All right, elizabeth. Thank you. We are following breaking news this morning in san jose, where police are investigating the citys first homicide of the new year. Officers were called to san antonio and 33rd streets on the citys east side about 1 30 this morning. They found a gunshot victim. The wounded man was rushed to a hospital and later declared dead. So far, there are no suspects. And a fire at the chinese consulate building in San Francisco appears to be arson. It began just before 9 30 last night. Crews managed to control the flames within minutes. We are going to have a live report from the scene in just a couple of minutes. New this morning, all 52 passengers once stuck on a ship in icy antarctica waters have been rescued. Susan mcginnis has the story of some happy and grateful passengers. Reporter shortly after a helicopter flew into assess the area around the icebound ship in antarctica, the rescue began. The helicopters to take us home. Todays breakthrough comes after days of failed rescue attempts, bad weather and ice 15 feet deep keeping icebreakers from australia and china from getting close enough. The researchers an tourists are expected to be reunited with their families in a week. The 22 crewmembers will stay on the icebound ship until the vessel can break free. New this morning, some shaking up in the north bay. There were two earthquakes in the geysers area overnight. The first magnitude 2. 5, at 12 23 this morning. Then a 3. 3 quake hit at 1 32. The usgs website reports a few people did feel the quakes but there have been no reports of damage or injuries. Big question right now about the driver arrested after a girl was killed in San Francisco on new years eve. Kiet do reports from the tenderloin. Reporter the memorial for 6 yearold sophia lu continues to grow here at the corner of ellis and polk streets. Thats the been a lot of back and forth theres been a lot of back and forth about whether the driver was working for the car service uber. It started with a Facebook Post by supervisor jane kim who said the driver was charged with vehicular manslaughter and the driver also selfidentified as an uber driver. Later supervisor kim backed off from that saying the driver was a nontaxi forpay driver. The crash happened at 8 p. M. On new years eve. The suv was making a right turn when it hit the mother and two children killing the 6yearold girl. The driver saying i had a green light. I had the right of way. He is saying that right after the incident. He got out of the car yelling, who saw it . I need a witness. I had a green light. I had a right of way. He was approaching the kids. The girl was screaming, kicking her foot in the air with tennis shoes on that grow when you run. The mother was just she was out. She was gone. Reporter months ago Cab Companies protested warning that a death like this could happen with loosely regulated car services. Now, at first uber said it was not their driver. Now they are asking San Francisco police to release more information about him so they can confirm that statement. If he was an uber driver, they say he will be removed from service. Kiet do, kpix 5. San Francisco Police have two suspects after a brief high speed chase in potrero hill. Officers spotting a car last night that looked a lot like one that was involved in a robbery. They tried to pull the car over but the driver took off. A few blocks away he crashed and was caught. His passenger jumped out and was also caught. Police say they recovered a gun that was thrown from the car during the chase. Back to our developing story now. Kpix 5s anne makovec is in San Francisco where a fire at the chinese consulate is being investigated as arson. Anne. Reporter and you can see the front entrance, the damage after last nights fire here at the chinese consulate building on laguna street. The u. S. State department is now involved in this investigation categorized as arson. Heres one of several pictures being circulated on social media this morning of the front door burning. The chinese consulate as office says someone in a minivan pulled up, poured two buckets of gasoline on the door and set it on fire around 9 30 last night. The Fire Department headed out in about 10 minutes and you can see the damage here. The consulate spokesman called the arson a Violent Crime targeted at the chinese consulate. He calls it a sabotage of a vile nature and a, quote, despicable attack. Now, you can see the door here, the damage to the front door. That has been removed. All parts of the investigation. There is also a Security Camera out here, also sure to be part of it. In the meantime, the chinese consulate is urging the u. S. Government to do a better job protecting its facilities and its personnel. Live in San Francisco, anne makovec, kpix 5. Police say that no one was injured. An uncle of jahi mcmath says the family is getting closer to moving the braindead teenager to a facility in new york. We do have Ground Transportation and a plane thats ready and as soon as our facility is ready to receive her, we will be moving jahi. In order for the girl to be moved out of Childrens Hospital oakland, breathing and feeding tubes have to be inserted, something the hospital wont do. The family and the hospital have been in a legal battle over whether to keep jahi mcmath on a respirator. We can make a better place for our babies. Yeah. And their babies. About 100 people rallied gathered at the Fruitvale Bart station in oakland to remember oscar grant yesterday. It was five years after his death. Grant was shot and killed by then bart Police Officer Johannes Mehserle on the station platform. Grants mother girlfriend and daughter all attended the event. Wouldnt be surprised to see a couple of 70s pop up outside and maybe a couple of more records begin to fall as the strong ridge sits overhead now. Next couple of days well see changes, cloudy tomorrow, lots of sunshine for the weekend. But by next week the jet stream may drop far enough south that we could see a couple of scattered showers as we head in toward tuesday.
