To politics with just eight days left until the election the fbi reopened a criminal investigation of Hillary Clintons private email server as she was secretary of state and it is now the main focus of the president ial campaign. Clintons campaign called on fbis director letter to Congress Short on facts. It related to clintons use of private email service but couldnt say, quote, unquote, if they were significant. Theyre calling on comey to release more facts. Voters deserve to get full and complete facts and so weve called on director comey to explain everything right away, put it all out on the table. But investigators say theyre still waiting for a search warrant so that they can begin reviewing the emails found on the laptop of longtime clinton aid huma abedin. Now huma abedin shared the computer with her husband new york congressman anthony weiner. The emails came to light as part of a separate investigation into wiener allegedly sending sexually explicitly messages to a 15yearold girl in north carolina. Donald trump is capitalizing on the issue this weekend on the campaign trail. Sources tell cbs that attorney general Loretta Lynch disagreed with comeys decision to notify congress about the new emails so close to election day. Because the department of justice is trying their hardest to protect the criminal activity of Hillary Clinton. Trump stops planned in three dates while clinton will campaign in florida. A National Poll taken before the bombshell announcement show the candidates in a tight race. Clinton now only holds a 2 lead over trump. Closer to home, silicons most powerful tech players is planning to address the backlash he received after donating money to trump. Peter thiel is expected to deliver a speech about the election in washington, d. C. Bernie sanders continues to call to an end of prouse gouging by big pharmacies. Sanders appeared in this documentary which aired on cbs stations across the state. It is for the pro prop 61 campaign which requires the state to negotiate drug prices. Opponents say an independent analysis concluded it could cost taxpayers millions more. Reverend al sharpton and several lawmakers will hold a meeting in support of prop 61 in los angeles. Along with that motor voetds are deciding whether or not to make recreational pot legal in california. The ballots are being cast, the city of martinez is preparing for the possible passage of proposition 64. This week the council could approve ordinances regulating the cultivation of recreational pot. The city staff is recommending that passage of all three under proposition 64 a city cant prohibit outdoor marijuana indoor cultivation but it can ban outdoor growing. And the city council will meet wednesday to discuss the issue. Palo alto has already taken action. Last week the city council there passed an ordinance banning outdoor cultivation. A california poll shows 55 of likely california voters are for prop 64. That is down from 60 . Now, if prop 64 passes, Californias Department of finance estimates the golden state could bring as much as 1 billion in tax revenues each year from legal pot sales. The states Legal Marijuana market is estimated 2. 7 billion for medical pot, and that can reach 6. 5 billion by 2020. California is one of five states voting on legal legalizing pot. Tonight on 60 minutes the governor of colorado is urging california to take a second look. My biggest concern is that were not collecting data. I told other governors to not wait for the laws to change. Collect baseline data now, how many kids are using marijuana. Look at accidents, was there thc involved, so that we have good baseline so as we accumulate more data, we can see what the effect of legalization itself really are. You can catch the full story on 60 minutes on kpix5 at 7 00. The poll showed a downward trend. It has gone from 60 to 55. Election is eight days away. I bet youre going to see a lot of ads on both sides of that issue in the final days. Now on to our other top stories. Police in hayward investigating an officerinvolved shooting. Officers were called to the park last night to help a park ranger who witnesses say had gotten into an argue men with a man in an rv. When the officers arrived the suspect allegedly started driving his rv toward them and a group of people in a nearby party. A small earthquake jolt people out of bed in Monterey County, magnitude 2. 8 earthquake struck before midnight. So far we receive no reports of damage. Is it a soda tax, is it a close gri tax . It is a bird, it is a plane. Donald trump not scaling back on his claims of a rigged election. This as new numbers show how confident American Voters are when it comes to the electoral process. Soggy sunday and wet halloween as well. Rain on halloween, not necessarily, but the timing is of the rain on halloween. Details on that coming up. , because she doesnt know that it kills 40,000 californians. Every year. Because she doesnt understand what cancer is. Because she cant spell emphysema. Because she is a butterfly, who fights fires. Because she is my daughter, and the Surgeon General says that raising tobacco taxes. Is a proven way to make sure she never smokes. Three bay area cities are getting ready to vote on a soda tax on as the polling booths prepare to open a showdown over sugar continues. Three bay area cities are getting ready to vote on the soda tax. Oakland, albany and San Francisco. The measure would charge strict tors one pen nee per ounce of soda sold. A soda tax is needed to protect kids health. A small soda tax can make a big difference. Those against it say it is really a grocery tax because it forces stores to raise the price of soda. They say grocers can recoup the tax how ever they want. Joe, what is the problem with adding a tax on this for children in Health Programs . That is if it was actually going on the beverages themselves, but as, you know, voters should take a close look at their ballots. It is on distributors of the beverages, not on look, if i buy this and it is a 12ounce or 20ounce f i buy this, dont i pay an extra 20 cents when i buy it . That is the thing. These ads that we just showed funded in part by michael bloomberg, essentially are misleading the voters. They make it think make you think it is on the beverages. It is up to the restaurant, grocer, because there is no mandate it has to go on the beverages. It can be spread out any way a grocer wants to. Whet it is a tax specifically on this bottle of soda or starbucks frappucino or any of a number of drinks we consider sugar or a spreadout, californians have gone along with the idea of adding costs or taxes to it for programs to in effect stop people from using that product. Is that the problem the Beverage Industry has with this . That assumes the money is actually going to be used for that. This is not 2014 again where the tax is actually going to be used for a specific item, you need a twothirds vote in San Francisco. This time the proponents lowered the goal post for themselves essentially said well make a general fund, general tax, 50 of the vote. Now goes to the general fund can be used for whatever they wan. All right. I understand what you are doing is raising questions about the law itself, how it would be implemented and where the money would go. For a 24 Million Campaign to defeat it here in oakland and albany, it seems like the other industries go along with it or tobacco fights it but others just say the tax gets passed on, people pay it, it doesnt hurt sales. In berkeley it hasnt hurt sales. I say talk to the grocery who is bearing the brunt of this. It is simple economics. Distributor is not going to just absorb this. They pass it on to the retailer and whether it is the safeway or small independent grocer and theyll pass it on to the consumer. That is how economics works and that is why were again calling it a grocery tax. Why is the Beverage Industry against it . Because it is bad public policy. Youre out there again with these billionaire funded ads saying it is on soda and going to health when that is really not the case. If you say it is going on beverages . Maybe. We did a study, campaign did, said 7 out of 10 grocers would probably do that. 70 said they would spread it out. Is the concern if it is one cent today and five cents tomorrow and 20 cents the next day, is that the concern . Concern is that what theyre seeing it will meaning fully reduce consumption when it wont do this. They said in berkeley where the similar tax the argument is that it is not going to work. Why . It is being sold . We have 20 seconds, why wont it work . The tax is not going to go on the beverages, it is up to the grocer and that means it can be spread out and in effect a grocery tax. Okay. Thats where we stand right now and in the next hour well have a person sylvia cohen who supports the tax. Well put her on the hot seat. New numbers show this years wildfires in Monterey County came at a cost of 10 million. Both fires damaged homes and roads but now they have a drain contingency fund. The rainy season getting under way more damage is expected from increased erosion and postfire flooding. Right now were watching for any reports from those areas as storms move through this morning. Here is a live look outside. Look at those clouds. Julie watts is in the forecast center. It is fitting weather as we head into halloween. We track the weather on highdef. Showers right now moving from south to north. They will be spreading in. I want to point thus out again because i think folks who enjoy ski season will appreciate this, we are already starting to see snow in the sierra. If you want to head up there for the end of the weekend, take halloween off, we will see snow 6500 feet. Closer to home, showers in our neck of the woods. In the north bay, we have showers in petaluma, closer to home, in San Francisco, just starting to see showers here as we look closer at the peninsula. Also seeing showers along the peninsula this morning as we look closer look here. You see San Francisco just starting to see the leading edge of those showers. Go ahead and look at the satellite. Ill show you where all of this rain is coming from. Area of low pressure still offshore heading to the pacific northwest. It will spread through the front later this morning and that is where we anticipate the heaviest rain passing through the bay area. You see the late morning, at 11 00 after the front has passed through and lingering showers behind it. Now here were at halloween. I mentioned bad news for trickortreaters. Dont enjoy halloween as well, it is for the kids. 5 00 is when well see some of the heaviest rain come through right now. Of course that is the time the little kids are out between 5 00 and 7 00. The adults maybe when you head to your party later, soggy but the heaviest rain will have passed through by 10 00. Much drier conditions. The brunt of this right now and im hopeful that maybe it will shift a little bit and we wont see all of the rain at 5 00 but it is something were anticipating right now. Rain future cast shows half inch to start and by the ends of monday we could see over an inch in some of the highest locations but for the most part likely closer to 3 4 of an inch. Showers for monday and again for your holiday on fourth of july on halloween, rather, and we start to dry out at the end of the workweek. Back over to you guys. Still thinking about summer. Turning to the president ial race. Donald trump is not changing his views of the Voting System is rigged. Outcome is fixed when the system is rigged. People lose hope. They stop dreaming. They stop trying. The talk of voter fraud is now turning into legal action with the Democratic Party suing the republicans. A lawsuit filed wednesday accuses the Republican National committee of violating federal restrictions against intimidating voters. That comes that among americans 43 have a great deal of caused the votes will be counted while 17 have little caused their vote will be accurately counted. With all of the past experiences covering a big part of elections, we asked melissa cane and willie brown, especially brown, do you think the system is rigged . No, theyre not really rigged but i got to tell you, if you are losing them, you always say theyre rigged because you cant believe the voters would reject you. That is the nature of the business. Everybody shouldnt be upset. There is also the macro feeling that it is rigged and for years one of the biggest points or complaints about it is the Electoral College. The fact that the popular vote in america does not counts. It is a big problem and in a lot of years you get complaints. When you have donald trump being close to being president , a lot of people on the right, im thinking there is a buffer between me and the president. Maybe there is a chance we could get some faceless electors who will save the country at the end of the day. And that is exactly how some of the republicans are trying to strategize. They have taken the guy, mcmullen in utah and with his new runningmate , his woman, and theyre smart about the whole thing. They want it to the point where neither candidate gets 270 by way of the popular vote and that the process goes into the Electoral College and it gets all screwed up so it will end up in the house of representatives and neither clinton nor trump when win in that environment. So basically the way it works if youre one of the top three Electoral College vote getters youre eligible to be declared president by the house of representatives. There is 33 republican and 27 democratic votes. When anybody wins by a sizeable majority or initiative, everybody says okay. The narrower the win, the more questions are raised about the vote, the count and the process. If this goes to the Electoral College and they dont get it there and goes to the house of representatives, people will question the entire democratic system. Especially at that stage of the game every state has one vote, the congress literally has one vote. The senator elects the vicepresident is is also a presider there. And the house does it without any votes being cast by the district of columbia. So were out. Basically we have the same vote as rhode island in that scenario. People in california might be really upset. All you need is 26 and youre the president. Democracy, a great system. Absolutely. ,,,,, want a great way to help our children thrive . Then be sure to vote yes on proposition 55. Prop 55 doesnt raise taxes on anyone. Instead, it simply maintains the current tax rate on the wealthiest californians to prevent education cuts that would hurt our kids. No wonder prop 55 is endorsed by the california pta, teachers and educators. Because all of us
