the recruiting and hiring of Police Officers. We dont want people who take advantage of young girls and sexually exploit them and pass them around like rag dogs. Reporter he points out many of the officers involved in the Sexual Misconduct case graduated in the academy in the last three years. Maybe we can make sure that we dont have officers slip through the cracks who have amoral philosophies. Reporter but not everyone is ready to support the idea of giving court monitowarshaw more power. I dont know that additional oversight is answer to any of the reforms that are needed. If oversight alone was sufficient, we wouldnt still be in oversight mode. Reporter the federal oversight has cost the city millions. Just this year alone, the city will pay warshaws Consultant Firm 800,000. Some say he has a vested interest to prolong the oversight given the money he makes but others think its necessary. I would be completely open to a federal oversight over the oakland Police Department. That means from the recruitment down to every level. To regain public trust, then i think thats an action i may have to take. Im not happy about doing that but im willing to sport complete oversight but im willing to support the complete oversight. Reporter john burris says a federal judge will make the ruling possibly next week on whether or not he will expand his powers. So we could hear a decision very soon. Stop data it racial profiling; strengthen its internal Affairs Units when it comes to investigating officers and lastly, improve how the Department Disciplines officers convicted of wrongdoing. What is it about money that really gets peoples attention . Well, money is the ability to carry out work. If you dont get money in your budget to pay officers then you cannot pay officers. Reporter sfpd came under public pressure after a series of officer involved fatal shootings one including a man who was killed seconds after they arrived on scene. Avalos and activists are proposing new reforms and more accountability, quarterly reports on data, metrics and increased transparency. When it comes to gathering the data, monitoring the data, effectively using the data to weed out abusive officers, it could very well be that the lives of so many people like emil carr, luis and others are at stake. Reporter the third of the Police Budget would be in reserve and if certain reforms arent met on time the money is frozen until they are. His early repartture came after the District Attorney asked for a different judge in another Sexual Assault case. Persky has faced criticism for sentencing former stanford swimmer brock turner to six months in county jail. Turn her just been convicted of Sexual Assaulting a woman who was unconscious but what many dont know is the judge was following someone elses recommendation. Reporter the judges sentence and rationale for it explained in court is strikingly similar to the Probation Departments report so some are asking why is the judge getting all the heat and the Probation Department is largely getting a pass . The criticism and scrutiny of judge Aaron Perskys sentence has been relentless but the probation report which echoed that decision and informed it has received far less attention. They are supposed to be solely providing information to assist the court in arriving at a sentence. Reporter kpix 5 legal analyst and former judge la l0]doris cordell says the probation officer is supposed to impartially weigh all of the facts of the case before making their recommendation. In the turner case, the probation officer considers the defendants lack of criminal history, young age and expressed remorse and empathy for the vic before recommending he serve time in county jail on probation. The victim in the case disagreed with the report writing an impact statement. Its a rallying crying for those who believe the punishment didnt fit the crime. In that statement the victim says a light sentence would, quote, make a mockery of the seriousness of of his assault. In the end, judge cordell says judge persky wasnt bound by the reports recommendations that and the sentence and fallout from it had rightly his. The judge basically embraced the report that the was submitted by the probation officer and decided to go that route. He didnt have to do that. Reporter judges have discretion. They can accept the probation report and recommendation. They can basically throw it out and give a different sentence that can even order the Probation Department to go back to the drawing board and prepare a new and presumably more thorough report. A Palo Alto High School teacher gets a date with the cops after he said he committed sex crimes against a student. 46yearold Ronnie Farrell is behind bars. Police said he asked a 15year old to meet him in his classroom after school let out. He then allegedly groped her. Her parents called dispatchers to report the assault. Then the next day, he invited the same girl to meet him again at the school. Detectives showed up instead and arrested him. In San Francisco, not guilty pleas from two people accused in the deadly stabbing of a construction worker. The pair is also charged in a second stabbing case. Police say they were arrested after a construction worker was found stabbed near folsom and harrison street and died at the hospital. The other stabbing case was in the tenderloin. In both Incidents Police say the suspect turned violent after they were refused permission to use restrooms. A south bay man heading to lunch is a hero. The man was on the way to lunch when he saw black smoke coming from the car when he noticed someone was inside he ran up to help. That person was unconscious so he pulled him to safety. The santa clara Sheriffs Department says the person in the car was suspected of driving under the influence and accidentally set the car on fire they say the man likely saved his life. In san jose an officer killed in the line of duty is being honored today by the entire community. There was a show of support from firefighters on a freeway overpass. They saluted officer Michael Katherman during the procession as his body was taken to the funeral home. We learned today that a public memorial for officer katherman is Tuesday Morning at 11 00 at the s. A. P. Center in san jose. Kpix 5s len ramirez shows us the respect shown today for officer katherman. Reporter police stood at attention and saluted as the family of fallen officer Michael Katherman passed. They went to the morgue to accompany it to the funeral home, hundreds of officers, a procession of Police Vehicles and dozens of civilians who gathered on the sidewalks to pay their respects. Hopefully this will show the people in the Police Department and sheriffs how they have support for what they do. Reporter katherman was 34, an 11 year veteran killed on his motorcycle in the line of duty on patrol tuesday afternoon when a van turned left into his path on 10th street striking his motorcycle nearly head on. When i saw the collision and saw the Police Officer bike down [ pause ] [ crying ] i was out of my truck in two seconds. Reporter the cement truck driver, dan sullivan, was one of two Good Samaritans who used the Officers Police radio to call for help. [ 911 call ] reporter while trying to revive the officer with cpr. [ 911 call ] i was on the radio. I was trying to, you know, speak to the officer . Reporter sullivan, who is the brother of a san jose cop, says he has had a hard time emotionally ever since. Just want to give my condolences to the wife and kids of officer mike. Reporter there are growing memorials at the Police Department and at the scene of the crash. Katherman was raised in san jose and graduated from valley christian high school. His funeral is scheduled for june 21 at the s. A. P. Center. In san jose, len ramirez, kpix 5. San Francisco Police are looking for a 15yearold girl who they believe might be in danger. Christine coleman is 510, 120 pounds, black. She is wearing a pink top and bluejeans. She was last seen with her father 53yearold derrick coleman. He is 63, 215 pounds, last seen wearing dark and a gray shirt. They are driving a black 1998 Toyota Corolla license plate number 4amj436. If you see the car, the girl or her father, call the police. Why did the bear cross the road . Its what one california Highway Patrol officer wants to know. He reported a bear on highway 128 today near healdsburg. Biologists from state department of fish game responded about noon. The bear wandered off the highway and into a nearby vineyard. Officials say they are just going to monitor the bear and let it leave the area on its own. Right now hundreds of firefighters in Santa Barbara county are battling a fast moving wildfire there. The socalled sherpa fire is burning in the refugio canyon. Its about 30 miles north of Santa Barbara. The winddriven fire has scorched 1200 acres. Nearly 500 firefighters are working to contain it. Nearby parts of highway 101 have reopened after firefighters had to shut it down. Officials say vegetation hasnt burned in 70 years. Reporter amy johnson shows us the damage and the rush for nearby residents to escape. This fire is still burning quite a bit. You can see from our Vantage Point a lot of smoke in this area. And you can see that there are different patches of the smoke in the area. It has been said that there are 1200 acres that have burned but that number is expected to climb because that number was obtained at 6 a. M. This morning. So they are expecting that number to go up and again it is just zero percent contain. Fire crews are battling the fire from the ground and from the air. But they are struggling with one side of the fire, the east side, because there are no roads in that area so they are sending in hand crews and they are tackling it by the air. And more importantly, they know that this weekend the temperatures are going to rise and the conditions are going to get worse. So they are trying to hit this fire with everything they have. And as the evening approaches, they know they will also be dealing with sundowner winds. The winds will pick up and again, make this fight a little more difficult. Back to you. Amy, thank you.
