Reporter she heard the rumors the fire may have been started by a marijuana farmer. Most of the community is worried since they moved up here that Something Like that would happen. Reporter as for the fire itself, its days are numbered. A cool, moist sea breeze with a steady stream of helicopters making bucket drops meant we didnt see any major flareups at all. [ chainsaw ] reporter we caught up with a prison work crew as they chased down hot spots on a steep hillside. As the fire winds down and burns out, investigators will get in there and find out the cause. Theres been some chatter it might be a marijuana farmer that caused this. The fire itself remains under investigation. Reporter is it suspicious in nature . We just dont have any better information at this time. Reporter and so this is the windiest day of the week. The fire technically is still not out, though. It could flare up. They have not gotten in there to determine the point of origin or even begun the investigation into the cause of the fire. Allen . Bright orange flames tore through a Historic Church this afternoon in berkeley causing part of the roof to collapse. The fire started in the building behind the First Congregational Church on channing way near the cal campus. Firefighters adjusted their tactics as the fire grew. Emily qwyn stahlhud mother its kpix 5s emily turner on how the fire is just now sinking in for church members. Emily. Reporter its very disappointing for members of the community especially members of the church. Luckily, though, as far as those flames go, those have come down and you can see whats left of the building. Right now actually the Sheriffs Department and the Police Department as well as the Fire DepartmentJust Launched a drone so they can see from the air just howed about that damage is. My parents church so it makes me sad. Reporter the Church Building was dedicated on this day in 1884. Now the neighborhood mourns the loss. My parents have been members. Offices and above the thrift shop have burned. Reporter the fire started just before 1 00 today. It bushed so dangerously firefighters had to pull their men from the building. You can see the building start to crumble. The chimney may collapse. We have removed the engineer who was pumping on that engine so he can be safe. Reporter there are no injuries and no cause so far the the daycare they run was evacuated and another across the street was told to shelter in place while 60 firefighters shut down city blocks to battle it. It was a historic part of the community. It housed the homeless in the winter, host concerts and choirs for the neighborhood. Its a great loss. Its a beautiful church. Wonderful venue. Reporter and that chimney that the fire chief was talking about earlier, you can see it Still Standing right now but a portion of the wall next to it, the chief isnt taking any risks. They will need a Structural Engineer to check it. They are also checking for hot spots. The first congregational has a long history in berkeley. It started in 1882 and moved to a larger building two years later become the citys first formal church. A new one was built in 1925 and thats the one that burned. In the north bay, novato firefighters are mopping up from a vegetation fire on marin valley drive. The fire covered about 18 acres. No homes were affected. The fire is about 75 contained right now and crews will be on scene this evening to deal with any flareups. New at 6 00 bay area families forced to pack up and leave many of them with nowhere to go. They claim their landlord is trying to beat a big rent control vote at the ballot box. Todays the deadline for many of the families living in the creek view apartments. Those are in richmond. To move out. Kpix 5s da lin reports the mass evictions come weeks before the people are set to vote on new protections for renters. Reporter its moving day. Some of these longtime tenants have no place to go. Everything is going to go into storage. Im going to move in with family temporarily. Put my stuff in storage and probably sleep on their couch here or there, you know, i dont want to be a burden to somebody else. The same situation im going to be put in, you know, couch hopping. Reporter these seniors never thought they would be homeless. For me to be uprooted like this after 22 years, i mean, just, you know, blindsided. Its devastating. Im depressed. Reporter the landlord, who lives in beverly hills, is evicting everyone so contractors can renovate the large complex. Creek view condos in richmond has 200 units. A pr unit for the landlord says all the units have mold. We dont believe in bandaid fixtures. We want to do it the right way. Reporter tenants think they want them out before richmond votes on rent control in november. If passed landlords would have to pay tenants to leave. The pr firm says the rent control measure has nothing to with the evictions. I have got notes all over through here that i been contact these people. I have been gone as far as pleasanton. Reporter 20 people havent found a new place. They cant afford it. Right now most of them pay 1,200 to 1,400 a month for a one bedroom. Im using one paycheck going into another paycheck just to pay rent. Reporter many families have to be out by tonight. Some tenants were given until october 15th to move out. So far the city of richmond has done nothing to help these tenants. In richmond, im da lin, kpix 5. The tenants were told that once the renovation at creek view condos is done, those who want to move back would have to pay market rate rents. They would also have to reapply and qualify. Nearly every city leader in san jose is calling on voters in the city approve measure s in november. It basically overturns measure b which passed in 2012 and would restore pensions and benefits. Kpix 5s len ramirez shows us a new ad and talks to people on both sides of the measure f debate. We had to declare a state of emergency. Reporter it places police chief in a starring role in the ad as political pitchman for san joses measure f. Losing more officers than we have been able to train. Reporter measure f which would undue parts of measure b which was overwhelmingly passed in 2012, is seen as the last best hope to rebuild the struggling san jose Police Department. Its my job and my duty to do everything i can for this Police Department and for this community. And so its just important to educate the community and people when they are going to make this decision, this critical decision. Reporter the Police Union Says san jose has lost 630 officers in the past five years. Theres been so much mandatory overtime to cover patrol beats that officers recently started camping overnight in rvs as kpix 5 first reported last month. The reality is were running out of runway. Reporter like the chief, mayor sam liccardo is going all out including spending his lunch hours at a pizza joint to help raise money to pass measure f because he cant make those calls on city hall time. We have to fundamentally fix the challenge we have as an employer in san jose to recruit and retain officers. Reporter but measure f does have its opponents who say its not fully baked. We dont know what the true costs are going to be, said former councilman Pete Constant to create a new pension benefit without knowing the full costs and impacts is foolhardy and is what got us into this situation were in now. A new poll of likely voters shows that measure f would pass by more than 2 1 but the poll also shows a large number of people in san jose a22 are still undecided. In san jose, len ramirez, kpix 5. Just in the last hour we learned that the San Jose Silicon Valley Chamber of commerce voted unanimously to endorse measure f. The chamber says measure f is a sound compromise to solving san joses policing issues. Going shopping in san jose this weekend . You might want to do it in the next few hours. As of tomorrow, the sales tax is going up from 8. 75 to 9 . Voters approved that bump back in june. The revenue will go towards road repairs and public safety. The tax will be in effect for the next 15 years. And it is expected to generate 30 million in the first year. San Francisco Police are going after speeding drivers. It is all part of the safe speeds sf campaign. Kpix 5 reporter jackie ward did some testing and found out trying to drive the speed limit in San Francisco isnt really all that easy. Jackie. Its one of the streets city data and analysis found where traffic speeds, injuries and deaths are all high. Sfmta spokesman paul rose says San Francisco is trying to get the number of traffic fatalities down to zero by the year 2024. The governor is cracking down on rape offenders in california with two new laws inspired partly by the brock turner case. The jury found the former stanford swimmer guilty of Sexual Assault. He served three months in jail and got probation because his victim was unconscious. But under a new law signed today a judge is required to sentence offenders like turner to prison instead of probation. Another law expands the Legal Definition of rape so it includes all forms of nonconsensual Sexual Assault not just intercourse. The prosecutor in the turner case says that she told the victim about the changes today. She was absolutely ecstatic, overwhelmed, that just a few months ago we were upset and saddened by the sentence but now the law is changed such that women on College Campuses are safer. The Legislature Passed the laws with a nearly unanimous vote. It takes effect on january 1. A popular park where the pavement is filled with cracks. There were big plans to fix them. Reporter thank you. An interesting and i guess sort of embarrassing start to life here in San Francisco. I was out for a run here in the panhandle a couple of nice ago and took a bad fall. Thankfully a couple of other kind runners stopped to see if i was okay. Apparently they have had plans to make repairs over a year. But repaving it is no longer a priority. Probably run maybe three or four times a week through the park. Reporter emily usually avoids the sidewalk inside the panhandle during her weekly run run. Its easy to stumble while running or just trip. Reporter tree roots, plus general wear and tear, creating cracks and crevices that makes running dangerous. Its completely unsafe. Reporter shelly no longers takes the stroller into the walk forcing her to walk along the bike path. She wants the city to do something and fast. Fix the sidewalk and running path so people dont have to crowd the bike path and frankly piss off the bikers. Reporter the city knots this park needs improvement knows this park needs improvements. They announced a project last summer. Construction was to start this summer to repave this pathway. A half Million Dollars are in place for the project but all that money is going to l. E. D. Lighting, trash cans, lighting, landscaping, but repaving the sidewalk isnt at the top of the list. I reached out to the Parks Department over the past three days trying to go on camera to explain why this path is no longer a priority. And they told me no one had time to speak with us. Veronica and allen . Thank you, susie. Two drifters accused in the killings of marin hiker and tourist in Golden Gate Park are going to trial. A marin county judge ruled during a preliminary hearing this morning. Murder charges for Morrison Lampley and Lila Alligood also include special circumstances of lying in wait and murder during a robbery. A third drifter charged with the murder sean angold testified against the other two. We caught up with Allen Martins attorney after the hearing. Alligoods attorney after the hearing. Whats the most frustrating thing about the preliminary hearing . It took a while and the [ indiscernible ] rules were issued for me but its just a preliminary. Its the d. A. s show, not our show. So we dont get to put on the versions that make the whole truth come out. We have to wait until trial. Prosecutors say alligood and lampley went on their crime spree so they could start a pot farm in oregon. They are due back in court late next month. This afternoon a former sheriffs deputy caught up in a Bay Area Police sex scandal was arraigned in hayward. Ricardo perez pled not guilty to a charge of a sex act with a minor, a felony. Perez did not have to post bail after the hearing. A 19yearold woman Jasmine Abuslin says she had sex with perez about 10 times in the Oakland Hills last year. She claims she had sexual relations with about 30 bay area officers. And in some cases when she was under age. Jasmine abuslin has now filed millions of dollars in claims against several agencies which will likely lead to civil lawsuits. This week her attorney said five officers in richmond took advantage of her instead of helping her escape prostitution. They said those officers did not have adequate training for identifying victims of sexual exploitation. They paid millions of dollars for a condo in a luxury highrise in San Francisco only to find out their investment is now worth next to nothing. As we have been reporting Millennium Tower in the south of market area is sinking more than a foot and also tilting a few inches. The San Francisco examiner reports the assessment appeals board has received 163 appeals from condo owners at that troubled tower including people such as former 49er joe montana who claims his unit was worth 2. 8 million.
