Meeting changed its agenda so that barts police chief could address the board and give the latest update on the investigation. A moment silence in memory of our Fallen Police Sergeant Tommy smith. Reporter emotions are still raw for bart police and its chief. We have a lot [ pause ] outpouring of support from the public and Law Enforcement around the country. Reporter bart Board Members asked questions about the investigation over Sergeant Tommy smiths death. Robert raburn asked the chief to clarify if officers were wearing cameras during the incident. Two uniformed patrol officers did have videocameras as required by policy what it captured i dont know. Reporter whether or not the video will help the investigation is unknown. Bart police are not officially naming the officer who shot and killed smith. Kpix 5 confirmed it was michael maes. John henry lee was not home at the time the officers were searching for stolen property. An hour into the search maes killed smith. The details are unknown. Please convey the condolences of this entire board and bart family on behalf of all of us. Its a real tragedy. It wont be forgotten. Reporter Funeral Plans are in place. We know the sergeants viewing will be next tuesday in hayward and his funeral wednesday morning at three cross church in castro valley. Thank you, cate caugiran. The officer who fired that fatal shot michael maes is on administrative leave. Its unclear what happened. The Law Enforcement experts believe the cramped apartment may have played a role. Being in a tight confined area, limited Movement Capability and probably some type of tripping accident bumping into furniture accident or Something Like that. I mean, thats what i would speculate but again, we cant tell. The wife of detective Sergeant Smith opened up to kpix 5 about the husband she lost. Smith is known to his family as tommy. His wife, two brothers and brotherinlaw are all in Law Enforcement, as well. They invited Juliette Goodrich into their home to remember tommy. If you are lucky to find the love of your life, you hold on to it. I did, i cherished every moment. Reporter kellie is a k9 officer with bart pd. She was working when she heard the call about her husband come in. This was friendly fire. Friendly fire. Reporter kellie rushed to Eden Medical Center where her husband was pronounced dead. And then she learned he was accidentally killed by a fellow officer, his own partner. Not only my family out here grieving, his family, theres another officers family out there grieving. So just hope that the community respects everybodys grief and supports everybody involved. Reporter Patrick Smith is tommys older brother. He is a Field Training officer for newark pd. You know, you dont expect to bury your brother. You expect to bury your parents. You expect to bury your grandparents. Not your little brother. Reporter ed smith is the oldest of the three. He works for the Alameda County sheriffs department. He says tommy would refer to his wife and 6yearold daughter as his girls. Its hard. Its really hard. But a lot of support has helped. The Police Community is incredible. Reporter tommy comes from a family of Law Enforcement. And they have one rule never say goodbye, just say stay safe. Never say goodbye. Just i love you, stay safe. Thats all you can do. No guarantees in life especially in our line of work. Reporter tommys brotherin law is a k9 officer with hayward pd. Tommy wasnt just a brother inlaw to me. He was my brother. [ crying ] i gained two more. Reporter all of them in Law Enforcement, all of them knowing they risk their lives every day to serve and protect as hard as it was for them to talk, they wanted the community to know they appreciated the support and they wanted to express their heartfelt condolences to the other officer and his family. We have been through losses and we have been through that and we have been going through doors not knowing whats on the other side. I mean, i know that. But sometimes i dont understand what happened. I dont know what happened. Reporter kellie told me she wants everyone to know tommy was an amazing husband and father and that is how she found the courage to talk. We were thrilled. He is the love of my life. My daughters, everything. Tommy will always be my heart. Ill love him forever. Reporter Juliette Goodrich, kpix 5. A new report suggests caltrans tried to cover up safety problems with the new eastern span of the bay bridge. The investigation was commissioned by the state Senate Transportation committee which will hold a hearing on the matter tomorrow. The report says an official overseeing the construction project told an engineer not to document concerns but, rather, voice concerns so theres no paper trail. There are real large concerns about the integrity of the system, the transparency and the compliance with the spirit if not the letter of the public records act. We are reviewing the findings in the report and we will respond to the findings in the report friday. Safety concerns came to light in the months before the spans opening last year. Those issues included defective bolts as well as problems with the welds on the bridge. State Health Officials are calling the flu season severe especially after six more flu deaths were reported here in the bay area this week. The total number so far this year is 28. Last year at this time there were only 5 deaths. Its unclear if the recent victims were vaccinated. Many had underlying medical conditions. Its not too late to get vaccinated. A morning fire gutted a building with lofts and art studios in the Mission District at the 1400 block of stevenson in san francisco. Residents watched crews against some heavy smoke. The challenge was getting into the building since the staircase was burned. At one point a firefighter fell 10 feet off the charred building. Its tough, but i think everybody is going to be okay. If everybody is alive, its just stuff. Investigators dont know how the fire started. Everyone who lived inside did make it out safely. Residents credit a bicyclist who was riding by who spotted the fire, then alerted people to get out of that building. Developing news this afternoon. Pop star Justin Bieber just left a miami jail after getting arrested for driving under the influence early this morning. The 19yearold appeared at his arraignment this morning through a video link. He was charged with drunken driving, resisting arrest and driving without a valid license. Just after 4 00 this morning, miami police pulled him over in his yellow lamborghini after spotting him dragracing in a residential area. Just minutes ago he created a scene as he was released from jail. He climbed on top of a black suv and waved to a crowd that had gathered outside. He posted bail at 2,500. As we head throughout the afternoon, it will be sunny and breezy at times with some mild temperatures. Partly cloudy tonight a few high clouds likely to drift across our skies and then looks like mostly sunny skies and warmer temperatures over the weekend. In fact, some of these numbers well be getting next week will be Something Else again. High pressure backing away a little bit. We got this area of low pressure thats going to retrograde backing up toward the coastline bringing more clouds in our direction for friday. The same time, we have had some big storms off the coastline generating big swells, up to 13 feet. Occasional 20 feet out toward the coastline. And, of course, mavericks goes up to 40 feet high. Tomorrow, a few high clouds rotating in from the low pressure system moving through. Otherwise it should be a decent friday. You will see a mix of sun and clouds. Today should be mostly sunny, plan on about 67 degrees in san francisco. 69 degrees in oakland. About 65 degrees as you head into the city. Sunset time will be at 5 23. Your sunrise is at 7 24 tomorrow. And over the next couple of days, a few more clouds coming our way. Then it looks like some warmer weather expected on saturday and sunday. The average high is 60 going up to a forecast high today of 67 degrees. We have seen a string of unseasonably warm days here in san jose. In fact, ten straight days. And while it is warm outside, it is cold but the heat is on inside where we have San Jose Sharks playing host tonight to the Winnipeg Jets. We are expecting a great game between two western conference rivals. The Winnipeg Jets are coming in on a fourgame winning streak. I believe the San Jose Sharks have some of the best fans in the nhl. But speaking of fans, this saturday night, 45 to 50,000 people at dodger stadium. Not for baseball. Correct. Its for hockey. The dodgers stadium is hosting an outdoor game between the l. A. Kings and the ducks and they are expecting a sellout crowd and we have the best fans in all of the nhl and all of sports i might add. Reporter if its successful this saturday which we expect it to be in los angeles, why cant san jose host an outdoor professional hockey game. San jose can host an outdoor game. I have spoken to the league about this and if the l. A. Game goes well from a weather stand point and if the league wants to continue the stadium series we are very much on the short list for a game in northern california. We have already talked to three locations, stanford stadium, at t park where the giants play and the new levi stadium all three very interested. But were early in the process. One peninsula mother found a way to help the parents get through the tough times. And kate kelly has this weeks jefferson award winner. I was heartbroken, heartbroken. Reporter colleen is talking about the first time she came to a willows in the wind meeting. Her then 13yearold son had become out of control and she just sent him to a therapeutic boarding school. She needed support and found it here among parents who shared similar experiences. You feel like youre the only one going through this. And you feel like you are really totally alone. Reporter janet rao co founded the company after hers daughter needed to be sent away. There were few resources to help parents with teens in crisis. It could be flatout behavioral, it could be mental health, bipolar, depression. It could be for many reasons. But it all equals the same thing. You have a child thats in danger and you have to do something. What does it mean to have a child thats out of control . Reporter its not a replacement for professional help. Willows is about parents helping parents, whether its finding the right program or helping them prepare for a childs return to the family. Janet and her allvolunteer board have been there. They have all gone through it. They all have graduates. They all come out the other side. Everybody has their own struggles and our kids do, too. Reporter once a month parents can drop into free meetings in los altos and oakland. Thats what does it for me. Reporter its a chance to connect. I came and its like, oh. I didnt feel alone. I felt supported. I felt like there are resources. Reporter working out of the family Marketing Office in south san francisco, janet talks to parents daily and so her daughter is now a thriving adult, janet continues to share life lessons she says made her family stronger. Thats what my hope is for every parent that it can be a positive experience. And thats what we strive for in terms of helping.
