Working through the night to clear the intersection. We have been seeing trains go through all morning long. Cars not allowed through yet. They are also installing a new red and white striped crossing arm. They just put the arm on now. These are the arms that they are designed to try to keep cars from getting through these tracks in the first place. It was a horrific scene yesterday evening. The impact threw the car 40 feet from where it was impacted and came to rest against a crossing box and pole. The damage was so bad, it was difficult to tell exactly what kind of car it was. Firefighters pulled that 30 yearold woman out of the wreckage took her to the hospital in Critical Condition. Thats where she died. Its unclear why or how she ended up on the tracks. One of things we try to tell people is dont stop on the tracks. You dont start across the tracks until youre sure you can get all the way across and she just got caught in traffic. Apparently, wasnt paying real close attention. Traffic all the time. I see people stop on the tracks all the time. I just wonder why are they doing that . Reporter now, the accident stranded several hundred passengers for a couple of hours during the evening commute. The train had significant damage but no passengers were injured. Caltrain says that the crossing arms were working properly at the time. And speaking of crossing arms, there they are now. They are putting it on now as we speak. It looks like its going to take a couple of more hours. Live in menlo park, kiet do, kpix 5. In a separate incident a caltrain hit and killed a man in a tunnel in San Francisco. That happened around 9 30 last night. 6 people have now died on the tracks this year compared to 10 all of last year. A woman is in custody and investigators are seeking more suspects in connection with the killing of a gilroy man. Yesterday, police announced the arrest of Gabriela Ortiz. She was taken into custody friday after Police Received tips from the community. Those tips were prompted by the release of Surveillance Video. Police say it shows ortiz and another woman at an East San JoseConvenience Store using a credit card belonging to victim robert heiser. Investigators believe ortiz and two other people were involved in the death. An autopsy shows heiser died of bluntforce trauma. Police found his body last week while responding to a barking dog complaint. New this morning, a pedestrian was struck and killed by a car on a milpitas freeway overnight on the off ramp from northbound 880 to highway 237. Police say the vehicle involved was a silver infiniti sedan. No more details have been released. Californias gas excise tax could shrink a bit come july. Today, the state board of equalization will meet in culver city to consider reducing that tax from 36 cents per gallon to 28. 5 cents. The excise tax is only part of the overall tax on gas in california. People in the state currently pay 64 cents a gallon in various taxes and fees. Time to check traffic. Liz . She wants 16 million claiming to havesexually harass to have been sexually harassed and excluded from meetings. She said she was fired when she complained. Kleiner says she was let go because of poor job performance. Congress has until friday to pass a bill funding the department of Homeland Security or risk shutting down. As Susan Mcginnis reports, its a partisan battle linked to president obamas executive action on immigration. Reporter Senate Majority leader Mitch Mcconnell took a shot at trying to break the stalemate. Democrats blocked consideration of the bill funding the department of Homeland Security for the fourth time monday. The bill is tied to provisions that would repeal president obamas executive action which temporarily shields millions of undocumented immigrants from deportation. But democrats oppose the repeal. Mcconnell now plans to separate the issues and introduce a standalone bill this week that would block the president s orders on immigration. Its another way to get the senate unstuck from a democratic filibuster and move the debate forward. Reporter some Senate Democrats have already expressed support for debating the two issues individually. People have really strong opinions about both topics and they both should be debated fairly, openly and separately. Reporter but many republicans remain opposed to doing so. And point to a ruling by a texas judge last week blocking the white house plan. Its time for democrats to stop defending the president and the white house. Reporter should the deadline arrive without a deal, 30,000 workers could be furloughed, many others expected to show up to work without pay. These are folks who if they dont have a paycheck are not going to be able to spend that money in your states. New this morning, the fight over morality clauses for some bay area Catholic High School teachers intensifies. Ryan takeo joins us live in San Francisco to explain why some state lawmakers are calling now for an investigation. Ryan. Reporter frank, good morning. This is the latest attempt to try to put pressure on the San Francisco afternoon diecies. We are here outside the high school near city college of San Francisco. This is one of the high schools one of the Catholic High Schools impacted by the morality clauses. San franciscos archbishop has a plan to add those morality clauses into upcoming Teacher Union contracts. They call for teachers to live by Church Teachings at school and in their private lives. The teachings include the churchs opposition to abortion, contraception and homosexuality among other things. State Assemblyman Kevin Mullin of san mateo and phil ting of San Francisco say the clauses set a bad precedent for workers rights. They want an investigation into working conditions at the four Catholic High Schools in the San Francisco archdiocese to see if the requirements violate state Discrimination Laws. This is the latest public outcry after many students and teachers got together last week to unite against the catholic church.
