Private property, litter and calling the truck and eyesore. The city sided with casa real and told nelly she needed to move. Thats when the general public took a stand on social media against casa real. Yes, i had a facebook review and google review of one star and mentioned they are bullies. I thought it was terrible and disgusting. Reporter in a matter of hours, casa reals social media reviews went from all five stars to a series of one star reviews. Callahan says they never meant to hurt her business or for things to go this far. So they are offering her space on their land. Thats the ultimate goal is to is to peacefully coexist like we have for years. Reporter now, this sounds like a nice compromise. Of course, if nelly accepts. But theres one more wrinkle. The city says it still has to make sure that no one is violating traffic laws. So its planning on putting up no parking signs along vineyard avenue tomorrow where nelly used to park. So the problem may still exist. Veronica . All right. Susie, we appreciate it thank you. New at 6 00, the mayor of santa clara is calling out the San Francisco 49ers saying that the team has taken advantage of the city. Kpix 5s devin fehely on the money fight hanging over the start of a new football season. Devin. Reporter yeah. Well, tonight soccer fans are streaming into levis stadium for a game here this evening. Now, for anyone who had been hoping that the off season might improve the off the field relationship between the city of santa clara and the 49ers, the short answer is it hasnt. The issues that divide them continue to do so. Santa clara was ill prepared to manage this. And the 49ers i believe took advantage of that. Reporter Court Battles and constant bickering have come to define the acrimonious relationship between the city of santa clara and the 49ers. Even the release of a long awaited audit report examining the stadiums finances seems unlikely to resolve issues. I think the audit is going to be illuminated due to the lack of clarity and transparency. Reporter santa clara mayor lisa gillmor says auditors spent nearly a half million in taxpayer money for protection at the events that should be paid back. No money from the public should paid for the stadium events the crux of measure j and thats violated. Reporter they said the audit is full of erroneous information, halftruths and out right misrepresentations. The team says if santa clara underbilled them for Public Safety costs the error was the citys and not theirs. No one from the team wanted to talk. They fear the public feud has the potential to hurt business and in turn the citys bottom line. But the mayor says the legal and Financial Issues have to be hammered out to protect the city and the Citizens Investment in a 1. 3 billion stadium. We actually work for the public. We want to make sure its successful. Most of the time our goals are aligned. Sometimes they are not going to be aligned. Reporter now, the mayor says that final audit report should be out early next or towards the end of next month. There is also a court battle over financial documents the city says the 49ers should have but never turned over and one Additional Court battle over how much the 49ers have to pay the city in rent. Kpix 5s emily turner live in San Franciscos Castro District where a protest just began. Emily. Reporter veronica, they got started just after 6 00. They have flags and banners and posted and a loudspeaker chanting, if our rights are under attack, we will fight back, which they say is starting peacefully here tonight. This october, transgender military members have been able to receive medical care since october and officially change their gender identification in the personnel system. Now they wont be allowed in the military at all. If you serve in the military like i did and others, this is not a factor. It just is not a factor. Reporter Theresa Sparks was drafted and already fought during one war in vietnam. And now thanks to President Trumps ban, the transsh veteran will fight a political war. Its outrageous. Like i couldnt believe it. I thought it was a joke. I mean, to do it number one makes little sense. To say the outrageous things why he was doing it makes no sense. Reporter especially for those who are out and in the military already. Experts say they must now wonder what their future holds. And if they will keep their jobs. That means that its time for a purge. There are thousands of transgender troops serving loyally and honorably and they have been serving all year and the president declared open season on them today. This is a witch hunt. Reporter aaron belkin is with the palm center that studies sexual minorities in the military. He says President Trumps claim that transgender members disrupt service and their medical care is too expensive are based on bogus information as is, he claims, the white houses claim that this is a move the military wants. This ban is dont ask, dont tell 2. 0 and its a shocking attack on loyally serving american troops. This is not about the military. The military did a year of study and concluded that inclusive policy works. Reporter even local republicans are speaking out against the ban. It doesnt matter if you wear a moustache or a direction if you are willing to put your life on the line for this country and you can serve and you can do the job well, then thats all that needs to thats all that really matters. Reporter as you can imagine, we did have some trouble finding someone here locally in the bay area who is willing to go on camera and speak openly about their support for this ban. At this rally today there are at least 200 people. But we have a statement from tony perkins, who is the president of the conservative Family Research council. He says, quote, i applaud President Trump for keeping his promise to return to military priorities and not continue the social experimentation of the obama era that has crippled our nations military. This will likely continue for some time and well have continuing coverage this evening at 10 00 and 11 00 so be sure to tune in. Reporting live from the castro, emily turner, kpix 5. New at 6 00, perhaps a change in policy after san jose threatened to fine Charity Groups who were feeding the homeless the idea was to clean up st. James park. Our kiet do is there and says at least for now both sides are talking about this. Kiet. Reporter yeah. The big headline to come out of this meeting is that there was an august 5 deadline where San Jose Police were set to start writing citations and busting people for feeding the homeless here in the park. That deadline is completely off the table now pushed back indefinitely. Tensions have been rising between the homes advocates and the city and today, they met to try to begin to hash things out. Officially, today was a Food Service Provider partner meeting. Nearly 3 dozen people including the housing department, parks and rec, San Jose Police along with a host of Homeless Service providers gathered to talk about how to get the homes who have been hanging out in st. James park for decades into nearby soup kitchens. We are committed to working to find solutions that meet the needs of all san jose residents. We want to make sure we are connecting people with the resources they need to not only survive but to homelessness in the long term. Reporter last month the city announced it was cracking down on the feeding of the homeless at st. James a long time tradition for churches and good samaritans. The city argued food alone wont solve homelessness and the homeless are better served if they get wraparound services, help finding housing and counseling for drug addition and mental problems. Churches and homeless advocates pushed back saying the feeding ban was inhumane and staged feedings anyway in protest. Is this meeting enough to quell some of the unrest amongst advocates . No. This is just were just scratching the surface. Reporter you still plan on fighting this feeding ban . All the way tooth and nail to the end. Reporter San Jose Police say issuing fines and citations is a last resort and that open dialogue with homeless advocates just might avoid confrontations. We hope that by continuance to bring them to the table and give them a voice, provide them with an opportunity to help us find solutions that we can avoid the need for them to really want to take a stand at st. James park. Reporter theres been a lot of chatter about building a centrally located building with those socalled wraparound building. Whether or not theres funding and political will to pull that off remains to be seen. Well wait to see how this plays out in the months and years ahead. Live in downtown san jose, kiet do, kpix 5. The state run agency has seen a 63 increase in calls this year over last year for nests and wasps. The Yellow Jackets nests did not die out like they normally do in the wintertime so they are bigger this year and theres lots of rain that helped more vegetation an insects who have had more food. Mainly on the nevada side of the border but just a sign that even though things are super dry in the bay area during the summertime, you dont have to go that far if you want to see some rainfall. We will not see rainfall around the state capital tomorrow. The state fair continues, sunny, 100 degrees in sacramento for thursday. So this area of low pressure which is fed in a nice marine layer is beginning to dissipate and also beginning to move out. What that will do, it will open the door for something new to move in, the same ridge of High Pressure which bounced back and forth from Southern California to new mexico. Its on a trip back to the west and what that will do is further compress the marine layer and warm up the atmosphere. Those two things will combine to give us hotter weather and will stay hot this time because the ridge will stay for a longer period of time. Fog returns to the coast and bay overnight tonight. What happens in a pattern like this you get more of a temperature spread. Temperatures will cool a bit near the water but they will warm up in the afternoon inland.
