As far as what was or was not captured, again, i will have to defer to the Alameda County Sheriffs Department who is conducting that investigation. Reporter bart patrol officers have been ee equipped with these cameras since last summer trained to use them during any enforcement action including searches like the one that ended with bart Sergeant Tom Smith killed by friendly fire. If you capture some events or object on video and its in a system that cant be tampered with, its irrefutable what you see. Reporter plainclothes detectives are not required to wear the cameras but uniformed officers are. At least two officers in uniform were on scene during tuesdays search. Our personnel train for these type of scenarios. And what they did, how they approach that department, is important with our training. Reporter but if reports are right and no video exists, it raises a red flag for oakland attorney john burris. He represented oscar grants family after the infamous fruitvale shooting. When a camera is not on when it was supposed to be you have to wonder why it wasnt on and also unfortunately eliminates a quality piece of evidence. Reporter and bart officers began using those body cameras in large part because of the fruitvale shooting. Meantime, today a show of support for fallen officer Sergeant Tom Smith. His san ramon neighbors are flying the American Flag in his honor. Flags were flying today on porches and front lawns. A Memorial Service for smith is planned for next wednesday. A major gun manufacturer is refusing to sell certain handguns in california. Reporter the sacramento gun shop owner says the states newest regulation is more of the same. It creates problems for me and the manufacturer. Reporter smith wesson announced it will stop selling new handgun models in california rather than comply with the controversial law. It requires new or redesigned semiautomatic pistols to have a feature called microstamping. Each time a gun is fired, it stamps a unique code on every bullet. In a news release, smith wesson says, a number of studies have indicated that microstaring is unre microstamping is unreliable, serves no safety issue and is not proven to aid in preventing or solving crimes. He says his lawabiding customers are the ones penalized. Responsible firearm owners are not the problem but they are being constantly picked on because they just dont like guns in california. Reporter on the other side of this always contentious debate, the law center to prevent gun violence. Quote, Smith Wessons statement represents the same hysterical reaction that we have come to expect from the gun lobby every time a new safety standard is required by california law. It is not surprising that the gun lobby is trying to use scare tactics to stop the implementation of this law since they have done the same thing in the past. Smith wesson will keep selling existing handgun models in california. But since they refuse to use microstamping with the new models, you wont find them here. And by the way, you wont be allowed to go across the border to oregon or nevada to buy guns since youre required to live in the state where youre purchasing a gun. Nick janes, kpix 5. Another large gunmaker ruger also says that it will stop new sales in california. And another group filed a lawsuit against the state over the microstamping law. Safety advocates say that the law will make the state safer. New at 6 00, San Francisco General Hospital says its made major changes to ensure the safety and security of its patients. Those changes come following the death of lynne spalding. Her body was found in a hospital stairwell in october more than two weeks after she disappeared. The hospital says it had federal officials check out the improvements this week. They include daily searches updated policies on tracking patients and alarms on stairwells. We have taken it very seriously and made many significant changes to assure her family, our patients today, our patients in the future, and the whole city that we are safer now. Those changes primarily have been around security and safety. A review of spaldings disappearance found numerous communication breakdowns as well as a lapse in searches of the hospital. State Health Officials report a dramatic spike in the number of flu deaths this season. We have been talking about this. They have almost doubled to a total of 95 this year. Health officers say its not too late to get vaccinated. Santa clara county reported today two more flu deaths. This time last year the state says only 9 people died from the flu. State lawmakers are demanding answers over another controversy with the new bay bridge. Caltrans is being accused of brushing aside safety concerns during construction. Whistleblower mike morgan an engineering geologist says his supervisors covered up structural problems. A report commissioned by the state senate a project official reportedly told an engineer not to document concerns but voice them instead. Caltrans says its not a cover up, just a difference of opinion. After the falsifications were discovered, they quickly became apparent to me it quickly became apparent to me that was problem was being ignored or covered up and kept secret. I have no reason to believe that there was any coercion or anything like that and bullying to make determinations. Caltrans says the bay bridge is structurally safe and the quality was not compromised. There will be another Senate Hearing next month. That one dealing with possible reforms for caltrans. A great day of competition and a South African for the second time won this mavericks invitation national, grant baker out of durban south africa, won the title second a hawaiian and third was Ryan Augustine of santa cruz. Local guy. This was a big contest, big time contest. A lot of people came out to enjoy it. Many of them seeing their first big surving contest ever. You really know a sporting event is huge when it has the power to draw in the casual or nonsports fan. Today the mavericks surfing invitational brought them in by the thousands. Do you know anything about surfing . No. But you know about mavericks . Yes. Reporter what was once an obscure surf break on the San Mateo County coast is now a destination for the worlds greatest big wave surfers. Guys willing to risk it all to conquer the fastmoving four story high walls of water. Its a Major International happening streamed live around the world an event with enough gravity to take people out of their normal orbits. We had never done anything like this before. Its a great time just to say you were here in california. Were here. Reporter nevermind the fact that spectators cant even get close to the beach anymore after rogue waves wiped out crowds at the 2010 contest. Spectators now must watch a video feed of the contest in a Hotel Parking lot about a mile from the waves. But still, they come. What makes it mavericks . Big, fast drop, everything you could think of that you look at a wave. Reporter gary bayless surfed california and hawaii for 40 years. Its not waikiki. Reporter since you are brandnew fans what can you tell us about it . Its dangerous. Reporter the newbies know that, which is what gives this event its human drama appeal. They are taking risks. They are up against waves that are 50, 60 feet high. And theyre executing this beautiful graceful, you know, body in motion. And its beautiful. Reporter it is a beautiful sport. Lots of courage and skill shown by all the surfers out here today at mavericks. Other top finishers rounding out the top people were tyler fox of aptos, greg long of san clemente and anthony of santa cruz. So ken, there were a couple of californians in the top 6 but a South African won the mavericks invitational. Im wondering how much of the attraction is, you know, that ultimate wipeout thats going to happen at some point . You know, this is an invitation nol not just anybody who thinks they are a surfer can get out there. These are men who are hand picked. These only a couple of dozen of these men. You get a chance to talk to any of them . Reporter didnt get a chance to talk to them. Their timing and our timing to get this story on the air didnt work out. They are coming out of the water about the time were putting our stories together. So but i do know that a lot of these men have a lot of experience. You do end have a lot of newbies here. Not a lot of young guys. Theres a lot of older surfers in their 30s and 40s who have to know the wave, have to know this break, have to know how it pitches and where to go and when to take off, hold back. Theres a lot of knowledge that goes into winning a contest like this. Obviously, with twiggy baker winning the second one, you know, it shows that experience counts in a contest like this. Police believe the 14yearold still has the murder weapon. Police say the shooting happened in this onebedroom apartment. Family members say the 14year old suspect shot and killed his own sister after she bleached his clothes. Their father mario toliver, sr. , is devastated. To stay that im hurt, its devastating. Its sad that he got to go through this. Reporter this is the sister, 17yearold Justice Toliver. Neighbors said they heard two to three shots. The property manager says surveillance cameras recorded the teenager running down the hallway and leaving the complex. Police took the video. Doesnt make any sense for people being killed or shot because of laundry. For me, its liker, oh,er, crazy. Reporter the property manager says the two siblings have been living with their grandmother at this fifth floor apartment for a couple of years. Its a tragedy. Were sorry about it. Reporter both the cops and family are looking for the boy. Im trying to find out or catch up with him. He doesnt have a cell phone. Reporter Oakland Police are even offering a 10,000 reward for information leading to his arrest. We are treating him as armed and dangerous. And the reason is we have not recovered the weapon. In this case its a handgun that was used. Reporter the father says he has already lost his daughter. He wants to save his son. Please, son. The property manager at the condominium complex says this is the first shooting they have had there in 30 years. In palo alto, police have released a sketch of one of the suspects involved in a Home Invasion robbery in palo alto. Investigators are looking for this man and two others in their 20s. They say the suspects barged into the home of an elderly couple yesterday and robbed them. The 80yearold couple were forced to lie on the floor for 15 minutes with a gun to the head. The robbers took off with wallets, cash and valuables. A roof repair job in San Franciscos twin peaks neighborhood took a terrible turn this morning. A homemade scaffolding collapsed sending three workers falling 20 feet on clayton street. Police say it started off as a minor roof repair but then grew more elaborate. Evidently, nobody got permits so this is all unpermitted. So if the permit process was involved, i dont think this would have been approved. The workers were taken to San Francisco general with various bone fractures. Two were said to have life threatening injuries. Other bay area headlines tonight, faulty wiring may have caused a marijuana grow house in pittsburg to go up in flames overnight. When firefighters arrived they found flames through the roof. Investigators say the suspects were stealing electricity with some pretty sophisticated equipment. A brush fire raged through an east san rafael marsh this burning burning three acres. It was out in 45 minutes. There was a concern because of red flag warnings in the area. The marsh is used as a homeless encampment. Bay area skies blanked by a thick haze today. And, of course, were mired in what could be cal scientists said it might be a 500 year drought were talking about here, no rainy season drier for 500 years. We have seen no rain for january.
