If the California Legislature wanted to, they could say that for these type cases theres no probation it owns eligibility. And for all other assaults it is mandatory prison, but for one like this, they could say mandatory prison like all of the others. The judges do not have inherent power to change the law. I spoke with a few legislators that have asked me what they can do about it, and i give them options that the legislature could do if they chose to. They could do it if they wanted, and it is their choice whether to initiate legislative action, their only choice. If there is a situation of date rape, and a lot of it is involving a drug that is slipped into someone strengths, what is the position someones drinks, what is the position legally . It could be reduced to a misdemeanor. It is a misdemeanor to have the drug and not someone out . Yes it is. That would be a tool that could of been used to prevent some of these things. No question, east lake the legislature could change that. And we did want them to do that, but it did not make its way through legislature. What type of crime is that if you put something in someones drink . If you put it in with intent to rape the woman, or the fentanyl drug that they use, it could be a felony drug case. What if it is a mickey that is slipped in and someone takes advantage . If you had knowledge it can be a felony and you can go to prison. We use the changes statewide as result of this case . You know our legislature a new study it better than anybody, and whether they could agree on making a change or whether it will slip into the past like so many high publicity cases, that is what we will watch closely.
