Deadly shooting along montereys historic cannery row happened on wave street around 1 00 a. M. Where police found a victim with several gunshot wounds. He died at the hospital. This type of crime very rare. Its the first homicide on cannery row which overlooks monterey bay since 1991. No arrests have been made. Police believe the 28yearold victim was targeted. Its been two weeks since the election and the ballot counting continues in santa clara county. Workers were busy tallying the last 50 ballots at the office in san jose today. Several races are still too close to call. So the process is far from over. An automatic manual recount will start on monday. It will be between 150 and 200 staff hand counting ballots for 7 to 8 days. After that, we will perform our final manual audit and certify the election by december 8. As of this morning, there were still nearly 1. 8 million unprocessed ballots in all of california. Thats more than the populations of San Francisco, oakland and stockton combined. New at 6 00 a late count of ballots shows california voters have approved prop 66. That means big changes to the Death Penalty process. Now, some of the men here on californias death row were sentenced to die in the 1970s or 1980s. But they are more likely to die from illness or suicide than execution. And the numbers are in. It looks like a majority of californians have decided to change all that. California voters have hit the gas pedal on the Death Penalty. It was a close vote but now we know that proposition 56 will pass. That measure is supposed to speed up the Death Penalty process. Prop 66 green lights the Death Penalty, speeds appeals guards against wrongful convictions monitored by the supreme court. Reporter the vote will officially be certified on december 9. So what happens on december 10 . Will executions resume . If the court dont stop it, if we just went now we have this new law, clearly in 2017, execution dates should be set. Reporter steve wagstaffeis the district attorney. 20 have exhausted appeals on death row and two of those 20 have committed their crimes in san mateo. As soon as this law is certified, as soon as it is, you know, formally on the books, we will go into court and ask our trial courts to set execution dates. Reporter california hasnt executed anyone since 2006 because legal challenges against the method of execution having dragging out in courts. Now proposition 66 is supposed to resolve that issue but wagstaffe expects more lawsuits. Theres already been one lawsuit that was filed directly with the California Supreme Court trying to stop prop 66 even before the vote was finalized. And there will be many more. Reporter but theres more to prop 66 than a new method of execution. Theres also new rules to speed up the appeals and appoint lawyers more quickly. In order to carry out the mandate of the ballot measure we are going to need hundreds of lawyers, hundreds of new courtrooms that are open to do these cases. Reporter he represents San Francisco. He doubts that lawmakers will prioritize funding for more lawyers and judges. The voters have spoken and obviously folks will do what they can to comply with it but the budgetary pressures of adding hundreds of millions of dollars on top of a very expensive Death Penalty system is going to be extremely challenging. I agree with him. It is going to be difficult for our legislators to do that. The choice will be whether our legislature decides they want to uphold the will of the people or whether they want to impede the will of the people. Reporter assemblyman chiu says that this whole budgeting process could be made even more difficult if the Trump Administration withholds billions of dollars that the state gets from the federal government each year. New at 6 00 a plan to transform the Petaluma River into a Recreation Area is moving forward. Organizers want to build a 300,000 small boat dock at steamer landing park. Kpix 5s don ford on the new grant that could make that dream into a reality. Reporter theres actually great paddling in petaluma which is sort of its extremely under used body of water. During the morning its beautiful. Reporter friends of the Petaluma River agree. They operate out of this historic barn and now with a 100,000 grant, from the Sonoma County agricultural and open space district, they are planning to replace this dilapidated rundown ramshackle dock with something the public can use. But 100 grand will only get you so far. This 100,000 grant will get us about a third of the way there. But its going to do a lot for this community. Reporter to completely rebuild a new floating dock system, its estimated to cost 300,000. The friends of the river know they still have a long ways to go before the new kayak dock becomes reality.
